ORDINANCE NO. 49-78 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REZONING AND PLACING LAND PRESENTLY ZONED RM-15 (MULTIPLE FAMILY DWELLING) DISTRICT, IN RM-10 (MULTIPLE FAMILY DWELLING) DISTRICT, A PARCEL OF LAND IN SECTION 29-46-43, LOCATED SOUTH OF LINTON BOULEVARD, BETWEEN LINDELL BOULEVARD AND S.W. 4TH AVENUE, AND AMENDING "ZONING MAP OF DELRAY BEACH, FLORIDA, 1977" . WHEREAS, the Planning and Zoning Board, at the meeting held on January 17, 1978, recommended rezoning and placing land presently zoned RM-15 (Multiple Family Dwelling) District in RM-10 (Multiple Family Dwelling) District; and, WHEREAS, the city Council at the June 12, 1978, regular meeting considered the rezoning request and authorized preparation of an ordinance to effect the rezoning, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the following described property in the city of Delray Beach, Florida, is hereby rezoned and placed in the RM-10 (Multiple Family Dwelling) District as defined in Chapter 29 of the Code of Ordinances of the City of Delray Beach to-wit: A parcel of land lying in Section 29, Township 46 South, Range 43 East, Delray Beach, Palm Beach County, Florida, being more particularly described as follows: Commencing at the quarter corner in the West line of said Section 29; thence South 2© 09' 50" East, along the West line of said Section 29, a distance of 847.26 feet to the intersection of the centerline of Audubon Boulevard; thence due East, along said centerline of Audubon Boulevard, a dis- tance of 651.55 feet to a point of curvature of a curve concave to the South; thence Easterly, along the arc of said curve having a radius of 1434.88 feet and a central angle of 14° 20' 00", a distance of 358.96 feet; thence South 75° 40' 00" East, a distance of 146.19 feet to the intersection of the centerline of Dotterel Road; thence North 14° 20' 00" East, along the centerline of said Dotterel Road, a distance of 383.67 feet to the point of curvature of a curve concave to the Southeast; thence Northeasterly, along the arc of said curve, having a radius of 770 feet and a central angle of 75° 40' 00", a distance of 1016.89 feet; thence due East, a distance of 240.13 feet to the intersection of the centerline of Lindell Boulevard, said intersection being a point on a curve concave to the Southwest, whose local tangent bears North 8° 25' 58" West; thence Northwesterly, along the arc of said curve, having a radius of 1340 feet and a central angle of 34© 44' 57", a distance of 812.69 feet to the Point of Beginning of the parcel to be herein described, said Point of Beginning also being the intersection of the centerline Egret Circle and the centerline of Lindell Boulevard; thence North 46° 49' 15" East, along said centerline of Egret Circle, a distance of 215.0 feet to the point of curvature of a curve concave to the South; thence Easterly, along the arc of said curve, having a radius of 815.30 feet and a central angle of 43° 10' 50", a distance of 614.45 feet; thence South 89© 59' 55" East, a distance of 141.03 feet to the point of curvature of a curve concave to the Northwest; thence Northeasterly, along the arc of said curve, having a radius of 500.00 feet and a central angle of 38° 32' 10", a distance of 336.29 feet; thence South 39© 45' 50" East, a distance of 55.11 feet to a point of curvature of a curve concave to the Southwest; thence Southeasterly~ along the arc of said curve, having a radius of 254.94 feet and a central angle of 11© 35' 13", a distance of 51.56 feet to a point of reverse curve of a curve concave to the Northeast; thence South- easterly, along the arc of said curve, having a radius of 55 feet and a central angle of 61° 49' 18", a distance of 59.34 feet; thence South 89° 59' 55" East, a distance of 556.63 feet to a point of curvature of a curve concave to the Southwest; thence Southeasterly, along the arc of said curve, having a radius of 55 feet and a central angle of 56° 52' 50", a distance of 54.6 feet; thence North 56© 52' 55" East, a distance of 205.58 feet; thence North 2© 49' 30" West, a distance of 863.66 feet; thence South 89° 57' 10" West, a distance of 665.07 feet; thence North 2© 40' 20" West, a distance of 187.03 feet; thence North 76° 51' 45' West, a distance of 842.32 feet; thence South 89© 27' 25" West, a distance of 480.02 feet and to a point in the centerline of Southwest 10th Avenue; thence South 2° 21' 45" East, a distance of 1.27 feet to a point of curvature of a curve concave to the West; thence Southerly, along the arc of said curve, having a radius of 300 feet and a central angle of 42° 9' 12", a distance of 220.71 feet; thence South 39© 47' 27" West, a distance of 165.15 feet to a point of curvature of a curve concave to the Southeast; thence Southwesterly, along the arc of said curve, having a radius of 415 feet and a central angle of 24° 30' 45", a distance of 177.55 feet; thence South 15© 16' 43" West, a distance of 404.87 feet to a point of curvature of a curve concave to the Northwest; thence Southwesterly, along the arc of said curve, having a radius of 393.38 feet and a central angle of 31° 32' 32", a distance of 216.56 feet; thence South 46© 49' 15" West, a distance of 90 feet to the intersection of the centerline of Lindell Boulevard; thence South 43© 10' 45" East, along the centerline of said Lindell Boulevard, a distance of 776.88 feet to the Point of Beginning aforedescribed. Section 2. That the Planning Director of said City shall, upon the effective date of this ordinance, change the Zoning Map of Delray Beach, Florida, to conform with the provisions of Section 1 hereof. Section 3. That this ordinance shall become effective immediately upon passage on second and final reading.
