Property Address: 109 Fern Court, Delray Beach, Fl 33444 HPB Meeting Date: August 3, 2011 File: 2011-109 ITEM BEFORE THE BOARD The item before the Board is the consideration of a Certificate of Appropriateness (COA), and Variances to reduce side interior setback associated with additions and alterations to a contributing property located at 109 Fern Court., Del-Ida Park Historic District, pursuant to Land Development Regulations (LDR) Section 2.2.6(D) and 2.4.6(H). Pursuant to LDR Section 2.2.6(D)(6), the Historic Preservation Board (HPB) shall act on all variance requests within a historic district or on a historic site, which otherwise would be acted upon by the Board of Adjustment. BACKGROUND & PROJECT DESCRIPTION The subject property is located on Lot 14, and Lot 15, Block 5, Town of Delray and is zoned R- 1-A-A (Single-Family Residential). The 9,800 square foot (70' x 140') property contains a circa 1954 one-story, ranch-style single-family residence and detached storage sbed. The property is classified as contributing to the Del-Ida Park Historic District. Building records indicate that the structure built a driveway in 1999, remodeled the roof and window in 1998. There are no other records indicating further development or improvements on file with the City regarding the subject property. The subject request consists of the following improvements: • One-story addition to rear (west) consisting of approximately 824 square feet • Additions consist of the following spaces: o a new master bedroom, o a laundry room, o covered porch, and o a dining room • Increase of square footage from 1,473 (under roof) to 2,297 (under roof) ; Materials and Colors: o All colors & material to match existing. • No landscape changes are proposed at this time. There is a variance request associated with the subject proposal, which seek relief as follows: 109 Fern Court;COA 2011-10 HPB Meeting of August 03, 201 I Page 2 of 6 • Side Interior (North) Setback Encroachment: Reduce required setback from 10'-0" to 7'-8" associated with additions to the historic structure; The subject COA and variance request for additions and alterations is now before the Board for review. ANALYSIS Items identified in the Land Development Regulations shall specifically be addressed by the body taking final action on the site and development application/request. Pursuant to LDR Section 2.4.6(H)(5), prior to approval, a finding must be made that any Certificate of Appropriateness which is to be approved is consistent with Historic Preservation purposes pursuant to Objective A-4 of the Land Use Element of the Comprehensive Plan and specifically with provisions of Section 4.5.1, the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. Zoning and Use Review Pursuant to LDR Section 4.3.4(K), Development Standards, properties located within the R-1- A-A zoning district shall be developed according to the requirements noted in the chart below. A Variance has been requested for encroachments and is analyzed further in this report. Positive findings may be made subject to the approval of the requested variance associated with the setback requirements. Pursuant to LDR Section 4.5.1(E) Development Standards: All development regardless of use within individually designated historic properties and/or properties located within historic districts, whether contributing or noncontributing, residential or nonresidential, shall comply with the goals, objectives, and policies of the Comprehensive Plan, these regulations, the Delray Beach Historic Presentation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. (E)(2)(b)(2-3), Major and Minor Development: The subject application is considered "Major Development", as it is the construction, reconstruction, or alteration of in excess of twenty-five percent(25%) of the existing floor area of the building". 109 Fern Court;COA 2011-10� HPB Meeting of August 03,20 Page 3 of 6 STAFF COMMENT: The proposed addition and alteration classify the subject request as "major development" (An increase of approximately 56% in the total area under roof is requested) VARIANCE ANALYSIS Pursuant to LDR Section 2.2.6(D), the Historic Preservation Board (HPB) shall act on all variance requests within an historic district, or on a historic site, which otherwise would be acted upon by the Board of Adjustment. In acting on such variance requests the Board may be guided by the following as an alternative to the criteria normally used by the Board of Adjustments: (1) That a variance is necessary to maintain the historic character of property through demonstrating that: (a) A variance would not be contrary to the public interest, safety, or welfare; (b) Special conditions and circumstances exist, because of the historic setting, location, nature, or character of the land, structure, appurtenances, sign, or building involved, which are not applicable to other lands, structures, appurtenances, signs, or buildings in the same zoning district, which have not been designated as historic sites or a historic district nor listed on the Local Register of Historic Places; (c) Literal interpretation of the provisions of existing ordinances would alter the historic site to such an extent that it would not be feasible to preserve the historic character, of the historic district or historic site; and, (d) The variance requested is the minimum necessary to preserve the historic character of a historic site or a historic district. Note: As required by the LDRs, a notice regarding the subject variance request was sent to those property owners located within a 500' radius of the subject property. Side Interior Setbacks (North): Additions to Historic Structure Pursuant to Section 4.3.4(K), the required side yard setback is 10'0", and the proposal includes an addition which encroaches into the north side yard by 2'4" for a setback of 7'8'. STAFF ANALYSIS In review of the criteria above, the variance can be considered accordingly: (a) The variance would not be contrary to the public interest, safety or welfare in that it is appropriately placed on the site to the rear of the historic structure which is in the interest of the public by maintaining its visibility on the streetscape; (b) Special conditions exist as the historic structure is significantly setback from the front property line, and accommodating an appropriate addition within the required setbacks and which are not forward of the front wall plane would require its relocation forward on the property causing potential compromise of the integrity; (c) While literal interpretation of the requirement would not alter the historic character of the property, it could encourage the property owner to add onto the historic structure in an inappropriate manner or seek demolition of the significantly deteriorated structure; (d) While the variance is not the minimum necessary to preserve the character, it is necessary to assist and encourage the property owner to maintain the historic structure, thereby preserving the historic character. Given the analysis provided above, Staff recommends approval on the variance request as positive findings can be made pursuant to LDR Section 4.5.1(J)(1). 109 Fern Court;COA 2011-10� HPB Meeting of August 03,2C Page 4 of 6 Pursuant to LDR Section 4.5.1(E)(5), Standards and Guidelines, a historic site, building, structure, improvement, or appurtenance within a historic district shall only be altered, restored, preserved, repaired, relocated, demolished, or otherwise changed in accordance with the Secretary of the Interior's Standards for Rehabilitation, and the Delray Beach Historic Preservation Design Guidelines, as amended from time to time. The applicable Standards are noted below: The historic character of a property shall be retained and preserved. The removal of historic materials or alteration of features and spaces that characterize a property shall be avoided. (Standard 2) New additions, exterior alterations, or related new construction shall not destroy historic materials that characterize the property. The new work shall be differentiated from the old and shall be compatible with the massing, size, scale, and architectural features to protect the historic integrity of the property and its environment. (Standard 9) New additions and adjacent or related new construction shall be undertaken in such a manner that if removed in the future, the essential form and integrity of the historic property and its environment would be unimpaired. (Standard 10) STAFF ANALYSIS: The property will be maintained as a single-family residence and the integrity and character of the property will not be compromised. The new additions are both compatible and appropriate, yet have minor details which will differentiate them from the original structure. Therefore, positive findings can be made with respect to the subject LDR requirement. Pursuant to LDR Section 4.5.1(E)(8), Visual Compatibility Standards, New construction within a designated historic district shall be visually compatible. In addition to the Zoning District Regulations, the Historic Preservation Board shall apply the visual compatibility standards provided for in this Section with regard to height, width, mass, scale, façade, openings, rhythm, material, color, texture, roof shape, direction, lot coverage, and square footage, and other criteria set forth elsewhere in Section 4.5.1. Visual compatibility for major development as referenced in Section 4.5.1(E)(2) shall be determined by utilizing criteria contained in (a)-(m) below. Those applicable Standards within LDR Section 4.5.1(E)(8) are noted below. (a) Proportion of Openings (Windows and Doors): The openings of any building within a historic district shall be visually compatible with the openings exemplified by prevailing historic architectural styles of similar buildings within the district. The relationship of the width of windows and doors to the height of windows and doors among buildings shall be visually compatible within the subject historic district. (b) Rhythm of Solids to Voids: The relationship of solids to voids of a building or structure shall be visually compatible with existing historic buildings or structures within the subject historic district for all development, with particular attention paid to the front facades. (c) Relationship of Materials, Texture, and Color: The relationship of materials, texture, and color of the facade of a building and/or hardscaping shall be visually compatible with the 109 Fern Court;COA 2011-1C= HPB Meeting of August 03,2C Page 5 of 6 predominant materials used in the historic buildings and structures within the subject historic district. (d) Roof Shapes: The roof shape, including type and slope, of a building or structure shall be visually compatible with the roof shape of existing historic buildings or structures within the subject historic district. The roof shape shall be consistent with the architectural style of the building. (e) Scale of a Building: The size of a building and the building mass in relation to open spaces, windows, door openings, balconies, porches, and lot size shall be visually compatible with the building size and mass of historic buildings and structures within a historic district for all (f) Architectural Style: All major and minor development shall consist of only one (1) architectural style per structure or property and not introduce elements definitive of another style. STAFF COMMENT: The proposed addition is in keeping with the existing structure's scale and mass in addition to its roof type, pitch, and materials. The new addition complements the principal structure and will have a minimal, if any, impact on the property. Positive findings can be made with respect to the subject LDR requirement. ALTERNATIVE ACTIONS A. Continue with direction. B. Move approval of the Certificate of Appropriateness (2011-109) for 109 Fern Court. Del-Ida Park Historic District, by adopting the findings of fact and law contained in the staff report, and finding that the request and approval thereof meets the criteria set forth in the Land Development Regulations, the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. C. Move denial of the Certificate of Appropriateness (2011-109) for 109 Fern Court. Del-Ida Park Historic District, by adopting the findings of fact and law contained in the staff report, and finding that the request does not meet the criteria set forth in the Land Development Regulations, the Delray Beach Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation.
