Prior to granting a variance, HPB must make certain findings pursuant to LDR Section 2.4.7(A)(5): Mr. Keith Spina, architect was here to answer any questions regarding the project. Chairman Perez asked if there was anyone from the public who wished to address the Board. There were none. The Board concurred that it was a nice project. D. 706 SE 2nd Street, Marina Historic District, Enrique Martinez Celaya Item Before the Board: Consideration of Appropriateness associated with the demolition of a dwelling. Chairman Perez asked if there were any ex-parte communications. There were none. Mr. Adams entered the project file into the record. The subject property consists of Lot E less the east 148.3 feet of the north 145.6 feet, The Moorings, Delray Beach. The property is situated on the south side of SE 2nd Street approximately 150' east of SE 7`h Avenue and contains a 2,163 square foot contributing, one-story, Cottage style single- family dwelling. From the records available, there is some confusion as to when the structure was built as a 1986 survey suggests it was constructed in 1936, the Property Appraisers website suggests 1956, and the building record card suggests 1936, 1951 and 1971. The property is zoned Single Family Residential (R-1-AA) and is situated within the Marina Historic District. The dwelling is of wood frame and stucco construction and is in a poor condition, particularly the south section which is cracking and is not depicted on the building record card. There are no recent administrative or Board actions pertaining to this property. 8 Historic Preservation Board Minutes August 17, 2005 The current proposal is for the demolition of the dwelling. At the time of survey in 1986, the structure was classed as a contributing building as it was deemed to be architecturally significant, it was in excellent condition, and it was unaltered. The plan of the structure on the survey record is identical to the plan on the building card; however, these plans bear little resemblance to what is actually in existence now. The building card was last updated in 1971 when a frame addition costing $27,000 and an A/C system costing $1,200 were approved. Analysis of the available evidence suggests that the development history of the dwelling is as follows: 1936 Original cottage dwelling constructed. 1951 Kitchen and dining room added to the north of the dwelling. 1971 Addition added to the south of the dwelling when details were added to the building record card but the plan was not updated. 1986 Dwelling classed as being contributing without a full survey being undertaken which would explain its description as `unaltered'. Further evidence of the above can be found in the construction of the three phases as there is a solid floor in the central (original) section and wood floors in the north and south additions. Also, the central (original) section retains what appears to be an original window and one design of shutter while the two additions have windows of a later design and differing shutter design. The applicant has submitted his own theory as to the construction history (attached); however, it is clear that the original dwelling has been substantially altered over time. There are a number of different windows inserted into all three of the building phases, and a sun room has been added to the rear of the original dwelling which is accessed from a large opening cut into the original rear wall. The dwelling is also in a very poor condition with obvious decay in the floors, windows, walls and roofing timber. The external walls of the addition to the south are cracking which is probably caused by poor construction and poor ground conditions. In support of the application for demolition, the applicant has submitted a letter outlining his theories on the inappropriate development of the dwelling and has stated that plans are being developed for the construction of a new dwelling. It should be noted at this point that the design of the new dwelling will be required to meet strict historic preservation design guidelines to ensure compatibility with design and massing in relation to the surrounding area. The demolition of a historic structure is a loss to the community and the city; however, when architectural significance and authenticity are lost it is difficult to justify the structure being classed as contributing. Demolition of the dwelling will not have an adverse effect on the Marina Historic District as it cannot be seen from the public right-of-way. However, it can be seen from the Intracoastal Waterway and, as such, any new structure will have to be compatible with the other waterfront properties in the district. Based upon the above, therefore, positive findings can be made with regard to Sections 4.5.1(F)(1)(a-e) of the Land Development Regulations, subject to conditions. 9 Historic Preservation Board Minutes August 17, 2005 While the Board can impose a 6 month delay in the demolition of a contributing structure to allow another site to be found for its relocation, it is not anticipated that anyone would be willing to pay the expense of moving a house of this particular design and condition. Mr. Jose Lorenzo, the applicant, advised he reviewed the report and will follow the recommendations. Chairman Perez asked if there was anyone from the public who wished to address the Board. There were none. Board discussion ensued and it was agreed that the dwelling should be demolished. Mr. Ad ms-advis`edthat several alterations were made to the dwelling over several years. Mr. Adams entered the project file into the record. The subject property is located on the northwest corner of Nassau Street and S. Ocean Boulevard within the Nassau Park Historic District. The property encompasses the south 21.65' of Lot 1, all of Lot 2 and the east 35' of Lot 3, Nassau Park subdivision and consists of 0.41 acres. The property is zoned Multiple Family Residential (RM). The main house, located on the south side of the property, was constructed in 1936. In 1943 Theodore and Mary Meyers purchased the house and all of the vacant lots in the north half of Block 127. The Meyers replatted their property and created The Moorings, a subdivision of 5 lots. In 1955 the subject house, which is located on Lot E, was sold to Mr. & Mrs Oudman and Lot E was divided to create the present lot and private driveway. As the property is single family and is not visible from the street the landscaping will not be reviewed by the Historic Preservation Board. However, it will be necessary for the applicant to submit a landscape plan which reflects conformity to the City's Landscape Regulations before a building permit will be issued. This must include an irrigation plan, foundation plantings for new construction, relocation of landscape materials and areas of sod and ground cover. With respect to the balance of of Section 4 .5. 1(E) (8) , the project generally conforms. The project presents an interesting facade and roofline to the Intracoastal Waterway vista. The garage addition, while large, is well located and integrates itself to the west elevation. The use of non-functioning decorative shutters does not conform to the Design Guidelines and are generally not recommended. However, the shutters are not visible from the street, do not impact neighboring houses and do not detract from the overall design and massing of the windows. The Board moved to approve COA 8-213 based upon positive findings with respect to Section 4 .5 . 1(E) for the renovation of an existing residence and new construction to accommodate the addition of a second story and attached 4 car garage with the following conditions: 1 . That the cupola be relocated to the center of the garage roof. 2 . That the arched window on the second floor of the east elevation be 6 ' wide and be lengthened to be in proportion with the bay window beneath it. 3 . That the south window on the second floor of the east elevation be the same size as the east window on the second floor of the south elevation. 4 . That the French doors to the south on the first floor of the east elevation have the same pent roof (eyebrow) as the adjacent bay window. DISCUSSION AND ACTION ITEMS: A. ELWOOD' S CANOPY ELEVATIONS : Staff requested the Board' s recommendation to be forwarded to the Site Plan Review and Appearance Board (SPRAB) on a change in the site plan to modify the canopy to an awning. The Board preferred the original canopy but due to the cost factor moved to recommend approval to SPRAB of the modification as presented. Sandy Jamison moved to recommend approval of the modification to the site plan for an awning, seconded by Christine Bull . The vote was as follows: Christine Bull - Yes; Daniel Carter - Yes; Sandy Jamison - Yes; Buck Miller - Yes; Margie Miller - Yes; John Vaughan - Yes . Analysis of the COA's In analyzing the five elevations it is clear that a variety of massing and fenestration has been approved. ' ( 1) 229 S.E. 7th Ave. , presents a generic rear elevation which can be found in many new houses . No attempt was made to integrate the rear elevation to the criteria for new construction in historic districts. (2) 321 S.E. 7th Ave. , has attractive massing and presents an interesting rear facade. (3 ) 840 E. Atlantic Ave. , Busch' s Restaurant deck is an appropriate addition to previously altered east facade. (4) 325 S.E. 7th Ave. This is an eclectic but pleasant facade which successfully blends the existing house and the new construction. (5) 335 S.E. 7th Ave. Attractive new construction which is compatible to the district. With the exception of the "picture" window to the south, it presents a well balanced elevation to the waterway. Waterway elevations with respect the the 4 .5 . 1(E) , Development Standards. The Board also requested that staff review the Historic Preservation Ordinance with regard to elevations viewed from the Intracoastal Waterway. No mention is made of the view from the waterway with respect to compatibility to the adjoining properties . However, when the ordinance was adopted the historic districts had not been established and the focus was primarily on the front facades and their relationship to the streetscape. It is staff' s opinion that some of the Development Standards should apply to the waterway vista but not to the extent that is applied to the front or street facade. With respect to the waterway vista, visual compatibility should be determined by the criteria set forth in the relevant paragraphs of Section 4 .5. 1(E) (8) , Visual compatibility shall be determined in terms of the following criteria: (a) Height, compatible in comparison or relation to the height of existing structures. Staff Report COA 8-213 Page3 (c) Proportion of openings (windows and doors) . (g) Relationship of materials, texture, and colors. (h) Roof shapes . (j ) Scale of a building. This project conforms to all of the above with the possible exception of paragraph (c) . However, paragraph (c) relates to the prevailing historic architectural styles and the relationship of the width of windows and doors to the height of windows and doors among buildings within the district. As the ordinance was written with the front or streetscape view in mind, and as we do not have documentation or photographs of the rear elevations which face the waterway (except for the approved COA' s) , it is difficult to make positive or negative findings with regard to the compatibility windows and doors among buildings facing the waterway. It might be more appropriate to refer to (d) Rhythm of solids to voids ; front facades . , even though the paragraph specifies front facades. OTHER ITEMS I have discussed your concerns with the applicant. He will bring some alternative suggestions for the south portion of the east facade to the meeting. POSSIBLE ACTION In the report for the September 1, 1993 meeting, staff recommended approval of COA 8-213 as presented. The recommendation was based on making positive findings with respect to Section 4 .5 . 1(E) that the project was in general conformity with the development standards . After reviewing the pertinent paragraphs of Section 4 .5 . 1(E) , staff found enough positive findings with respect to the rear elevation to continue to recommend its approval. The applicant will be presenting the Board with alternatives to the window and door treatments for south portion of the east facade. These alternatives will address the concerns of the Board regarding the window styles and placement. 1 . By making positive findings to Section 4 .5 . 1(E) , approve COA 8-213 as originally presented. 2 . Failing to make positive findings with respect to Section 4 .5 . 1(E) , deny COA 8-213 .
