AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 9 "BUILDING CODE" OF
THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH BY
AMENDING SECTION 9-1.2(SEC. 105.4(b)) TO PROVIDE THAT
THE FLOOR SLAB SHALL BE SEVEN (7) FEET RATHER THAN SIX
(6) FEET ABOVE MEAN SEA LEVEL AND TO AMEND SECTION
9-46(a) BY ADDING "AS AMENDED BY ORDINANCE NO. 71-79";
PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 9-1.2 of the Code of Ordinances of the
City of Delray Beach is hereby amended to read as follows:
Section 9-1~2 Amendments and Additions to 1976 Edition
of the Standard Building Code.
SEC. 105.4 PLOT DIAGRAM
(b) Before slab inspection or prior to framing, the
building department shall be supplied a certified sketch
by a Florida registered land surveyor or a Florida registered
engineer showing setback distances from each property line to
the stem walls or sills of the building or structure under
construction. The building department shall be furnished
by a Florida registered engineer or land surveyor, a certi-
ficate stating the fact that the floor slab is s~-~
seven (7) feet above mean sea level measured to the top
of the concrete slab which will be a minimum of eighteen
(18) inches above the crown of the road or measured to the
bottom of the wood joists which will be a minimum of eighteen
(18) inches above the crown of the road.
Section 2. That Section 9-46(a) of the Code of Ordinances of the
City of Delray Beach is hereby amended to read as follows:
(a) This article is not intended to repeal, abrogate
or impair any existing easements, covenants or deed
restrictions, nor is it intended to repeal Section
9-1.2(Sec. i05.4(b)) of the Delray Beach Code of
Ordinances, as amended by Ordinance No. 71-79.
Where this article and another conflict or overlap,
whichever imposes the more stringent restrictions
shall prevail.
Section 3. That should any section or provision of this ordinance
or any portion thereof, any paragraph, sentence, or word be declared by a
Court of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof.
Section 4. That this ordinance shall become effective ten days
after passage on second and final reading.
