Consider a Certificate of Appropriateness for the installation of vinyl awnings,
relocation of the A/C units, and an exterior color change for a contributing
property.

Consider a Certificate of Appropriateness for the demolition of a non-contributing
building and the construction of a single family home.

After preliminary discussion, Mr. Johnson moved to set the Public Hearing
date for June 3, 1998, the motion failed for lack of a second. After further
discussion, the Board concluded that the property owners needed more
information to understand the pros and cons of becoming a district.
It was moved by Mr. Ames, seconded by Ms. Farrington and passed 7-0 to
table establishing the date for the Public Hearing with instructions for staff to
do the following:
❑ Mail to all affected property owners the Historic Preservation
Ordinance, the Historic Properties Tax Abatement brochure,
preservation information sheets, a list of names and addresses of all
property owners in the district, a summary of the economic impact
of historic designation in the Town of Palm Beach, and, a cover
letter explaining the Board's actions.
Mrs. Cayce asked the Board to amend the agenda to add Agenda Items IV.F. COA 307,
and IV.G. COA 348. The Board was of the consensus to do so.
IV. CERTIFICATES OF APPROPRIATENESS:
A. COA 219-Continuation: 325 S.E. 7th Avenue, Contributing Single Family
Residence, Marina Historic District. James Kolleda, Owner.
Item Before the Board: The action requested of the Board is that of approving
a COA for a small addition to the southwest front ell and to replace an existing
roof and extend it over a deck patio area, also located on the southwest ell.
It was moved by Mr. Ames seconded by Mr. Johnson and passed 7-0 to
approve COA 218-Continuation as presented based upon positive findings
with respect to LDR Section 4.5.1(E), with the following condition:
❑ Two additional roof support columns will be added, equally spaced across -
the front (west) patio. A wood railing, similar to or the same as, the deck
railing on the east side of the Kolleda residence, will be installed along the
south and west perimeter of the patio. The railing is to be painted white.
B. COA 334-Continuation: 35 & 41 S.W. 1st Avenue, Old School Square
Historic District, Sundy Estates. Rodeny Romano, Authorized Agent.
Item Before the Board: The action requested of the Board is that of approving
a COA to relocate or demolish two contributing single family residences
associated with the development of the Sundy Estates.

Project Name: COA-219 Continuation Kolleda Residence
Project Location: 325 S.E. 7th Avenue
The action requested of the Board is that of approval of COA-219 Continuation
for the design elements associated with the following:
• Construction of a roofed patio at the southwest corner (front) of the •
structure;
• The reconfiguration of an existing hip/gable roof at the same corner;
• The enlargement of the ell on the southwest corner of the structure.
• The construction of a fence/wall on the front and south side property line.
Originally this property had approximately 228' of lot frontage. The previous
owner replatted the property into 3 separate building lots. The subject property
is located on the center lot. At the time of replotting a portion of the subject
structure extended over the new south property line. In order to create the south
lot, the encroaching portion of the structure was demolished. A variance was
granted by the HPB to allow the balance of the house to remain with a 7.5' south
setback so that additional demolition would not be required. The demolition of
the south portion created a foreshortened, and awkward, hip/gable roof on the
southwest corner which faces the street.
The applicant came to the Board on April 2, 1997 for a pre-application review.
The Board members stated that they could support the variance for the-roofed
patio and recommended that the applicant return with a formal submission. The
Board also requested that the applicant provide scaled elevations for the north,
south and west views of the patio and roof for consideration during the COA
review. .
The applicant is proposing to remove the foreshortened hip/gable roof covering
the southwest ell of the building and replace it with an east/west gable which will

• That the landscape approval required for the project may be staff
approved.

Item Before the Board: The action requested of the Board is that of approval
of design elements associated with the following:

Item Before the Board: The action requested of the Board is that of a pre-
application review and comment on a proposal to convert a commercial
structure to a restaurant, with a second story to be added to accommodate
two residential apartment units. The Board previously reviewed this item at
their October 2, 1996 meeting. They felt there were several inconsistencies
with the elevations and suggested the applicant consult with his architect to
resolve these problems.
The Board was not enthusiastic about the revised elevations. They felt the
building lacked a definitive style and contained too many mixed architectural
elements. Additionally, they did not support the fiberglass roof, as the roof is
such a prominent architural feature of the building.

The new owners plan to add the bedroom addition to the S. E.
corner of the house. Wooden French doors will be installed,
the exterior siding and roof will match existing. The
addition is not visible from the street.

Pat Cayce requested to amend the amendment to the agenda to
allow Item 3.A. , under the direction of David Kovacs, COA 8-139 Continu-
ation A, which is Phase II, Old School Square. It is the modification
of the south wall in the service parking area to allow an 8 X 37 1/2
foot storage room to be built on the north side of the wall. Represen-
tative Bert Schneider was present.
2. Public Hearing: Variance Request 88-20, 325 S.E. 7th Avenue,
David M. Riekse, Jr. , Owner.
A variance from Section 4.3 .4 (K) of the Land Development
Regulations to allow a 2.65 foot building encroachment within the side
yard setback of Lot II of the proposed Riekse Plat. The effect of this
variance will be to allow an existing historic residence to remain in
its original location. The subject property is located within the Marina
Historic District and zoned R-1AA. The requirement is 10 feet and
divided will be 7.35 feet.
Public Hearing was opened.
The public hearing was closed.
Christine Bull moved approval of the variance allowing a 2. 65
building encroachment, taking it from the requirement of 10 feet down to
7.35 feet, seconded by Bill Ayers. The vote was as follows: Bill Ayers

Variance Request 88-20 for David M. Riekse, Jr, 325 S.E. 7th
Avenue.
BACKGROUND
Mr Riekse gained approval from the City commission, at its
meeting of November 13, 1990, to replat his property into a
subdivision containing three building lots.
On November 14, 1990 the HPB gave approval to demolish the
contributing single family family house located int`center of the
property, Lot II according to the replatted parce‘l. The north
and south wings (noncontributing) of the building encroach on
Lots I and III respectively.
ITEM BEFORE THE BOARD FOR VARIANCE CONSIDERATION
Mr. Riekse has a buyer for Lot II and the contributing house.
The buyer will rehabilitate the house and it will remain in
place. In order to accomplish this the north and south wings
(noncontributing) will have to be demolished. Though the south
wing will be removed, a part of the original house will encroach
on the side interior setback of Lot II by 2. 65 feet. The
required set back is 10 feet and only 7. 35 is provided.
Please see the attached survey.
Staff recommends granting this variance as it is the only
practical way to preserve the house and prevent demolition.

Included in the packet are the designs for the Sundy House signs.
This item will come for Sign Department staff review, Friday,
March 29 , 1991 for consideration of size, setbacks, etc. If the
the signs are approved on Friday the HPB agenda will be amended
to include the Sundy House sinage.

Sloan - Yes. Motion passed 5-0.

It was the consensus of the Board that if the colors for the
fence and the residence are within the guidelines of the City, there is
no problem with the color choice.

5. Recommendation to the Planning and Zoning Board regarding the
proposed abandonment of the alley in Block 62, in association with the
Sundy House and the Sundy apartments.
Jeff Costello made a presentation and answered questions with
regard to the above item.
Daniel Carter moved denial of the proposed abandonment of the
alley as filed, seconded by Bill Ayers.
Daniel Carter amended his motion, Bill Ayers amended his
second.
Daniel Carter recommended approval for the abandonment of the
alleyway subject to the condition that a master plan be submitted which
provides access to the adjacent lots, seconded by Bill Ayers. The vote
was as follows: Bill Ayers - Yes; Christine Bull - Yes; Wayne Campbell -
Yes; Daniel Carter - Yes; Spencer Pompey - Yes; Rose Sloan - Yes.
Motion passed 6-0.
6 . Reports from Historic Districts:
A. Mary Lou Jamison, Chairman of Del-Ida Park Neighborhood
Association.
Presentation of 8th Street Traffic Circle Plan and Sinage.
Mary Lou Jamison presented new changes in the district and will
bring back the signage after Dr. Westine approves it. She wanted to
comment that there will be only three (3) signs in the district instead
of twenty (20) .
B. Old School Square.

Gene Fisher reported that there was no news from his area. He
briefly discussed the widening of Lake Ida Road and the widening of 10th
Street which will put more traffic on Swinton Avenue.
C. Marina District.
There was no representation from this area of the District.
7. Report on "Banker' s Row" .
Daniel Carter reported Banker' s Row will have a presentation on
June 27, 1991.
8. Approval of Minutes of May 15, 1991.
Wayne Campbell moved approval of the Minutes of May 15, 1991,-
seconded by Christine Bull. The vote was as follows: Bill Ayers - Yes;

Pat Cayce introduced a prospective buyer to the Historical
District area. She has lived in the area for ten years as a renter and
is now going to buy property with a grant she hopes to obtain in order
to help save the property.

For the record, Frank McKinney stated he was not the owner of

tion of the fence, seconded by Christine Bull. The vote was as follows:

Rose Sloan stated Item #5 could be approved upon submittal of
the rendering, followed by a telephone poll. Stan Weedon stated the
understanding will be if the design guidelines are adopted as otherwise,
it will be handled that way.
6 . COA 8-141 - 325 S.E. 7th Avenue, David Riekse, Owner. Consider
demolition of above noted residence.
Roger Sabserson, Attorney, was present on Mr. Riekse' s behalf.
Bill Ayers moved approval for demolition, seconded by Rose
Sloan.
Pat Healy-Golembe read a letter from Daniel Carter, an absent
Board Member, who stated he chose to deny the demolition request.
Letters from residents were also read.
The following people spoke regarding the. demolition:
Ray Yardley stated he is in favor of the demolition.
Dawn Blumgren stated the house should be moved, not demolished.
Carolyn Patton stated she is against the demolition.
James Bowen stated he is against the demolition.
Carol Westendorf stated she is in favor of the demolition.
Alieda Riley stated she is against the demolition.
In order to avoid demolition, the structure is available for
removal if it can be done within a proper time frame. Bill Ayers
suggested Mr. Rieske contact a moving company to see if the building can
be moved from it' s present location, and then return to the next meeting
to present his findings.
After extensive discussion, a vote was taken on this issue.
The vote for the above motion was as follows: Bill Ayers - Yes;
Christine Bull - No; Wayne Campbell - Yes; Spencer Pompey - Yes; Rose
Sloan - Yes; Pat Healy-Golembe - No. Motion passed 4-2.
The consensus of the Board was to give Mr. Rieske 30 days to
see if the building can be moved and/or to see if there is any public
interest in this structure.
4. It was the consensus of the Board to inform the owners of this
building that no action has been taken, it has not been approved and all
work should be stopped.

Rose Sloan moved acceptance of the concept of the deck, thus-
far, and approved the lighting, awnings and landscaping as in the Boyd
Building, seconded by Bill Ayers. The vote was as follows: Bill Ayers -

synopsis of the requirements for landscaping in the Old School Square
Historic Arts District. He stated it may not go as a policy issue, but
. rather as a text amendment, with the Board making the recommendation.

not administer - requirement 4 . 6.16 (H) (3) (e) perimeter landscaping in

Mr. Martin presented a site plan reflecting changes to parking
and landscaping which were . requested by the Planning and Zoning staff.
The corrected plan has not been reviewed by staff. If any additional
changes are required after staff review, these changes may be approved.

Kathy Stokes and Carolyn Patton, spoke with regard to the
proposed removal of the Monument when the park is renovated.
It was the consensus of the Board to recommend leaving the
Monument in the park.

Site Plan Review Board, the City Manager, Planning Director, Parks and

if not he can be fined on a daily basis. One of his code violations is

The existing roof is asphalt shingle and was originally grey. The
owner will replace it with the same material.
An historic comment for your interest, this bungalow was built in
1925 and served for many years as the rectory for the First Methodist
Church of Delray.
3 . COA 8-142 101 Dixie Blvd., Estate of Edward Carpenter,

The existing roof is wood shingle and the trustees for the estate
will replace with same material.
Eddy Carpenter, who was a great supporter of historic preservation
in Del-Ida Park, died of a heart attack last month. His mother
built the house in 1939 and he wintered here as a young man and
later made it his full time residence. He told me a great deal
about the neighborhood as he remembered it in the 1940s and was a
great help when we were writing the designation report for the
district.

As you will see when you drive past, the house has already been
painted and a new front door has been installed. I spoke with
Robert Turner and he told me that his daughter failed to tell him
that he needed approval from the Board before proceeding. He said
that he had rehabed his property in Pineapple Grove and thought that

building. The original concrete drive will be retained and 6
parking spaces will be provided at right angles to . the south
property line. The parking is to be white rock and the wheel stops
will be wooden. The existing plants to the south will be maintained
and a 4 foot hedge will be planted at the west side of the sidewalk,
south of the curb cut, to screen the parking from view. The front
and north property lines will have a 3 or 4 foot white picket fence
installed.
Staff recommends approval.

Consider Granting a Waiver from Section 4 .4 ..9-6- to Allow Parking in
the Front Yard.
Section 4 .4 .76 allows parking only in the rear or side yard. This is
not possible because of the location of the building, therefore a
waiver is requested by the applicant to accommodate parking in the
front yard.
Staff recommends approval.
6 . COA 8-141 325 S.E. 7th Avenue, David Riekse, Owner.
Consider demolition of above noted residence.
This single family residence at 325 S.E. 7th Avenue was designed by
Nels S . Jacobson for Mr. and Mrs T.W. Boykin, Jr. and was built in
1938. It is a colonial revival cottage which was a very popular
architectural style, especially for winter residents, in Delray .
Beach during the 1930s and 40s .
The house was purchased by Mr. and Mrs. William Clark Arkell and in
1941 a substantial addition was constructed from plans drawn by the
New York City architectural firm of Magill Smith. Mr. Arkell was
the chairman of the Beechnut Company (baby food, etc. ) which was
founded by his father, Bartlett Arkell.
The house was later bought by the Owsley family who added a Florida
room and other additions .
Mr. Riekse has prepared a booklet regarding his demolition request
which he tells me he has delivered to the HPB members . The booklet
contains photos: of the style of homes he plans to build as well as a
sample site plan for the proposed 3 lots. This is a conceptual plan
which does not adequately address setbacks and other required items
and should not be regarded as a final site plan. Nor should you
consider this site plan when deciding on demolition approval.

The booklet also contains a list of names and addresses of neighbors
who favor demolition. Seventeen of the addresses appear to be
outside the Marina Historic District. See attached.
At. the HPB's instruction a letter of notification was sent to all
property owners in the District. One letter opposed to the
demolition has been received, none in favor. See attached.
Mr Riekse's final platting for 3 lots on his property will come
before the City Commission on Tuesday, November 13, . 1990. The City
Manager is recommending approval with conditions pertaining to
sidewalk right of way and upgrading of the water main along S.E. 7th
Avenue. Please note Kathy Dearden's letter of October 26, 1990,
which is attached.
The house in question is an important link to Delray Beach's
unique, affluent, winter resort community during the 1930s and 40s.
While the house probably would not qualify for . National Register
designation it is an excellent, and one of the last remaining,
examples of the "cottages" built along Delray's. Intracoastal .
Waterway. It is in harmony
with its location and certainly is a
vital contributor to the Marina Historic District.
If approval for demolition is denied Mr. Riekse may appeal the
HPB' s decision to the City Commission.
Staff recommends denial of demolition.

This building was built by Charles Toth, Architect, for his office.
He is in the process of selling it to Dr. and Mrs Tomelleri for use

installation of vinyl awnings, relocation of the A/C units, and an exterior color
change for a contributing property.

It was moved by Mr. Miller, seconded by Mr. Keavney, and passed 5 to 0 to
approve the COA and associated Class I site plan modification for 9 SE 7th
Avenue, Brisa Atlantica, based upon positive findings with respect to LDR
Sections 4.5.1(E)(4), (E)(8)(g), and the Delray Beach Design Guidelines.
C. 325 SE 7th Avenue, Marina Historic District, Stofft.Architects, Inc., Authorized
Agent
Item before the Board: Consider a Certificate of Appropriateness for the
demolition of a non-contributing building and the construction of a single-family
home.
Chairman Perez asked if there were any ex-parte communications. There were
none.
Ms. Shay presented the project to the Board and entered the project file into the
record.
Mr. Craig Valvo, Island Homes presented elevations of the pool, as well as the
proposed home that depicts what changes would be incorporated into the plans.
Chairman Perez inquired if there were any questions from the public. There were
none.
Chairman Perez closed the Public Hearing, and asked if there were any
comments from the Board
The Board recommended that additional architectural elements be incorporated
into the side and rear elevations, such as banding, arched windows, and door

surrounds. The pool needs to be set back, and the applicant must provide a true
color palette
Demolition
It was moved by Ms. Jamison, seconded by Mr. Keavney, and passed 5 to 0_to
approve a Certificate of Appropriateness for the demolition of the non-
contributing dwelling at 325 SE 7t' Avenue, based upon positive findings with
respect to LDR Section 4.5.1(F), and it is approved administratively when the
changes come in.
Certificate of Appropriateness
It was moved by Mr. Miller, seconded by Mr. Silberstein, and passed 4-1
(Jamison dissenting)to approve the Certificate of Appropriateness for 325 SE 7th
Avenue, based upon positive findings with respect to the LDR Sections
4.5.1(E)(4), (E)(7), and (E)(8)(a-k), 4.6.15(G), and the Delray Beach h Design
Guidelines, subject to the following conditions:
1) That additional architectural elements be incorporated into the side and rear
elevations, specifically including but not limited to: banding, arched windows
and door surrounds, and variation of the exterior,
2) That the south end of the proposed pool be relocated to comply with the
required minimum ten foot(10') side setback;and,
3) That the applicant submit a true color scheme.
4) That additional landscaping be added facing the intercoastal.
D. Blue Anchor, 802 East Atlantic Avenue, Marina Historic District, American
Awning, Authorized Agent

the installation of an awning.

Mr. Joseph Mattei of American Awning submitted royal blue canvas material to
the Board for review.
Chairman Perez closed the Public Hearing, and asked if there were any
comments from the Board.There were none.
It was moved by Ms. Jamison, seconded by Mr. Miller, and passed 5 to 0 to
approve the COA associated with the Class I site plan modification for the
installation of a canvass awning for 802 East Atlantic Avenue, Blue Anchor,

and the Delray Beach Design Guidelines, subject to the following conditions:

2) That prior to issuance of a building permit, the applicant enter into a Hold
Harmless Agreement with the City.
3) That Royal Blue canvas material be utilized and all framing is painted to
match.

Ms. Shay presented the project to the Board and entered the project file into the
record.
Staff is recommending re-designing the awning to accommodate the existing
landscaping at the patio. The owner was notified that if the company occupies
816 East Atlantic Avenue, additional parking will be required. Staffs concern is
that the planter area can be covered and the square footage increased resulting
in the additional need for parking.
Mr. Donald Day, Delray Awning, stated that the awning was re-designed to cut
around the planter. The posts will be painted to match the building, and the upper
portion of the structure will be painted to blend with the canvas awning.
Chairman Perez closed the Public Hearing, and asked if there were any
comments from the Board.
Mr. Silberstein inquired about exterior lighting. Mr. Day advised that there would
more than likely be fans and lighting under the awning.
It was moved by Mr. Silberstein, seconded by Ms. Jamison, and passed 5 -0 to
approve the COA associated with the Class l site plan modification for the
installation of an awning at 814 East Atlantic Avenue, Old School Square Bread
Company, based upon positive findings with respect to LDR Sections 4.5.1(E)(4),
(E)(8)(g), and the Delray Beach Design Guidelines, subject to the following
condition:
1) That the awning be re-designed as a gable in order to ell from the front door
out to the patio area without covering the existing landscape strip adjacent to
(east of) the building.

installed wrought iron gates without approval. George Bush is a collector road
and the gates do not open automatically. Therefore, they will be blocking the

Ms. Shay requested that a Board member attend the West Settlerq Advisory
Board meeting on the fourth Monday of each month. Several Board members
expressed interest.

The action requested of the Board is that of granting
approval for the demolition of a 176 sq. ft. storage
room on the west (front) facade. The storage room is
to be replaced with 17 ' 6" x 24 ' garage.
The Board moved to approve COA 8-219 based upon
positive findings with respect to Section 4 .5. 1(E) (8)
(Visual Compatibility) , as follows:
* Approve the demolition of a storage room on the
northwest corner of the building. In its place a
17 ' 6" x 24 ' frame garage will be constructed.
The entrance of which will face south, no
reconfiguration of the existing driveway will be
required. The roof of the garage is to have a
gable running north and south and will be the
same height as the hip roof on the existing
building which is behind it. The west facade,
facing the street, will have a small bay window.
The garage is to have horizontal siding to match
the main residence. The new roof surface will
match the roof of the residence. The garage door
is to be wood with raised panels . Glass panes
may be used in the garage door if the owner
chooses to do so.
Buck Miller moved for approval of COA 8-219, seconded
by Charlie Williams. The vote was as follows:

V. DISCUSSION AND ACTION ITEMS:
A. Location of the Boat Sewage Waste Pump at the City
Marina.
Joe Dragon of the Parks & Recreation Department,
explained to the Board why the City was placing the
boat sewage waste pump at the north end as opposed to
the south end of the City Marina. He explained that
if placed at the south end it would cost more to
install and the marina would loose two boat slips.
Where if placed at the north end the installation cost
would be less and the marina would loose only one boat
slip. He also stated that he had looked at the same
model pump at a marina in Fort Lauderdale and found no
odor problem.
The Board requested that Mr. Dragon check with the
Engineering Department on hooking into the sewer line
to the marina restrooms at the south end and get an
actual cost analysis for installation at both ends of
the marina. The Board felt that aesthetically the
pump would be better placed at the south end of the
marina.

F.J. Bright Park to the Board for their approval.

ITEM BEFORE THE BOARD
The action requested of the board is that of granting approval
for the demolition of a 176 s.f. storage room on the west
(front) facade. The storage room is to be replaced with 17 '6" x
24 'garage.
BACKGROUND
This house was built in 1938 for Mr. & Mrs. T.W. Boykin Jr. It
was designed by Delray Beach architect, Nels Jacobson in the
resort cottage style. It sat on a large plot of land; 244'
frontage on S.E. 7th Avenue. The house was remodeled with
additions in 1941 and again in 1959 . In the fall of 1990 David
Reikse the owner at the time, proposed replatting the land into
three buildable parcels. However, the house was situated in the
center of the plot and Mr. Reikse proposed to demolish it in
order to create the three lots. In a pre-application hearing
the Preservation Board expressed its opposition to the proposed
demolition. The COA for demolition was formally reviewed at the
Board's November 14, 1990 meeting. The board voted 4-2 to allow
the demolition with the condition that the owner consult with a
moving company to determine the feasibility of relocation. (By
this time staff had had several inquires regarding the
relocation of the house. ) The Board requested that the applicant
return to the Board at the next meeting to discuss relocation.
No demolition date was established. At the next meeting Mr.
Reikse informed the Board that he had found a possible buyer,
the present owner Mr. Kolleda. However, in order to sell the
house on its original site on the center lot and create the lots
to the north and south, several rooms would have to be removed
from the north and south facades and variances would be needed
to allow for side setback encroachment. Fortunately, the
portions of the house to be removed were the later additions.
The Board approved the room removals on the north and south
facades and granted the necessary variances to allow the
original portions of the building to encroach on the side
setbacks.
DESIGN CONSIDERATIONS
The applicant is proposing to demolish a storage room on the
northwest corner of the building. In is place he will construct
a frame garage, the entrance of which will face south. The roof
of the garage is to have a gable running north and south and
will be the same height as the hip roof on the existing building
which is behind it. The west facade (front) will have a small
bay window. The garage is to have horizontal siding to match
existing and the roof will also match existing.
RECOMMENDED ACTION
Make positive findings with respect to Section 4.5. 1(E) (8) ,
visible Compatibility, and approve COA 8-219 on the condition
that the horizontal siding is to match that of the existing
