AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 14 "FIRE DEPARTMENT,
FIRE PREVENTION AND FIRE REGULATIONS" SECTION 14-1 OF
THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH BY
REPEALING THAT PART OF SECTION 14-1 INCORPORATING BY
REFERENCE SECTION 14.4 OF THE 1976 EDITION OF THE FIRE
PREVENTION CODE AND ENACTING A NEW SECTION 14-1.1 RELATING
TO AUTOMATIC SPRINKLER SYSTEMS; PROVIDING A SAVING CLAUSE;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, in the interest of lessening the danger to life and
property from the hazards of fire, the City Council of the City of Delray
Beach deems it necessary and desirable to amend the provisions of the
Fire Prevention Code heretofore adopted by the City of Delray Beach with
regard to the provisions relating to automatic sprinkler systems,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH~ FLORIDA, AS FOLLOWS:
Section 1. That Section 14-1 of Chapter 14 of the Code of
Ordinances is hereby amended by repealing Section 14.4 of the 1976 Edition
of the Fire Prevention Code, adopted by reference only, and enacting a new
Section 14-1.1 to read as follows:
"Section 14-1.1. Amendments and additions of Section 14.4
of the Fire Prevention Code of 1976,
Automatic Sprinkler Systems.
Section 14.4 of the Fire Prevention Code of 1976, as
recommended by the American Insurance Association and adopted
and incorporated by reference into the Code of Ordinances of
the City of Delray Beach by Section 14-1, thereof, is hereby
amended as follows:
A. Approved automatic sprinkler systems shall be installed
throughout the following buildings and structures or
appropriate sections thereof constructed after the
effective date of this Ordinance.
(1) The following buildings of an institutional
character: hospitals, nursing homes, homes
for the aged, convalescent centers, jails and
penal institutions, nurseries caring for children
which are bedridden and all occupancies and uses
of similar nature to those herein stated, without
regard to the type of construction or height of
the building or structure involved.
(2) The following buildings devoted to residential
use or occupancy: apartment buildings, hotels,
motels, boarding houses, condominiums, rooming
houses, dormitories and orphanages subject to the
exceptions hereinafter set forth:
(a) Ail wood frame buildings and structures which
~ are two stories or less in height provided they
· do not exceed 20 feet in height.
(b) All buildings and structures of a non-wood frame,
· non-combustible type of construction, which are
four stories or less in height provided they do
not exceed 40 feet in height.
(c) Residential buildings wherein a smoke detection
~ system is or will be installed in all living units
i for early warning monitored with a sprinkler system
i! which protects all common areas of egress and
~ extra-hazardous areas.
(3) All other buildings and structures without regard to
the type of construction which are used or occupied
for purposes other than institutions or residential,
except those buildings and structures coming within this
classification which are four stories or less in height,
provided they do not exceed 40 feet. in height and pro-
vided further that the gross square foot floor area of
any one floor does not exceed 15,000 square feet.
(4) All portions or sections of buildings and structures
which are below grade or which constitute the basement
!' area of a building or structure or vehicle parking areas
~ shall have automatic sprinkler systems regardless of
square footage of floor area or type of construction.
B. The above provisions shall also apply to buildings in
existence at the date of the passage of this Ordinance if
alterations or repairs are made to said buildings within the
time period and to the extent hereinafter set forth.
(1) If, within any (12) twelve month period~ alterations
or repairs costing in excess of (50O/O) fifty percent
of the then physical value of the building are made
to an existing building, such building shall be made
to conform to the requirements of this Ordinance for
new buildings.
(2) If an existing building is damaged by fire or otherwise
in excess of fifty (50%) percent of its' then physical
value, before such damage is repaired, it shall be made
to conform to the requirements of this Ordinance for
new buildings.
(3) If the cost of such alterations or repairs within any
twelve (12) month period or the amount of such damage
as referred to in paragraph (2) is more than twenty-five
(25) but not more than fifty (50%) percent of the then
physical value of the building the portions to be al-
tered or repaired shall be made to conform to the
requirements of this Ordinance for new buildings to
such extent as the Building Official may determine.

(4) The physical value of the building as referred to
in (B) (1), (2) and (3) above, shall be determined
by the Building Official.
C. The automatic sprinkler systems herein referred to and the
installation thereof which are required by this Ordinance
shall conform to the current adopted edition of the National
Fire Protection Association Standard No. 13 entitled
"Standards for the Installation of Sprinkler Systems"."
Section 2. That specific authority to codify this Ordinance in
the City's Code is hereby granted.
Section 3. That should any section or provision of this Ordinance
or any portion thereof, any paragraph, sentence or word be declared by a
court of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof, as a whole or part thereof
other than the part declared to be invalid.
Section 4 That violations of any of the provisions of this
Ordinance shall be governed by Section 14-12 of the Delray Beach Code of
Ordinances.
Section 5. That all ordinances or parts of ordinances in con-
flict herewith are hereby repealed.
Section 6. That this Ordinance shall become effective upon its
passage on second and final reading, as provided by Law.
