AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 7, SECTION 7-2(9) OF
THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH TO
PROVIDE FOR NEW EFFECTIVE DATES; PROVIDING A SAVINGS
CLAUSE; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 7-2(9) of the Code of Ordinances of the
City of Delray Beach is hereby amended to read as follows:
(9) Boat owners shall be-~e~-~-~e~e~-e~-~-~ys-a~e~-~he
e~{ee~ve-~aee-e~-~h~s-e~a~ee-~-w~e~ have until
October 1, 1979 to obtain the necessary boat storage
permit from the City or remove their boat from the
municipal beach. After
ahe-e~ee~e-~a~e-e~-~h~s-~a~ee~ September 1, 1979,
the City Administration shall affix a notice to any boat
remaining on the municipal beach without the proper per-
mit, which shall give the owner thereof notice that
w~h~m-~-~ays by .Qctober 1, 1979, the owner must either
obtain a boat storage permit from the City or remove the
boat from the municipal beach The notice shall further
advise the owner that in the event a boat storage per-
mit is not obtained and the boat remains on the municipal
beach after ~h~s-pe~e~-~-~me? October.i, 1979, the
boat owner will be subject to a fine of $10 per day for
each day the boat remains on the municipal beach and
that if the boat remains on the municipal beach for ten
(10) days in violation of this provision that it shall
be subject to impoundment by the City of Delray Beach
and that in addition to paying the $10 per day fine
(which shall also be applicable during the ~eriod of impound-
ment )' the ~boat owner as a condition precedent t~ obtaining
the return of his boat shall be responsible for all
expenses of the City in impounding it and all storage
costs thereof.
Section 2. That should any section or provision of this ordinance
or any portion thereof, any paragraph, sentence, or word be declared by a
Court of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder he~eof.
Section 3. That this ordinance shall become effective ten
days after passage on second and final reading.
