AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 29 "ZONING"
OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH,
FLORIDA, BY AMENDING SECTION 29-12 SC DISTRICT (N)
BY ADDING A NEW SUBSECTION (5) ESTABLISHING A SPECIAL
GEOGRAPHICAL AREA WHICH WOULD HAVE ITS OWN SPECIAL
REQUIREMENTS FOR LOT DIMENSIONS, SITE AREA AND SETBACKS;
PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Board at the January 24, 1978, meeting
recommended that the zoning ordinance be amended to establish a special
geographical area within the SC Zoning district which would have its own
special requirements for lot dimensions, site area, and setbacks to eliminate
possible non-conformities; and,
WHEREAS, after consideration and recommendation by the City Administra-
tion, the City Council at the January 30, 1978, Workshop meeting authorized
the amendments to the Zoning Ordinance,
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA AS FOLLOWS:
Section 1. That Section 29-12 SC (Specialized Commercial) District (N)
be amended by adding a new subsection (5) to read as follows:
(5) Within the geographical area zoned SC which is located east
and west of the FEC Railroad, which is bounded on the north
by S.E. 2nd Street, on the south by SoE. 6th Street, and
situated between Swinton Avenue and S.Eo 3rd Avenue, the
following special provisions shall apply:
(1) There shall be no minimum lot dimensions and site
area.
(2) Minimum setbacks shall be as follows:
(1) Front 10 ft.
(2) Side (interior) 0
(3) Side (street) 10 ft.
(4) Rear 10 ft.
(3) Within one-hundred (100) feet of the Florida East
Coast Railroad right-of-way, the following additional
uses shall be allowed:
(1) Warehouses
(2) Trade shops
( 3 ) Storage
Section 2. That should any section or provision of this ordinance
or any portion thereof, any paragraph, sentence, or word be declared by a
Court of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 3. That this ordinance shall become effective ten days after
passage on second and final reading.
PASSED AND ADOPTED in regular session on second and final reading on
