SUBJECT: Koch House - Historic Designation
There was a scrivener' s error in the legal description in the
original Ordinance No. 162-88 which designated the Koch house
as a historic building. Lot 22 should not have been included.
Pat Cayce, Historic Preservation Planner, has confirmed that a
scrivener' s error was made.
Recently, our office was contacted by Cindy Van Buskirk, Legal
Assistant for Alan J. Werksman, Esq. who pointed out the error
which impacted the closing of the adjacent property (Lot 22 ) .
In order to correct the error, I have drafted the attached
ordinance which should be recorded to clear up any title
irregularities or confusion.
Please call if you have any questions . Please place this
ord' ante on the City Commission' s agenda for consideration.

DELRAY BEACH, FLORIDA, REPEALING ORDINANCE 162-88
WHICH DESIGNATED THE KOCH HOUSE LOCATED AT 777 NORTH

BEACH SHORE ACRES, AS RECORDED IN PLAT BOOK 7, PAGE

FLORIDA, AS A HISTORIC BUILDING; AND ENACTING THIS
ORDINANCE TO PROVIDE A CORRECTED LEGAL DESCRIPTION
SHOWING THE DESIGNATION AS LOT 21 ONLY; PROVIDING A
GENERAL REPEALER CLAUSE; PROVIDING A SAVINGS CLAUSE;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Historic Preservation Board, at a meeting held on
November 29 , 1988, unanimously recommended the designation of the Koch
House as a historic building; and,
WHEREAS, the City Commission of the City of Delray Beach
passed on second reading on January 10, 1989, Ordinance No. 162-88 which
accepted and designated the Koch House as a historic building; and,
WHEREAS, the legal description contained within Section 1 of
Ordinance 162-88 included Lot 22 and Lot 21 of Block D, Palm Beach Shore
Acres, as recorded in Plat Book 7, Page 38 of the Public Records of Palm
Beach County, Florida; and,
WHEREAS, the correct legal description for the Koch House is
Lot 21 of Block D, Palm Beach Shore Acres, as recorded in Plat Book 7,
Page 38 of the Public Records of Palm Beach County, Florida; and,
WHEREAS, the City Commission desires to correct the
scrivener' s error by deleting all references to Lot 22 .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1 . That Ordinance 162-88 is hereby repealed and
this ordinance is enacted to read as follows :
That the following described building in the City of Delray
Beach, Florida is hereby designated as a historic building:
The Koch House, 777 North Ocean Boulevard, located on Lot 21,
Block D, Palm Beach Shore Acres as recorded in Plat Book 7,
Page 38, of the Public Records of Palm Beach County, Florida.
Section 2 . That the Planning Director of the City of the City
of Delray Beach, Florida, shall upon the effective date of this
ordinance, amend the Zoning Map of Delray Beach, Florida, to show, in an
overlay manner, the above designation.
Section 3 . That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 4 . That should any section or provision of this
ordinance or any portion thereof, any paragraph, sentence, or word be
declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a
whole or part thereof other than the part declared to be invalid.
Section 5 . That this ordinance shall become effective upon
passage upon second and final reading.
PASSED AND ADOPTED in regular session on second and final

This is second reading and public hearing for Ordinance No. 29-94
repealing Ordinance No. 162-88 wherein the Koch House at 777
North Ocean Boulevard was designated as an historic building, and
enacting this ordinance to provide a corrected legal description.
There was an error in the legal description in the original
Ordinance. Lot 22 should not have been included in the
description, and this ordinance will clear up any title
irregularities or confusion.
On May 17, 1994, Ordinance No. 29-94 was passed on first reading
by a 4-0 vote.
Recommend approval of Ordinance No. 29-94 on second and final
reading.

I. PURPOSE •
The purpose of designating The Koch House, 777 North Ocean Boulevard,
to the Delray, Beach Local Register of Historic Places is to preserve
the architectural and cultural significance of the town's most
distinctive private, residential oceanfront estates constructed during
the Great Depression. While Palm Beach and Gulfstream feature many
Mediterranean Revival style estates built from 1923-1937, the Koch
House is the town's only contribution to this magnificent South
Florida style.• 777 North Ocean Boulevard's designation will protect
the scale, grandeur, dimensions, and eclectic qualities which the
house demonstrates. It is an excellent example of a certain
historical period in Florida and the United'States.
II. LOCATION
The Koch Residence is situated at 777 North Ocean Boulevard, Delray
Beach. Its 200 x 215 foot ocean front parcel is the northern most
ocean lot., and lies on the Delray Beach/Gulfstream Town line. The
legal description is Palm Beach Shore Acres, Block D, Lot 21 and Lot
22.
The house has been aligned more with the construction and style of the
period in Gulfstream than Delray Beach. The Mediterranean style in
Delray Beach was primarily along South Ocean Boulevard, while North
Ocean Boulevard, North of Atlantic Avenue to Eighth Street, NE was
developed in the 1930's with British Colonial, Cape Cod, Mission, and
the Monterey Style of architecture.
III. HISTORICAL AND ARCHITECTURAL SIGNIFICANCE
Constructed in 1933, the Koch House was built and designed by its
owner, Dr. William Fredrich Koch (1885-1967) . Born in Detroit, and
educated at the University of Michigan (BA-1909, MA-1910, PHD-1916) .
Dr. Koch received his M.D. from the Detroit College of Medicine in
1918. He was an instructor of Histology and Embryology (1910-1914) , a
Professor of Physiology (1914) , a Pathologist (1915) , and began
private practice and research in Europe and South America beginning in
1919.
Dr. Koch was the topic of a book, "Birth of a Science" (1950) , and the
author of "The Survival Factor in Cancer and Viral Infections (1958) .
He was the creator of "Glyoxylide", and was a renowned figure in
enlightened national and international medical research circles for
almost 50 years. In late fall, 1948, he established residency in Rio
de Janairo, Brazil where he lived until his passing on December 8,
1967.

A seasonal visitor to Palm Beach and Gulfstream in the 1920's and
1930's, Dr. Koch built 777 North Ocean Boulevard as a winter seasonal
beach house in the then popular Mediterranean Revival Style. The
owner is credited with being the architect of record, and it is widely
believed Mr. C.G. Warner, illustrious Palm Beach builder, was the
contractor. Delray mason Mr. E.M. McLaren designed much of the
ornamental stone work. Local and Palm Beach craftsmen were employed
as artisans for the masonry work, cypress, flooring, and other
structural details.
The Koch House is a four thousand square foot, three story, ten room
structure. It is embedded into the natural coral stone foundation.
Dr. Koch's concern for seasonal hurricanes prompted him. to reinforce
all the bearing walls of the estate. The five ranked east facade with
its multi-planes, L-Shaped, barrel tile roof is a classic, superb
representation of its style. Centered by a third story elaborated
tower room and a banded open porch flanked by decorative double fire
places, the house's silhouette is opened by an extensive open Loggia
on the ground level. The elaborated period chimney tops compliment
the Gothic-like ornamentation of the tower. Crowned with corner
escutcheons, finials, a crested roof line, a rare triple leaded glass
windowed oriel .of intricate cypress construction highlights the west
facade. Resembling a turn of the century midwest university turret,
the tower room was used by Dr. Koch as a laboratory.
The walled entrance courtyard on the property's west side is the
town's most significant. It served as an entertainment area as well
as protection from the ocean breezes. The original stonework, crests,
fountain, mahogany batten doors remain. Some of the stonework is
believed to be from Mizner Industries. In 1939, a garage was added in
the same architectural character to the courtyard north side. All
decorative trim and accessories match the original construction. The
courtyard's northern side was abridged by a kitchen addition (10 x
20') .
The massive, glazed, board and batten front double door entrance is
capped by hooded keystone sash windows and a triple crested balcony.
The principal living ocean room features three matched Islamic
patterned, ribbon windows facing east, south and west. All windows
feature keystone hood molds with label stops, and double round
Corinthian columns. This breathtaking ocean room also features a
massive Mediterranean fireplace with a mantel to ceiling bonnet with
inlaid stone crests.

The main level loggia overlooks the ocean, and is a rectangular 13 x
27' structure framed by six Corinthian columns made of Keystone. All
original portals doors are framed by keystone quoins, pediments, or
elliptical framing. Exterior original light fixtures reflect the
- 1930's style.
The owner was influenced by travels to Spain, Italy and Western
Europe. Stained and leaded glass windows accentuate the houses
detailing and period.
The interior features imported ceiling woods, cypress and stone
staircases. There are nearly 30 original windows, 10 doors, and
all the period light fixtures remain.
The structure was built for approximately $ 40,000.00
IV. PRESENT USE, CONDITION AND ZONING

A. Present Use
The property is a vacant single family residence with a detached
garage apartment (1939) and a separate guesthouse (1980) .
B. Condition
The structure is in very good condition. Post World War II window
additions and replacements have been inappropriate.
C. Zoning
•
Current zoning is R-1AAA for both parcels.
V. IMPACT
The designation is being made at the request of the owner of contract.
The owner would reserve the intent, restore, and modify the house. A
Certificate of Appropriateness would be necessary from the Historic
Preservation Board for any structural alterations.
VI. RESOLUTION
It is resolved that 777 North Ocean Boulevard (The Koch House) be
deemed on the Local Register of Historic Places of the City of Delray
Beach for its architecture, historical and cultural contribution to
the City of Delray Beach.

The Koch Residence is situated at 777 North Ocean Boulevard, Delray
Beach. Its 200 x 215 foot ocean front parcel is the northern most
ocean lot•, and lies on the Delray Beach/Gulfstream Town line. The
legal description is Palm Beach Shore Acres, Block D, Lot 21 and Lot
22.
The house has been aligned more with the construction and style of the
period in Gulfstream than Delray Beach. The Mediterranean style in
Delray Beach was primarily along South Ocean Boulevard, while North
Ocean Boulevard, North of Atlantic Avenue to Eighth Street, NE was
developed in the 1930's with British Colonial, Cape Cod, Mission, and
the Monterey Style of architecture.
III. HISTORICAL AND ARCHITECTURAL SIGNIFICANCE
Constructed in 1933, the Koch House was built and designed by its
owner, Dr. William Fredrich Koch (1885-1967) . Born in Detroit, and
educated at the University of Michigan (BA-1909, MA-1910, PHD-1916) .
Dr. Koch received his M.D. from the Detroit College of Medicine in
1918. He was an instructor of Histology and Embryology (1910-1914) , a
Professor of Physiology (1914) , a Pathologist (1915) , and began
private practice and research in Europe and South America beginning in
1919.
Dr. Koch was the topic of a book, "Birth of a Science" (1950) , and the
author of "The Survival Factor in Cancer and Viral Infections (1958) .
He was the creator of "Glyoxylide", and was a renowned figure in
enlightened national and international medical research circles for
almost 50 years. In late fall, 1948, he established residency in Rio
de Janairo, Brazil where he lived until his passing on December 8,
1967.

A seasonal visitor to Palm Beach and Gulfstream in the 1920's and
1930's, Dr. Koch built 777 North Ocean Boulevard as a winter seasonal
beach house in the then popular Mediterranean Revival Style. The
owner is credited with being the architect of record, and it is widely
believed Mr. C.G. Warner, illustrious Palm Beach builder, was the
contractor. Delray mason Mr. E.M. McLaren designed much of the
ornamental stone work. Local and Palm Beach craftsmen were employed
as artisans for the masonry work, cypress, flooring, and other
structural details.
The Koch House is a four thousand square foot, three story, ten room
structure. It is embedded into the natural coral stone foundation.
Dr. Koch's concern for seasonal hurricanes prompted him. to reinforce
all the bearing walls of the estate. The five ranked east facade with
its multi-planes, L-Shaped, barrel tile roof is a classic, superb
representation of its style. Centered by a third story elaborated
tower room and a banded open porch flanked by decorative double fire
places, the house's silhouette is opened by an extensive open Loggia
on the ground level. The elaborated period chimney tops compliment
the Gothic-like ornamentation of the tower. Crowned with corner
escutcheons, finials, a crested roof line, a rare triple leaded glass
windowed oriel .of intricate cypress construction highlights the west
facade. Resembling a turn of the century midwest university turret,
the tower room was used by Dr. Koch as a laboratory.
The walled entrance courtyard on the property's west side is the
town's most significant. It served as an entertainment area as well
as protection from the ocean breezes. The original stonework, crests,
fountain, mahogany batten doors remain. Some of the stonework is
believed to be from Mizner Industries. In 1939, a garage was added in
the same architectural character to the courtyard north side. All
decorative trim and accessories match the original construction. The
courtyard's northern side was abridged by a kitchen addition (10 x
20') .
The massive, glazed, board and batten front double door entrance is
capped by hooded keystone sash windows and a triple crested balcony.
The principal living ocean room features three matched Islamic
patterned, ribbon windows facing east, south and west. All windows
feature keystone hood molds with label stops, and double round
Corinthian columns. This breathtaking ocean room also features a
massive Mediterranean fireplace with a mantel to ceiling bonnet with
inlaid stone crests.

The main level loggia overlooks the ocean, and is a rectangular 13 x
27' structure framed by six Corinthian columns made of Keystone. All
original portals doors are framed by keystone quoins, pediments, or
elliptical framing. Exterior original light fixtures reflect the

The owner was influenced by travels to Spain, Italy and Western
. Europe. Stained and leaded glass windows accentuate the houses
detailing and period.
The interior features imported ceiling woods, cypress and stone
staircases. There are nearly 30 original windows, 10 doors, and

The structure was built for approximately $ 40,000.00

garage apartment (1939) and a separate guesthouse (1980) .

The structure is in very good condition. Post World War II window
additions and replacements have been inappropriate.

The designation is being made at the request of the owner of contract.
The owner would reserve the intent, restore, and modify the house. A
Certificate of Appropriateness would be necessary from the Historic
Preservation Board for any structural alterations.

• The purpose of designating The Koch House, 777 North Ocean Boulevard,
to the Delray Beach Local Register of Historic Places is to preserve
the architectural and cultural significance of the town's most
distinctive private, residential oceanfront estates constructed during
the Great Depression. While Palm Beach and Gulfstream feature many
Mediterranean Revival style estates built from 1923-1937, the Koch
House is the town's only contribution to this magnificent South
