07-78 ORDINANCE NO. 7-78 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 15C "LANDSCAPING" OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 15C-5(b) RELATIVE TO PERIODIC INSPECTION OF LANDSCAPING, USE OF SURFACE OR SUBSURFACE WATER FOR SPRINKLING AND USE OF CITY WATER; PROVIDING A SAVING CLAUSE; PROVIDING ~ EFFECTIVE DATE. WHEREAS, the City Administration has considered and recommended that Chapter 15C "Landscaping" of the Code of Ordinances, Section 15C-5(b) be amended to provide periodic inspection of the landscaping, use of surface or subsurface water for sprinkling and the approval of the use of City water if satisfactory water from these sources is not available; and, WHEREAS, the City Council of the City of Delray Beach concurs in the recommendation of the City Administration, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 15C-5(b) of the Code of Ordinances is hereby amended to read as follows: (b) Maintenance. The owner, or his agent, shall be responsible for the~maintenance of all landscaping, which shall be maintained in good condition so as to present a healthy, neat, and orderly appearance and shall be kept free from refuse and debris. Land- scaping shall be inspected period~callyby the chief buildiqg official or his designee to see that the approved and implemented landscaRe plan is in satis- factory condition. All landscaped areas shall be provided with a sprinkler system, either manually or automatically operated, to adequately cover all plant materials and grass to be maintained. Wherever feasible, surface or subsurface water shall be used for sprinkling. If satisfactor~ water from these sources is not available, the chief building official may approve the use of Ci.t¥ water; provided, the prop~ erty owner submits and ~.~es with t~.e Building Depart- ment proof of nonsatisfactor¥ Surface or subsurface water. Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That this ordinance shall become effective ten days after passage on second and final reading.
