Mr. Nathanson made a motion to approve the minutes with correc- tions of 9/1/88, 9/29/88 and 10/17/88. Seconded by Mr. Mayhew. Approved. Ms. Healy indicated that under Section V (Present Use, Condition and Zoning) of the designation report for the Marina Historic District a change is needed to replace "west" with "east" on both No.2 and No.3 of that section. Mr. Mayhew indicated several changes on the designation report on 777 North Ocean. The word "Town" should be replaced with "City" throughout the entire report. Mr. Nathanson made a motion to approve the designation report for 777 North Ocean with corrections. Seconded by Ms. Finst. Approved Mr. Mayhew made a motion to schedule the Public Hearing for 777 North Ocean at the regular meeting on November 18, 1988. Seconded by Ms. Finst. Approved The Board reviewed the C.O.A application for the Metz property at 1112 Nassau Street. Mr. Metz is proposing to erect a 3 to 4 foot Victorian picket fence. Mr. Mayhew made a motion to approve the C.O.A. application. Seconded by Mr. Nathanson. Approved. Ms. Finst passed out a copy of the revised Brochure on the Del Ida Park Historic District. All comments and or revision will be heard at the next regular meeting. )1. 4 • Mr. Nathanson made a motion to adjourn the special meeting at 7:00 p.m. Seconded by Mr. Mayhew. Approved Public Hearing - Marina Historic District Ms. Healy called the public hearing on the Marina , Historic District to order at 7: 00 p.m. Ms. Healy announced that all speakers state their name and address and to please limit their comments to a maximum of three minutes. During the discussion period several residents came forth asking the Board for more information as to what the designation of the Marina District would mean to them as residents living within the district and the effect on their residential and commercial properties. Several residents stated their opposition to the designation and several indicated their support. Ms. Healy called the Public Hearing closed. Members of the Board answered questions asked previously by the residents. Ms. Healy made a closing statement and expressed her support of the desig- nation. Mr. Handelsman strongly disagrees with any sug- gestion that the Buildings have continuing historical, architectural or artistic merit. To the contrary, all of the Buildings have been, over time and out of necessity, substantially altered and modernized by repairs or other- wise. Perhaps unfortunately, such alterations have substantially changed and greatly diminished the original character of the Buildings. As of today, the Buildings have all but lost their original and true designs, lines, and architectural artistry. They no longer under any objective view represent shining or even minor examples of classic designs or architectural schools of thought and are there- fore of little or no continuing historical merit. For the foregoing reasons, Mr. Handelsman strongly objects to the proposed historic designations of the Buildings, and he respectfully submits that the Buildings, in all fairness , be excluded from the proposed Marina Historic District. Does the City Commission entrust the CRA with a building which was once the town's Landmark Attractions, but now have no economic viability except by condemnation? By allowing the CRA to determine the future of the Marina District's commercial block, doesn't the City Commission give credibility to a modus operandi which has only led to deterioration, destruction, a lowering of property values and an environmental hazard? The Historic Preservation Board offers a positive, flexible, structural and economic grid for development through its COA, variance procedure, and its guidelines for new construction in Historic Districts. The Preservation Board utilizes a respect for the values and qualities of town planning in the past in order to attract first class restoration, rehabilitation, or redevelopment. The Boyd Building was the town's finest, most progressive structure built before World War II. This mixed use, multi-functional structure provided an economic dynamic to Atlantic Avenue and created a superb aesthetic by National Register architect, Gustav Maass. The inappropriate alterations during the past several years are regrettable. The signage, plate glass, awnings, wood hoods have defaced the Deco Stream Line Moderne facade of one of Palm Beach County's best examples of this architectural style. The Boyd Building still displays a style which could be restored. The Ocean Liner silhouette along the Intracoastal Waterway provides Delray Beach with a vital link with its successful past as a development leader in the state of Florida during the 1930's. Inappropriate or intentional facade changes in order to devalue the structure are not a new pose for a property owner to employ. The Agency has unique powers to assemble land, pay for losses inherent in land assembly and to market land for new and productive uses. We also are sensitive to other values in the community including the need to preserve buildings and places which have true historic value. We have supported Old School Square since its inception. However, our Board is of the opinion that there is a major difference between the preservation of truly worthwhile buildings and attempts simply to prevent change by cordoning off buildings of questionable character just because they are old. Much of the housing stock .described as "Florida Cottage" is simply a group of small winter vacation homes without any important architectural or historic heritage. Because of the CRA' s charge to rebuild many parts of our main street, Atlantic Avenue, we strongly object to your declaring the Atlantic Avenue frontage, and the block behind it, as part of an historic district. We believe that the City Commission will agree with our concerns. Therefore, we request that you reconsider the proposed boundaries of the District, that you confer with our agency before taking other steps,• and that you do not precipitate an inter-agency confrontation in the light of our strong objections. The Historic Preservation Board at it' s November 29th meeting recommended that the Koch House located at 777 N. Ocean Boulevard be added to the Local Register of Historic Places. Recommend approval of Ordinance No. 162-88. REGULAR AGENDA Item No. --- Approval of Modification to Historic Preservation Board' s Rules and Regulations. The Historic Preservation Board at it' s November 29th meeting voted to modify several sections of their Rules and Regulations. Most of the modifications were minor, involving the renumbering of items and correcting syntax errors. The major changes included a modification to the text adding language which provides that, if the Board grants a motion for rehearing, public notice of the rehearing shall be given at the cost of the applicant. HISTORIC AND ARCHITECTURAL SIGNIFICANCE The Marina Historic District's 51 contributing buildings were constructed between 1922 and 1943. Focused on the 50 year old Delray Beach City Marina and highlighted by beautiful old Florida tropical landscapes and Royal Palms, this district features single family homes, apartments, a church, and commercial buildings. Mediterranean Revival, Mission, Monterey, Cottages and Art Moderne are the principal architectural styles. There are excellent examples of each. Located along the west bank of the Intracoastal Waterway, - this prominent neighborhood showcases some of the area's most accomplished architects. The Boyd Building included artist studios and nearby clusters of cottages served as homes for the Artist & Writer's Colony during the- 1930's. The human scale and dimensions provide a walking street: scape. Prominent American industrialists built winter homes around the Marina where Gulfstream residents also docked their yachts for the season. District attractions include: 1. The Presidential, 700 E. Atlantic Avenue, built in 1940, Henry Pope, Architect, style Art Moderne. 2. The Boyd Building, 840 E. Atlantic Avenue, built in 1939, Gustav Maass, Architect, with 1981 Renovation award to Architect Robert Currie. This was the most progressive structure built on Atlantic Avenue before WWII. It featured retail, offices and the town's first penthouse apartment. Styled in the oceanliner silhouette of the Art Moderne period, the Boyd Building is one of the most excellent examples of its style between Palm Beach and Miami Beach. 3. The Christian Science Church, S.E. 7th. Avenue and S.E. 2nd. Street. Built in 1942, by the U.S. Government, it served as a chapel at the U.S. Army Air Force Base in Boca Raton. In 1949, it was sold, cut in half and moved by truck to the present site. Architect Sam Ogren, Sr. designed' and executed the beautiful facade and renovation. He called the. style Southern Colonial Revival. 4. The Anchorage, 66 Marine Way, built in 1941 and designed by architects Gustav Maass and Sam Ogren, Sr. in the Monterey style. r Marina Historic District Page Three • IV. Marine Villas, 110 Marine Way, built in 1937 and designed by Architect Sam Ogren, Sr. The villas are Mediterranean Revival in style and are in excellent condition. 6. The Fontaine Fox Cottages at 238, 232, 228 and 222 S.E. 7th. Avenue, between S.E. 2nd. and S.E. 3rd. Streets (west side), built in 1937 are excellent examples of the Florida Cottage Style of the time, designed by Architect John Volk. Fontaine Fox, a famous cartoonist and the creator of "Toonerville Trolly", was a notable winter resident of Delray's artist colony. 7. One of the great visual attractions, which enhances the varied, . architectural styles, both past and present, of the Marina << District is its landscape and Royal Palm trees. Part of the District was once the Blank's Nursery, founded early in the century. 8. 48-46 Marine Way (1924c.) Early Mission Style townhouses barged up the Intracoastal in the 1930's from the Boca Raton Hotel. V. PRESENT USE, CONDITION AND ZONING A. Condition - The condition of the buildings and the neighborhood include: 1. Most of the buildings are well maintained. • • 2. Most of the contributing buildings are unaltered. 3. All of the commercial buildings are well maintained with -the exception of 714 E. Atlantic Avenue (Patio Delray), also known as Ostro Building. 4. Good condition but cosmetic repairs needed. B. Current Zoning - 1. Lots fronting on E. Atlantic Avenue and lots 9, 10, 11, 44, 45, 46, 56, 57, 58, 91, 92 and 93 of Palm Square Unrecorded in blocks 125 and 133 are zoned Central Business District. FIRST READING Item No. --- (Ordinance No. 162-88) This is a first reading of designation The Koch House as a local historic place. The Historic Preservation Board at it' s November 29th meeting recommended that the Koch House located at 777 N. Ocean Boulevard be added to the Local Register of Historic Places. Recommend approval of Ordinance No. 162-88. REGULAR AGENDA Item No. --- Approval of Modification to Historic Preservation Board' s Rules and Regulations. The Historic Preservation Board at it' s November 29th meeting voted to modify several sections of their Rules and Regulations. Most of the modifications were minor, involving the renumbering of items and correcting syntax errors. The major changes included a modification to the text adding language which provides that, if the Board grants a motion for rehearing, public notice of the rehearing shall be given at the cost of the applicant. Recommend approval of the modifications to the Historic Preservation Board' s Rules and Regulations. Item No. --- Consulting Engineering Services Agreement Between the City and Gee and Jenson. This agreement covers a three year period of time, subject to annual performance review, for consulting engineering services for general engineering projects. Key highlights of this agreement are: • AGENDA REPORT Meeting of December 20, 1988 1. An approved Service Authorization must be completed prior to start of project. This authorization will describe the scope of work, budget costs, wage rates, reimbursable expenses, and a purchase order number. 2. Designation of a point of contact to act as liaison between Gee and Jenson and the City Engineering Department. 3. Computation of salary and compensation. A detailed memo is included in your agenda packet. Recommend approval of an agreement between the City and Gee and Jenson for continuing civil engineering consulting services. Item No. --- Revised Agreement Between the City and F.E.C. Railroad. Item No. --- Lift Station 101. CONSENT AGENDA Item No. --- Request for Administrative Relief--Parking Mayfair Plaza. A non-impacting site plan modification was processed for Mayfair Plaza involving adding a 20 ' x 41 ' addition and parking lot. This was to accommodate the required parking for the center and additional spaces. Subsequently another request for an additional 200 square feet increase was received to allow for nine compact spaces for employee parking. Generally requests of this nature are first processed through the Technical Advisory Committee for review and comment. However, because holiday scheduling and in order to provide expedient processing this item is before you for consideration. The Planning and Zoning staff have reviewed this request and finds no negative impacts related to the granting of this request. Recommend approval of Administrative Relief to provide nine compact spaces at the Mayfair Plaza contingent upon the findings of the Technical Advisory Committee. Item No. --- Request for Funds for Christmas Parade. The Chamber of Commerce is requesting the $3,000 previously budgeted for the Holiday Pageant. If approved funds will come from the Commission' s Special Event's Fund. Recommend approval of request for funds in the amount of $3,000 to be taken from Special Events Account #xxxxxxxxxxx. Item No. --- Request for Balance of Funding--Continental Players Tennis Cup. Mr. Glen Feldman, promoter of the tournament is requesting the balance of the $10,000 originally budgeted for this event. One payment of $5,000 was requested and approved at your November 22nd meeting. Recommend approval of request for $5,000 to the Continental Players Tennis Cup. Item No. --- (Resolution No. 73-88) This is a Resolution for the abandonments of a portion of a drainage easement in the Waterford Village Subdivision. This drainage easement was part of the ditch - 2 - AGENDA REPORT Meeting of December 20, 1988 that served as an outfall for the storm sewers in the Lavers development. It was relocated and incorporated into the lake system as part of the Waterford Village project. New easements were dedicated on the Waterford Village plat therefore this easement is no longer required. Recommend approval of Resolution No. 73-88. Ordinance No. 156-88, designating Marina ,toric District in the area between Atlantic on the north from the In racoastal west to approximately 100 feet of Federal Highway extending southbound to 4th Street then eastward to the Intracoastal Waterway, is before the Commission for consideration on Second and FINAL Reading. Prior to consideration of passage of this ordinance on Second and FINAL Reading, a public hearing has been scheduled to be held at this time. The City Attorney read the caption of the ordinance. A public hearing was held having been legally advertised in compliance with she laws of the State of Florida and the Charter of the City of Delray Beach, Florida. Larry Smith, representing the Willie Mae Lawson Trust, staNec1 his client owns property within the proposed Marina Historic District. He asked the Commission to consider carefully whether or not commercial properties should be included in historic districts. His clients property is located at the extreme northwest corner of the proposed district and he is requesting that it be excluded. He advised that the Historic Preservation ordinance requires that within 30 days of a positive recommendation for historic status the Commission will hold a public hearing concerning the recommendation in accordance with the established procedures for public hearings. It is his understanding that the Historic Preservation Board held their public hearing and has taken no subsequent action in terms of recommendation since October 27th; this is clearly beyond the 30 days which the ordinance prescribes . Richard Robb, 50 Palm Square, stated he is the spokesman for the coalition of property owners who are opposed to the historic desig- nation of the marina area. He feels that the Commission should take a 1 -7 look at this, reconsider and delay their vote. Pat Healy, Chairman of the Historic Preservation Board, stated she feels that their efforts have been very visible and positive in the community and she appreciates the Commission' s support. She would encourage the Commission to vote yes on the marina historic district in its entirety. Provide a legal framework and incentive for protecting the significant historic buildings and natural resources in the Marina area. B. Accentuate the existing structures with design guidelines for complimentary alterations or new construction. C. To spotlight the civic contributions by National Register architects Sam Ogren, Sr. , Gustav Maass, John Volk, and Gulfstream's Henry Pope. D. Encourage community pride in Delray Beach's rich and interesting architecture, street scapes, flora and culture. II. LOCATION The Marina Historic District is bounded by East Atlantic Avenue on the north; S.E. 4th. Street on the south; the Intracoastal Waterway on the east. Monterey 2 8. Mission 3 Marina Historic District Page Two IV. HISTORIC AND ARCHITECTURAL SIGNIFICANCE The Marina Historic District's 51 contributing buildings were constructed between 1922 and 1943. Focused on the 50 year old Delray Beach City Marina and highlighted by beautiful old Florida tropical landscapes and Royal Palms, this district features single family homes, apartments, a church, and commercial buildings. Mediterranean Revival, Mission, Monterey, Cottages and Art Moderne are the principal architectural styles. There are excellent examples of each. Located along the west bank of the Intracoastal Waterway, this prominent neighborhood showcases some of the area's most accomplished architects. The Boyd Building included artist studios and nearby clusters of cottages served as homes for the Artist & Writer's Colony during the 1930's. The human scale and dimensions provide a walking street scape. Prominent American industrialists built winter homes around the Marina where Gulfstream residents also docked their yachts for the season. District attractions include: 1. The Presidential, 700 E. Atlantic Avenue, built in 1940, Henry Pope, Architect, style Art Moderne. 2. The Boyd Building, 840 E. Atlantic Avenue, built in 1939, Gustav Maass, Architect, with 1981 Renovation award to Architect Robert Currie. This was the most progressive structure built on Atlantic Avenue before WWII. It featured retail, offices and the town's first penthouse apartment. Styled in the oceanliner silhouette of the Art Moderne period, the Boyd Building is one of the most excellent examples of its style between Palm Beach and Miami Beach. 3. The Christian Science Church, S.E. 7th. Avenue and S.E. 2nd. Street. Built in 1942, by the U.S. Government, it served as a chapel at the U.S. Army Air Force Base in Boca Raton. In 1949, it was sold, cut in half and moved by truck to the present site. Architect Sam Ogren, Sr. designed and executed the beautiful facade and renovation. He called the style Southern Colonial Revival. 4. The Anchorage, 66 Marine Way, built in 1941 and designed by architects Gustav Maass and Sam Ogren, Sr. in the Monterey style. l Marina Historic District Page Three IV. Marine Villas, 110 Marine Way, built in 1937 and designed by Architect Sam Ogren, Sr. The villas are Mediterranean Revival in style and are in excellent condition. 6. The Fontaine Fox Cottages at 238, 232, 228 and 222 S.E. 7th. Avenue, between S.E. 2nd. and S.E. 3rd. Streets (west side) , built in 1937 are excellent examples of the Florida Cottage Style of the time, designed by Architect John Volk. Fontaine Fox, a famous cartoonist and the creator of "Toonerville Trolly", was a notable winter resident of Delray's artist colony. 7. One of the great visual attractions, which enhances the varied architectural styles, both past and present, of the Marina District is its landscape and Royal Palm trees. Part of the District was once the Blank's Nursery, founded early in the century. 8. 48-46 Marine Way (1924c.) Early Mission Style townhouses barged up the Intracoastal in the 1930's from the Boca Raton Hotel. V. PRESENT USE, CONDITION AND ZONING A. Condition - The condition of the buildings and the neighborhood include: 1. Most of the buildings are well maintained. 2. Most of the contributing buildings are unaltered. 3. All of the commercial buildings are well maintained with the exception of 714 E. Atlantic Avenue (Patio Delray) , also known as Ostro Building. 4. Good condition but cosmetic repairs needed. B. Current Zoning - 1. Lots fronting on E. Atlantic Avenue and lots 9, 10, 11, 44, 45, 46, 56, 57, 58, 91, 92 and 93 of Palm Square Unrecorded in blocks 125 and 133 are zoned Central Business District. • 0.4 . IMPACT The Marina Historic District designation will give confidence and strengthen the resolve of the neighborhood residents preserving the character and unique quality of the historic district. RESOLUTION The Marina area, with its varied building styles and examples of prominent architects of the time, is a composite of Delray Beach from 1922 to 1943.
