HPB- 10-01-03 MINUTES OF THE HISTORIC PRESERVATION BOARD CITY OF DELRAY BEACH DELRAY BEACH, FLORIDA PUBLIC HEARING MEETING DATE: OCTOBER 1, 2003 LOCATION: FIRST FLOOR CONFERENCE ROOM I. CALL TO ORDER The meeting was called to order by the Chairperson at 6:02 P.M. Upon roll call it was determined that a quorum was present. MEMBERS PRESENT: Mary Lou Jamison, Jim Keavney, John Miller, Jr., Randee Schatz, Rhonda Sexton, Francisco Perez- Azua, (Gloria Elliott resigned-no new appointment). MEMBERS ABSENT: None STAFF PRESENT: Paul Dorling, Robert Tefft, Lynne Tuzik, Terrill Pyburn, II. APPROVAL OF MINUTES The Minutes for the Public Hearing/Regular Meeting for September 3, 2003 and September 17, 2003 were before the Board for consideration. Ms. Jamison made a motion to approve the Minutes as written. It was seconded by Ms. Sexton and passed 6-0. III. PUBLIC HEARINGS Mr. Perez read a summary of the Quasi-Judicial Hearing Procedures and swore in all those wishing to speak. A. Sandoway House, 142 South Ocean Boulevard, Individually Listed Historic Property, Michael Kravitt, Authorized Agent. Action Before the Board: Consider a Certificate of Appropriateness and associated Class III Site Plan Modification for a second-story addition to the Sandoway House, construction of a garden shed, and associated variance. Mr. Perez inquired about disclosure of any ex parte communication. Ms. Schatz disclosed for the record that she had hired Michael Kravitt a few years ago as an expert witness. A Ms. Pyburn inquired if she had any current cases with Mr. Kravitt. Ms. Schatz stated that she did not. Mr. Dorling entered the project file and a copy of his resume into record and presented the item to the Board. Michael Kravitt was present to represent the project. He stated that the addition would follow the current building footprint atop the rear, one- story portion of the building. The applicant's concern regarding changing the siding was that it would distract from the original house. In order to maintain the integrity of the historic building, he would prefer to keep the same siding. Mr. Perez noted that members of the public were present for comment and asked if there was any public discussion. Henry Foell, 1120 Coconut Row, spoke against the variance. He stated that the building was in violation of LDR 4.3.4(K) already, and stated that it would negatively affect his adjacent property through devaluation. Carolyn Patton, Sandoway House Treasurer, spoke in favor of the Sandoway House addition. The addition would not be expanding beyond the existing footprint of the building which has been in situ since 1936. The addition would be used to house a 10,000 piece shell collection and would not change the usage of the property. Mr. Dorling inquired if there was any evidence that Mr. Foell's property would be de-valued. Nothing was presented to support Mr. FoeII's claim. Mr. Kravitt stated that the addition would be placed over what was historically the garage. He further stated that there were no setbacks when the building was constructed. He requested consideration of the variance based on the fact that the addition is facilitating the use of the historic building. David DeFrancesco, representative of the Jardin del Mar Condo Association (south of the Sandoway House) expressed his concern regarding the use of the property. Mr. Perez confirmed that the use will remain the same. Mr. Keavney inquired about the differentiation of building materials. -2- HPB Minutes 10/1/03 Ms. Sexton inquired about changing the window style or light configuration rather than the exterior siding. She further inquired whether the stairway was new. Mr. Kravitt stated that there would be no problem with differentiating the windows. He also stated that the stairwell is currently in place, though the landing at the top of the stairs is proposed. Variance After some discussion, it was moved by Ms. Jamison, seconded by Ms. Sexton and passed 6-0 to approve the variance from LDR Section 4.3.4(K) to reduce the side setback from 10' to 5.3' for a second floor addition to an existing contributing building at the Sandoway Nature Center, based upon positive findings with respect to LDR Section 4.5.1(J). Site Plan It was moved by Ms. Jamison, seconded by Ms. Sexton and passed 6-0 to approve the Certificate of Appropriateness and the associated Class III site plan modification for the Sandoway Nature Center, based on positive findings with respect to Chapter 3 (Performance Standards), and LDR Section 2.4.5(G)(5) (Findings), and the policies of the Comprehensive Plan. Design Elements After some discussion, it was moved by Ms. Jamison, seconded by Ms. Sexton and passed 6-0 to approve the COA for the design elements for Sandoway Nature Center, based on positive findings with respect to LDR Sections 4.5.1(E)(4), (E)(7), and (E)(8)(a, c, g, h, and j), the Delray Beach Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation, subject to the following condition: 1) That the windows on the second floor addition have a different configuration than those found on the remainder of the building, subject to administrative approval. B. Amelung House, 102 NE 12th Street, Individually Listed Historic Property, Gary and Toni Eliopoulos, Owners. Action Before the Board: Consider a Certificate of Appropriateness for elevation changes and a waiver request for 102 NE 12th Street, the Amelung House, pursuant to LDR Sections 2.4.6(J) and 4.1.4(C). -3- HPB Minutes 10/1/03 Mr. Perez inquired if there was any ex parte communication on this project. Ms. Jamison stated that she had roughly five conversations with Scott Christianson concerning the right-of-way improvements during the relocation of the house and issues related to the variance. Ms. Pyburn inquired about the nature of the communication. Ms. Jamison stated that it was all verbal communication. Ms. Pyburn inquired about whether he showed a particular bias toward the project. Ms. Jamison stated that Mr. Christianson supported the preservation of the house but was reluctant to support a precedent for development of a non-conforming lot in the Seacrest neighborhood. Mr. Dorling entered the project file and a copy of his resume into record and presented the item to the Board. Mr. Eliopoulos was present to represent the project. He distributed photographs highlighting the building in situ, its relocation, and its current location on NE 12th Street. He further described in detail the background of the building's relocation. Waiver It was moved by Ms. Jamison, seconded by Ms. Schatz and passed 6-0 to approve a waiver from LDR Section 4.1.4(C) to allow the development of Lot 9, Block 6, Dell Park, for the property at 102 NE 12th Street, the Amelung House, based upon positive findings with respect to LDR Section 2.4.7(B). Certificate of Appropriateness It was moved by Ms. Jamison, seconded by Mr. Miller and passed 6-0 to approve the Certificate of Appropriateness for elevation changes associated with a COA for 102 NE 12th Street, the Amelung House, based upon positive findings with respect to LDR Sections 4.5.1(E)(4), (E)(8)(b-g) and (k), the Delray Beach Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. IV. CERTIFICATES OF APPROPRIATENESS A. Copeland & Bowman Residence, 10 NE 7th Street, Del-Ida Park Historic District, Copeland/Bowman, Owners. -4- HPB Minutes 10/1/03 J Action before the Board: Consider a Certificate of Appropriateness for the installation of storm protection on a non-contributing building, pursuant to LDR Section 2.4.6(J). Mr. Perez inquired if there was any ex parte communication on this project. There was none. Mr. Dorling entered the project file and a copy of his resume into record and presented the item to the Board. Ms. Bowman was present to represent the project. She stated that the color of the house was a very pale yellow and the storm shutters were white to match the color of the window frames. If they were required to paint the material the contractor stated that they would eventually peel. The shutters did come in other colors, however, other colors would not be appropriate for their home. Ms. Schatz asked why there was a concern over the color as the yellow is very pale and it appears as though the tracks are very close to the white window trim. Mr. Dorling stated that the tracks needed to blend with the body of the building so that none of the color of the house was viewed from the right- of-way. If the tracks were close enough to the trim of the same color, then the white would be appropriate. Ms. Bowman stated that the tracks will be as close to the trim as possible. Mr. Perez stated that as long as the tracks blend in with the trim, the white would be acceptable. After much discussion, it was moved by Ms. Jamison, seconded by Ms. Schatz and passed 5-1 (Sexton dissenting) to approve the Certificate of Appropriateness for the installation of accordion shutters, rollup shutters, and removable storm panels on a non-contributing building located at 10 NE 7th Street, based upon positive findings with respect to LDR Section 4.5.1(E)(8)(g) and the Delray Beach Design Guidelines, subject to the following conditions: 1) That the tracks or channels for the accordion shutters, rollup shutters and storm panels are placed as close to the window frame as possible so that the base color of the building does not show through and that the color be white as presented during the meeting. -5- HPB Minutes 10/1/03 2) That the proposed accordion shutters on the first floor of the front façade for the two, paired French doors be changed to removable storm panels. Report from Historic District Representatives: Ms. Jamison inquired about a house the corner of North Swinton and NE 6th Street where the windows are being boarded up and stucco is being applied to the door facing Swinton. Mr. Dorling stated that he would have Ms. Shay look into it. C. Board Members: Ms. Sexton stated that there was a 1925 house for sale in the warehouse area on NE 3rd Avenue that may be available for relocation. D. Staff: Mr. Dorling stated that to date there was nothing submitted for the October 15th meeting and it is likely to be canceled. Ms. Pyburn clarified that Mr. Dorling was correct in going through the Board to address comments made by the public. VI. Staff: Ms. Shay reported that the Amelung House (102 NE 12th Street) was slated for relocation on September 7, 2003 and that the City Commission mandated that the historic designation would apply only to the lot that the house will occupy (Lot 9) effective September 30, 2003. Review of the elevation changes and waiver for the lot will be heard by the Board during the meeting of October 1, 2003. IV. Ms. Shay entered the project file and a copy of her resume into record and presented the item to the Board. Butch Johnson and Stewart Hall were presented to represent the project. Mr. Johnson stated he had wanted to open up the entire building and worked with staff to develop this proposal. The color will be changed as presented upon approval by the landlord, otherwise it will remain the same color. Ms. Shay entered the project file and a copy of her resume into record and presented the item to the Board. Ms. Jamison inquired if there was any ex parte.communication. There was none. Mr. Cope was present to represent the project. He agreed with all the recommendations stated by Ms. Shay regarding the windows and roof. Regarding the exterior siding, Mr. Cope stated that the owners wanted to replace the entire wood siding exterior with hardiplank due to maintenance issues. The owner wished to re-insulate and install hardiplank to match the original profile and board exposure. Ms. Schatz requested to see the sample of hardiboard. She stated that the hardiboard did not resemble wood. She further asked how much of the building would need to be re-sided. Ms. Shay inquired as to why the new siding was necessary. Mr. Cope said a great deal of siding would have to be replaced because of rot, but the applicant did not want to have the building's exterior consisting of half hardy-plank and half wood siding. They therefore wished to replace all of the remaining wood siding with hardiplank based on its life expectancy and maintenance. Mr. Miller stated that there would be no problem with using the hardiplank if the building were not a contributing property. Mr. Cope said that if the Board decided to mandate replacement of the siding in-kind, he would inform the owner of its decision and the owner would follow the Board's mandate. -3- HPB Minutes 9/17/03 Ms. Sexton asked about the request for casement windows and Mr. Cope explained that windows as small as 30" could be ordered and installed. They do not make the casements any smaller than that in two pieces. She further stated that the exterior siding should be wood. Ms. Shay noted that no public was present to comment. Ms. Elliott mentioned that the landscaping was the biggest contribution to wood rot and that reduction of bushes and shrubs would help. Mr. Cope said that would be the entire north side of the building. Ms. Shay noted that the landscaping strips had been reduced along the north elevation during the previous site plan approval. Ms. Jamison said that she was uncertain about the use of hardiplank fro the entire building. Ms. Shay clarified with Mr. Cope that the proposed windows are wood frame and not aluminum as stated in the staff report. After much discussion, it was moved by Mr. Keavney, seconded by Ms. Sexton and passed 6-0 to approve the Certificate of Appropriateness for building elevation changes associated with a Class I site plan modification for 131 North Swinton Avenue, Kemish Office, based upon positive findings with respect to LDR Sections 4.5.1(E)(4), (E)(8)(c) and (g), the Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation, subject to the following conditions: 1) That repairs/replacement of exterior siding be made in-kind using wood matching the profile of the existing clapboard; and, 2) That any new windows installed on the front façade be casement windows to match the light pattern of the windows on the remaining elevations. MEMORANDUM; STAFF REPORT Fr 1993 - 2UU1 U9J 2001 Agent: All American Shutters Project Name: Copeland/Bowman Residence Location: 10 NE 7th Street ITEM BEFORE THE BOARD The item before the Board is approval of a Certificate of Appropriateness for the installation of storm protection on a non-contributing residence, pursuant to LDR Section 2.4.6(J). BACKGROUND The subject property consists of Lot 22, Block 2, Del-Ida Park subdivision. The property contains a 2,250 sq. ft., two-story, frame vernacular, single family residence and a 290 sq. ft. guest cottage, both of which were constructed in 1999. The property is zoned Single Family Residential (R-1-AA) and is considered a non-contributing building within the Del-Ida Park Historic District. The Board reviewed and approved, with conditions, the construction of a 2,250 sq. ft. single family home and a 290 sq. ft. garage during its meeting of June 17, 1998. The proposal included requests for a variance to reduce the front setback to 25' and side setbacks to seven and a half feet (7.5') and a waiver to reduce the landscape strip between the driveway and the east property line to three feet (3'). Both the variance and waiver were approved as proposed. The project was completed in 1999. The applicant is now before the Board for the installation of storm protection including white, accordion shutters, rollup shutters, and removable storm panels on a non- contributing building. PROJECT=DESCRIPTION LAN ALYSIS Project Description The project involves the installation of storm protection including: white, rollup shutters, white, accordion shutters, and aluminum, storm panels. The majority of the proposed storm protection will consist of accordion shutters which are proposed on the first floor of the residence on each elevation, the side (east) and rear (south) elevations of the second floor, and on the front (north) and side (east and west) elevations of the guest cottage (see attached plan). Accordion shutters fold to the sides of the opening and secure in the middle upon the approach of a storm. A track will be permanently attached Meeting Date: October 1,2003 Agenda Item: IV.A. 10 NE 7th Street,Storm protection Del-Ida Park Page 2 at the top and bottom of the opening to provide fluid motion of the shutters. The shutters are secured at the sides of the opening when not in use. Rollup shutters are only proposed on the second floor (right) window on the front façade (over the oculus window). These shutters will be permanently affixed above the opening and will roll down vertically on a track from a housing mechanism (shutter box). Those windows on the front elevation on the second floor (center and left); all of the second floor, west elevation windows; and the two windows on the first floor on the east elevation will have removable storm panels. The panels consist of imbricated, corrugated aluminum alloy panels that will slide into a track or channel and be bolted to the building upon the approach of a storm. Only the tracks will be permanently affixed to the building. The panels will be stored when not in use. Design Elements LDR Section 4.5.1(E)(8)(g) "Development Standards" provides guidelines in evaluating Certificates of Appropriateness for the alteration or addition of exterior architectural features. The guidelines are as follows: The Board Shall Consider: (E)(8)(g) All improvement to buildings, structures, and appurtenances within a designated historic district shall be visually compatible. Visual compatibility can include but is not limited to: consistency in relation to materials, texture, and color of the facade of a building in association with the predominant material used in surrounding historic sites and structures within the historic district. Delray Beach Design Guidelines The following is a list of recommended treatments with respect to hurricane protection: Window shutters that are removable are preferred. If the tracks are to be installed year-round, they should be painted to match the exterior surface. Accordion or roll-down shutters should only be considered when they are in locations - not visible from the public right-of-way. Analysis While the residence is considered a non-contributing building within the district, installation of storm protection is still visible from the right-of-way and can have a visual impact on the district. As the building is two-story with fenestration on all elevations and many of the windows are difficult to access, it is reasonable for the applicant to request storm protection that requires minimal preparation time and minimal storage. While the proposed rollup shutters and accordion shutters can be easily utilized, they are typically 10 NE 7th Street,Storm protection Del-Ida Park Page 3 not appropriate on the front façade of a residence if viewed from the right-of-way. It is therefore recommended that removable storm panels be utilized for those openings (two, paired French doors) on the front façade as directed by the Delray Beach Design Guidelines rather than the accordion shutters. Those accordion shutters proposed for the remainder of the residence and the guest house cannot be easily viewed from the right-of-way and the tracks will readily blend in with the exterior of the building once painted. Installation of the remaining accordion shutters, once the tracks are painted to match the exterior, can therefore be supported. The proposed rollup shutters for the oculus window on the front façade, second floor is considered an unconventional shape that presents a challenge when considering storm protection options. As the window is difficult to gain access to, the shape can accommodate few alternatives, and since the window is somewhat camouflaged by the property's landscaping, installation of the roll up window can be supported for that particular window. As all of the storm protection options require some type of tracks or channels for installation, the tracks should be painted to match the exterior of the house in order to conceal their location when the shutters/panels are not in use. This has been added as a condition of approval. Based on the analysis above, positive findings with respect to LDR 4.5.1(E)(8)(g) and the Delray Beach Design Guidelines can be made for the installation of the proposed storm protection once the conditions, as stated above, are addressed. REGOMMENDATiON Approve the Certificate of Appropriateness for the installation of accordion shutters, rollup shutters, and removable storm panels on a non-contributing building located at 10 NE 7th Street, based upon positive findings with respect to LDR Section 4.5.1(E)(8)(g) and the Delray Beach Design Guidelines, subject to the following conditions: 1) That the tracks or channels for the accordion shutters, rollup shutters and storm panels are painted to match the exterior of the building; and, 2) That the proposed accordion shutters on the first floor of the front façade for the two, paired French doors be changed to removable storm panels. A. 7r ITEM BEFORE THE BOARD The action before the Board is that of approval of a Certificate of Appropriateness which incorporates the following aspects of the development proposal for 142 South Ocean Boulevard, Sandoway Nature Center, pursuant to LDR Section 2.4.5(G)(1)(c): U Class III Site Plan Modification; ❑ Design Elements; and, ❑ Variance Request. The subject property is located on the west side of South Ocean Boulevard, between Miramar Street and Ingraham Avenue. BACKGRO.UND� - The subject property consists of the south 73' of the north 100' of Lot 24 less the west 355', Beach Lots. The property is located on the west side of South Ocean Boulevard and is zoned Community Facility (CF). Designed by famed architect Samuel Ogren, the 3,688 sq. ft., frame vernacular building was constructed in 1936 and was individually listed in the Local Register of Historic Places in December 1996 and listed in the National Register of Historic Places in March 2002. In July 1995, the City of Delray Beach and Palm Beach County entered into an interlocal agreement to purchase the Sandoway property for the preservation of the historic house and to facilitate the conversion of the house to a nature center including the provision of additional parking. On October 9, 1996, the City Commission approved Ordinance No. 44-96 to rezone the Sandoway property from Medium Density Residential (RM), which did not allow the museum/community educational facility use, to Community Facilities (CF). On April 16, 1997, the Historic Preservation Board (HPB) reviewed and approved a Certificate of Appropriateness (COA) for the conversion of the single family home to the nature center. The HPB reviewed and approved a COA for the landscape plan and conversion of the swimming pool to an artificial coral reef during its meeting on November 19, 1997. During its meeting of October 18, 2000, the Historic Preservation Board reviewed and approved a COA and associated Class I site plan modification for the installation of a green, vinyl mesh awning over the rear yard swimming pool. On September 5, 2001, the Board reviewed a COA and associated variance request to reduce the side interior setback from 10' to 0' to accommodate the installation of a fabric cover for the pool equipment and a sound proof box to cover the existing pool pumps. The project was approved and completed. HPB Staff Report Sandoway Nature Center —Class Ill Site Plan Modification Page 2 The applicant is now before the Board for review of a COA and associated Class Ill site plan modification for a 529.9 sq. ft. addition to the Sandoway House, construction of an 80.6' garden shed, and a variance to reduce the side setback of the historic building. DE=VELOPMENTPROPOS°'AL The development proposal consists of the following: ➢ Construction of a 529.9 sq. ft. second-story addition on the-rear (southeast corner) of the Sandoway House; ➢ Construction of an 80.6 sq. ft. concrete block garden shed with a 48 sq. ft. covered porch; and, ➢ A variance request to LDR Section 4.3.4(K) to reduce the side (south) building setback from 10' to 5.3'. SITE PLAN MODIFICATION ANALYSIS COMPLIANCE WITH THE LAND DEVELOPMENT REGULATIONS: Items identified in the Land Development Regulations shall specifically be addressed by the body taking final action on the site and development application/request. Community Facility (CF) Zoning District Development Standards: The following table indicates that the proposal either meets or exceeds the requirements of LDR Sections 4.3.4(K) and 4.4.21(H)(2), as they pertain to the CF zoning district. HPB Staff Report Sandoway Nature Center —Class Ill Site Plan Modification Page 3 Parking Requirement Pursuant to LDR Section 4.6.9(C)(6)(g), the parking requirement for the CF zoning district is established by use. As the Sandoway Nature Center is considered a museum by use, parking is established at five (5) spaces per 1,000 square feet of floor area open to the public. The current square footage of the building is 3,688 sq. ft. Factoring in the additional square footage for the proposed second floor addition and garden shed, which totals 610.5 sq. ft., the total number of parking spaces necessary to support the enlarged facility is 22 spaces. -- In order to convert the Sandoway House from a single family residence to a public education facility/museum, the City entered into an interlocal agreement with Palm Beach County in order to provide adequate parking for the facility. Within this agreement, the City of Delray Beach provided 30 parking spaces adjacent to the site (to the south of the building), known as the Ingraham Parking Lot. Based on the required parking for the current square footage and the proposed additional square footage, 22 parking spaces are necessary. Once the parking calculation for the new proposal is factored, the existing parking lot has an excess of eight (8) spaces. VARIANCE REQUEST The applicant is requesting a variance from the 10' side interior setback requirement in order to permit the construction of a second-story addition to the historic building. Pursuant to LDR Section 4.3.4(K), the requirement for Community Facility(CF) zoning district is 10'around the perimeter of the property. The current side setback measures 5.3' based on the existing footprint of the building. Required Findings Pursuant to LDR Section 4.5.1(J), in addition to the required findings of LDR Section 2.4.7(A)(5) (copy attached), the Board may also be guided by the following as an alternative to the above criteria: (1) That a variance is necessary to maintain the historic character of property through demonstrating that: (a) A variance would not be contrary to the public interest, safety, or welfare; (b) Special conditions and circumstances exist, because of the historic setting, location, nature, or character of the land, structure, appurtenances, sign, or building involved, which are not applicable to other lands, structures, appurtenances, signs, or buildings in the same zoning district, which have not been designated as historic sites or a historic district nor listed on the Local Register of Historic Places; (c) Literal interpretation of the provisions of existing ordinances would alter the historic site to such an extent that it would not be feasible to preserve the historic character, of the historic district or historic site;and, (d) The variance requested is the minimum necessary to preserve the historic character of a historic site or a historic district. HPB Staff Report Sandoway Nature Center —Class Ill Site Plan Modification Page 4 (2) Or, as an alternative to Sub-Section (J)(1), that a variance is necessary to accommodate an appropriate adaptive reuse of a structure within a Historic District or upon a Historic Site through demonstrating that: (a) A variance would not be contrary to the public interest, safety, or welfare; (b) The variance would not significantly diminish the historic character of the Historic District or Site; and, (c) That the variance requested is the minimum necessary to effect the adaptive reuse of an existing structure or site. (3) The Board shall otherwise follow procedures and impose conditions as required of the Board of Adjustments. Analysis The variance would allow a second-story addition on the existing, non-conforming historic building. Granting the variance would not be contrary to the public interest, safety, or welfare based on the fact that the proposed addition is adjacent to_a public parking lot and is set back 44.5' from the residentially zoned property to the west. Special conditions and circumstances exist due to the historic nature of the property and based on the use of the surrounding lots as public parking. Further, as the addition is proposed on the second story within the existing footprint of the extant building, the addition will not further encroach into the side setback. The second-story addition will be constructed above the 24.83' portion of the building which currently encroaches into the side setback. Therefore, the variance requested is the minimum necessary to sustain the adaptive reuse of the existing, historic building. Given the conditions under which this variance is being requested it is reasonable to believe that the variance would be granted elsewhere under similar circumstances. Therefore, positive findings to reduce the side (south) set back from 10' to 5.3' can be made with respect to LDR Section 4.5.1(J) and 4.3.4(K). PROJECT DESCRIPTION/ANALYSIS LDR Section 4.5.1(E)(4), (E)(7) and (E)(8) "Development Standards" provides guidelines in evaluating Certificates of Appropriateness for the alteration or addition of exterior architectural features. These guidelines are as follows: The Board Shall Consider: (E)(4) A historic site, or building, structure, site, improvement, or appurtenance within a historic district shall be altered, restored, preserved, repaired, relocated, demolished, or otherwise changed in accordance with the Secretary of the Interior's Standards for Rehabilitation, as amended from time to time. (E)(7) The construction of new buildings or structures, or the relocation, alteration, reconstruction, or major repair or maintenance of a non-contributing building or 4tructure within a designated historic district shall meet the same compatibility HPB Staff Report Sandoway Nature Center —Class Ill Site Plan Modification Page 5 standards as any material change in the exterior appearance of an existing non- contributing building. Any material change in the exterior appearance if any existing non-contributing building, structure, or appurtenance in a designated historic district shall be generally compatible with the form, proportion, mass, configuration, building material, texture, color, and location of historic buildings, structures, or sites adjoining or reasonably approximate to the non-contributing building, structure, or site. (E)(8) All improvement to buildings, structures, and appurtenances within a designated historic district shall be visually compatible. Visual compatibility can include but is not limited to: (a) height, (c) proportion of openings, (g) consistency in relation to materials, texture, and color of the façade of a building in association with the predominant material used in surrounding historic sites and structures within the historic district (h) roof shapes, and (j) scale of a building. Delray Beach Design Guidelines Additions Locate an addition as inconspicuously as possible, usually to the rear or least public side of a building. When possible, design and construct the addition so that the basic form and character of the historic building would remain intact if the addition were ever removed. Do not introduce a new architectural style, or too closely mimic the style of the existing building. Additions should be simply and cleanly designed and NOT attempt to replicate the original design. Accessory Structures New accessory structures should compliment the principal building and should be located to either the rear or the side of the principal building. Secretary of the Interior's Standards for Rehabilitation The historic character of a property shall be retained and preserved. The removal of historic materials or alteration of features and spaces that characterize a property shall be avoided. Each property shall be recognized as a physical record of its time, place, and use. Changes that create a false sense of historical development, such as adding conjectural features or architectural elements from other buildings shall not be undertaken. New additions, exterior alterations, or related new construction, shall not destroy historic materials that characterize the property. The new work shall be differentiated from the old and shall be compatible with the massing, size, scale, and architectural features to protect the historic integrity if the property and its environment. HPB Staff Report Sandoway Nature Center —Class Ill Site Plan Modification Page 6 New additions and adjacent or related new construction shall be undertaken in such a manner that if removed in the future, the essential form and integrity of the historic property and its environment would be unimpaired. Project Description The proposal involves the construction of a 529.9 sq. ft., second floor addition to the rear of the building (including the covered landing) and an 80.6 sq.-ft. shed to be located at the northwest corner of the property. The addition will measure 19'10" x 24'10" and will include a 6'0" x 6'0" covered landing. The addition will have a median height of 23' and will be constructed of wood frame with board and batten siding, 6/6 single hung sash, wood windows, and shingle, hip roofs to match that found on the remainder of the second floor. The addition will be constructed on what is currently a landing over the first floor and will therefore not increase the building's footprint. An existing stairwell, providing access to the first floor, will remain as a second means of egress from the second floor. The proposed garden shed will measure 10'8" x 8'0" (excluding the 12'0" x 4'0" covered porch) with a median height of 11' and will be wood frame and display clapboard siding, paired, divided light French doors, and a shingle, hip roof to compliment the adjacent frame building. An existing concrete slab is located at the northwest corner of the property. The new shed will be constructed in the same general location as the previous shed, however, the proposed shed does not encroach into the setbacks. Analysis Construction of the addition and the garden shed will not negatively impact the contributing status of the historic building as the addition is proposed to the rear of the building as directed by the Delray Beach Design Guidelines and the Secretary of the Interior's Standards for Rehabilitation. The shed will not encroach into the setbacks, however, the second story addition on the building will encroach into the side setback by 4.7' thus requiring approval of a variance (see analysis above). Neither the addition nor the shed will exceed the maximum height of 48'. Both will be painted white with green trim to match the existing color scheme. The proposed addition and garden shed are pragmatic in design and are consistent with those design elements, scale, and massing displayed on the original historic building. While the addition does compliment the original design elements of the building it blends into the building too seamlessly and should be differentiated more clearly from the original building in order to be noted as a recent addition. It is therefore recommended that the second floor addition display a varied type of siding in order to be differentiated from the original. Positive findings can be made with respect to LDR Sections 4.5.1(E)(4), (E)(7), and (E)(8)(a, c, g, h, and j), the Delray Beach Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation provided the condition of approval is addressed. • HPB Staff Report ` Sandoway Nature Center —Class Ill Site Plan Modification Page 7 REQUIRED FINDINGS Pursuant to LDR Section 2.4.5(G)(1)(c)(Class III Site Plan Modification), a Class III site plan modification is a modification to a site plan which represents either a change in intensity of use, or which affects the spatial relationship among improvements on the land, requires partial review of Performance Standards found in LDR Sections 3.1.1 and 3.2.3, as well as required findings of LDR Section 2.4.5(G)(5). Pursuant to LDR Section 2.4.5 (G)(5) (Findings), with a Crass III site plan modification formal findings under Section 3.1.1 are not required. However, a finding that the proposed changes do not significantly affect the originally approved plan must be made concurrent with approval of a Class III modification. The development proposal involves construction of a 529.9 sq. ft. second-story addition on the historic building and construction of an 80.6 sq. ft garden shed and associated variance. Pursuant to LDR Section 2.4.5(G)(5), this minor modification does not significantly impact the findings as they relate to consistency with the Future Land Use Map, Concurrency or the Comprehensive Plan. Compliance with the Land Development Regulations was discussed earlier in this report. The development proposal has a minor impact on Concurrency items as discussed below. Traffic Based on the increase in square footage to 4,298.5, the 610.5 sq. ft. museum building addition and shed will generate an additional four (4) average daily trips which can readily be accommodated on the adjacent roadways. The projected increase will therefore not negatively impact the traffic flow of the surrounding area. Solid Waste Requirements The proposed 4,288.5 sq. ft. museum (3,688 sq. ft. and the 610.5 sq. ft. addition and shed) will generate 3.43 tons of solid waste per year [(4,217.9 sq.ft. x 1.6 lb./sq.ft./year = 6,861.6 lbs/2,000 lb. = 3.43 tons)]. The Solid Waste Authority indicates in its annual report that the established level of service standards for solid waste will be met for all developments until 2021. ASSESSMENT AND—CONCLUSION The development proposal consists of a 529.9 sq.ft. addition on the rear (west) elevation of the Sandoway House and construction of an 80.6 sq. ft. garden shed. The proposed addition will increase the required parking to 22 spaces, however, per the interlocal agreement, 30 spaces are available in the parking lot to the south for this facility. The proposed design elements for the addition and the shed are complimentary to the extant historic building though the addition is not adequately differentiated from the original and should be easily distinguishable from the original exterior, which is attached as a condition of approval. The development proposal will be consistent with the policies of Chapter 3 of the Land Development Regulations and the Comprehensive Plan. The variance requested is the minimum necessary to permit the adaptive reuse of the existing building. Given the conditions under which this variance is being requested, it is reasonable to believe that the variance would be granted elsewhere under similar circumstances. Based upon the above, positive findings can be made with respect to LDR Sections 4.3.4(K), 4.5.1 (J) and 4.5.1(E)(8)(a, c, g, h, and j) once the condition of approval, as stated in the staff report, has been addressed. : ALTERNATIVE ACTIONS A. The subject property is located on the south side of NE 12th Street, approximately 300' east of North Swinton Avenue. Originally located at 1125 Vista Del Mar Drive, the Sears & Roebuck kit house, constructed in 1937, was relocated to its present location in September 2003 due to a threat of demolition. During its meeting on June 18, 2003, the Historic Preservation Board reviewed the designation report for the relocated dwelling. At its meeting of July 16, 2003, the Board held a public meeting to discuss the proposed designation and recommended to the City Commission approval for the individual historic property designation. On August 19, 2003, the City Commission on second reading approved Ordinance No. 25-03, to individually list the historic property in the Delray Beach Local Register of Historic Places. The applicant is now before the Board for an elevation change to create an entrance on the front of the building and to request a waiver to allow the development of Lot 9, Block 6, Dell Park. PROJECT.DESCRIPTION, The two-story, four bay, frame house displays wood shiplap siding, casement windows, a front-facing gable entryway, and side-facing gable roof with two symmetrical, gabled dormers. A chimney lies to the west of the center of the building, asymmetrical to the entryway. The façade is symmetrical with the exception of the one-story extension on Meeting Date: October 1, 2003 Agenda Item: III.B. The proposal includes the orientation of the building with the original front façade (displaying dormers) facing the side interior (east property line), due to the lot configuration. This re-orientation mandates the creation of a new entrance on the north elevation in order to maintain the solids to voids pattern consistent with the surrounding neighborhood. The new entrance will include the installation of a gable hood with decorative knee braces which are intended to mimic the front facing gable roof above. The door hood will shelter a multi-light single, panel door which is centered on the north elevation to provide access on the front façade into the first floor of the house. Development of the non-conforming lot requires approval of a waiver by the City Commission. Analysis of this request follows. WAIVER ANALYSIS. The waiver request is to allow the development of Lot 9, Block 6, Dell Park, a vacant lot that does not currently meet the minimum lot requirements of 75' width and frontage or the minimum square footage of 9,500 square feet of the R-1-AA zoning district. The non-nonconforming lot measures 50' x 140' and is 7,000 square feet in area. The lot is currently owned by the adjacent property owner (also the applicant for this proposal) to the east of Lot 9 that encompasses the west half of Lot 7 and all of Lot 8 and measures 75'x140'. According to LDR Section 4.1.4(C), if two (2) or more adjoining lots of record are under the same ownership they shall not be developed except in accordance with the minimum frontage and the lot area requirements. Approval of the waiver would allow the relocated house to be permanently located on Lot 9 also known as 102 NE 12th Street, adjacent to the owner's current residence at 106 NE 12th street (the west half of Lot 7 and all of Lot 8, Block 6, Dell Park). REQUIRED FINDINGS: Pursuant to LDR Section 2.4.7(8)(5), prior to granting a waiver, the granting body shall make findings that the granting of the waiver: a) Shall not adversely affect the neighboring area; b) Shall not significantly diminish the provision of public facilities; c) Shall not create an unsafe situation; and, d) Does not result in the grant of a special privilege in that the same waiver would be granted under similar circumstances on other property for another applicant or owner. Immediately west of the subject property there are three 50' wide lots, each occupied by a single family home. To the north, across the street, exists single family homes on 50', 60', and 65' wide lots. The predominant development pattern along this section of NE 12th Street (between Swinton Avenue and NE 2nd Avenue) consists of single family homes constructed on lots less than the required 75' width and 9,500 sq. ft. area, with 50' being the prevailing lot width. Based on the existing development pattern, the waiver can be supported. Amelung House-102 NE 12th Street Elevation Changes&Waiver Request Page 3 Given the discussion above, the waiver request will not adversely the neighboring area or is a special privilege being granted as other non-conforming lots already exist in the neighborhood. No public facilities will be at risk and no unsafe situations shall be formed by the granting of this waiver. Therefore, positive findings with respect to LDR Section 2.4.7(B)(5) can be made. ANALYSIS . . LDR Section 4.5.1(E)(8)(g) "Development Standards" provides guidelines in evaluating Certificates of Appropriateness for the alteration or addition of exterior architectural features. The guidelines are as follows: The Board Shall Consider: (E)(4) A historic site, or building, structure, site, improvement, or appurtenance within a historic district shall be altered, restored, preserved, repaired, relocated, demolished, or otherwise changed in accordance with the Secretary of the Interior's Standards for Rehabilitation, as amended from time to time. (E)(8) All improvements to buildings, structures, and appurtenances shall be visually compatible. Visual compatibility shall be determined in terms of the following criteria: (b) Front Facade Proportion: The front façade of each building or structure shall be visually compatible with and in direct relationship to the width of the building and to the height of the front elevation of either adjacent or adjoining buildings within a historic district. (c) Proportion of Openings (Windows and Doors): The openings of any building within a historic district shall be visually compatible with the openings exemplified by the prevailing historic architectural styles within the district. The relationship of the width of windows and doors to the height of windows and doors among buildings within the district shall be visually compatible. (d) Rhythm of Solids to Voids: Front Facades: The relationship of solids to voids in the front facade of a building or structure will be visually compatible with the front facades of historic buildings or structures within the district. (e) Rhythm of Buildings on Streets: The relationship of buildings to open space between them and adjoining buildings shall be visually compatible with the relationship between historic sites, buildings, or structures within a historic district. (f) Rhythm of Entrance and/or Porch Projections: The relationship of entrances and porch projections to the sidewalks of a building shall be visually compatible with the prevalent architectural styles of entrances and Amelung House-102 NE 12th Street Elevation Changes &Waiver Request Page 4 porch projections on historic sites, buildings, and structures within a historic district. (g) Relationship of Materials, Texture, and Color: The relationship of materials, texture, and color of the facade of a building shall be visually compatible with the predominant materials used in the historic sites, buildings, and structures within a historic district. (k) Directional Expression of Front Elevation: A building shall be visually compatible with the buildings, structures, and sites in its directional character, whether vertical, horizontal, or non-directional. The following is suggested by the Delray Beach Design Guidelines regarding relocation: Location is an important element in satisfying the integrity requirement. The location, (the place where the property was constructed or the place where the historic event occurred), is important in determining its character, why it was created, and its relationship to the history of the area. If a property is moved, it may lose its historic significance unless it can be demonstrated that: • The new location is sufficient in size and character to recall the basic qualities of the original historic environment and setting; • The property is oriented appropriately in relationship to its historic natural and/or manmade surroundings; and, • The relationships between such historic features as landscaping and foundations are maintained. The Secretary of the Interior's Standards for Rehabilitation suggest the following: The historic character of a property shall be retained and preserved. The removal of historic materials or alteration of features and spaces that characterize a property shall be avoided. Each property shall be recognized as a physical record of its time, place, and use. Changes that create a false sense of historical development, such as adding conjectural features or architectural elements from other buildings shall not be undertaken. Deteriorated historic features shall be repaired rather than replaced. Where the severity of deterioration requires replacement of a distinctive feature, the new feature shall match the old in design, color, texture, and other visual qualities and, where possible, materials. New additions, exterior alterations, or related new construction, shall not destroy historic materials that characterize the property. Amelung House-102 NE 12th Street Elevation Changes &Waiver Request Page 5 Conclusion The proposal includes the creation of a new gable entrance on the single family home and a waiver request to permit the accommodation of the historic single family home. While the orientation of the building is not that of its original design, the re-orientation and alteration to the front elevation can be supported based on the retention of the historic home (being saved from demolition), consistency with the solids to voids pattern on the front elevation, and that the proposed alterations are complimentary and reversible and are the minimum required to accommodate the adaptive use of the building in its new location. Based on the analysis above, positive findings with respect to the LDR Sections 4.5.1(E)(4), and (E)(8)(b-g) and (k), the Delray Beach Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation can be made. REVIEW BY OTHERS; On September 18, 2003, the Delray Beach Board of Adjustment reviewed and approved a variance request (5-0) to reduce the side (west) setback from 10' to 4'8" for Lot 8, Block 6, a portion of the property at 106 NE 12th Street which lies adjacent to (east of) the historic house at 102 NE 12th Street. The variance allows the retention of an existing guest cottage to the rear (southwest corner) of the property on Lot 8. This was submitted in anticipation of the proposed waiver to facilitate the placement of the historic house on Lot 9. AL-TERNATIVE AC:TIONS. . A. Continue with direction. B.
