ORDINANCE NO. 50-78 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REZONING AND PLACING LAND PRESENTLY ZONED RM-15 (MULTIPLE FAMILY DWELLING) DISTRICT, IN PRD-4 (PLANNED RESIDENTIAL) DISTRICT, A PARCEL OF LAND IN SECTION 29-46-43 AND 30-46-43, LOCATED ON THE WEST SIDE OF LINDELL BOULEVARD, BETWEEN LINTON BOULEVARD AND DOTTEREL ROAD, AND AMENDING "ZONING MAP OF DELRAY BEACH, FLORIDA, 1977". WHEREAS, the Planning and Zoning Board, at the meeting held on January 17, 1978, recommended rezoning and placing land presently zoned RM-15 (MULTIPLE FAMILY DWELLING) District in PRD-4 (Planned Residential) District; and, WHEREAS, the City Council at the June 12, 1978, regular meeting considered the rezoning request and authorized preparation of an ordinance to effect the rezoning, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the following described property in the City of Delray Beach, Florida, is hereby rezoned and placed in the PRD-4 (Planned Residential) District as defined in Chapter 29 of the Code of Ordinances of the City of Delray Beach to-wit: A parcel of land lying in Section 29, Township 46 South Range 43 East, Delray Beach, Palm Beach County, Florida, said parcel being more particularly described as follows: Commencing at the quarter corner in the West line of said Section 29; thence North 1° 54' 45" West, along the West line of said Section 29, a distance of 930.37 feet to the Point of beginning of the parcel to be herein described~ thence continue North 1© 54' 45" West, along said West line of Section 29, a distance of 986.06 feet; thence North 68© 53~ 11" East, a distance of 690.02 feet; thence South 43© 14' 25" East, along the centerline of Lindell Boulevard, a distance of 740.41 feet; thence South 43° 10' 45" East, along the centerline of Lindell Boulevard, a distance of 1207.49 feet to the point of curvature of a curve concave to the West; thence Southeasterly, along the arc of said curve, having a radius of 1340 feet and a central angle of 34° 44' 57", a distance of 812.69 feet to the intersection of the centerline of Dotterel Road; thence due West, a distance of 186.58 feet; thence North 23° 02' 12" West, a distance of 264.84 feet to the point of curvature of a curve concave to the Southwest; thence Northwesterly, along the arc of said curve having a radius of 1125 feet and a central angle of 20© 08' 33", a distance of 395.5 feet; thence North 43° 10' 45" West, a distance of 946.89 feet; thence South 46© 49' 15" West, a distance of 200 feet to a point of curvature of a curve concave to the Northwest; thence Southwesterly, along the arc of said curve, having a radius of 815 feet and a central angle of 43© 10' 50", a distance of 614.22 feet; thence North 89© 59' 55" West, a distance of 435.87 feet to the Point of Beginning afore- described. Together with the East 175 feet of the Southeast quarter (S.E. ¼) of the Northeast quarter (N.E. ¼) of the Northeast quarter (N.E. ¼) of Section 30, 'Township 46 South, Range 43 East, Palm Beach County, Florida, lying South of Germantown Road. Section 2. That the Planning Director of said City shall, upon the effective date of this ordinance, change the Zoning Map of Delray Beach, Florida, to conform with the provisions of Section 1 hereof. Section 3. That this ordinance shall become effective immediately upon passage on second and final reading.
