ORDINANCE NO. 53-78 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REPEALING ORDINANCE NO. 46-75 AND ENACTING A NEW ORDINANCE RESTRICTING THE HOURS OF PARKING ALONG STATE ROAD A-1-A BETWEEN THE HOURS OF 1:00 A.M. AND 7:00 A.M. TO ONE HOUR PARKING BETWEEN THE CENTERLINE OF CASUARINA ROAD DESIGNATED BY THE DEPARTMENT OF TRANSPORTATION AS SLD MP 9.328 ON THE SOUTH TO THE NORTH RIGHT-OF-WAY LINE OF BEACH DRIVE DESIGNATED AS SLD MP 10.358 ON THE NORTH AND TO PRO- HIBIT BETWEEN SAID BOUNDARIES ALONG STATE ROAD A-1-A DURING ALL HOURS THE PARKING OF VEHICLES PRIMARILY DESIGNED, CON- STRUCTED OR USED AS TEMPORARY OR PERMANENT LIVING QUARTERS, VEHICLES EXCEEDING 8,000 POUNDS GROSS WEIGHT, AND VEHICLES UTILIZING MORE THAN ONE STANDARD SIZE PARKING SPACE; PROVIDING THAT SAID DESCRIBED VEHICLES BE PARKED IN DESIGNATED OFF-STREET PARKING LOTS; PROVIDING DEFINITION OF VEHICLES; PROVIDING A PENALTY FOR VIOLATION THEREOF; PROVIDING FOR CODIFICATION; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, parking space in the City of Delray Beach along A-1-A adjacent to the beach is very limited; and, WHEREAS, campers and other large vehicles are often parked in this area and used as temporary living quarters; and, WHEREAS, these vehicles often remain parked in the same parking space for extended periods of time thereby precluding others from using this area; and, WHEREAS, campers and other large vehicles often use more than one standard size parking space and at times extend unsafely into the roadway; and, WHEREAS, alternate off-street parking is available for these types of vehicles in a City-owned parking lot near the beach area, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the geographic area along State Road A-1-A within which the below described parking restrictions will apply is that area from the centerline of Casuarina Road designated by the Department of Transporta- tion as SLD MP 9.328 as the southern boundary and the north right-of-way line of Beach Drive designated by the Department of Transportation on SLD MP 10.358 as the northern boundary. Section 2. That it shall be unlawful to park any vehicle in the above area between the hours of 1:00 A.M. and 7:00 A.M., for more than one (1) hour. Section 3. That no vehicle exceeding 8,000 pounds gross weight or which itilizes more than one standard size parking space (8' x 22' for parallel parking spaces and 10' x 19' for angular parking spaces with an angle of 45©) will be permitted in this area. Section 4. That it shall be unlawful for any person to park or cause to be parked in the above described area any recreational vehicle primarily designed, constructed or used as temporary or permanent living quarters for recreational camping or travel use, which either has its own motive power or is mounted on or drawn by another vehicle, including the following: 1. "Travel trailer": A vehicular portable unit, mounted on wheels, of such a size or weight as not to require special highway movement permits when drawn by a motorized vehicle. It is primarily designed and constructed to provide temporary living quarters for recreational, camping, or travel use. It is of a body width of no more than 8 feet and a body length of no more than 35 feet when factory-equipped for the road. 2. "Camping trailer": A vehicular portable unit mounted on wheels and constructed with collapsible partial sidewalls which fold for towing by another vehicle and unfold at the campsite to provide temporary living quarters for recreational camping, or travel use. 3. "Truck camper": A portable unit, designed to be loaded onto, or affixed to, the bed or chassis of a truck, constructed to provide temporary living quarters for recreational, camping, or travel use. Truck campers are portable units designed to be affixed to a truck chassis and constructed to provide temporary living quarters for recreational, travel, or camping use. 4. "Motor home": A vehicular unit built on a self-propelled motor vehicle chassis, primarily designed to provide temporary living quarters for recreational, camping, or travel use. 5. "Fifth wheel recreation trailer": A vehicular portable unit mounted on wheels of such size or weight as not to require special highway movement permits. It is primarily designed and constructed to provide temporary living quarters for recreation, camping, or travel use and designed to be connected for towing through the use of a fifth wheel device. Section 5. That any recreational vehicles as defined in Section 4, and any vehicle exceeding 8,000 pounds gross weight,or which utilizes more than one standard parking space, as referred to in Section 3, shall be parked in designated off-street parking lots near the beach area. It shall be unlawful for any person to park or cause to be parked any of said vehicles in the area described in Section 1. Section 6. That this ordinance shall be codified as Section 25-50 of the Delray Beach Code of Ordinances and any person violating the provi- sions of this section shall be subject to a fine in an amount not less than $15.00 for each violation. Section 7. That should any section or provision of this Ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. ~ - 2 - ORD.
