No. 43-20RESOLUTION NO. 43-20 1\ RESOLUTION OF THE CITY OF DELRAY BEACH, FLORIDA, AUTHORIZING FLORIDA POWER AND LIGf IT TO INSTALL DECORATIVE LED STREET LIGHTS AS PART OF THE OSCEOLA PARI<: NEIGHBORHOOD IMPROVEMENTS PROJECT AND AUTHORIZING PAYMENT IN A NOT-TO-EXCEED AMOUNT OF $300,000 FOR THE DESIGN AND INSTALLATION OF THE LED FIXTURES; 1\ND PROVIDING FOR J\N EFFECTIVE DATE; AND OTHER PURPOSES. WHEREAS, the City of Delray Beach (City) and the Community Redevelopment Agency (CRA) approved a neighborhood improvements project (Project) at Osceola Park Neighborhood to improve the infrastructure and safety of the neighborhood; and WHEREAS, as part of the Project, the City intends to replace the existing cobra-head fixtures with Decorative LED fixtures to enhance public safety and electrical efficiency; and WHEREJ\S, Florida Power and Light (FPL) requires the City to pay the Cost in Aid of Construction (CIAC) for the design and installation of fixtures prior to the commencement of any work; and WHEREAS, FPL does not require a formal agreement; and WHEREAS, the City Commission deems approval of this Resolution to be in the best interest of the health, safety, and welfare of the residents and citizens of the City of Delray Beach and the public at large. NOW, THEREFORE, BE IT RESOLVED BY TI-IE CITY COMMISSION OF THE CITY OF DELRJ\ Y BEACH, FLORIDA, AS FOLLOWS: Section 1. That the foregoing recitals are hereby affirmed and ratified. Section 2. The City of Delray Beach hereby approves the replacement of the existing cobra-head fixtures with decorative LED fixtures to enhance public safety and electrical efficiency in the Osceola Park Neighborhood project, subject to the City's regulatory authority and the Code of Ordinances. Section 3. The City Commission authorizes a Cost in Aid of Construction in a not-to-exceed amount of $300,000 for the design and installation of fixtures as part of the neighborhood improvements project at Osceola Park Neighborhood.
