AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 29
"ZONING" OF THE CODE OF ORDINANCES OF THE CITY
OF DELRAY BEACH, FLORIDA, BY A~4ENDING SECTION
29-9 NC DISTRICT (B) PERMITTED USES TO ADD A
NEW PARAGRAPH UNDER (B) TO READ "ALL DEVELOPMENTS
SHALL BE SUBJECT TO SITE AND DEVELOPMENT PLAN
APPROVAL"; SECTION 29-11 GC DISTRICT (N) BY
ADDING A NEW SUBSECTION (4); SECTION 29-12 SC
DISTRICT (N) BY ADDING A NEW SUBSECTION (4);
SECTION 29-13 CBD (0) BY ADDING A NEW SUBSECTION
(3); SECTION 29-13.1 LC DISTRICT (M) BY ADDING A
NEW SUBSECTION (4); PROVIDING A SAVING CLAUSE;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Board at the January 10, 1978,
meeting recommended that the zoning ordinance be amended to require site and
development plan approval for certain commercial uses and developments; and,.
WHEREAS, after consideration and recommendation by the City Adminis-
tration, the City Council at the January 30, 1978, Workshop meeting author-
ized the amendments to the Zoning Ordinance,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 29-9 NC (Neighborhood Commercial) District,
b~ ~mended by adding the following paragraph under subparagraph (B) Permitted
Uses to read as follows:
(B) PERMITTED USES
All developments shall be subject to Site and Development
Plan Approval (Sec. 29-22).
Section 2. That Section 29-11 GC (General Commercial) District (N)
and Sectio'n 29-12 SC (Specialized Commercial) District (N) be amended by
adding a new subsection (4) to read as follows:
(4) Any use or uses which meet any of the following
conditions, shall be subject to site and develop-
ment plan approval (Sec. 29-22):
(a) A use or uses that have a floor area
of six-thousand (6,000) square feet or more.
(b) A use or uses that have a lot size of
one-half (%) acre or more.
Section 3. That Section 29-13 CBD (Central Business District) (O) be
amended by adding a new subsection (3) to read as follows:
(C) That Sec. 29-13(0) CBD Central Business District, be
amended by adding the following subsection:
(3) Any use or uses which meet any of the following
conditions, shall be subject to site and develop-
ment. plan approval:
(a) A use or uses that have a floor
area of six-thousand (6,000) square feet or more.
(b) A use or uses that have a lot size
of one-half (%) acre or more.
Section 4. That Section 29-13.1 LC (Limited Commercial) District
(M) be amended by adding a new subsection (4) to read as follows:
(4) Any use or uses which meet any of the following
conditions, shall be subject to site and develop-
ment plan approval:
(a) A use or uses that have a floor area
of six-thousand (6,000) square feet or more.
(b) A use or uses that have a lot size of
one-half (%) acre or more
Section 5. That should any section or provision of this ordinance or
any portion thereof, any paragraph, sentence, or word be declared by a Court
of competent jurisdiction to be invalid, such decision shall not affect the
validity of the remainder hereof as a whole or part thereof other than the
part declared to be invalid.
Section 6. That this ordinance shall become effective ten days after
passage on second and final reading.
PASSED AND ADOPTED in regular session on second and final reading on
