AN ORDINANCE OF TH5 CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 29 "ZONING" OF THE CODE
OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY
AMENDING SECTION 29-20(C)(2), "MOTOR VEHICLES PROHIBITED
OR RESTRICTED IN RESIDENTIAL ZONING DISTRICTS", TO PRO-
HIBIT THE OWNERS, AGENTS OR OPERATORS OF CERTAIN MOTOR
VEHICLES FROM PARKING, STORING OR KEEPING SAID MOTOR
VEHICLES ON PROPERTY IN ANY RESIDENTIAL ZONING DISTRICT
IN THE CITY OF DELRAY BEACH; PROVIDING A SAVING CLAUSE;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning & Zoning Board at its September 25, 1979
meeting passed unanimously a motion to amend Section 29-20(C)(2) of the
Code of Ordinances to correct an inconsistency in said Section; and,
~{EREAS, the City Council of the City of Delray Beach, Florida,
deems it to be in the best interests of the residents and citizens of the
City of Delray Beach to make such amendment,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLO%~:
Section 1. That Section 29-20(C)(2) of the Code of Ordinances of
the City of Delray Beach, Florida, entitled "Motor Vehicles Prohibited Or
Restricted In Residential Zoning Districts", be amended to read as follows:
(2) Unless otherwise provided for in this chapter, it shall be
unlawful for the owner, agent or operator of the motor
vehicles set forth herein or the owner of property in any
residential zoning district in the City of~Delray Beach,
to park on, or cause to be parked on, or allow to be parked
on any residential property in the City of Delray Beach, or
in the streets, alleys, or parkways abutting the property
any bus, pole trailer, semi-trailer, trailer, trailer coach,
truck or truck trailer, as previously defined, for a period
exceeding one (1) hour in any twenty-four (24) hour period.
Each such period shall commence at the time of first stop-
ping or parking, unless a permit is first obtained from the
Police Department, or as otherwise provided for in this
ordinance.
Section 2. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 3. That this ordinance shall become effective ten days
after passage on second and final reading.
