AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 29 "ZONING" OF THE CODE
OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY
AMENDING SECTIONS 29-8.1(R)(2) PRD-4, 29-8.2(R)(2) PRD-7
AND 29-8.3 (R) (2) PRD-10 PLANNED RESIDENTIAL DISTRICTS,
TO ADD A SUBSECTION (e) RELATIVE TO ALLOWING DUPLEX
DWELLING UNITS WHEN "T" CUL-DE-SACS ARE USED; PROVIDING
A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Board at the meeting held on
July 18, 1978, unanimously recommended that Sections 29-8.1(R)(2) PRD-4,
29-8.2(R) (2) PRD-7and 29-8.3(R)(2) PRD-10 be amended by adding a subsection
(e) relative to allowing duplex dwelling units when "T" cul-de-sacs are
used; and,
WHEREAS, the Administration has recommended that said amendment be
made; and,
WHEREAS, at the August 7, 1978, workshop meeting the City Council
concurred in said recommendation and authorized preparation of the ordinance
to effect the amendments,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Sections 29-8.1(R) (2), 29-8.2(R) (2), and
29-8.3(R) (2) are hereby amended to add a new subsection (e) to read as
follows:
(e) Where "T" cul-de-sacs are used, a maximum of three
(3) duplexes may be employed, provided they comply
With the building setback requirements for zero lot
line detached family dwellings.
Section 2. That should any section or provision of this ordinance
or any portion thereof, any paragraph, sentence, or word be declared by a
Court of competent jurisdiction to be invalid, such decision shall not affect
the validity of the remainder hereof as a whole or part thereof other than
the part declared to be invalid.
Section 3. That this ordinance shall become effective ten days
after passage on second and final reading.
