SPECIAL MEETING AGENDA
Pursuant to Section 3.12 of the Charter of the City of Delray Beach, Mayor Jeff Perlman has
instructed me to announce a Special Meeting of the City Commission to be held for the following
purposes:
1. MUNICIPAL ELECTION RESULTS: Canvass the returns, and declare the results of
the March 13,2007 First Nonpartisan Election.
2. CERTIFICATION APPROVAL/SOUTH CENTRAL REGIONAL
WASTEWATER TREATMENT AND DISPOSAL BOARD (SCRWTDB)
INJECTION APPLICATION: Consider a request from South Central Regional
Wastewater Treatment and Disposal Board (SCRWTDB) regarding the application for a
permit for the Deep Well Injection and approve the Certification of Financial Responsibility.
3. CREATIVE CITY COLLABORATIVE: Provide direction regarding appointments to
the Creative City Collaborative Organizational/Incorporation Committee.
4. AUTHORIZATION/TRANSFER OF OWNERSHIP: Authorization for staff to send
a letter regarding the transfer of ownership of Barwick Road from West Atlantic Avenue to
the L-32 canal from Palm Beach County to the City of Delray Beach, provided that Palm
Beach County contribute $125,000.00 toward future resurfacing of the road.

Certification Approval Required for SCRWTD Board Injection
Application
In order to file an application for a permit for the Deep Well Injection, additional
information is required. Three items must be provided by the City of Delray
Beach:
1. Letter from City Attorney attesting to the permittee meeting the definition of
Local Government as defined in Chapter 218 F.S., and as to the City's
coverage under Part V, as to Financial Emergencies (see attached).
2. Approval and execution of the Certification of Financial Responsibility which
provides that the City is to pay 50% of the $300,000.00 total amount to be
expended for the plugging and abandonment. (Please note that the
certification allows for a 10% increase within a permit cycle without
authorization.)(See attached).
3. A copy of the financial statement for the latest complete fiscal year must
accompany Items 1 and 2.
Please place this item including the certification of financial responsibility on the
City Commission agenda as a Special meeting item before the workshop meeting
of March 13, 2007 at the request of counsel for the SCRWTD Board.

Financial Responsibility Requirements
Dear Susan and Jim;
Our Board voted in December 2006 to proceed with an Injection Well application
with the Florida Department of Environmental Protection. Our engineers filed the
application and we have received back DEP's Request for Information (RFI) dated 9
February 2007 (a copy of which J enclose) which, among other things, requires that we
demonstrate financial responsibility.
If I could certify that we were a local government as defined in 218 Part V we
could attempt to praceed ourselves to satisfy this requirement but I cannot. Section
218.502 defines "local government entity" to mean a county, municipality or special
district. In 218.31(1) it defines "local government entity" to mean a county agency,
municipality or a special district as defined in 189.403.....(which definition we do not
meet).
I spoke with Mr Richard Deuerling of DEP (850)-245-8653 who is the person that
handles financial responsibility matters and he said we could satisfy the requirement by
having each of our City's.approve the Certification of Financial Responsibility form
(which is enclosed and indicates each city is responsible for 50%) and have it signed by
the Mayor or City Manager whomever is appropriate to bind the cities. The City Attorney
of each City would provide the certification referred to in Attachment A of the RFI
indicating that the City meets the definition of local government as defined in Chapter

Emergencies. Your certification letter would be addressed to Mr. Richard Deuerling,
Florida DEP, UIC Program, MS-3530, 2600 Blair Stone Road, Tallahassee, FI. 32399-
2400. Although the letters are so addressed I would appreciate it if you would send the
originals to my office. r believe they will be put together with other information we are
submitting to DEP.
Together with the certification form and letter we will need to submit a copy of the
financial statements for each city. Mr. Deuerling indicated that some local governments
financial statements can be accessed at their web sites. If this is so then we won't need
to provide separate text bound booklets of each city's financial statements. Could you
please let me know whether your financial statements can be accessed on your web
sites or are otherwise available on the internet. I presume that the financial statements
that are referred to are the most recent audits.
After your review of the enclosed information, if you agree, I would appreciate it
you would let me know when the Certification of Financial Responsibility could be
placed on your respective City Commission's agenda for approval. We are trying to
kept the application moving as quickly as possible with DEP.

set up the Creative City Collaborative as a 501 (c )(3) and to establish an
Organizational/Incorporation Committee.

Downtown Development Authority serve on the committee instead.
I have attached a listing of nominations received from each of the represented groups, as
well as a listing of the chairpersons of each of the major cultural festivals.
The City representative could be the Mayor, one of the Commissioners, a staff person, or
an individual from one of the other City Boards.
Staff is seeking direction from City Commission on how you would like to proceed. Our
goal was to have appointments made at your March 20, 2007 meeting.

Action:
City Commission is requested to consider an appeal received from Mr. Brodzinski to the
City Manager's denial of his request to allow the consumption of alcoholic beverages on
property outside his business on Saint Patrick's Day, per Section I 13.02(B) of the Code of
Ordinances.
Backflround:
Attached is the original request received from Mr. Brudzinski for the extension of his liquor
license premises to a 60' x 23' tent adjacent to his business on Saint Patrick's Day. Before
the State will approve such a request, per City Code Section 113.02, a waiver for the
consumption of alcoholic beverages must be approved. This request was considered by the
City Manager and was denied. Staff has a concern that other restaurants and bars would
submit similar requests and could create a problem for our Police staff. We also have a
concern that there is no time limit to the request. A waiver had been granted for the
consumption of alcoholic beverages along the parade route only beginning at 2:00 p.m. and
ending at 3:30 p.m.
Mr. Brudzinski is appealing the City Manager's denial.
Recommendation:
Staff recommends denial of the appeal received from Mr. Brodzinski to waive the code
provision for the consumption of the alcoholic beverages in public and the extension of his
liquor license premises.

GENERAL PROVISIONS
Sec. 113.01. DEFINITIONS.
The definitions as set forth in F.S. Section 561.01 are hereby adopted by reference.

Sec. 113.02. PROHIBITION OF CONSUMPTION OR POSSESSION OF OPEN
CONTAINERS OF ALCOHOLIC BEVE:RAGES IN PUBLIC PLACES.
(A) Within this City it shall be unlawful for any person to consume alcoholic beverages or have
in his-her possession any open container containing an alcoholic beverage while such person
is:
(1) On the public streets, sidewalks, alleys and other rights-of-way with the exception
that seated patrons of a permitted sidewalk cafe may consume alcoholic beverages;
(2) On the beach;
(3) In public parks, provided, however, that patrons of the restaurants located at the
Delray Beach Municipal Golf Course and Lakeview Golf Course may consulile alcoholic
beverages on the Delray Beach Municipal Golf Course and Lakeview Golf Course when
they are golfing, and patrons attending an Old School Square, Inc. event at Old School
Square or a Delray Beach Tennis Center event at the Delray Beach Tennis Center may
consume alcoholic beverages during the event;
(4) In motor vehicles or trailers; or
(5) On business property outside the building with the exception that patrons seated at
permanent tables provided by the business may consume alcoholic beverages.
(B) Any person may request that the City Manager waive the applicability of division (A) for
certain public functions or affairs. The City Manager shall have seven (7) days to consider such
a request and if denied, the applicant may appeal the denial of the request to the City
Commission. Such appeal to the City Commission must be made within seven (7) days and will
be considered by the City Commission within thirty (30) days of the denial.

1. This appeal of the denial of an administrative waiver request to allow the

2. The Appellants, Appellee and City staff presented documentary evidence
and testimony to the City Commission pertaining to the appeal of the denial of an

property outside his business pursuant to Ordinance Section 113.02(B). All of the
