Neither I nor my neighbors are taking this lightly, Our newest neighbor, Mr. Silberstein at 219 N/E First Avenue, an architect, no less, failed to comply with the decisions of the Historic Preservation Board (H.P.B. ) with reference to window and door guidelines required for this historic block. Instead he proceeded with his work in violation of current code. . . I guess he figured it was easier to get forgiveness then approval. It turns out that his thinking might have had some merit in that rather than see to his compliance, the staff person from (HPB) Pat Casey came to us, the Homeowners Association of Bankers ' Row, with a request that we change our code to allow for what Mr. Silberstien has already done. In a nutshell, we were being asked to back in to amend the codes to accommodate a particular new owner. Because of this, we asked that we be allowed time to call a meeting of the homeowners, this request was granted. Currently we are required by (HPB) to maintain to a fault the front facades of our homes and/or businesses to include wood windows and doors; original restoration where possible and milled wood windows and doors to simulate the authentic where repairs are impossible. At exceptional expense to us all, we have all complied. We complied because we knew what we were getting into when we bought a home on Bankers' Row. We are ordinary people. . .certainly, an architect should be more familiar with the historic styles of architecture and the particular codes in Delray Beach and be able to make an educated decision as to whether he was willing to comply to Bankers' Row codes. . .or locate in a different block, or part of town. e Page #2 In the Past, the (HPB) has afforded the cottages on Bankers' Row the opportunity (variances) to utilize wind resistant aluminum (rather then impact glass aluminum) on the sides and rear of our homes with proper shuttering. At the homeowners association meeting, of which minutes were taken and provided to the (HPB) , it was voted after much discussion that aluminum impact windows would be allowed on the facades thus accommodating Mr. Silberstein's fear of "snatch and grab" crimes. At the Bankers' Row meeting we asked Mr. Silberstein if he had used impact resistant windows on the sides and rear of his building, to which he responded "YES". A vote was taken and summarized in our Bankers' Row minutes that aluminum would now be allowed on the front facade provided they were impact resistant and that authentic period shutters and wood trim would be utilized to somewhat preserve the historic integrity of the block. In summery, Bankers' Row decided to allow for aluminum impact windows in addition to keeping our current code in place. (Silberstein' s non-conforming doors resembling a store front were another issue) . Bankers' Row sent our minutes to the (HPB) staffer, Pat Casey, she sent back an amendment that now removed our rights to install wind resistant aluminum windows and ONLY allowed aluminum impact windows; Silberstein' s costs were reduced and our costs were increased along with our existing right to use wind resistant aluminum removed, such a deal! We immediately contacted Ms. Casey to clear up the misunderstanding and were told to attend the meeting of the (HPB) dated February Second. At the February Second meeting the amendment was still incorrect. The Bankers ' Row homeowners who attended the meeting tried to voice what was actually voted at the homeowners meeting by exhibiting the minutes, a copy of which was attached to the HPB February Second agenda (Here we were defending this new comer and we find ourselves loosing our own rights provided in the original code in order to accommodate Silbersteins' need for an amendment! ) Further, this man Silberstein had approached the staffer, Pat Casey to request an additional accommodation to his project. He requested to change the approved gray color of the historic Mackle roofs that all of us were required to install, and change to charcoal! This eleventh hour issue was not on the February Second agenda and was presented as an add-on issue. We would not have even known about the variance request if we had left the meeting after our agenda discussion. Silberstein of course did not show up for the (HPB) meeting. As the Bankers' Row homeowners who were present tried to Page #3 clear-up the amendment pursuant to our minutes, either the chairlady or Tony Keller of the (HPB) Board said, "why are you going through all this work to amend your code?" To which we replied that, . . ." we liked the codes as they were, but Pat Casey asked our input to a revision to accommodate Silberstein who was in noncompliance of the board. Here is our compromise, ( the Bankers Row minutes attached to the HPB agenda) and now we see that in addition to this compromise, Silberstein wants to change the whole roof color!" At this point the Board said that they were sorry that we had been put through this exercise and voted to retain the existing code. In addition, they voted to table Mr. Silberstein' s request to change his roof to a nonconforming color until after the commission appeal meeting. The HPB Board also said we should attend the city commission meeting and voice our opinions. That is what I am doing, so here it is very clearly: I feel I am being bullied into a situation that will effect the beauty of this historical block. I don't care how strong or rich or influential an individual is or who he knows, we expect the codes to apply equally to all parties concerned. The HPB Board is in place to protect all of us. I want them respected especially by this commission. This block was a disaster and it was the strict adherence to the codes that made this block a delightful charming vision of the past. Have you forgotten we were your first joint venture? I brought this up at the January Design committee meeting at Bob Curry' s office and those experts concurred that one of the best interests of Bankers ' Row would include preserving the historic integrity of the individual residences and businesses. Mr. Silberstein will have effectively block-busted this lovely historic street if allowed free run. We conceded to his aluminum windows with proper shuttering, the doors we did not know what to do with. . .But now, a black roof! The other businesses including the lawyers office and counseling center complied beautifully in their restoration, and Silberstein is an architect! He should be the first to comply and not plead ignorance. Please support the Historic preservation Boards in their decision to uphold the current code. The homeowner of Bankers' Row are counting on you. Silberstein -Z/tr/ oo 219 NE First Avenue Delray Beach, Florida 33444 Dear Commission Members, From 1991 -1993, a time in Delray Beach in which the Old School Square area was in serious ruin, the homeowners of Banker' s Row came together as neighbors and heroically decided to save their historic block. The homeowners of Bankers ' Row pulled together to create a homeowners association. And then with an unprecedented majority voted to tax themselves so that the city would put in street improvements which mirrored the Atlantic Avenue street improvements. (i.e. brick sidewalks and old style street lights) The homeowners of Bankers' Row had a dream that the new street improvements, would attract new kind of resident on the block. A resident who would help restore Banker Row. Because preservation and restoration was important to the homeowners of Bankers' Row and because the homeowners had agreed to assess themselves, the city agreed to create special building codes for this block. Codes which would protect the unique historic nature of the Bankers ' Row facade. Working with the City Redevelopment Agency and the Historic Preservation Board, these codes were set into place to prevent the homogenization of this block facade into the rest of the city' s development. Here on Bankers' Row was an opportunity to restore and maintain a more authentic "Old Delray" . Since the creation of these Bankers ' Row building codes, the homeowners of this block have been restoring their properties in accordance with these codes. The homeowners have complied with the Historic Preservation Boards recommendations. . .that is until Jeffrey Silberstein commenced . his "remodeling". RE: Appeal from J. Silberstein 219 NE First Avenue Delray Beach, Florida 33444 Page #2 Jeffrey Silberstein has ignored the Historic Preservation Boards request that he install wood windows with true dividing lights on his facade. Silberstein has proceeded to create a commercial store front effect using inappropriate materials, non period doors, windows, shutters and roofing. The consequence of which is a facade which is totally out of proportion with the other Mackle cottages on the block. The small porch attached to the building does not soften the effect. It is often said though, that a picture is worth a thousand words. . .with this in mind I am respectfully submitting to the commission members an illustrated streetscape of Bankers' Row detailing the code approved facades (i.e. using the approved materials, widows, doors shutters and roofing) juxtaposed by the Silberstein "remodeling" . I am hoping that it is within the City Commissions capacity to rule in favor of the preservation of this block as written in the current codes. And to ask Silberstein (an architect) to work within the set guidelines. I feel it would be disastrous to the future of this block if the Silberstein approach of "build what you want and force the approval through an appeal" sets a precedent for any future builder, developer or architect. Lastly, I would like to mention that Bankers' Row is truly a neighborhood. It is not an impersonal business community, rather we are a community made up of mostly entrepreneurs who welcome our mix/use zoning. Though we expect the character of the neighborhood be protected; we have always encouraged the development of our properties to optimum use. As a whole, the Bankers' Row homeowners have always practiced the good neighbor policy of tolerance. Silberstein however, has shown little regard for the block on which he is developing. He has jeopardized the overall historic integrity of Bankers' Row. Further, when he met with the homeowner to discuss his project, his demeanor was unyielding. Personally, I saw no other way to save our block then to then to appeal to you, the Commission. • Respectfully submitted, • Cynthia Bush Leeds Everitt Cynthia Bush Leeds A.K.A. First Avenue Delray Beach, Florida 33444 RE: Bankers Row Window Codes Comments from Bankers Row Homeowners on the new revised amendment. Dear Pat, I have received a number of phone calls from the homeowners on Banker Row commenting on the proposed revised amendment, and I thought it best to forward them to you before the meeting. 1 . Although not written in the Banker Row window code, I have been advised by some of the homeowners on the Mackle side of the street that they have been allowed to use wind resistant aluminum windows on the sides and back of their cottages as long as the front facade (or visible sides of the house) have wooden windows with shutters. Those home owners wish that they be allowed to continue to use this method of window replacement. A. They feel that the amended code may restrict their ability to use wind resistant aluminum and that they will be forced to use either Impact Glass Aluminum or Wood on the rear of their homes. They wish that this point be reviewed and an adjustment to revised amendment be considered. B. They have commented that their understanding of the amendment was that use of Impact Glass Aluminum was for window replacement in cottages that were to be used commercially. Their understanding of the amendment was that the Impact Aluminum was being used to prevent "Snatch and Grab" . There is a suggestion that the amendment allow for Impact Glass Aluminum on the Mackle homes "only when the end use of the cottage is commercial and in that case then the entire building should be converted to Impact Resistant Aluminum" for uniformity. 2 . Another concern about the proposed revised amendment is that it does not clearly specify the wish of the homeowners to have window codes which differ according to the two architectural styles on this block. It is felt that the revised amendment is too broad. The homeowner had voted to have a voice in the ?4a/6 ) RE: Bankers Row Window Codes Comments from Bankers Row Homeowners on the new revised amendment. Page #2 specifications of the windows. Perhaps the revised amendment merely should reference the detailed window code specifications which will be finalized shortly. Although a few window replacement projects will be on hold until the finalized Banker Row window Codes are in place. This is what the homeowners of this block wish. There is a universal wish of the homeowners to preserve the unique historic charm of this block. A few points which the homeowner' s wish to detail in these window specification are: A. The best window replacement for the Samual Ogren architecture is Historically Correct Wood Windows with standard glazing. No other window construction should be considered unless there is a total "change out" of windows. If there is a total window "change-out" an acceptable alternate window material is aluminum clad/wood with impact glass. Aluminum windows should never be allowed. B. D. All windows must be approved by the HPB so that they will not radically compromise the historic integrity of a structure. E. The homeowners wish to detail shutters, mullions and other architectural details as well. Pat, I will be happy to review this with you over the phone. Dear Ms. Cayce, I have spoken to Gene Fisher and Cecelia Boone, and they have requested that I forward to you the minutes from the above referenced meeting (attached. ) With in the minutes you will be able to hear each member who attended the meeting feelings and concerns regarding the future of our historic block and their opinion about the window codes. What is interesting, is the almost universal opinion from the homeowners that we are on a special block and the historic facade of the block must be preserved. The homeowners wish to keep the block as authentic as possible, while allowing" mixed use" ( I.E. residential/commercial) . On page five of the minutes you will see what the consensus ( the Vote) was with regards to the window and door codes on this block. I will be happy to review this with you in advance of our February Second meeting should you have any questions Lastly you will see in the minutes that the Homeowners would like Jeffrey Silberstein to modify his project to better reflect the historic cottage look on the Mackle side of the block. The majority would like for him to immediately change his shutter design to copy the current wooden shutters on the street. It is felt that his shutters are out of proportion with his windows and do not reflect the period of his cottage. Secondly there is discussion that his French doors do not reflect the original style consistent with the period (era) of the French doors on the Mackie side of the block. Pat Kaufman and Jarad Hunts home still have the original French doors with the original mullions which can be used as a reference. (Note: the french door issue is still not resolved, perhaps the HPB can review and comment on this suggestion? ) . JAN-26-00 12 :09 PM BUSH—EVERITT 561 274 8884 P. 03 ?A;C.5..i«-Lt.tA-AR_. Gene Fisher Called Meeting to Order: Fisher explained the purpose of the meeting was to review the current Window Code set forth for Banker ' s Row and, the purposed Amendment Drafted by the Historic Preservation Board of Delray Beach . Gene Passed copies of the HPB Amendment to the Banker ' s Homeowners for review and comment. (Attached) Gene Fisher further explained that Mr. Shane and Mr. Keller (HPB board members) plan to create a window spec that is stringent enough to properly preserve the facade of Banker' s Row and keep them historically correct. This spec should prevent a second rate window installation. Gene also advised that Banker ' s Row has requested a continuance regarding the proposed amendment so that we may have a chance to review the amendment and voice our concerns . Fisher then opened the floor for discussion. 3 . Points Made at Open Floor Discussion: Jeffrey Silberstein: Explained his current blue print and vision as to the construction/remodeling of 219 NE First Ave . He further explained his personal difficulty with the current Banker ' s Row window code. He explained how the codes were in conflict with his wish to create a business facade, Z .E . his wish for impact Glass to protect his business from "Snatch and Grab" . Silberstein further suggested that he be allowed to finish his project and then "as a good neighbor" let Banker' s Row decide If the cottage would be esthetically pleasing. "upon completion" , Silberstein said, " he would consider modifying his design. " Note: At the conclusion of the meeting Silberstein said that he would consider modifying the current plans to reflect Jared Hunts suggestion of using a real , more historically accurate JAN-26-00 12 : 11 PM BUSH-EVERITT 561 274 8884 P. 05 • shutter (consistent with the other shutters on the Mackle side of the block) for the front facade. That he will consider making the shutters more proportional to the size of the windows . And that Silberstein would consider adding mullions to front French doors after completion. Should the home owners of Banker' s Row still feel that the facade looks like a store front after review of the completed porch addition and wood casements . Then Silberstein will make the necessary alterations. Cynthia Bush: Explained that she is trying to preserve and restore her home, that she feels that maintaining the facade as close as possible to there original appearance is very important. With regard to window replacement; Cynthia plans to repair and replace her windows in accordance to the current window code. She plans to use wood historic copies with standard glazing. Cynthia feels that there is a fair argument for updating the code to allow for new technologies as long as the original historic appearance of the windows are maintained. She feels that Banker Row needs to be very careful when specing the new window and door code, as there are two separate styles of architecture on the street and the specifications that work for the Mackle side of the street does not necessarily work for the Samual Ogren side of the street. Further, she feels that not only the windows but also the window finishing need to be speced with proper brick molds and casements . Lastly, she feels that specifications should be different for total window replacement vs. individual window replacement. She feels that only with total window replacement can one use the proposed amended code of aluminum or aluminum clad/wood windows . Uniformity to the whole facade of the home should be considered when selecting window materials . To Silberstein, Cynthia commented that the homeowners of Banker ' s Row were here to discuss the window codes of Bankers Row and possible amendments . However the conflict with the Silberstein project seems to be an esthetic issues well as a code issue. As the Silberstein project looks presently, it appears that Silberstein has modified the origional historic cottage look to a modern store front look. Cynthia asked Silberstein if he had any ideas as to how he can modify his designs to recapture the cottage look on his facade. Cynthia suggested Mullions be added to Silbersteins front door, that would be consistent in styling with the original French doors on the Mackle side of the street. Cecelia Boone: Explained how she moved onto Banker ' s Row because it was a unique and historic block in Delray Beach. That the preservation of the facades on this block is extremely important because each home on this block is uniquely historic. She JAN-26-00 12 : 12 PM BUSH-EVERITT 561 274 8884 P. 06 explained that the charm of this block is that it looks residential not commercial. Cecelia stated: " This is why we received grants for this block and this is how we want to keep our block. " Further, Cecelia explained, Every homeowner on this block has conformed to the current codes and specifications of Bankers Row, and that it is only fair and respectful that Silberstein also conform to the guideline set forth by the HPB. Cecelia felt that it would be all right to use aluminum windows everywhere but on the facade of the home. She felt that the facade should be preserved. The wood windows with true dividing lights should remain code. Note: At the conclusion of this meeting Cecelia felt that Silbersteins wood casements around his windows and doors will greatly improve his facade and camouflage his aluminum windows and doors. She also felt that he should use wooden shutters which are consistent with the shutter style on the rest of the block. Jared Hunt: Described himself a "purest" with regards to restoration and preservation of facade on Bankers Row. Jarad feels that the whole home as well as the facade should be preserved as close to the original style as possible. He feels that at the very least the facade and front windows and doors need to be preserved. Jared would like all front windows and doors to remain wood with true dividing lights . Jarad also made a suggestion to Silberstein that he consider using a real shutter reflective of the period rather then the fake shutter currently detailed in Silberstein' s blueprints . Jarad also felt that Silberstein' s facade would be greatly improved if the shutters were in better proportion to the window then currently speced. Jarad felt that Silberstein' s facade would look fine when the porch was installed, but still would prefer that Silberstein use wood windows and doors as originally approved by the HPB. And Jarad would like Silberstien to use appropriate shutters. Bill Murray: Bill felt that aluminum windows should be allowed on Bankers Row. Further, he felt that his windows do not have set-backs like the other Samual Ogren homes on his side of the block and therefore the selection of windows and doors must be made on a case by case basis taking into consideration the uniqueness of each homes facade. Patricia Kaufman: Pat pointed out that there is a record of what the original French doors looked like on the Mackle homes . Pat' s house and Jarad' s house still have the original French doors with the original dividing lights. Pat suggested that Silberstien use these two doors as model doors to recreate a JAN-26-00 12 : 13 PM BUSH-EVERITT 561 274 8884 P. 07 facade which is more reflective of the period. Pat felt: If Silberstein copied the unique divided light pattern on her door, Silberstein would still be able to have an open airy feeling to his cottage. She felt that this unique mullion pattern would not be too busy, or compromise Silberstein' s wish for a more contemporary esthetic. Patricia also wanted to point out that she followed the current HPB Banker' s Row codes for her cottage and used wood windows on her facade. She pointed out that we need to insure that homeowners preserve their right to continue to use wood replacement windows if they so choose. She does not want to see a change of the current code which would force homeowners on Banker Row to use impact glass. Bud Merrill : Explained that he is an original owner on the block and that he has seen the facades change over the years and is certain that the facades will continue to change. Bud pointed out that no facade on the block is absolutely original at this time. Bud also pointed out how important it is to have residenences in the neighborhood and not strictly commercial. (Most Banker' s Row homeowners agreed with Bud that it is important to maintain a mixed use on this block. that it is important not to lose the residential appeal/facade. ) Gene Fisher: Felt that it is important to do what is right for the block. Gene feels that this is a special historic block and that the facades must be preserved. Gene also pointed out that building materials have improved over the years and that on a case-by-case basis, new building materials have some validity . Gene does believe however that all members of Banker' s Row must respect and maintain the overall integrity of the block. Banker ' s Row Historic guidelines were designed to be different then the rest of the city and "we must be careful to stay different and unique. " Banker' s Row homeowners must respect the HPB and their guidelines, and everyone should go through "due process" with their renovations. Robert Sarage: Richard felt that it was important to maintain the cottage residential/historic facade of the Mackle homes. He also felt that it was important to maintain the wooden shutters so that they are consistent with the rest of the Mackle side of the street. He did however feel that it would be fine to use either wood or aluminum windows, as long as the historic look of the home was maintained. J,,N-26-00 12 : 14 PM BUSH-EVERITT 561 274 8884 P. 08 l'Ae.21V.S 4 .The Vote: The majority voted YES to the following: That Bankers Row current window and door codes would remain as written to allow use of wood windows and doors with true dividing lights and standard glass. That an amendment would be written to allow impact resistant aluminum and aluminum clad wood windows and doors on a case-by-case bases as long as the quality of materials is superior and that proper casings , brick molds , shutters and finishes are historically accurate. The homeowners of Bankers Row wish to stipulate in the writing of the amendment that historic facade of the building must be preserved. Special attention must be given by the HPB insure that the aluminum and aluminum clad/ wood windows and doors reflect the original style of the buildings . The homeowners wish to have a direct voice in writing the spec ' s and guidelines in window and door amendment. They have appointed Gene Fisher and Jarad Hunt as their representatives, with Cecelia Boone and Cynthia Bush as their alternate representative. 5 . First Avenue Delray Beach, Florida 33444 RE: Bankers Row Window Codes Dear Ms. Cayce, I have received your invitation to attend the discussion regarding modifying the Bankers Row Window Code, and happily I will be able to attend the meeting on Wednesday. Prior to the meeting, I would like very much for you to come and walk through my home. I have been meaning to have you see the house for some time, I think that you will find the restoration we are doing here very interesting. My schedule is open this week and I would love it if you can find some time to stop by. When we last spoke, I had mentioned to you that I had reached a dilemma regarding the repair and replacement of the windows in my home. I have done much research this past year, and would like to show you what I feel so far are the best options for this house. I would also appreciate any advice and window solutions you may be able to share with me. Ms . Cayce, if you remember when I bought this house although advertised as restored, it had been merely decorated. Shortly after I bought this house the roof leaked, pipes broke, walls and ceilings crumbled. . .and among the countless horrors, curtains were hung to hide extremely damaged and decaying windows . My modes operandi these past eight years has always been to respect the codes while preserving and restoring this house. An enormous amount of time and money has been spent on the careful selection of the proper craftsman and materials. I can happily report that the house is now sound and ready for decorating. . .with the exception of replacing a few badly damaged windows. Herein lies the dilemma GCr JAN-17-00 01 :28 PM BUSH-EVERITT 561 274 8884 P. 03 Re: Bankers Row Window Codes, Page #2 THE WINDOW DILEMMA My home has 42 windows on the main house and 8 windows on the guest house. 50% of the windows on the main house are "Double Hung" and the balance are "Casement" , all wooden with true dividing lights. At the moment I have two windows that must be replaced immediately, the 40 on the main house are holding with minor repairs. The best solution for maintaining the integrity of the house at this time is to replace these two windows with custom, historic wood copies of the originals widows with standard glazing. This is what was used at the Old School Square restoration. If one was to try to use a code approved, impact glazed window for replacement, due to the limited styling available on code approved windows the two replacement windows would severely deface the original balance of the house. Further, replacing the entire home or a section at a time with the "code" (aluminum clad or wood) is cost prohibitive. Approximately $100 , 000 .00-$150 ,000 .00 for the entire home. STYLING AVAILABILITY: A) Double Hung: 1 .Double Hung Wood with Standard Glazing and True Divided Lights- Although not code, this is what was used for the Old School Square Restoration. The advantage of using this window when replacing less then 15% of a building (less then one room) is that replacement can be done affordable and the esthetic integrity of the building is maintained. I believe that a variance should be granted to allow such window replacement in Bankers Row, because at the moment all the windows are not code and to replace a small percent of window with code will not upgrade the safety of the home. Further to miss match the window in any particular room will greatly deface the building. 2 . Double Hung Wood with Impact Glazing and Faux Divided Lights- Although I have spoken to salesman from many window manufacturers about making a custom wood window with impact glazing and true or faux divided lights. The answer I have consistently received is that the window is not code, so the manufacturer will probably not make it for me, but even if they would consider making such a window the problem is with the thickness of the impact glass . The wood window is not designed to hold a thick piece of glass CT" JAH-17-00 01 :29 PM BUSH-EVERITT 561 274 8884 P. 04 RE: Bankers Row Window Codes, Page #3 and it can not engineered. 3 . Double Hung Aluminum Clad Wood with Impact Glazing and Faux Divided Lights- The situation is similar as the wood double hung with impact glazing, in that this window is not code and therefor the manufacture will probably not manufacturer it. However it does seem possible to insert impact glazing into an aluminum clad wood windows. A variance must be allowed to use this window as a window replacement option, but I feel that this is also a fairly good solution with regard to maintaining the integrity of the facade. The only negative I foresee with this solution is the price of such a window and the possibility that as the years progress and buildings change hands, that window replacement becomes inconsistent due to taste and selection from various manufacturers. B) Casement Windows : 1 . Casement Wood with Standard Glazing and True Divided Lights- Although not code, I feel that when replacing less then 15% of a building (less then one room) that this is the best solution for maintaining the esthetic integrity of the building. A variance should be granted to allow such window replacement in Bankers Row, because at the moment all the windows are not code and to replace a small percent of windows with code will not upgrade the safety of the home. Further to mismatch the window in a particular room will greatly deface the building. 2 . Casement Wood with Impact Glazing and Faux Divided Lights- This situation is the same as the Double Hung Wood with Impact Glazing as the thickness of the glass makes it impossible to engineer. 3 . Aluminum Clad Casement Windows with Impact Glazing and Faux Divided Lights- This window is code. Actually this is the only which is code. Visually it makes sense to use this window in areas of the house where wood casements are being replaced but not in areas where double hung windows need replacement. The only negative I foresee with this code window is the price. It is too cost prohibitive to replace and entire section of Double Hung windows in the house with Casements for the sake of esthetics. Further I feel that as the years pass and the buildings change hands, that JAN-17-00 01 :30 PM BUSH-EVERITT 561 274 8884 P. 05 RE: Bankers Row Window Code, Page #4 window replacement becomes inconsistent due to taste and selection from various manufacturers. Possible Solution: Perhaps a possible solution to amending the code would be to allow a variance on a case-by-case bases which allows wood windows with standard glazing on window replacement that constitutes less then 15% of the building (less then one room) . Such a variance will help maintain the integrity of the building and preserve the ceiling and walls until such a time that Bankers Row properties increase in value enough to substantiate a total window replacement. At such a time then I feel that total window replacement of Code Aluminum Clad Wood Casement Windows with proper brick mold would be very attractive. As example, there are a historic homes in Old Floresta, Boca Raton that have total "code" window replacement. These homes however have a resale value of $600 ,000 .00-$800 ,000 .00 Ms . Cayce, I look forward to hearing from you and am most eager to show you my home. I hope that the comparisons I have detailed are helpful to you. I am also attaching a cost comparison of the above referenced window options for you review. ACTION TAKEN BY THE BOARD The following Bankers Row property owners were present and spoke at the meeting. Cynthia Bush Leeds Everitt Cecelia Boone 248 NE 1st Avenue 239 NE 1st Avenue Patricia Kaufman Jarad Hunt 235 NE 1st Avenue 211 NE 1st Avenue After discussion, it was determined that the Bankers Row property owners chose not to add the proposed amendment regarding the use of aluminum windows to the Bankers Row design guidelines. The majority of property owners feel that the existing guidelines reflect what is appropriate for the type of windows to be installed in the historic homes. Each request for a window change, whether new of replacement, will be heard by the Historic Preservation Board (HPB) through the Certificate of Appropriateness (COA) review process on a case by case basis. The HPB will continue to use the criteria set forth in the Bankers Row design guidelines as a basis for COA approval. Aluminum windows, with standard glass or impact glass, will be permitted on the side and rear elevations. Wood windows will be required for all front facades. At the suggestion of Gene Fisher, 247 NE 1st Avenue, the following procedure will be followed with respect to design changes for Bankers Row properties: When a COA is received by the Planning Department for any design change, including windows, for a property located in Bankers Row, all Bankers Row property owners will be notified by mail. The proposed changes will be available in the Planning Department for review and comments by all Bankers Row property owners prior to the HPB meeting. It is hoped that all property owners will take the opportunity to review the COA proposal and will attend the associated HPB meeting and provide comments to the Board. File/s/pz/hpb/Bankers Row amd-ff Meeting Date: February 2, 2000 Agenda Item: IV-A HISTORIC-PRESERVATION BOARD STAFF REPORT SUBJECT: AMENDMENT TO BANKERS ROW DESIGN GUIDELINES ITEM BEFORE THE BOARD The action requested of the Board is that of approving an amendment to the Bankers Row Design Guidelines to allow the installation of aluminum windows with impact resistant glass panes. BACKGROUND . _ r.r The building codes were revised after Hurricane Andrew to require that all new or replacement windows have hurricane rated shutters or be constructed of impact resistant glass. Wood windows with impact glass panes are prohibitively expensive and are not manufactured with true divided lights. As a result, the HPB has been approving new and replacement windows with aluminum frames and impact glass for historic buildings, which are outside of Bankers Row, when requested by the owners. The attached letter was sent to all property owners in Bankers Row. As a previous letter requesting comments produced no activity, the owners have been invited to attend this meeting and give their comments with respect to the design guidelines amendment. Page 77 of the Bankers Row Development Plan states: Any changes to the exterior of a structure require review and approval of the Historic Preservation Board. This is accommodated through the COA process. The design guidelines contained in Chapter Ill of this plan shall supersede all other historic guidelines, which may exist. Compliance with the style specific guidelines included herein, shall warrant issuance of a COA. Chapter Ill of the Guidelines state: All new and replacement windows and doors, exterior wall finishes and roofing materials shall be consistent with the historic features. No existing non-compatible feature or material shall be added to or altered unless it is replaced by historically appropriate feature or material; and Only real dividing muntin bars should be used in replica windows, not surface mounted grids that fake their appearance. Therefore, in order for the HPB to approve aluminum windows with impact glass panes, as is done outside of Bankers Row, the third paragraph of the section titled Windows on page 47 of the Bankers Row Development Plan should be added as follows: Meeting Date: January 19, 2000 Agenda Item: IV-A e- HPB Staff Report Amendment to Bankers Row design guidelines Page 2 Windows Repair of damaged wood windows is always preferred to their replacement. Wood windows with impact resistant panes are prohibitively expensive and are not manufactured with true divided lights. Should it be necessary to install impact resistant glass, new or replacement windows may be made of aluminum with impact resistant glass panes with applied exterior and interior dimensional muntins, at the owner's request. Aluminum windows are to be installed according to the specifications set forth by the HPB so that they will not radically compromise the historic integrity of a structure. Currently the Banker's Row Design Guidelines require that the Board may approve only wood windows with true divided lights. The building codes were revised after Hurricane Andrew to require that all new or replacement windows have hurricane rated shutters or be constructed of impact resistant glass. Wood windows with impact glass panes are prohibitively expensive and are not manufactured with true divided lights. As a result, the HPB has been approving replacement windows with aluminum frames and impact glass for historic buildings, which are outside of Bankers Row, when requested by the owners. The HPB is currently working on specifications that will offer appropriate methods of installation for aluminum windows and their casings, so that they can be used without radically compromising the historic integrity of the buildings. Sometimes referred to as Spanish Eclectic or Spanish Colonial Revival, this style is most often found in those states that have a Colonial Spanish heritage. The style was first popularized through a detailed study in 1915 of Latin American architecture made by Bertram Grovesnor Goodhue at the Panama-California Exposition in San Diego. The Goodhue exhibit prominently featured the rich Spanish architectural variety of South America. Encouraged by the publicity afforded the exposition, architects began to look directly to Spain and elsewhere in the Mediterranean where they found still more interesting building traditions . Even before it became a popular architectural style, Mediterranean Revival designs appeared in Florida. The f" first expression of the style appeared in 1888 when Henry Flagler asked architects Carrere and Hastings to design the Ponce de Leon Hotel in St. Augustine. The architects concluded that the climate and historical heritage of the city lent itself to some form of Spanish Renaissance style. Flagler used the Mediterranean Revival style for many of his other hotels and train stations along the railroad, exposing seasonal visitors and newcomers to the "Florida style. " Well before the twenties boom, South Floridians were familiar with the Mediterranean Revival style, due in large part to Henry Flagler's personal taste. Addison Mizner helped further establish the style by designing the Everglades Club in 1918 in Palm Beach. The style was immediately popular as a romantic alternative to the common wood frame structures and drab shingled bungalows. A popular building style in Florida during the 1920s, Mediterranean Revival is closely associated with the land boom and became the style of choice for developers. Mediterranean Revival architectural style has been called the most significant expression of South Florida's lifestyle during the boom years. It reflects the excess and extravagance of the Roaring Twenties . It is ornate, pompous and flamboyant like the wealthy industrialists and speculators who built their winter residences in South Florida. It is deeply rooted in the Spanish heritage of the state, yet in tune with national trends of the time. Identifying features of the style include flat, hip or gable roofs, often displaying some form of parapet; ceramic tile roof surfacing; stuccoed facades; shed or flat roof entrance porches, commonly with arched openings and elaborate columns; casement or double-hung windows; and ceramic tile decorations. Applied decoration is generously used such as elaborated door and window surrounds, stucco or tile decorative vents, window grilles, elaborated chimney tops often with small tiled roofs, and balconies with wood or iron railings. The style continued in popularity following the collapse of the land boom and into the 1930s . The style was adapted for a variety of building types ranging from grandiose tourist hotels to modest private residences. _ Many buildings underwent renovation to reflect the Mediterranean influence. The five residences on the West side of Banker's Row are classic examples of the Mediterranean Revival style. Many of the identifying elements are still present, although some alterations have occurred through the years. The style represents a time period when wealth and extravagance, or aspiration to them, were reflected in architecture. • r iii . x Fig. 12 Looking South L.H. Walker House Foreground (#234) J.C. Actually a system of several paper and computer files, it is administered by the Division of Historical Resources, under the Florida Department of State . 'The FMSF depends primarily on the reporting of outside individuals and organizations for its information. The FMSF is not a state historic register, but an inventory which is intended for use as a planning tool and as a central repository of archival data on the physical remains of Florida' s history. Each individual site file in the FMSF could become a permanent archival record upon the loss of, or irreversible damage to, that particular site. The FMSF forms require detailed information including legal and technical data, architectural descriptions and a statement of historical significance. A sketch map, a U. S. Geological Survey map, and photographs are required for each site. Sixteen FMSF forms were completed during the Bankers ' Row Project (8PB6235-6250) and submitted to the City of Delray Beach and the Division of Historical Resources. The forms and their accompanying documentation are included in this Appendix. A Note About Names Bankers ' Row sites are identified in the FMSF by two names and current address. The Site Name is that of the owner as of April , 1991 , with the name of the first home purchaser listed under "Other Names. LOCATION In looking at the block I think the best places for the signs are: ( 1) on the garden wall of Frank McKinney' s house at 248 N.E. 1st Ave. which is the north west corner and (2 ) under the banyan tree in the front yard at Anita Shannon' s house at 201 N.E. 1st Ave. , the south east corner. I have talked to Frank McKinney and he has agreed to the sign. I have not talked to Anita & Larry but Frank says he thinks they would be delighted. Do you know what kind of authorization is needed from the owner to allow the City to install the signs? TYPE OF SIGN This is a "designation plaque" as opposed to an informational sign so it will not need a text. For example: DELRAY BEACH "BANKER' S ROW" HISTORIC BLOCK BETWEEN N.E. 1ST AND 2ND STREETS HISTORIC PRESERVATION BOARD The wall sign will be flush mounted but the sign in the front yard will be single pole mounted. I suggest using a square 12" x 12" sign. Aluminum will cost $158 .00 and bronze $248 each plus shipping and does not include installation or any decorative elements such as City Logo. I have talked to Mark Little regarding Bright Image doing the signs and he suggests we order directly from the Nelson-Harkins foundry and ask the City to install them. The signs are on the HPB agenda for the November 14 , 1990 meeting. c: David Kovacs Historic Preservation Board Members 1 MEMORANDUM TO: PAT CAYCE FROM: o, KATHLEEN E. DEARDEN PLANNER II DATE: NOVEMBER 9 , 1990 SUBJECT: BANKER' S ROW SIGN REPLACEMENT WITH THE PROPOSED INSTALLATION OF A SIGN ON PRIVATE PROPERTY IT WILL BE REQUIRED THAT THE PROPERTY OWNER AGREE TO PROVIDING AN EASEMENT OVER THAT PORTION OF LAND THAT THE SIGN IS TO BE PLACED ON. THIS WOULD ALLOW FOR THE INSTALLATION AND MAINTENANCE OF THE SIGN. IT IS SUGGESTED THAT THE CITY ATTORNEYS ' OFFICE BE CONSULTED ON PROVIDING THE EASEMENT DEED. THERE WOULD APPEAR TO BE NO PROBLEM IN GETTING THE CITY CREWS TO INSTALL THE SIGN HOWEVER IT IS SUGGESTED THAT THE STREETS DEPT. /PUBLIC WORKS BE NOTIFIED AS TO HOW THE SIGN IS PROPOSED TO BE INSTALLED AND AS TO THEIR ABILITY TO DO IT. Truck use seems to be exclusive of Post Office Shopping Center and Neals Market. The placement of No Thru Trucks signs on NE 1st Avenue can be posted but it will only deterrent which can not be easily enforced. 2. A work order has been issued to eliminate parking between 8 AM and 6 PM on the west side of NE 1st Avenue south of NE 4th Street. 3. A work order has been issued to install "Banker 's Row" street signs on NE 1st Avenue at NE 2nd Street and NE 3rd Street. KED:slg APR 2 5 90 LIM) THE MACKLE COMPANY, INC. Frank E Mackle, Jr. President March 29, 1990 - Mr. Jim Smith Secretary of State State of Florida Tallahassee, Florida Dear Jim: At the request of Clemmer Mayhew III of Delray Beach, Florida, I am communicating to you the facts as I remember them concerning 11 homes The Mackle Company built in Delray in 1938. In June of 1938, having just graduated from Vanderbilt University, my brother Elliott and I drove to Florida to build houses on 11 lots my father had bought the winter before. (He had a winter home in Delray.) The idea was to build the homes by fall and in winter when he came down, he would sell them. We built the homes by August, 1938 and sold them. So we called Dad in Nashville to report them sold and asked if we could buy more lots and build more homes (I believe 11 more) which he approved. We proceeded to build and sell these. My father figured that if two kids could do this in so short a time, he would move the company to Florida, which he did. I believe these were the first FHA -houses built in Delray Beach. I have tried to find plans or pictures of-the houses, but to no avail. Respectfully submitted, / — Frank E. Mackle, a prominent Florida builder and developer, applied for twenty building permits(eleven main houses and nine guest cottages) . These Craftsman Cottages would be built on Northeast First Avenue between Second/Third Street. The residences were built at a cost of $3, 000 each, and were all constructed from twelve train cars of lumber. They were the first FHA development in Delray Beach . Frank Mackle' s architects were Paist and Steward from Miami ,Florida. Phineas E. Paist , a graduate of Drexel Institue at the Pennsylvannia Academy of Fine Arts, was the principal supervising architect for Vizcaya , the Charles Deering Estate(1924) , as well as the Colonnade Building(Coral Gables) , and numerous Mediterranean style residences in Coral Gables. In partner ship with Harold D. Steward, the Coral Gables Methodist Church , several Miami Beach residences, and the United States Post Office and Courthouse in downtown Miami(National Register of Historic Places) In May, 1939 , they designed a home for Mr. & Mrs. F.E. Mackle in Seabreeze Park, Delray Beach. Paist and Steward designed the Florida Building at the 1939 New York' s World Fair. On January 13, 1939 , Wood Cowan, creator of the Major Hoople nationally syndicated comic strip, moved his residence and art • studio to 211 Northeast First Avenue. On January 13 , 1939, Wood Cowan, creator of the Major Hoople nationally syndicated comic strip , moved his residence and art studio to 211 Northeast First Avenue. Prominent local artist , Aaron Smock lived at House #1 on the corner of Northeast First Avenue and Northeast Second Street. Mohawk Carpet President and CEO, R. Shuttleworth purchased the Gracey House during the 1930s where later Chic Raymond , noted cartoonist of "Blondie" lived and worked. BANKER' S ROW in Pineapple Grove has a multiplicity in function, architectural and historic interest, and offers a concentration and density which no other Old Delray street offers-30 structures over fifty years of age. All structures have remained in good condition with some needing immediate preservation efforts. Their significance for the community today is as vital as it was fifty years ago when it formed the heart of the artist ' s colony which the town was noted. BANKER' S ROW could serve as a model for the Spanish Style sections of the Del—Ida Park Historic District, the Bungalows in the Marina District, and for the Nassau Street Historic District . OBJECTIVES Obtain a Planning and Survey grant from the State of Florida before April 15 for the Historic Streetscape. Create a joint effort of the Pineapple Grove group , the CRA, the OSSHA, and the Historic Preservation Board . Re engineer the street as to redirect traffic patterns from the Publix Shopping Center. Either a one way , or block the North end of the street creating a cul de sac for residences to enjoy on a day to day basis and which would encourage more walking in the neighborhood. The City of Delray Beach shall notify the residences of the combined efforts to make Banker's Row a showcase of historic resources. Create an Attraction which will further encourage the redevelopment of the downtown area. DRAFT PROPOSAL Revised 2-21-90 DRAFT PROPOSAL BANKER' S ROW Pineapple Grove Delray Beach ---- 1924-1938 ---- HISTORIC STREETSCAPE The City of Delray beach has a rare opportunity in creating a complete historic streetscape with eleven Craftsman Cottages and nine guest houses(1938) complimented by five Mediterranean Revival residences(1924-1925) . These sixteen major architectural contributions by National Register architects(with an additional 14 guesthouses) would be greatly enhanced by an aesthetic, functional streetscape which would link it to the Old School Square center and the Del-Ida Park Historic District. Streetlamps, brick sidewalks, and period signage would encourage the current preservation effort as well as catalyze the additional renovation of significant housing along the street. The stabilization of the neighborhood , the restoration of the tax base, the improved economics of nearby shops and cultural opportunities, and a sense of civic pride can be gained by this endeavor. BANKER' S ROW offers an immediate aesthetic for the Pineapple grove environment which can spotlight and model their efforts to further development along Second Avenue and Third Avenue. The Mediterranean Revival structures on the Westside of the street are highlighted by the Walker Home , the . A.G. Evans Home, and the Matt Gracey Home. All five principal buildings were designed by Sam Ogren, Sr, National Register architect of Old School Square , the Arcade Tap Room, and over 200 other Boom style buildings in Delray Beach. Facing these Spanish style town houses, are the Mackle Corporation ' s first "development" in the State of Florida. These cottages are a significant link with the history of building repetitive subdivisions which became the prevalent post-war style . On September 23 , 1938 , F.E. Mackle, a prominent Florida builder and developer , applied for twenty building permits(eleven main houses and nine guest cottages) . These Craftsman Cottages would be built on Northeast First Avenue between Second/Third Street.
