CALL TO ORDER The meeting was called to order by Chairman Perez at 6:07 p.m. Upon roll call it was determined that a quorum was present. No one from the Public addressed the Board on non-agenda items. Chairman Perez inquired if there were any changes to the Agenda. Ms. Shay advised that IV.A. Handelsman Yellow Building is being postponed due to the fact that the applicant is out of town. Chairman Perez read a summary of the Quasi-Judicial Hearing procedures. The Notary swore in individuals for testimony. II. APPROVAL OF MINUTES • December 3, 2003 Motion made by Ms. Sexton, and seconded by Ms. Jamison, and approved 5 to 0 to approve the Minutes as written III. PUBLIC PRESENTATION A. Recommended modifications to the Delray Beach Land Development Regulations (LDR) Section 4.6.7—Sign Code Ms. Lula Butler, Director of Community Improvement, presented background of the signage. Historical Preservation Board Meeting February 4,2004 Chairman Perez inquired if there were any question from the Board. There were none. IV. CERTIFICATE OF APPROPRIATENESS A. Cason Cottage Complex Bungalow, 5 NE 1st Street, Old School Square Historic District, Bill Branning, Authorized Agent. Chairman Perez asked if there was any ex-parte communication. There were none. Ms. Shay presented the project to the Board and entered the project file and a copy of her resume into the record. Mr. Branning presented a drawing of the handrails to the Board. Chairman Perez inquired if there were any question from the public. There were none. Chairman Perez closed the Public Hearing, and asked if there were any comments from the Board. The Board did not feel the design was in keeping with the style of the cottage, and suggested they be changed to a cross pattern with heavier posts and be painted green to match the trim. It was moved by Ms. Sexton, seconded by Ms. Schatz, and passed 6 to 0 to approve the Certificate of Appropriateness associated with a Class I site plan modification for the installation of handrails at 5 NE 1st Street, Historic Bungalow, based upon positive findings with respect to LDR Section 4.5.1(E)(4), (E)(8)(f) and (g) and the Delray Beach Design Guidelines with the following condition: 1. That the design be modified changing the handrails to an X design in each section and the posts to 2" x 4". C. Tapas, 8 East Atlantic Avenue, Old School Square Historic District, Perez Architects, Inc. Chairman Perez stepped down. Ms. Schatz asked if there was any ex-parte communication. There were none. Ms. Shay presented the project to the Board and entered the project file into the record. Staff recommended the sign be relocated to the first floor, and the tile be limited to a border. 2 Historic Preservation Board Meeting February 4,2004 There was much discussion by the Board regarding color and percent of tile that would be on the façade of the building. The Board requested another rendering be submitted with different color samples (more muted tones). Ms. Schatz inquired if there were any questions from the public. There were none. Ms. Schatz closed the Public Hearing, and asked if there were any comments from the Board. It was moved by Ms. Jamison, seconded by Mr. Silberstein, and passed 5 to 0 to the table this item. Mr. Perez swore in all those wishing to speak and read in record the Quasi-Judicial proceedings. Mr. Perez asked if there was any ex-parte communication regarding this project. There was none. After a brief discussion, it was moved by Ms. Jamison, seconded by Ms. Sexton and passed 7-0 to approve the recommendation to the Planning & Zoning Board approval regarding a Future Land Use Map (FLUM) amendment from General Commercial (GC), in part, and Commerce (CMR), in part, to CMR and a rezoning from GC, in part, and Mixed Industrial and Commercial (MIC), in part, to MIC. IV. PUBLIC PRESENTATIONS A . Review of Recommended Modifications to the Delray Beach Land Development Regulations (LDR) Section 4.6.9(E)(3)- In-Lieu Of Parking Fees Scott Aronson, Parking Management Specialist, presented the proposed changes to the in-lieu parking program. The Board supported the proposal with the exception of the requirement to open a private lot for public use during off hours. The Board felt that the issue could open opportunities for litigation. V. DISCUSSION ITEM A. Public Comments: None B. Report from Historic District Representatives: Ms. Jamison inquired about the construction on the 300 block of North Swinton Avenue. Ms. Shay stated that the construction was for the development of the parking lot at 310 North Swinton Avenue. Ms. Jamison inquired about the new fence on NE 8th Street, east of NE 2nd Avenue. Ms. Shay stated that she will look into it. C. Board Members: Mr. Perez welcomed Mr. Silberstein to the Board. Ms. Jamison inquired about the fence at 110 NE 5th Street. Input was provided from numerous staff members from various City Departments and two sign contractors (Mr. Mark Gregory, Mobile Sign Company and Robert Freeman, McNeill Signs). In addition, the revisions were discussed at several of the Design Guideline meetings at the CRA with their consultant. The current sign code is antiquated. The language needed revising to bring the code into compliance with present laws. In addition, modifications were made, resulting in a code that is more in keeping with the renaissance of the City. While many of the sections of the code were re-written to clarify language and sections were reorganized to make them more cohesive and coherent, there were only several sustentative changes as described below: House Keeping Issue: Currently, within the Land Development Regulations, the sign code is located in three different sections of the Code (Section 2.4.6. Procedures for Obtaining Permits and Approvals and Submission Requirements, Section 4.6.7 Sign Regulations, and Appendix A — Definitions). Section 2.46 has now been combined with Section 4.6.7 so that all the requirements for erecting a sign can be found in one section of the code. The definitions will remain in Appendix A. This change helps to make the sign code more "user friendly". Portable Signs: A new section has been added to allow for Portable Signs (sidewalk ' sandwich signs) for certain businesses located in the Central Business District (see Page 14). • Roadway Banner Signs: A new section has been added to allow Roadway Banner Signs for special events. The Banners will be limited to events for City or City co-sponsored events or recognized civic groups (see Page 14). Free Standing Signs: The overall height of a Free Standing Sign has been decreased from 18' to 14' in height (see Page 23). That Chapter Four, "Zoning Regulations", Section 4.6.7, "Signs", be repealed in its entirety and a new Section 4.6.7, "Signs" is hereby enacted to read as follows: Section 4.6.7 Signs (A) Purpose: The purposes of these sign regulations are: to encourage the effective use of signs as a means of communications in the City;to maintain and enhance the' aesthetic environment and the City's ability to attract sources of economic development and growth;-to improve pedestrian and traffic safety; to minimize the possible adverse affect of signs on nearby public and private property; to foster the integration of signage with architectural and landscape designs; to streamline the approval process by requiring master signage plans; and to enable the fair and consistent enforcement of these sign regulations. (1) Communication: Signs should not deny other persons or groups the use of sight ,lines on public rights-of-way, should not obscure important public messages, and should not overwhelm readers with too many messages. Signs can and should help individuals to identify and understand the jurisdiction and the character of its sub-areas. (2) Preservation of.Community's Beauty: The City of Delray Beach which includes a beach resort community as well as major office and industrial parks relies heavily on its natural surroundings and beautification efforts to retain its economic advantage. This concern is reflected by actively regulating the appearance and design of signs. (3) Property. Value Protection: Signs should not create a nuisance to the occupancy or use of other;properties as a result of their size, height, brightness, or movement. They should be in harmony with buildings, the neighborhood, and other conforming signs in the area. (B) Applicability: It shall be unlawful for any persons to post, display, change, or erect a nonexempt sign or a sign structure, that requires a permit, without first having obtained a permit therefor. Signs or r sign structures erected without a valid permit shall be deemed in violation and it shall be mandatory to obtain a permit, based on this Section, or else remove the sign or sign structure.:Signs erected, under a valid permit, prior to January 1, 1987, which have since become. nonconforming shall be allowed to remain in accordance with the time limitation and structure requirements set forth in these LDR's. All signs not expressly allowed by these LDR's are prohibited. 7 ORD NO. -03 (C) Procedures.. (1) Issuance of Permits, Validity and Renewal: Upon satisfactory compliance with the minimum submission requirements of the LDRs and a determination that the proposed sign meets all applicable standards set forth in the LDRs, the Chief Building Official, or his designee, shall cause a sign permit to be issued to the applicant. The permit shall be valid for a period of 180 days during which period the sign may be erected; however, the Chief Building Official, or his designee, for good cause shown and upon payment of 50% of the original application fee, may renew the permit for an additional 90 day increment provided that there have not been enacted, in the 180 day period, standards of which the permit would be in violation. (2) Permits for Individual Signs: Permits for signs shall be on a form as promulgated by the Chief Building Official. (a) Minimum Submission Requirements: The application form and associated submission materials shall include the following: (i) The type of sign and/or sign structure as set forth in the LDRs. (ii) The street address of the property upon which the sign and/or sign structure is to be located along with identification of where on said property the sign will be located. If there is no street address another suitable method of identifying the location shall be provided. (iii)` The area per sign face and the aggregate area of the - sign and/or sign structure. (iv) The name and`address-of the owner or other person in control or possession of the real property upon which the sign or sign structure is to be located. (v) Written consent of the owner, or his designated agent, granting permission for the` construction, operation, maintenance, or 'displaying of the sign and/or sign structure. (vi) °Two copies of a blueprint, sketch, blue line print, or similar presentation, drawn to scale and dimensioned,_ showing elevations of the sign as proposed and its— relationship to other existing or proposed signs or sign 8 ORD NO. -03 structures in the area In the case of a free-standing sign, the representation shall include a sketch site plan showing the location of the sign. (vii) Appropriate exhibits showing the proposed location of the sign with respect to ' nearby, structures and vegetation. (viii) The seal of a state registered engineer or architect shall be affixed to drawings of signs and/or sign structures where the sign face is in excess of thirty-two square feet (32 sq.ft.) certifying that it is designed in accordance with wind load requirements of the Florida Building Code. A sign contractor shall provide a signed certificate stating that wind loading to withstand a pressure of fifty (50) pounds per square foot when an application for signs less than 32 square feet in area is submitted. (D): Aesthetic Qualifications: (1) Applicability: The following subsection describes basic aesthetic qualifications which apply to signs that require permits. (2) Basis: The aesthetic quality of a building, or of an entire neighborhood, is materially affected by achieving visual harmony of the sign on or about a structure as it relates to the architecture or the building:or the adjacent surroundings. In addition-to-the mechanical limitations on signs imposed. in Subsections'(G) and (K), the following-aesthetic considerations must-be met. (a) Garishness: The overall effect of the configuration or color of assign shall,not be garish. "Garish" signs are those that are too bright of' gaudy, showy, glaring,and/or cheaply brilliant or involving excessive ornamentation. Garish signs are not in harmony with and are not compatible with the building or adjacent surroundings. (b) Scale and Conformity with Surroundings: The"scale of the in terms of area; shall be consistent with the scale of the building on which it is to be placed or painted and the neighborhood or streetscape where it is to be located. Scale shall also be considered in terms of Subsection (F)(2)with respect to height and area. 9 ORD NO. -03 • (E) Signs Requiring Permits: (1) General: All signs, other than those exempted by Subsection (H) or prohibited by Subsection (I), must obtain a sign permit. Applications for sign permits shall be submitted and processed pursuant to these LDRs. Sign permits shall be issued by the Sign Administrator under the direction of the Chief Building Official for the following: (a) Master and Blanket Sign Program Signs: Individual signs being permitted under the provisions of an approved Master Sign Program or Blanket Program. (b) Signs Meeting Standards: Individual signs which conform in all respects to the provisions of Subsections (F), (H), and (J) or this Section. (c) Special Purpose Signs: Which comply with the requirements of Subsection (E) (3) f (2) Master Sign and Blanket Sign Programs: (a) Blanket Sign Program: A Blanket Sign Program may bey required for a commercial property establishing the font, color, size and locations of signs on a multiple tenant,building. A Blanket Sign Program shall be approved by the Site Plan Review and Appearance Board or the Historic Preservation Board if the project is in a historic district or historically designated site. After approval of a Blanket Sign Program, individual signs consistent therewith shall be administratively approved. (b) Master Sign Program: A-Master Sign,Program is to be used when the_development of a project_is of..such a scale:.or character ,that the normal application' of the design and/or aesthetic :standards. of_.Subsections (D) and (F), respectively, will not result in an effective sign program and signing more permissive than said :standards is. necessary. Approval ;of >a::Master Sign Program may include the . automatic granting of waivers and/or adjustments to:the provisions of Subsections (D) and (F) provided that the intent of the sign code is maintained and the-:character of the community and neighborhood is not ,diminished A Master,:.Sign Program shall be approved only by the Site Plan Review and Appearance Board or the Historic Preservation Board if the project is in a historic district or historically designated site. After approval of a Master Sign. Program, individual signs consistent;-therewith shall be administratively approved. • (3) Special Purpose Signs and Signing: Permits for the following signs may be issued administratively provided that the provisions contained herein are complied with. 10 ORD NO. -03 (a) Directional Signs for Churches, Civic, or Recreational Facilities: General directional signs for civic, church, or recreational facilities up to a maximum of four(4) shall be allowed in the City street rights-of-way subject to the approval of the City Engineer and/or his/her designee. The number of directional signs permitted for each qualifying applicant shall depend upon the location and need of the traveling public. The dimensions of the directional signs shall be no greater than eight (8) inches by thirty (30) inches per sign. The signs must be designed and installed in accordance with these LDRs. A permit to work in the right-of- way must be obtained by the City Engineer or his/her designee. (b) Directional Signs in Residential Subdivisions: Residential subdivisions containing twenty-five (25) or more dwelling units may have a maximum of four (4) directional signs placed in a right-of-way which is located wholly within the subdivision. Such directional signs shall not exceed eight feet (8') in height, shall be no greater than four feet (4') in width and shall have an area no larger than sixteen square feet (16 sq.ft.). Said sign shall contain information related only to the internal street system of the subdivision. A permit to work in the right-of-way must be obtained by the City Engineer or his/her designee. (c) Gasoline Prices: Signs may advertise the price of gasoline subject to the following restrictions: (i) Not more than twelve square feet (12 sq.ft.) per sign face. (ii) If free standing, it shall not exceed five feet (5') in sign height. (iii) If a part of a permanent free standing sign, the price sign shall be included in the area of the permanent sign. (iv) One sign is permitted per frontage with a maximum of two signs per site. (v) Signs placed on pumps shall not exceed three square. feet(3 sq.ft.) per sign face nor a total of six square feet (6 sq.ft.) per sign. (d) Grand Opening Banner: One banner may be placed on the building of a newly opened business pursuant to the following: 11 ORD NO. -03 (i) Display is limited to four(4)weeks. (ii) The banner shall not exceed an area of fifty square feet (50 sq.ft.), (iii) The banner may not be more than fifteen feet (15)' above the grade, and must.be.placed on'the building of the business, in the front of the business.. (iv) Banners shall be made of color fast material. (e) Historic Signing: Signs which are building mounted or free- standing which provide information of historic value. Said signing shall not exceed six feet (6'),_above grade when free-standing and shall.not exceed three square feet (3 sq.ft.) in area: in any.circumstance. Such signing.shall not be permitted until approval has been gained from the Historic Preservation Board.. (i) Maintenance of Nonconforming Nostalgic Signs: (a) Signs that have an historic or nostalgic appeal, and constitute artistic expression, and not solely advertising may be exempted from the removal requirements if a recommendation by the Historic Preservation Board is approved by the City Commission. (b) An owner of property on which an existing nonconforming sign is located may request the Historic Preservation Board to recommend to the City Commission that the existing nonconforming sign be designated as a "nostalgic sign." (c) In considering whether to recommend that the existing nonconforming sign be designated as nostalgic, the Historic Preservation Board shall consider .the sign's value as a part of the historical, cultural, aesthetic, and architectural heritage of the city, state, or nation. The Historic Preservation Board shall review the criteria contained in Section 4.5.1, of the Land Development regulations prior to making its recommendation. 12 ORD NO. -03 - y (d) Any existing nonconforming sign designated as a nostalgic sign must be maintained in good condition. If at any time the sign becomes unsightly, or becomes a danger to the public health, safety, or welfare, the City Commission, following notification to the owner, may remove the nostalgic designation and set a date by which time the sign must be removed. (f) Menu Board Signs: Signs used by businesses to advertise prices of items in conjunction with service at a drive-thru window, such as fast-food restaurants, may be permitted'as long as the size of the menu board does not exceed seven feet (7') in height, and is not greater than twenty four square feet (24 sq.ft.) in size. (g). Murals:and Signs Within Murals: A large painting or drawing affixed to the wall of a building located in commercially zoned districts shall be subject to approval by the.Site Plan Review and Appearance Board or the Historic Preservation Board. The mural shall not directly represent or constitute advertisement of the goods, products, or services provided on site. If any portion of the.mural includes identification of the establishment or the goods, products, or services provided on site, only that portion of the mural which specifies such information shall have its area included in the calculation of the sign area: (h) Non-Residential Real Estate Signs: (i) Non-residential Real Estate Signs shall not exceed thirty-two square feet (32 sq.ft.), and shall.be limited to.. seven feet (7') in height. (ii) Within a non-residential property located in a Historic District, real estate signs may not exceed sixteen square feet (16 sq.ft.), and shall be limited to seven feet (7') in height: (iii) A permit may be granted toy allow for the placement of one non-illuminated freestanding real estate sign advertising_"For Sale'!, "For Rent", or "For Lease" and may identify the seller or agent along each street frontage, including those located within a historic district. 13 ORD NO. -03 • (i) Parking Area Signs: Parking area signs, as specified herein, provided the sign contains no more than the name of the building or development and the words, "Entrance", "Exit", "Parking for . . .", or "Entrance for . . ." or their equivalent, may be erected at each;point of ingress and egress to a parking lot or parking area, and the signs shall not exceed four square feet (4 sq.ft.) in area nor extend to a greater height than five feet(5') above the ground, and shall be erected within the parking area. Only one sign shall be allowed at each point of ingress and egress, provided the signs do not create a traffic or pedestrian.hazard. (j) Portable Signs: Portable signs shall only be allowed within the Central Business District (CBD)for businesses holding a restaurant, entertainment, ice cream or deli occupational license., Businesses licensed as retail merchants are not included under this Subsection. Portable signs shall be subject to the:following restrictions: la One sign per business to be either a wall mounted menu _ board sign that does:not exceed three square feet (3 sq.ft.); or an."A-Frame" sign that does not exceed three feet (3') in sign height with a maximum of six square fee (6 sq.ft:)_per sign face;ora free standing easel that doe not exceed five feet (5') in sign height with a sign fac that does not exceed-six square feet(6 sq.ft.). ii Signs must be placed immediately in front of the business in a manner that provides a clear pathway, parallel to the:;street with a minimum width of five feet (5') for through pedestrian traffic, and if placed within the right-of-way, a hold harmless agreement in a form • acceptable to the City Attorney shall be provided. iii Signs must be removed and stored inside the business upon the closing of the-business day, and therefore may not be permanently affixed to the ground. (k) Roadway Banner Signs: Roadway Banner Signing, in accordance -with this subsection may be approved and issued by the Sign Administrator under the direction o€rthe Director of Community Improvement, for special events for City or City :co-sponsored events: or recognized civic association such as the Chamber of Commerce; Downtown Development Authority, or Old School Square. Such signing shall be subject to the following standards 14 ORD NO. -03 p Roadway Banner Signs will only be allowed to be displayed at the following intersections within the City limits and on City installed poles: • NE 1st Avenue and East Atlantic Avenue; • NE 7th Avenue and East Atlantic Avenue; and • Pineapple Grove Way and East Atlantic Avenue within the arch area. 21 The Roadway Banner Sign must be no more than three feet (3') in height by twenty-four feet (24') in length, and placed at least fifteen feet (15') above the surface of the roadway on City installed poles. The Roadway Banner sign must be constructed with a standard vinyl awning material. (iii) The text of the banner shall include the name of the special event, the date or dates of the event and the name or logo of the City and the name or logo of the association or organization co-sponsoring the event. The text' on the banner shall not be utilized for co- sponsorship advertisement. (iv) Display of the Roadway Banner Sign will be limited to a maximum of seven (7) days prior to the event and must be removed by the day after the event. (I) Special Event Signing: Special signing, in accordance with this Subsection, may be allowed by the Chief Building Official or his/her designee, for special events which are of general benefit, civic or cu)tural, to the community at large if it Is.determined'that the sign type meets the following criteria:` (i) the sign provides notice to the public of a public meeting or other public event, (ii) the sign is temporary and for a limited time, and (iii) the sign if allowed for a limited time, will meet the following criteria: (a) the signs will not conceal or obstruct adjacent land uses or signs, 15 ORD NO. -03 • (b) the signs will not conflict with the principal permitted use of the site or adjoining sites, (c) the signs will not interfere with, obstruct vision of or distract motorists, bicyclists or pedestrians, and (d) the signs will be installed and maintained in a safe manner. The approval, or disapproval, of such signs shall not be based on the content of the message contained (i.e., the viewpoint expressed) on such signs. The Chief Building Official or his/her designee shall render a decision within ten (10) days after an application is made for utilizing this sign type at a special event. Such a decision shall be deemed an administrative _ interpretation and any person adversely affected has the right to appeal the decision to the City Manager. Such signing shall be subject,to the following standards: (i) Each sign limited to less than twenty square feet (20 sq.ft.)in area; (ii) ,Allowed:.ten (10) days prior to the event and must be removed by the second day after the event. • (m) Standard Street Signs: A subdivision name sign may be placed on a City street post by City personnel only, provided it is requested through the City Engineer or his/her designee and paid for by the party requesting the sign. This sign shall be identical to the street sign as to color, size, and shape. (n) Subdivision,Entrance Signs: Residential subdivision entrance signs shall be subject to the following standards: (i) Such signs may be either one double faced sign or two signs where there are two walls at the entrance and where the sign is permanently affixed to the walls at each entrance of the subdivision; 16 ORD NO. -03 r (ii) The sign area shall be no greater than thirty-six square feet (36 sq.ft.) in area; (iii) Such subdivision entrance gates signs are permitted within all residential zoning districts. They are further _ permitted in any commercially zoned,property which is adjacent to a subdivision in existence as of July 1, 1988; (iv) Such subdivision identification signs may be erected within rights-of-way or median strips adjacent to the subdivision if approved by the City. A subdivision sign may also be located within the setbacks of private property within the subdivision or adjacent to the subdivision or adjacent to the subdivision within the guidelines set forth in 4.6.7(F)(3), if such sign was in existence as of July 1, 1988. • (v) Any such sign erected within a right-of-way or setback shall be at least ten feet (10')from a paved roadway and signs located within a median shall be at least five feet (5')from any paved roadway; (vi) Any signs approved for location within the right-of-way or median, if such right-of-way or median is not within the jurisdiction of the City, shall obtain written permission • from the governmental entity controlling the right-of-way or median to erect the sign in a requested and approved location; (vii) Any signs proposedto be located on adjacent private property shall have fo be approved and permitted by the owners of the adjacent:property on which the sign is to rest. Any such signs lying on private property shall be considered an additional permitted sign without regard to other applicable sections of this code;and (viii) All signs proposed to be located within a right-of-way or median shall be reviewed and approved by the City Engineer or appointed designee for compliance with this section. 17 ORD NO. -03 • y • (o) Temporary Business Identification Sign: A temporary Business Identification Sign shall be allowed to be placed on the building façade once a sign application has been submitted and shall be removed within sixty (60) days from date of sign permit application. (p) Temporary Construction/Development Signs: New construction, renovation work or temporary development signs shall be `subject to the following standards: fil Freestanding Sign: One sign per street frontage, non- illuminated, with a sign area of not more than thirty-two square feet (32 sq.ft.), nor more than seven feet (7') in height. fiq Sign Located on a Building: One sign per building frontage, non-illuminated with a sign area of not more than thirty-two square feet (32 sq.ft.). (iii) The sign may be installed at the time of submission of;- building permit application. It must be removed upon expiration of building permit or building permit application or when the project obtains a Certificate of Occupancy. (F) Sign Design Standards: The following subsections describe basic standards which apply to signs. The application of these standards to specific types of signs-.and their location in specific zone districts is set forth in a ' ' t matrix contained in Subsection (F)(7) (1) Types of Signs: ) •(a) Free-Standing Signs: A free-Standing sign is not affixed to any EQ ` other structure and is limited to no more than two (2) faces. Types ofANNEX I walls signs may be applied to a canopy or mansard, or building face. _ Restaurant L�S (2) Sign Area and Height: . (a) Basis for Measurement: The area in square feet or square inches allowed for each sign face. The sign face includes any background material, panel, trim, color, and direct or self-illumination used that differentiates the sign from the building, structure, backdrop surface, or object upon which, or against which, it is placed. When there is no such differentiation, the sign face shall be a rectangle just large enough to enclose all lettering, illustrations, ornamentation, symbols, or logos. A sign structure shall not be computed in sign area provided that no message, symbol, or any of the aforementioned are displayed on, or designed as part of, the sign structure. (b) Height: .A sign's height is the vertical distance measured from the grade of the nearest abutting street to the highest point of the sign or sign structure. (3) Setback Requirements: (a) Allowed in Special Setbacks: When considered as a part of a site plan approval, or modification to a site plan, pursuant to Section 4.3.4(G)(6), a sign may be located within a special setback area'provided that: (i) If the sign is to be located no less than ten feet (10') nor more than twenty feet (20') from the right-of-way, the sign height shall not exceed seven feet (7'), and the sign area shall not exceed forty square feet (40 sq. ft.). 19 ORD NO. -03 S (ii) If the sign is to be located between twenty feet (20') to thirty feet (30') from the right-of-way, the sign height shall not exceed fourteen feet (14'), and the sign area shall not exceed ninety-six square feet(96 sq. ft.). (b) Allowed Partially in Standard Setback: When considered as a part of a site plan approval, or modification to a site plan, a sign may be located partially within the ten foot (10') setback area provided that (i) The sign height is not greater than seven feet (7'); (iii) The sign area is a maximum of forty square feet (40 sq.ft.); (iii) The sign area for that portion of the sign within the setback area is less than twenty square feet (20 sq.ft.). (c) Allowed Totally in Standard Setback: When considered as part of a site:plan approval,.or modification-to:.a site plan, a sign may be located totall). within the ten foot (10') setback area provided that:. (i) The sign height is not greater than seven feet (7'); (ii) The sign area.is less than twenty square feet (20 sq.ft.); (d) Basic Setback=Determinants: The,setback for a free standing sign shall be ten feet (10') from the ultimate right-of-way line unless there is a special - setback, or special.: landscape area. ,designated for the street pursuant to Section 4.3.4(G)(6). The setback,is measured from the closest portion of the sign,to the right-of- way. Projecting signs, canopy signs, and wall signs may extend into standard and special setback areas. No signs shall extend.into a right-of-way: (4). Safety and LocationRequirements. (a) Location . - (i). Agreement Required: Whenever a sign requires a permit and is allowed within a setback area, easement, or- right-of-way, the person erecting the sign shall be required.. to execute an agreement, which shall be countersigned by the property owner, providing that it is the obligation of the owner of the sign and/or the 20 ORD NO. -03 r property owner to relocate the sign at such time as the City determines that additional right-of-way or setback is required, or if conflicts occur with it being located in an easement. A performance bond, or acceptable substitute guarantee, may be required. (ii) Obstructions: A sign shall not be located in such a manner as to obscure another sign or to be obscured by an existing sign, a structure, or existing vegetation unless provisions .are made for the removal of the obscuring sign;structure, or vegetation. (b) Safety. (i) Safety Determination Required: Whenever consideration is given to locating a sign within a special setback-àrthe standard ten foot (10') setback area, the granting body must determine that the location of the sign does not present a hazard to pedestrians or to vehicular traffic circulation. (ii) Traffic Safety: No sign shall be located in such a manner that it will become a hazard to automotive or pedestrian traffic nor shall any sign or lighting of a sign be so placed as to obstruct the vision of the driver of any motor vehicle where vision is necessary for safety. (5) Illumination: Signs may be illuminated directly or indirectly unless specifically prohibited elsewhere in these LDRs. In residential zoning districts, all illumination shall be cut off luminair so that the light is not directed toward adjacent residentially zoned property. (6) Restrictions: (a) Intermittent Lighting or Animation: Shall not be accommodated on any sign except for time and/or temperature unit, or a traveling message sign which is a part of a sign permitted in commercial zone districts provided that such part of the sign shall not exceed twenty-five square feet 25 sq.ft. in area. (b) Moving or Rotating Signs: A sign shall not involve motion or rotation of any part of a sign structure or display. 21 ORD NO. -03 (c) Noise Producing Signs: A sign shall not produce noise or sounds. (d) Obscene Signage: A sign shall not exhibit thereon any lewd, lascivious, or obscene, character, or illustration. (e) Restrictions as to Functions: The use of a sign may be restricted to functions as set forth in Subsection (F) (7) (Matrix) under the column of"type of sign". (f) Smoke or Odor Producing Signs: A sign shall not produce or emit smoke, vapor, particles, or odor. (7) Design Standards Matrix: The following matrix sets forth the standards for various types of signs when located in various zoning districts or defined by use. The non-commercial message may occupy the entire sign face or portion thereof. The sign..face may be changed from commercial to non-commercial messages as frequently as desired by the owner of the sign, provided that the size and design .criteria: conform to the applicable portions of this section, the sign is allowed by this Code, the sign conforms to the requirements of the zoning designation..and the appropriate permits are obtained: For the purposes of Section 4.6.7, non-commercial messages, by their very nature, shall never be deemed off-premises. (H) Exempt Signs: The following signs are allowed to be erected in the City of Delray Beach, pursuant to the limitations set forth herein, and do not require a permit: (1) Automated Teller Machine (ATM) Panels: One panel which is physically constructed within and is an integral part of an ATM, and bears the name of th= ATM system to which it belongs. (2) City Civic Signs: . Signs for facilities located on City"property, or within public right-of-way, and which are operated by_ the City, its licensees, agents, or contractors, or by other public purpose organizations of general benefit to the community may be exempt by order of the City Manager if it is determined that the sign type meets the following criteria: (i) the sign provides notice to the public of a public meeting or other public event, (ii). the sign is temporary and for a limited time, and (iii) the sign, if allowed for a limited time, will meet the following criteria: (a) the signs will not conceal or obstruct adjacent land uses or signs;: (b) the signs will not conflict with the principal permitted use of the site or adjoining sites, 24 ORD NO. -03 (c) the signs will not interfere with, obstruct vision of or distract motorists, bicyclists or pedestrians, and (d) the signs will be installed and maintained in a safe manner. The approval, or disapproval, of such signs shall not be based on the content of the message contained (i.e., the viewpoint expressed) on such signs. The City Manager or his/her designee shall render a decision within ten (10) days after an application is made for utilizing this sign type at a special event. Such a decision shall be deemed an administrative interpretation and any person adversely affected has the right to appeal the decision to the City Commission. Such signing.shall be subject to the following standards: (i) Each sign limited to less than twenty square feet (20 sq.ft.) in area; (ii) Allowed ten (10) days prior to the event and must be removed by the second day after the event. (3) Directional Signs: Such signs shall not extend more than five feet (5')from the ground and shall not be greater`than foursquare feet (4 sq.ft.) in area. (4) Flags: (a) • Flags`may be displayed on any residential or non-residential parcel of land in accordance with the following rules: (1) A Flag being defined as a piece of cloth usually attached at one edge to a staff or cord, and used as the symbol of a nation, state municipality or service or civil organization. (2) No more than three (3) flags may be placed upon any parcel or development less than one acre in size which is zoned and used for non-residential purposes. • 25 ORD NO. -03 (3) For parcels or developments equal to or greater than one acre in area, no more than one flag per 15,000 square feet of lot area shall be allowed. (b) Two (2) flags may be flown at a time when model homes or model apartments are open for inspection. (c) Flags of service or civil organizations may be displayed at respective meeting sites during meeting hours. (5) Hours of Operation Sign: A sign denoting hours of operation which are non-illuminated; have a sign face of less than one square foot (1 sq.ft.); located close to the entry to the business; and being a flat wall sign. (6) Instructional Signs: Instructional signs are signs which convey instructions with respect to the premises on,which it is located, such as "no trespassing", a danger sign, and similar signs (other than parking signs). Such signs shall not extend more than five feet (5').from the ground and shall not be greater than three square feet (3 sq.ft.) in area. (7) Nameplates: One.. (1.). nameplate sign per building, not exceeding three square feet. (3 sq.ft) in area,:of a noncommercial nature, and bearing the name or street address of the principal occupant. (8) Non-Residential; (a) Non-Residential Window Signs. - . (i) Plastic, neon,; or painted signs may be placed upon windows .when: limited to 20%..of the:aggregate glass area, per tenant space-or per main use. (ii) Paper signs displayed two feet (2') or more from the inside of the glass but which are visible from the outside shall;be limited to 20% of the aggregate area, per tenant space. 26 ORD NO_ -03 • (9) Residential. (a) Residential Real Estate Signs: (i) One sign per lot, the sign being less than three square feet (3 sq.ft.) in area on residentially zoned property; (ii) One additional sign per lot may be erected on a lot which borders a waterway provided that it is located along the waterways; said sign shall not exceed nine square feet (9 sq.ft.) in area; (iii) All real estate signs shall be non-illuminated; (iv) The text of real estate signs shall be limited to the phrase "For Sale" or "For Lease" or "For Rent" and may identify the seller or agent; (v) An additional sign, of not greater than three square feet (3 sq.ft.), may be attached to a real estate sign provided that its text is limited to the words such as "pool" or "open" or"sold"; (vi) An additional "open house" sign of not more than three square feet (3 sq.ft.) in area may be displayed only during the hours when the house is being shown. (vii) Non-residential real estate sign is exempt if the sign is less:thah sixteen square feet (16 sq.ft.) in area. • (b) Other Residential Signs. (i) One sign her lot, the sign being less than three square feet (3 sq.ft.) in area on residentially zoned property. (ii) One sign per residence, not to exceed three square feet (3 sq.ft.). (c) Window signs. 27 ORD NO. -03 r (10) Temporary Signs: (a) Temporary Political Signs (i) Non-illuminated temporary political signs for each candidate or two (2) such signs for, or against, a referendum issue may be placed on any parcel or lot. (ii) Each temporary political sign shall be removed within ten (10) days after the date of election or referendum. In the event that said signs are not removed prior to expiration of the ten (10) day period, the sign shall constitute an abandoned sign and the City shall send by certified mail, return receipt requested, to the addresses of the Owner of each property whereon the temporary political sign is located and Owner is listed on the current tax roll of the county, a notice of noncompliance stating that the City's Code Enforcement Board shall fine the property owner for each day of noncompliance if the sign is not remove= with the ten (10)days after receipt of notice. (iii) No temporary political sign shall exceed twelve square feet (12. sq.ft.) per sign face in area on any private lot or parcel. (iv) Any 'temporary political sign in the public right-of-way cannot exceed three square feet (3 sq.ft). No temporary political sign shall be placed on any public-property. Signs may not be placed in a location that constitutes a safety hazard or hindrance to pedestrian or vehicular traffic. (b) Other Temporary Signs. (i) All other temporary signs non-commercial in nature not addressed herein or prohibited may be placed in the public right-of-way, but not on public property,as long as they do not create a safety hazard or as long as they do not constitute visual blight for a period not to exceed three (3) days. 28 ORD NO. -03 (11) Tenant Panels: A change of a tenant panel in a directory sign, or a sign which accommodates a tenant, is exempt from needing a permit provided that the sign was permitted and there is no change in colors or letter style. (I) Prohibited Signs: The following signs, or sign features, are prohibited within the City of Delray Beach; however, exceptions as noted herein are allowed. It shall be unlawful for any persons to erect prohibited signs or use prohibited sign features. Further, any sign not provided for, or expressly permitted by these LDRs is also prohibited. (1) Banners and Wind Signs: (a) Banners: A sign consisting of characters, letters, illustrations or ornamentations attached to cloth, paper, or fabric backing used for the purpose of communicating the presence of a business, the sale of a product, or the location of a business. For special events, temporary Roadway Banners may be allowed as provided for in Section 4.6.7(E)(3)(K). Grand Opening banners may be allowed as provided for in Section 4.6.7(E)(3)(I). (b) . Wind Signs: Signs consisting of banners, pennants, ribbons, spinners,streamers, balloons, or other objects or material fastened in such a manner as to move upon being subjected to pressure by wind. (2) Off-Premise Signs: A sign, including building signs, that advertise an establishment, merchandise, service, or entertainment which is sold, produced, manufactured, or furnished at a place other than the property on which the sign is located, however, non-commercial messages shall never be off-premises. (3) Roof'Signs: A sign erected on the roof, or above the roof line, or on the parapet. - . (4)- Snipe Signs: Snipe signs are prohibited. Snipe signs include: any sign located in the public right-of-way or placed in the ground for commercial purposes; excluding garage sales,yard sales or homeowners and civic meeting signs. (5) Traffic Confusion: A,sign or other advertising matter erected at the intersection of any streets or in any street right-of-way in manner as to obstruct free and clear vision; or.at any location where, by reason of the position, shape, or color, it may interfere with, obstruct the view of, or be confused with any authorized traffic sign, a traffic signal, or traffic device; or which makes use of the words "stop", "look", "drive-in", "danger", or any other word, phrase, symbol, or character in a manner as to interfere with, mislead, or confuse vehicular traffic. 29 ORD NO_ -03 r• (6) Vehicular Signs: Signs placed on vehicles or trailers that are parked in the street, public right-of-way or on private property for the primary purpose of displaying the sign for advertising a commercial enterprise. (7) Waterbourne Signs: No sign or advertising shall be displayed on a vessel plying the waterways, excluding, the identification of the vessel. (J) Structural Standards: In addition to provisions of the Standard Building Code and provisions of Chapter 7 of this Code, the following structural standards shall be required for all signs erected in the City. (1) . Combustible Materials:,No sign constructed of combustible material shall be attached to any structure,or building if the sign has enough area to require a permit. (a) Combustible signs up to fifty square feet.(50 sq.ft.) in area shall be at least twenty feet (20')from any building or structure. (b) Combustible signs from fifty-one square feet (51 sq.ft.) up to one hundred square feet (100 sq.ft.) in area shall be at least forty feet (40') from an). building or structure. (c) Combustible .signs•,from one hundred one square feet (101 sq.ft.) up to,one hundred sixty square feet (160 sq.ft.) in area shall:be at least eighty feet (80')from any building or structure. (2) Securing Signs: Wall signs shall be securely attached to the building or structure by means of metal--anchors, bolts, or-expansion screws. No wood blocks or anchorage with wood used in connection with screws or nails shall be considered proper anchorage, except in the case of wall signs attached to buildings or structures with walls of wood. No wall sign shall be.entirely supported:by'an.unb)aced.parapet wall. (3) Wind Loading Every, sign shall be constructed in a manner as to withstand 140 miles per hour wind. Sign contractors or the owner shall submit plans showing location, structural members, and design calculations for wind loading and for signs thirty-two.square feet (32 sq.ft.) or over, a certification sealed by,a state registered engineer or architect-stating that the design will meet the requirements of this code shall be submitted. All sign contractors shall sign a certificate-stating:.wind loading will meet requirements of this chapter where signs under thirty-two square feet 132 sq.ft.) are submitted 30 ORD NO. -03 (K) Removal of Signs: (1) Removal and Disposition of Non-Complying Signs: (a) It shall be unlawful to erect, use or maintain a sign or sign structure when it does not comply with the requirements of Section 4,6.7. The City is authorized to remove unlawful signs and sign structures pursuant to the provisions of Section 4.6.7. (b) Unauthorized signs are subject to removal pursuant to the following provisions: (i) The City finds that, in view of the inexpensive nature of these signs and the administrative burden which would be imposed by elaborate procedural prerequisites prior to removal, any procedure other than summary removal of these signs when unlawfully erected and maintained would defeat the purpose of regulating such signs. Therefore, the City Manager is hereby authorized to remove such signs when unlawfully erected and maintained, subject to the provisions contained in (ii). below. (ii) After removal of a sign pursuant to this section, a notice will=be sent, either in person or by fast-class postage, prepaid, to the occupant of the property from which the sign was removed, and if the sign identifies a party other than the occupant of the property, the party so identified. The notice shall advise that the sign has been removed and shall state that the sign may be retrieved within thirty (30) days of the date of the notice, and that, if the sign is not retrieved within thirty (30) days, it will be disposed of by the City. If the sign is removed from public property, the party, if any, identified on the sign shall be notified; if no party is identified on the sign, then no notice prior to disposition is required. The City shall dispose of all unclaimed signs after the expiration of the thirty (30) day period. (c) Signs and sign structures not subject to removal pursuant to (ii) above which are or have been erected or maintained unlawfully, may be referred to the code enforcement board for appropriate action or the City may proceed to pursue all 31 ORD NO. -03 y J♦ remedies available at law or equity to it to remove signs or sign structures which are or have been unlawfully erected or maintained. (2) Removal for Safety Reasons: Notwithstanding the above provisions, any sign which does not meet the fifty pound per square foot (50 Ib/sq.ft.) wind loading standard is declared to be a dangerous nonconforming sign and shall be removed or made to conform with this requirement within thirty (30) days of notification of same by the Chief Building Official. (L) Penalty: Section 10.99, "General Penalty" of the Code of Ordinances of the City of Delray Beach shall apply. (M) Severability: If any word phrase, clause, sentence, or section of this Section is for any reason held unconstitutional or invalid, the invalidity thereof shall not affect the validity of any remaining portions of Section 4.6.7. BACKG.ROUND The subject property is comprised of Lots 12, 13 and 14, Block 117, Town of Linton, and consists of 0.39 acres. The property is zoned CBD (Central Business District) and is designated as an individually listed historic property. The property contains a two-story commercial building (formerly a single family residence), an office building, (previously the garage), a carport, and a two-story apartment building with two, one bedroom apartment units and one, two bedroom apartment unit. The single family house, now a restaurant, was built in 1903, remodeled in 1918 and was designated a historic building (traditionally known as the Blank House) on June 6, 1994. In 1947, the two story apartment building (2,224 sq. ft.) containing three apartments and a garage was constructed at the southeastern portion of the site. In 1950, a garage was constructed on the northeast portion of the site and the garage associated with the southeastern apartment building was converted into additional living area. A carport, between the apartment building and garage, was built in 1954. The apartment building, carport, and garage are considered non-contributing due to their lack of architectural integrity. In 1995, the Historic Preservation Board approved a Certificate of Appropriateness and associated site plan for the conversion of the 2,137 sq. ft. single family residence to a retail establishment, conversion of the existing 1,027 sq. ft. garage to two offices, along with construction of a second floor addition accommodating a two bedroom apartment, construction of a nine space pea rock parking area at the southwest corner of the site, and installation of associated landscaping, walkways, and refuse area. The single family residence was subsequently converted to retail use and the garage was converted to offices, however neither building permits were obtained for the conversion of the garage nor was the parking area installed. Therefore, the two new offices were not considered legally established. Meeting Date: February 4, 2004 Agenda Item: IV.A. HPB Staff Report Handelsman Yellow Building—Class II Site Plan Modification Page 2 In October 1995, the two-story historic building was converted to a restaurant, with the second floor serving as storage area. During its meeting of May 2, 2001, the Historic Preservation Board reviewed and approved a Class III site plan modification for the conversion of the 1,027 sq. ft. garage into two offices, construction of a 600 sq. ft. concrete outdoor dining area on the south side of the restaurant, construction of an exterior staircase on the north side of the 2,137 sq. ft. restaurant, installation of an eight space asphalt parking area at the southwest corner of the property. The improvements included installation of one handicap accessible parking space on the north side of the property, and installation of associated landscaping, walkways and refuse container area. While the proposed project was approved by the Board, the project was not undertaken. Approval for the project expired on November 2, 2002. On March 19, 2003, the Board again reviewed and approved a new request for a Class III site plan which included the conversion of the garage into two offices, construction of a new nine (9) space asphalt parking lot, installation of a handicap accessible ramp, and installation of associated landscaping and walkways. The improvements were never undertaken. On January 7, 2004, the Historic Preservation Board reviewed a COA and Class II site plan modification request for the elimination of a nine (9) space asphalt parking lot in order to accommodate construction of a tea garden in addition to consideration of six (6) in-lieu parking spaces. During the review, the Board suggested an alternative to the proposal that involved the demolition of the office at the northeast corner of the property for the construction of on-site parking. The Board tabled the request to provide the applicant time to modify the proposal. The applicant is now before the Board for re-consideration of the original Class II Site Plan Modification proposal for the elimination of the nine (9) space parking lot and request for consideration of construction of an English tea garden, internal walkways, and purchase of six (6) in-lieu spaces. The proposal includes retention of the office building. DEVELOPMENT PROPOSAL : The development proposal consists of the following: > Elimination of the approved nine (9) space parking lot; > Construction of an English tea garden with extensive landscaping and circular paver walkway and associated internal walkway; and, > Consideration of a request for six (6) in-lieu parking spaces. Project Description The applicant proposes the installation of a circular English tea garden and paver pathway at the southwest corner of the property, adjacent to the historic building. The garden and associated landscaping is proposed in place of a nine (9) space parking lot previously HPB Staff Report Handelsman Yellow Building—Class II Site Plan Modification Page 3 approved with the Class Ill Site Plan Modification. The purchase of six (6) in-lieu spaces are proposed to meet the site's parking requirement of six (6) spaces. The new proposal involves the construction of a new walkway that will lead from the porch of the historic building to the tea garden (at the southwest corner of the property) and a curvilinear walkway that leads from the handicapped accessible ramp to the office. No exterior lighting is proposed at this time. t REQUIRED FINDINGS Pursuant to LDR Section 2.4.5(G)(1)(b), a Class II site plan modification is a modification to a site plan which requires no review of the Performance Standards found in LDR Section 3.1.1, but requires action by a Board. LDR Section 2.4.5(G)(5) (Findings): Pursuant to LDR Section 2.4.5(G)(5), formal findings are not required for a Class I or II modification. SITE PLAN MODIFICATION ANALYSIS COMPLIANCE WITH LAND DEVELOPMENT REGULATIONS: Items identified in the Land Development Regulations shall be specifically addressed by the body taking final action on the site and development proposal. LDR Section 4.4.13 Central Business District (CBD): LDR Chapter 4.4.13(G)(1) - Parking Parking for this development proposal is being assessed as it relates to the conversion of the garage to offices, relocation of the garage spaces, and provision of a handicapped accessible space. The existing 2,137 sq. ft. historic building has been utilized as a restaurant, with the first floor utilized for dining and kitchen space area while the second floor is utilized for storage only. Pursuant to LDR Section 4.4.13 (G)(1)(a) within that portion of the CBD bounded by Swinton Avenue on the west, NE 1st Street on the north, the Intracoastal Waterway on the east, and SE 1st Street on the south, parking requirements for all non-residential uses, except restaurants, shall be one space for each 300 sq. ft., or fraction thereof. The parking required for the creation of new floor area shall also include the replacement of any previously required parking which may be eliminated. Based on the information above, the two new offices (the 1,027 sq. ft. garage) require four parking spaces and the replacement of two spaces eliminated with the conversion of the garage equal six (6) spaces thus, requiring six (6) parking spaces total. The applicant is proposing to purchase these spaces through the City's in-lieu parking program which is available within the CBD. HPB Staff Report Handelsman Yellow Building—Class II Site Plan Modification Page 4 LDR Section 4.6.9(E) - In-Lieu Parking (E)(1) Street parking, parking located in the public right-of-way, or parking located in public parking facilities shall not be used to satisfy on-site parking requirements. The terms "on-site parking" and "off-street parking" are synonymous. However, pursuant to the requirements of Section 4.6.9(E)(3)(e), the cost of construction of additional on-street public parking may be used to offset the total dollar amount due under an in-lieu fee agreement with the City. (E)(3) If it is impossible or inappropriate to provide the required number of on-site or off-site parking spaces, the City Commission may approve the payment of a fee in-lieu of providing such required parking, pursuant to the following provisions: (a) The in-lieu fee is authorized only in the CBD, CBD-RC, OSSHAD, and GC (West Atlantic Avenue Overlay District) Zoning Districts in compliance with the Supplemental District Regulations provisions therein. The in-lieu fee is $12,000 per space as required by LDR Section 4.6.9(E)(2). LDR Section 4.6.8 - Site Lighting Pursuant to LDR 4.6.8 (Lighting), site lighting is required on site for new development proposals. No exterior lighting has been proposed with this modification. While site lighting is not required for the proposed garden use, path lighting such as lighted bollards or other similar lighting should be provided along the pathways and within the garden area to ensure pedestrian safety. This has been added as a condition of approval. _LANDSC_-AP:E ANALYSIS The proposed landscaping consists of roses and orange jasmine surrounding the circular pathway at the center of the proposed garden and a Royal Poinciana at the outer edges of the garden. Existing Lady Palms and Lillies surround the historic building with Shining Jasmine, Cocoplum, Benjamin Fig, and Red Ixora proposed along the perimeter of the property and as well as the three buildings. Queen Palms and Christmas Palms will be relocated along the perimeter of the property (near the office and apartment building) with Lily of the Nile also proposed. While the proposed landscaping, as listed above, complies with the requirements of LDR Section 4.6.16, there are several issues concerning the data provided on the landscape plan. Therefore, the following technical items are attached as conditions of approval. Landscape Technical Items: If the Class II Site Plan Modification is approved, the following Technical Items must be addressed with the submittal of revised plans prior to building permit submittal: 1) That plant materials for area #10 is identified, and, 2) Consideration should be given to screening the west side of the carport with Cocoplum hedging to soften it from the garden area. HPB Staff Report Handelsman Yellow Building—Class II Site Plan Modification Page 5 Downtown Development Authority At its meeting of December 17, 2003, the DDA Board reviewed and recommended approval of the development proposal to eliminate the nine (9) space parking area and purchase six (6) in-lieu spaces, construction of an English tea garden, and associated walkways and landscaping. Parking Management Advisory Board The Parking Management Advisory Board (PMAB) reviewed the in-lieu request during its meeting of January 20, 2004. During the review, staff recommended that parking be constructed on the east side of the proposed garden area (approximately four spaces) while retaining the open space to the west (adjacent to SE 6 Avenue). Based on staffs recommendation, the applicant requested that the item be tabled for further consideration of staffs recommendation. The PMAB therefore tabled the item. PMAB action is anticipated on February 24, 2004. ... ASSESS-MENTAN © CONCLUSION Pursuant to LDR Section 4.4.13(G)(1)(c), if it is impossible or inappropriate to provide required parking on-site or off-site, per Subsection 4.6.9(E)(4), the in-lieu fee option provided in Section 4.6.9(E)(3) may be applied within the CBD. However, as the previous Class II Site Plan Modification permitted the construction of nine (9) parking spaces on site, there is no data to support that it is impossible to provide on-site parking. While the adopted Downtown Delray Beach Master Plan discourages parking in the front of the properties, provision of the six (6) parking spaces is appropriate based upon the prior illegal conversion of the garage to an office building and the current parking requirements for the restaurant which results in a significant parking deficiency for the site. Any future development or redevelopment of the site must consider utilizing the space (at the southwest corner) for a building (either newly constructed or relocated) along the property frontage with parking in the rear, adjacent to the alley. Per LDR Section 4.6.9(E)(1), street parking, parking located in the public right-of-way, or parking located in public parking facilities shall not be used to satisfy on-site parking requirements. While a 76 space City parking lot abuts the north side of the property, the parking lot is heavily utilized during the evenings and weekends and is a parking lot where employees of area businesses are encouraged to park. Given the significant parking deficiency of this property, and as the property contains adequate land (as illustrated by previously obtaining approval of a nine (9) space parking lot), it is neither impossible nor inappropriate to provide the required parking on site. In addition, though no exterior lighting is proposed at this time, due to the nature of the proposed landscaping, it is highly recommended that path lighting, such as lighted bollards, be installed along the proposed walkways. Further, the proposed landscaping is appropriate for the site, though several notations on the plans need clarification. Based upon the submitted plans, positive findings can be made with respect to LDR Sections 4.6.8 and 4.6.16, once the conditions of approval have been addressed. BACKGROUND/PROJECT DESCRIPTION .. Background Located in the Old School Square Historic Arts District (OSSHAD) zoning district, the subject property consists of the south 32' of lot 5, and lots 6-8, block 67, Town of Delray plat. The property contains a 1,507.3 sq. ft. frame building, the Cason Cottage Museum, along with a nine space asphalt parking lot, 34 stabilized sod parking spaces, and two bus parking spaces. In 1988, the HPB approved a COA for the conversion of the 1915 cottage to a museum. In 1992, the HPB approved a site plan modification for the construction of the associated on-site parking. During its meeting on March 20, 2002, the Board reviewed a COA and associated Class III site plan modification for the following modifications: • Relocation of the 1,209.3 sq. ft. bungalow (previously known as the Lavender Shutters building) to the museum site; • Conversion of four stabilized sod parking spaces to asphalt; • Modifications to the existing asphalt parking area involving relocation of the handicapped accessible spaces; and, • Elimination of three standard spaces, and installation of paver brick walkways and landscaping. The project was approved and is currently underway. The applicant is now before the Board for review of a COA and associated Class I site plan modification for installation of handrails. Meeting Date: February 4, 2004 Agenda Item: IV.B. 5 NE 1st Street Historic Bungalow at Cason Cottage Complex-OSSHAD Page 2 Project Description The project proposal involves the installation of decorative, dark green metal hand rails at the main and secondary entrances to the building on the south elevation of the bungalow. The hand rails are a requirement (per Section 1007 of the 2001 Florida Building Code) and are considered mandatory prior to occupation of the building. As proposed, the railings are oriented both perpendicularly and parallel to the building, however, they will not block any major portion of the building or significant architectural details such as the battered piers and French doors. ` ANALYSIS . �ry LDR Section 4.5.1(E)(8)(g) "Development Standards" provides guidelines in evaluating Certificates of Appropriateness for the alteration or addition of exterior architectural features. The guidelines are as follows: The Board Shall Consider: (E)(4) A historic site, or building, structure, site, improvement, or appurtenance within a historic district shall be altered, restored, preserved, repaired, relocated, demolished, or otherwise changed in accordance with the Secretary of the Interior's Standards for Rehabilitation, as amended from time to time. (E)(8) All improvements to buildings, structures, and appurtenances within a designated historic district shall be visually compatible. Visual compatibility shall be determined in terms of the following criteria: (f) Rhythm of Entrance and/or Porch Projections: The relationship of entrances and porch projections to the sidewalks of a building shall be visually compatible with the prevalent architectural styles of entrances and porch projections on historic sites, buildings, and structures within a historic district. (g) Relationship of Materials, Texture, and Color: The relationship of materials, texture, and color of the facade of a building shall be visually compatible with the predominant materials used in the historic sites, buildings, and structures within a historic district. Conclusion The proposed handrails are appropriate in color, design, material, and location as they •are decorative in nature and compliment the architectural detailing of the historic bungalow. As handrails are necessary per the 2001 Florida Building Code, the design and material are not obtrusive to the façade and will not block any major portion of the building or significant architectural details. Further, the handrails are reversible and will not irreparable damage the building if removed.
