COUNCIL CHAMBER
The Council met in regular session, the Mayor
presiding. Councilmen Barwick, Evans, O'Neal and Sundy
were present, Councilman Jelks was absent.
Minutes of the previous meeting were read and
approved.
The Mayor declared the meeting open to hear
complaints against street paving assessments as adopted
in the Ordinance entitled "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF DELRAY, FLORIDA, ASSESSING THE
COST OF CERTAIN STREET.IMPROVEMENT WORK AGAINST THE
ABUTTING PROPERTY AND DECLARING A LIEN UPON SAID ABUTTING
PROPERTY AND FIXING THE DATES OF PAYMENT OF SAID LIENS"
and passed by the City Council on the 28th day of June,
A. D. 1926. All complaints were explained satisfactorily
by City Engineer, L. A. Adkins, with the exception of
that made by Mr. E. Q. Hall, who entered a formal protest
on the assessment in Block 137, Item "A ". This complaint
was referred to the City Engineer for further discussion
with Mr. Hall. It was moved by Mr. Sundy and'seconded
by Mr. O'Neal that the assessments be accepted and
remain as specified in the Ordinance. On roll call the
vote was unanimous.
Mr. William B. Sperry, secretary of the Chamber
of Commerce, addressed the Council in regard to an
appropriation for advertising. On motion by Mr. Barwick
and seconded by Mr. O'Neal the request was ordered filed
for future reference.
The hour of eight o'clock having arrived it was
moved and seconded hhd carried on roll call that bids \
for sidewalk, curb and gutter around the school house
property be opened. The bids were then read to the
Council and it was moved by Mr. O'Neal and regularly
seconded that they be referred to the engineers for tab-
ulation.
It was moved, seconded and carried that the
Carpenters Building Association he allowed an extension
of time in which to pay their 1926 street paving assess-

After some discussion in regard to a uniform
oliey as regards expenditures by the City in street
idening it was moved by lie. O'Neal that the following
niform policy be adopted, "That the reconstruction of
idewalks be the only expense to be borne by the City
ad that no other reimbursement be made to the property
wnerept where frontage is takenR The motion was
econded by Mr. Evans and was carried unanimously on
oll call.
A communication from the McIntosh, Seymour
Gorporation, was read to the Council and the Clerk was
instructed by motion to reply that it would be impossible
for the City to order shipment of the pia i s now and
that we are unable to predict the time would be
prepared to day for the engines.
It was moved and regularly seconded that the `
matter of procuring right of way for the extensioh of
Northwest Second Street to the Seaboard Air Line be re
ferred to the City Attorney with instructions to secure
deeds where possible and where not possible to initiate/
condemnation proceedings and to proceed in the same way
ith the widening of Atlantic Avenue to sixty -six feet
also to the Seaboard Air Line. The motion was carried.
It was moved by Mr. Barwick, seconded by Mr.
ndy,and carried on roll call that the plat of a sub -
vision known as La Hacienda be approved.
An Ordinance MAKING IT UNLAWFUL FOR ANY PERSON
OR PERSONS TO DRIVE OR OPERATE AN AUTOMOBILE OR OTHER
VEHICLE UPON ANY PUBLIC STREET OR WAY WITHIN THE CITY OF
ELRAY WHILE INTOXICATED OR UNDER THE INFLUENCE OF IN-
TOXICATING LIQUORS AND PROVIDING A PENALTY FOR THE
IOLATION THEREOF was laid before the Council and read
- for the first time in full. It was moved and regularly
seconded and carried on roll call that the Ordinance be
passed on its first reading. It was moved by Mr. Evans
d seconded by Mr. Sundy that the rules be suspended
- and the Ordinance be read for the second time by caption
only. On roll call the vote was unanimous. The
Ordinance reading that it was an emergency was placed
on its third reading and final passage. On its final
passage those voting in the affirmative were Messrs.
Barwick, Evans, O'Neal and Sundy. In the negative none.
The Ordinance was declared adopted.
Current bills having been audited by the linanoe

Committee were referred back to the Council and ordered
paid.

Mr. Adkins, City Engineer, presented tabulation \
of bids mentioned above to the Council and it was moved, J1
seconded, and carried on roll call that the contract be
given to Guptill & Barentzen, lowest bidder.
It was moved, seconded, and carried on roll call
that City Clerk be granted a leave of absence of three
weeks.
It was moved by Mr. Barwick that the fee system
be discontinued for engineering services on all work not
actually under construction, that a salaried engineer be
employed and that the firm of Butler, Barnett & Taylor
be sent a notice of this motion. The motion was seconded
by Mr. O'Neal and unanimously adopted,,on roll call.
It was moved by Mr. Sundy and regularly seconded
that the certified checks be returned to the unsuccessful
bidders. The motion was carried.
The Council adjourned.

NOTICE TO TAX PAYERS
Notice is hereby given that on the 23rd, 24th
and 25th days of August, A. D. 1926, at eight o'clock
P. M. on said date, at the Council Chamber in the City
of Delray, the City Council of said City will sit to
hear complaints against the 1926 tax assessments, and
all persons interested in said assessments are hereby
notified to appear before said City Council at said
time and place and then and there show why said assess-
ments are not just and equitable, or else said assess-
ments will be deemed to be final and conclusive.
