I. CALL TO ORDER
The meeting was called to order by the Chairperson at 6:05 P.M. Upon roll call
it was determined that a quorum was present.
MEMBERS PRESENT: Gloria Elliott, Gail-Lee McDermott, Rhonda Sexton,
Francisco Perez-Azua, Jim Keavney, Bill Branning
(arrived 6:35).
MEMBERS ABSENT: Mary Lou Jamison
STAFF PRESENT: Wendy Shay, Lynne Tuzik
II. APPROVAL OF MINUTES
The Minutes for the Public Hearing/Regular Meeting for April 16, 2003 was
• before the Board for consideration. A motion to approve the Minutes as
presented was made by Ms. Sexton. It was seconded by Mr. Perez and passed
6-0.
III. PUBLIC HEARINGS
Ms. McDermott read a summary of the Quasi-Judicial Hearing procedures and
swore in all those wishing to speak.
A. Sundy Harvest Block, Lots 20-25, Block 70, Old School Square
Historic District, John Szerdi, Authorized Agent.

Action Before the Board: Consideration of granting an extension of a
COA and associated Class V site plan approval for Sundy Harvest,
pursuant to LDR Section 2.4.4(F)(3).
Ms. McDermott inquired if any Board member wished to disclose any
ex parte communications on this item. There were none.

Ms. Shay entered the project file and a copy of her resume into
record and presented the item to the Board.
Mr. Szerdi was present to represent the project.
Ms. Sexton inquired about the status of the non-contributing building.
Mr. Szerdi stated that it is still on site.
Ms. Sexton asked what would happen if the financial review was not
positive.
Mr. Szerdi stated that the buildings would remain but that perhaps
the funding would end.
Ms. McDermott inquired as to when the work would begin.
Mr. Szerdi stated that they will finalize the review of the project by the
end of the year.
Ms. Shay stated that at least 25% of the work must commence by the
time the 18 month extension period ends.
It was moved by Mr. Perez, seconded by Mr. Keavney, and was
passed 4-1 (McDermott dissenting) to approve the request for an
extension of Certificate of Appropriateness and the associated Class
V site plan, landscape plan, design elements, waiver request and
demolition request for Sundy Harvest, based on positive findings with
respect to Chapter 3 (Performance Standards), and LDR Section
2.4.5(F)(5) (Compatibility), Sections 4.6.16, and 4.5.1.(F)(1), and
2.4.7(B)(5) of the Land Development Regulations, said approval for
an additional 18 months (valid until April 17, 2005), subject to the
following conditions:
1) Provide stop sign and bar at egress into alley.
2) Provide drainage calculations with exfiltration test results.
3) A utility easement must be dedicated for the existing 8" sewer
main located along the west side of Lot 23.
4) The handicapped parking space must be placed at the most
readily available place within the development proposal. If the
proposed handicapped space remains in place behind Building
#1, it must be relocated once the conversion of Buildings #2 and
#3 occurs.
5) Change the notation for the porch on Building #2 and the
storage on Building #3 to read as "existing."

6) Back-out parking onto an alley must be 10' wide and 42' in
depth measured from the paved alley to the head of the parking
space.
7) That all proposed landscaping that will interfere with the line of
site of the front façade from the right-of-way be replaced or
relocated.
8) That revised plans be submitted addressing the technical items
and conditions of approval noted in the staff report.
9) That a Declaration of Unity of Title must be recorded for lots 20-
25, Block 70, Town of Delray, or cross-parking and access
easement recorded, prior to issuance of a building permit.
10) That a bike rack be placed on site.
11) That decorative site lighting fixture details are provided and that
the light locations be indicated on the site and landscape plans.
12) That the site plan must be revised to show the relocation of the
utilities underground.
13) Back-out parking onto an alley must be 10' wide and 42' in
depth measured from the paved alley to the head of the parking
space.
14) That the handicapped accessible parking space be centrally
located between the buildings being converted and a sidewalk
provided to the entrance to comply with the Florida building
Code for Building Construction.
15) That a right-of-way deed be executed and recorded, dedicating
5' of right-of-way along SE 1st Avenue.
B. Fisher Properties, 27-43 South Swinton Avenue, Old School
Square Historic District, John Szerdi, Authorized Agent.
Action Before the Board: Consideration of granting an extension of a
Class V site plan approval for Fisher Properties, pursuant to LDR
Section 2.4.4(F)(3).
Ms. McDermott inquired if any Board member wished to disclose any
ex parte communications on this item. There were none.
Ms. Shay entered the project file into record and presented the item
to the Board.
Mr. Szerdi was present to represent the project. He re-iterated that
the company was conducting a financial review and that the project
would be re-evaluated prior to commencement.

After a brief discussion, it was moved by Ms. Elliott, seconded by Ms.
Sexton, and passed 4-1 (McDermott dissenting) to approve an
extension of Certificate of Appropriateness and the associated Class
V site plan, landscape plan, design elements, and demolition request
for Fisher Properties, based upon positive findings with respect to
Chapter 3 (Performance Standards), Section 2.4.5(G)(5) (Findings),
Section 2.4.6 (COA Findings), and Sections 4.6.16, 4.5.1, and 4.6.18
of the Land development Regulations and policies of the
Comprehensive Plan said approval to be valid an additional 18
months (valid until March 20, 2005).
C. Yama Building/Masonic Lodge, 40-44 East Atlantic Avenue, Old
School Square Historic District, Weiner& Aronson, Authorized Agent.
Action Before the Board: Consideration of an approval of a
Certificate of Appropriateness associated with a Class I Site Plan
Modification for the installation of direct mount, metal storm panels.
Ms. Shay entered the project file into record and presented the
project.
Michael Weiner, authorized agent, was present to represent the
project.
It was moved by Ms. Sexton, seconded by Ms. Elliott, and passed 5-
0 to approve the Certificate of Appropriateness and the associated
Class Site Plan Modification for the installation of direct mount, metal
storm panels on the contributing building located at 40-44 East
Atlantic Avenue, based upon positive finding with respect to LDR
Section 4.5.1(E)(8)(g), the Delray Beach Design Guidelines, and the
Secretary of the Interior's Standards, subject to the condition:
1) That the panels be retrofitted to the building via the frame of the
openings or that an engineer draft specifications which highlight
how the panels are to be secured, or that they be secured by
means that are deemed appropriate by the Building Department.
D. Independence Title, 204 Dixie Boulevard, Del-Ida Park Historic
District, Roger Cope, Authorized Agent.
Action Before the Board: Consideration of an approval of a
Certificate of Appropriateness and the revised elevations associated
with a Class V site plan for 204 Dixie Boulevard, Independence
Title-Continued.

Ms. McDermott inquired if any Board member wished to disclose any
ex parte communications on this item. There were none.
Ms. Shay entered the project file into record and presented the item
to the Board. She expressed her concerns with the design of the rear
gable and the scale of the proposed rosettes and medallions.
Mr. Cope was present to represent the project. He presented the
elevation changes based on the Board's previous conditions of
approval and presented an alternate plan which displayed a
curvilinear parapet on the front elevation, alteration of the gable roof
(rear elevation), and simplification of the design elements.
Mr. Branning asked Mr. Cope which elevation he preferred.
Mr. Cope stated that he preferred the alternate elevations proposed
during this meeting.
Ms. Sexton inquired about the color on the windows.
Mr. Cope stated that they will have a bronze finish intended to
compliment the proposed monochromatic color scheme.
Mr. Perez requested that the water table be consistent in height on
the front elevation.
After much discussion, it was moved by Mr. Branning, seconded by
Mr. Perez, and was passed 6-0 to approve the Certificate of
Appropriateness and the revised elevations associated with a Class
V site plan for 204 Dixie Boulevard, Independence Title, based
upon positive findings with respect to LDR Section 4.5.1(E)(4), (E)(7),
and (E)(8)(a-k), the Delray Beach Design Guidelines, and the
Secretary of the Interior's Standards for Rehabilitation, subject to the
following conditions:
1) That the building elevation for the northeast elevation incorporate
the curvilinear parapet, alternate elevation A8.1, and that the
northwest elevation match the alternate elevation A1.1.
2) That proposed finials atop the flat roof(on the northeast elevation)
be removed.
3) Simplify the arch design on the covered walkway to display a
decorative arch and keystone (per elevation A8.2 submitted
during the meeting).

4) That the original wood window be painted to match the finish on
the new windows.
5) That the decorative medallions and rosettes be scaled down on
the front (northwest) elevation (per sheet A1.1 submitted during
the meeting).
6) That the water table on the front elevation (A8.1) be lowered to be
consistent with the adjacent water table to the east.

Ms. McDermott urged a Board member to volunteer as a liaison to
the West Settlers Advisory Board.

Ms. Shay thanked Mr. Branning and Ms. McDermott for all their
efforts with the Board, particularly their contributions toward the
design guidelines.
Ms. Shay stated that the City Commission sponsored $5,000 and
the CRA matched the amount for the 2004 Florida Trust
Conference.
V. ADJOURNMENT
There being no further business, the Board adjourned at 7:35 P.M.

ITEM BEFORE THE BOARD
The item before the Board is approval of a Certificate of Appropriateness associated
with a Class I Site Plan Modification for the installation of direct mount, metal storm
panels, pursuant to LDR Section 2.4.6(J).
BACKGROUND.
Located in the OSSHAD (Old School Square Historic Arts District) zoning district, the
historic Masonic Lodge Building, a two-story, frame commercial building with stucco
exterior was originally constructed in 1924 and was the home of the Delray Lodge of the
Free and Accepted Masons. The building presently houses the Yama Restaurant on the
first floor and offices on the second.
At its meeting of August 1, 2001, the Historic Preservation Board reviewed a COA
request involving elevation changes that included but were not limited to: removal of the
brick veneer on the first floor, exposing and recapping the parapet, replacing the
storefronts and second floor windows, adding stucco banding to the parapet, and
adding stucco lintels and sills. The Board asked the applicant to return during its
meeting of September 5, 2001 with additional details of the entrance gate design on SE
1st Avenue, the design for the panel windows on Atlantic Avenue and on SE 1st Avenue,
the color and striping pattern for the awning to be located on SE 1st Avenue, and the
kitchen entrance door. The applicant provided an alternative to the panel window
system and the side kitchen entrance was redesigned. The kitchen door, previously a
concern, was removed and the curvilinear pattern of the grill work was changed to a
rectilinear pattern. Upon further consideration, the Board approved the COA request
based on the revisions.
During its meeting of June 18, 2002, the Board reviewed elevation changes for the
building that included: replacement of the folding door system on the north elevation to
a fixed door system, removal of the single exterior door at the center (right) on the east
elevation, and installation of single light transoms above the door and window wall
systems on the north and east elevations rather than the originally proposed 2/2 light
pattern. The Board approved the requested elevation changes with the stipulation that

the stucco exterior at the base of the windows on the north elevation be retained and
that fixed windows be installed to mirror that of the window wall west of the proposed
door system.
The applicant is now before the Board for consideration of the installation of direct
mount, metal storm panels on the first floor windows.
PROJECT DESCRIPTION /ANALYSIS
Project Description:
The project proposal is to install direct mount, galvanized steel storm panels onto the
first floor windows of the building. The proposed storm panels consist of imbricated,
corrugated steel..panels that will bolt directly onto the hollow clay tile building. The
panels will be stored when not in use. The shutters will range between 83" and 247"
wide and will measure between 20" and 109" in length and will be designed per each
window's specifications. Per the 2001 Florida Building Code, the applicant is required to
provide storm panels when impact resistant windows do not exist or are not available.
Currently, there are direct mount storm panels that exist for some of the second floor
windows, however, the applicant is requesting protection of the remaining first floor
windows on both the north and east elevations.
Design Elements Analysis:
LDR Section 4.5.1(E)(8)(g) "Development Standards" provides guidelines in
evaluating Certificates of Appropriateness for the alteration or addition of exterior
architectural features. The guidelines are as follows:
The Board Shall Consider:
(E)(8)(g) All improvement to buildings, structures, and appurtenances within a
designated historic district shall be visually compatible. Visual compatibility can
include but is not limited to: consistency in relation to materials, texture, and
color of the facade of a building in association with the predominant material
used in surrounding historic sites and structures within the historic district.
Conclusion
As the building is considered contributing within the Old School Square Historic District,
it is imperative to ensure that modern equipment, such as hurricane protection, is
retrofitted for use on the exterior. The recently adopted Historic Preservation Design
Guidelines recommend the installation of removable storm shutters. While metal storm
panels have already been used on the building (as evidenced by the existing bolts on
the second floor windows), there have been no specifications submitted that reflects
how the new panels will be secured in the hollow clay tile building. It is therefore
recommended that the panels be retrofitted to the building via the frame of the openings
or that an engineer draft specifications which highlight how the panels will be secured.
This has been added as a condition of approval. Based on the analysis above, a

positive finding with respect to LDR 4.5.1(E)(8)(g) can be made for the installation of the
storm panels once the condition of approval has been met.
RECOMMENDATION
Approve the Certificate of Appropriateness and associated Class I Site Plan
Modification for the installation of direct mount, metal storm panels on a contributing
building located at 40-44 East Atlantic Avenue, based upon positive findings with
respect to LDR Section 4.5.1(E)(8)(g), the Delray Beach Design Guidelines, and the
Secretary of the Interior's Standards, subject to the following condition:
1) That the panels be retrofitted to the building via the frame of the openings or that an
engineer draft specifications which highlight how the panels are to be secured.
