05-18-29 Special17 COUNCIL ROOM May 18th, 1929. The Council met in special session a°~C the call of the Mayor at eleven A. M., Ssturday, May 18th, 1929, The following members were present: Mr. Keen, Mr. Porter, Mr. Smith and Mr. Troup. Owing to the absence of president warfield, Mr. Smith was on motion duly made, seconded and carried elected president pro tem, to preside at this meeting. After the reading of the Mayors call Mr. Porter introduced the following resolution and moved its adoption: "N~E~ The City of Delray Beach, the owner and holder of one certain mortgage given by Ralph Long and Mamie Long, to the Ocean City Bank, which said mortgage is recorded in Mortgage Book 194 at page 255, and -%` covers the following described property, to-wit: All the North S1* of Lot 13 of Block 67, of the City of Delray (formerly Linton), according to the plat of same on file in the office of the Cle rk of the Circuit Court, in and for Palm Beach County, which said mortgage was given to secure one certain promissory note, given by the same parties, bearing even date therewith, in the principal ~. sum of X4500.00, and WHEREAS FURTI~R, C. E. McMullin has offered the City of Delray Beach the stun of One Thousand 01000.00) Dollars in cash, and further tenders the past due and unpaid taxes and assessments on said property. N0~ THEREFORE, BE IT RESOLVED by the authoxLty aforesaid that the ity of Delray Beach do sell to C. E. McMullin the afore- said mortgage for the sum of One Thousand 01000.00) Dollars, and the payment of all past due and unpaid taxes and assessments and that the Mayor and Clerk are hereby authorized end directed to ex- ecute assignment of said mortgage to C. E. McMullin, upon the receipt of the consideration aforesaid." The motion was seconded by Mr. Troup and on roll call unanimously carried. Mr. Troup then moved that the City enter into a contract with Mr. Swanson for the purpose of installing a nursery at the golf grounds, the initial ~~qq~~ t of which is not to exceed X100.00 and the monthly expens~xh'"~'~'Tto exceed X25.00, The motion was seconded by Mr. Keen and unanimously carried. Mr. Smith made the following report in reference to certain street improvement assessments of Rev. J, R. Cason, $r.: In the 17 Council Room - May 18th, 1929. matter of adjusting the claims of the City against Rev. J. R. Cason, Sr., for street and sidewalks and gutter and materials furnished at PJest and South of Block Sixty-seven, this com-:ittee has reached a compromise in which Rev. Cason agrees to pap the sum of Four Hundred and Ninety-five Dollars 0495.00) in full settlement of any claim of the City for sidewalk, street and gutter improvements except special regular asseesments heretofore made t This eom~aittee~recomm~~ds that tris,settlemen.t be ~ecepted. _' ~r.
