Property Address: 20 North Swinton Avenue, Old School Square Historic District HPB Meeting Date: December 20, 2006 COA: 2007-045 ITEM BEFORE THE BOARD The item before the Board is consideration of a variance to LDR Section 4.3.4(K) to reduce the rear setback from ten feet (10') to three feet, ten inches (3'10") and side-interior setback from seven feet, six inches (7'6") to three-feet, eight inches (3'8") in order to accommodate the relocation of a contributing structure from 24 North Swinton Avenue to the property located at 20 North Swinton Avenue pursuant to LDR Section 2.4.7(A). Pursuant to LDR Section 2.2.6(D)(6), the Historic Preservation Board (HPB) shall act on all variance requests within a historic district or on a historic site, which otherwise would be acted upon by the Board of Adjustment. BACKGROUND AND DESCRIPTION The subject property (Lot 12, Less South 4 Feet Additional Right-Of-Way For Alley Lying South of. and adjacent to, Block 60, Town of Delray) is located in the Old School Square Historic District on. the west side of North Swinton Avenue between Atlantic Avenue and NE 1st Street. The property contains a Monterey style structure built in 1935. Originally located in West Palm Beach, it was relocated to. its current address in 1990, along with two other structures (presently located at 24 and 516 N Swinton Avenue) by way of the Intracoastal Waterway. The move provided an alternative to demolition, which would have occurred due to the Palm Beach International Airport expansion. The request before the Board is that of a variance to the rear (west) and side interior setbacks (south) of the property at 20 North Swinton Avenue. The purpose of the variance is to accommodate the relocation of the structure located at 24 North Swinton Avenue onto the subject property. The relocated structure would be used as additional office space by the CRA (Community Redevelopment Agency). The Site Plan Modification and Certificate of Appropriateness applications will come before the Board for review at a later date. Therefore, the relocation is not under review at this time, only the variance request. The property at 20 North Swinton Avenue is zoned OSSHAD (Old School Square Historic Arts District) and the following setbacks apply: ten-feet (10') in the rear and seven-feet, six inches (7'6") on the side interior, pursuant to LDR Section 4.3.4 (K). Please note that the site plan (attached) and variance request slightly differ by approximately two inches (2") on both the rear and side interior setbacks. Therefore, the most restrictive request is being applied. 20 North Swinton Avenue CO;.2007-045-COA HPB Meeting of December 20,2006 ANALYSIS �= Pursuant to LDR Section 4.5.1(J), the Historic Preservation Board shall act on all variance requests, within a Historic District or on a Historic Site, which otherwise would be acted upon by the Board of Adjustments. In acting on such variance requests the Board may be guided by the following as an alternative to the criteria normally used by the Board of Adjustments: (1) That a variance is necessary to maintain the historic character of property through demonstrating that: (a) A variance would not be contrary to the public.interest, safety, or welfare. (b) Special conditions and circumstances exist, because of the historic setting, location, nature, or character of the land, structure, appurtenance, sign, or building involved, which are not applicable to other lands, structures, appurtenances, signs, or buildings in the same zoning district, which have not been designated as historic sites or a historic district nor listed on the Local Register of Historic Places. (c) Literal interpretation of the provisions of existing ordinances would alter the historic character of the historic district, or historic site to such an extent that it would not be feasible to preserve the historic character, of the historic district or historic site. (d) The variance requested is the minimum necessary to preserve the historic character of a historic site or of a historic district. (2) Or, as an alternative to subsection (J)(1), that a variance is necessary to accommodate an appropriate adaptive reuse of a structure within a Historic District or upon a Historic Site through demonstrating that: (a) A variance would not be contrary to the public interest, safety, or welfare. (b) The variance would not significantly diminish the historic character of the Historic District or Site. (c) That the variance requested is the minimum necessary to effect the adaptive reuse of an existing structure or site. In response to LDR Section 4.5.1(J)(1), the authorized agent has submitted a letter of explanation to justify the variance request which states the following: • Adequate open space would exist between the proposed relocated structure and other adjacent structure; • The special condition is the actual size of the existing historic structure, which will be relocated to the existing property; • Literal interpretation...of existing setback ordinance would prevent us to (sic) relocating (and potentially saving) the existing historic structure, or it would force us to have to modify the existing historic structure by demolishing some of its parts; • The variance requested is the minimum necessary to preserve the character of the existing historic structure to be relocated into (sic) the sight. Additional justification was submitted in response to LDR Section 4.5.1(J)(2) as follows: • This project sets an example of adaptive re-use of historic buildings; • The variance will give the CRA the ability to expand their offices in the heart of the community; • The CRA office addition would be used to house some of the new CRA functions,...which has increased their demand for personnel; • The CRA will completely restore the relocated structure...The improvements will increase the value of the building, and will guarantee a longer life for this historic structure. 2/3 20 North Swinton Avenue COA 2007-045-COA HPB Meeting of December 20,2006 The justification noted above can be supported for many reasons, most importantly the reuse of a contributing structure which, ultimately, would have been in danger of demolition. In addition, the justification statements further demonstrate that the variances would allow the CRA offices to expand, while preserving the existing character of the historic district. Based upon the justification statements and analysis noted above, positive findings can be made with respect to LDR Section 4.5.1 (J). PUBLIC NOTICE .. Formal public notice has been provided to the property owners within a 500-foot radius of the subject property. ALTERNATIVE ACTIONS A. Continue with direction. B. Approve the two variances from LDR Section 4.3.4 (K) to reduce the rear setback from ten-feet (10') to three feet, ten inches (3'10") and side interior setback from seven feet, six inches (7'6") to three feet, eight inches (3'8") in order to accommodate the,relocation of a contributing structure from 24 North Swinton Avenue to the property located at 20 North Swinton Avenue, based upon positive findings with respect to LDR Section 4.5.1 (J) (1). C. The variance is necessary to relocate the new Historic Structure,and it is demonstrated as follows: • The variance is not contrary to the public interest, safety or welfare. In addition, in order to properly reinforce said wall for wind resistance, 5/8" layer of exterior grade plywood needs to be added to the exterior face of the wall. The CRA has recently become leaders in developing workforce housing in the State of Florida, and are actively working on several projects to provide housing to the community's work force.This new role has increased their demand for personnel,which is also good for the community as they are bringing more jobs into the downtown area. In addition,the CRA will complete restore the relocated structure, and provide hurricane impact windows through out. The improvements will increase the value of the building, and will guarantee a longer life for this historic structure. Furthermore,this project sets an example of adaptive re-use of historic buildings. The variance will give the CRA the ability to expand their offices in the heart of the community.
