A RESOLUTION OF THE CITY OF DELRAY BEACH
PROVIDING ITS SUPPORT FOR THE BEACH AND COASTAL
MANAGEMENT PROGRAMS OF THE FLORIDA
DEPARTMENT OF ENVIRONMENTAL PROTECTION,
SUBJECT TO THE CITY'S REGULATORY AUTHORITY AND
CODE OF ORDINANCES; ADVISING THE STATE THAT THE
CITY HAS THE ABILITY TO PROVIDE THE LOCAL
FUNDING SHARE NECESSARY TO IMPLEMENT THE STA TE
BEACH AND COASTAL MANAGEMENT PROGRAMS IN
WHICH THE CITY ELECTS TO PARTICIPATE; AND
PROVIDING FOR AN EFFECTIVE DATE; AND OTHER
PURPOSES.
WHEREAS, the City of Delray Beach (City) hereby supports the beach and coastal
management programs of the Florida Department of Environmental Protection (FDEP), subject to
the City's regulatory authority and the Code of Ordinances; and
WHEREAS, the City advises the State and the FDEP the City has the ability to provide the
local funding share necessary to implement the state beach and coastal management programs in
which the City elects to participate; and
WHEREAS, the City adopts, on a yearly basis, the Capital Improvement Program which
appropriates the funds necessary for the continued maintenance and construction of the beach
nourishment projects; and
WHEREAS, the City wishes to forward the City's intent of long-term maintenance and funding
of its beach and Coastal Management Programs to the State; and
WHEREAS, the City Commission deems approval of this Resolution to be in the best interest
of the health, safety, and welfare of the residents and citizens of the City of Delray Beach and the
public at large.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. The foregoing recitals are hereby affirmed and ratified.
Section 2. That the City of Delray Beach hereby supports the beach and coastal
management 'programs of the FDEP, subject to the City's regulatory authority and the Code of
Ordinances.
Section 3. The City of Delray Beach hereby provides its support for the City's
renourishm ent project and affirms its ability to provide the necessary local match necessary to
implement any FDEP beach and coastal management program in which the City elects to participate.
Section 4. This resolution shall take effect immediately upon adoption.
