12-10-28 Regular~+ r ~ i) COU1QCIh ROOM December 10th, 1928. Th Council met in regular session, the Idlayor and the following members of the Council were present: Pdlr. Tacobs, Mr. Keen, Mr. Smith and Mr. Troup. The minutes of the previous meetings were read and approved. P~4r. Smith, chairman of the Street Committee, requested that the Council take some definite action regarding the remov- al of trees Prom streets and alleys. It was moved by Idly. Keen and seconded by Mr. Smith that the Clerk be instructed to publish a notice that from now on all persons guilty of violat ing this ordinance will be prosecuted. The motion. was carried. It was moved by Mr. Smith and seconded by Mr. Keen that the City contribute Fifty Dollars to the Community Christmas Tree fund. The motion was carried. A communication was read from Mr. B. Shutt requesting an adjustment of his tax assessment in Section Nine. It ryas moved by Mr. Keen and seconded by lair. Smith that in as much as it had been shown that an error had been made in fixing the amount of this assessment that the Clerk be authorized to reduce this assessment from eight to six thousand dollars. The motion was unanimously carried. A communication was read from Mrs. Hirth requesting that she be refunded the amount of a widovrs exemption on taxes paid in 1926 and 1927. On motion duly made, seconded and carried this communication was referred to the City Attorney. It was moved by Mr. Keen, seoonded by Mr. Smith and carri- ed that the City Attorney proceed to secure a euit claim deed from Mrs. Sophie Frey to a strip of property for a road Bay or street lying between the Federal and Dixie Highway in the Sophie Frey SuBdivision. 8 The City Attorney reported that he had written to the F. E.'' C. Railway Company regarding the opening of the Northeast First Avenue crossing but as yet had had no reply to his letter. No further action was taken as the City Attorney stated he expected to call on the officials personally at an early date and would. then report. Mr. Smith, Mr. Keen and the Clerk were appointed ~ covnnittee ~~ Council Room - December 10th, 1928. to draft suitable resolutions on the. death of Mr. Frank A. Nicolls. Permission was granted the superintendent of public utilities to allow the Community Christmas Tree Committee to use ropes etc. belonging to the City. The president appointed 114r. Jacobs a member of the Finan- ce Committee pro tem to act in the place of Mrs. G6arfield who was absent. Current bills having been referred to-and audited by the Finanoe Committee were on motion duly made seconded and carried ordered paid. It was then moved, seconded and carried that the ballot bog containing the official returns of the December 4th election be opened and tabulated. The bog ryas then brought before the Council and opened and the official count was as fallows: J. B. Evans - Emmett C. Hall - 4Y. A. Jacobs - J. C. Keen - R. H. Porter - It having been found received the highest number the following resolution: 144 votes 82 274 ~~- 178 `5 5 ° that Mr. Keen and Mr. Porter had of votes cast Mr. Smith introduced RESOLVED that we do hereby declare J. C. Keen and R,. H. Porter elected, they having received the highest bomber of votes cast in said election held on December 4th, 1928, for the purpose of electing two councilmen at large for the City of Delray Beach in accordance with the Call of the Mayor heretofore made. The resolution was seconded by Mr. Jacobs and unanimously adopted. It was then moved seconded and carried that the Council adjourn sine die. Mr. Troup then called the Council to order and Iu4r. J. C. Keen and Mr. R. H. Porter;, the newly elected councilmen, were administered the oath of office by Mayor Johnson and declared them duly installed. On moticn of Mr. Smith, seconded by Mr. Keen and carried, Mr. Porter was elected temporary ahAlzman for the purpose of organizing the Council. Mr. Troup then presented the name of Mrs. C. P. YVarfield in nomination for permanent president. There being no further nominations the chairman called for the vote with the result that Mrs. 4Yarfield was elected president of the Council for the ensuing year. 79 Council Room - December 10th, 1928. Mr. Smith presented the following resolution and moved its adoption: BE IT RESOLVED by this Council that the following named persons be, and they are hereby appointed to the office and positions indicated: Arthur Barton - City Clerk, City Treasurer, City Tax Collector and Clerk of Municipal Court. ZN. 0. Winn - Auditor. Miss. Mae Cramp and Miss. Sadie Sundy - Assistants to City Clerk, City Treasurer and City Taa Collector. Lysle W. Johnson - Municipal Judge L. W. Cook - Fire Chief C. A. Baker - Supt. of Public Utilities Oscar Simmons - Assistant to Supt. of Public Utilities. J. H. Adams - City Attorney R. P. Endsley - Tax Assessor The resolution was adopted. The Mayor then announced the following appointments: Mr. '~~. M. Croft, Chief of Police Mr. George P7. Croft, Assistant Chief of Police. It was moved by Mr. Troup, seconded by Mr. Keen and unanimously carried that these appointments be confirmed. Mr. Smith introduced the following resolution, which was seconded by Mr. Troup and unanimously adopted: RESOLVED that standing committees be each committee to consist of three members, have charge of the matters indicated: FINANCE COMI4TITTEE - Charge of Fi STREET, 4YATER & FIRE CCMMITTEE - established as follows,;> each committee to 5 nance & Real. Estate Streets, water and fire protection LIGHT COMMITTEE - Lights, golf and parks SANITATION COMMITTEE - Health and Sanitation ORDINANCE COMMITTEE - Ordinances
