CERTIFICATION APPROVAL/SOUTH CENTRAL REGIONAL WASTEWATER TREATMENT AND DISPOSAL BOARD (SCRWTDB) INJECTION APPLICATION: Consider a request from South Central Regional Wastewater Treatment and Disposal Board (SCRWTDB) regarding the application for a permit for the Deep Well Injection and approve the Certification of Financial Responsibility. 3. CREATIVE CITY COLLABORATIVE: Provide direction regarding appointments to the Creative City Collaborative Organizational/Incorporation Committee. 4. AUTHORIZATION/TRANSFER OF OWNERSHIP: Authorization for staff to send a letter regarding the transfer of ownership of Barwick Road from West Atlantic Avenue to the L-32 canal from Palm Beach County to the City of Delray Beach, provided that Palm Beach County contribute $125,000.00 toward future resurfacing of the road. Three items must be provided by the City of Delray Beach: 1. Letter from City Attorney attesting to the permittee meeting the definition of Local Government as defined in Chapter 218 F.S., and as to the City's coverage under Part V, as to Financial Emergencies (see attached). 2. Approval and execution of the Certification of Financial Responsibility which provides that the City is to pay 50% of the $300,000.00 total amount to be expended for the plugging and abandonment. (Please note that the certification allows for a 10% increase within a permit cycle without authorization.)(See attached). 3. A copy of the financial statement for the latest complete fiscal year must accompany Items 1 and 2. Our engineers filed the application and we have received back DEP's Request for Information (RFI) dated 9 February 2007 (a copy of which J enclose) which, among other things, requires that we demonstrate financial responsibility. If I could certify that we were a local government as defined in 218 Part V we could attempt to praceed ourselves to satisfy this requirement but I cannot. Section 218.502 defines "local government entity" to mean a county, municipality or special district. I spoke with Mr Richard Deuerling of DEP (850)-245-8653 who is the person that handles financial responsibility matters and he said we could satisfy the requirement by having each of our City's.approve the Certification of Financial Responsibility form (which is enclosed and indicates each city is responsible for 50%) and have it signed by the Mayor or City Manager whomever is appropriate to bind the cities.
