CALL TO ORDER The meeting was called to order by the Chairperson at 6:02 P.M. Upon roll call it was determined that a quorum was present. MEMBERS PRESENT: Mary Lou Jamison, Gloria Elliott, Gail Lee McDermott, Jim Keavney, Rhonda Sexton (arrived at 6:10). MEMBERS ABSENT: Bill Branning, Francisco Perez STAFF PRESENT: Wendy Shay II. APPROVAL OF MINUTES The original motion for approval of January 15, 2003 was amended by Ms. McDermott to include the minutes collectively. The motion was seconded by Mr. Keavney and passed 4-0 as stated below. The Minutes for the Public Hearings/Regular Meetings on January 15, 2003, February 5, 2003, and February 19, 2003 were before the Board for consideration. Ms. McDermott made a motion to approve the minutes as written. The motion was seconded by Mr. Keavney and passed 4-0. III. CERTIFICATES OF APPROPRIATENESS A. McKeever/Fischer Residence, 255 North Swinton Avenue, Old School Square Historic, District, Bruce McKeever& Lori Fischer, Owners. Action Before the Board: The item before the Board is to approve a COA for the construction of a shed in the Old School Square Historic District, pursuant to LDR Section 2.4.6(J). Ms. Shay entered the project file into the record and presented the item to the Board. Ms. McDermott inquired about paint colors. Ms. Shay stated that the pre-fabricated shed comes with a white powder-coated finish and the applicant felt that painting it would be a maintenance issue. Mr. Keavney noted that the shed was already on site. Ms. Shay agreed and stated that the applicant had requested COA approval prior to delivery but that if the Board denied the request, they would have to relocate the shed off of the property. It was moved by Ms. Elliott, seconded by Ms. McDermott and passed 4-0 to approve the installation of a shed at 255 North Swinton Avenue based upon positive findings with respect to LDR Sections 4.5.1(E)(4), (E)(7), and (E)(8)(a), (b), (g), (h), (j) and the Delray Beach Design Guidelines. B. Old School Square Office Building, 75 NW 1st Avenue, Old School Square Historic District, Designer Sign Systems, Authorized Agent. Action Before the Board: The action requested of the Board is a COA for the installation of a free-standing sign for 75 NW 1st Avenue, Old School Square Office Building, pursuant to LDR Section 2.4.6(J). Ms. Shay entered the project file into the record and presented the item to the Board. Ms. Shay stated that the original design of the sign was a monument sign, however, the applicant has revised the design to a free-standing sign and that staff supported the revision. Ms. McDermott inquired about whether the applicant will request another sign. Ms. Shay stated that it was the applicant's right to request an additional sign at a later date but that the sign design as presented provides adequate signage for the building and its tenants. After much discussion, it was moved by Ms. McDermott, seconded by Mr. Keavney and passed 5-0 to approve the installation of a free-standing sign for 75 NW 1st Avenue, Old School Square Office Building, based upon positive findings with respect to LDR Section 4.6.7(G)(1)(b), (G)(2)(b), (G)(3)(d), (G)(7)(c), and (H)(2)(a-c) and the City's Design Guidelines, subject to the following condition: 1) That the sign text be reduced to 30 sq. ft. in order to meet the sign requirements for square footage. -2- HPB Minutes 5/7/03 IV. Ms. Shay stated that the colors will remain the same. D. Staff: Karen Schell, from the City Clerk's Office, requested that any Board Member who wishes to return as their term ends to please contact her (specifically Ms. Elliott and Mr. Branning). Ms. McDermott requested a support letter from staff and the Chairperson for a State grant for the Milton-Myers Legion Post. Both Ms. Shay and Ms. Jamison agreed to do so. Ms. Elliott inquired about paint color approval. Ms. Shay stated that any building painted without approval must come in after the fact for administrative approval. If it is controversial it will be presented to the Board for review and approval. Mr. Keavney inquired about painting natural finished. Ms. Shay stated that the design guidelines discourage painting any natural finish, however, if it has been painted in previous years, the owner would not be required to strip the paint but could chose to do so. BACKGROUND/PROJECT DESCRIPTION The subject property consists of Parcel 2 of the Stratford Atta Bowe Plat and is located on the east side of North Swinton Avenue, approximately 80' south of NE 3rd Street. The property is located within the Old School Square Historic District and is zoned OSSHAD (Old School Square Historic Arts District). The interior lot contains a one-story frame vernacular house constructed in 1940. The 1,468 sq. ft. dwelling lies at 255 N. Swinton Avenue and displays wood board and batten and lap siding, exposed rafter tails, and modern single light and metal casement windows. On October 7, 1998, the Historic Preservation Board approved COA 360 to relocate the contributing house from its original site at 116 S. Swinton Avenue to its present location with the condition that the owners would return for review of a landscape plan and any proposed exterior changes. The Board also approved the demolition of a detached garage, constructed in 1952, located adjacent to the historic dwelling. During its meeting on November 17, 1999, the Board reviewed and approved a landscape plan, paving, and the installation of a six foot (6') wood privacy fence at the rear yard (associated with the new site plan) subject to the condition that the rear maneuvering area proposed be eliminated. This original parking configuration allowed two cars to park in tandem along the northern elevation of the house. The applicant submitted a COA for a Staff Review on August 1, 2002. The applicant requested to extend the driveway to the northeast corner of the house and to change the driveway material from pavers to chattahoochee. The applicant also requested to install fencing and gates between the southwest and northeast corners of the dwelling and the north and south property lines. Both requests were reviewed and approved by Staff on August 1, 2002. Agenda Item: III.A. Meeting Date: May 7, 2003 McKeever/Fischer Shed COA 2003-188 255 North Swinton Avenue Page 2 During its meeting of November 6, 2002, the Board reviewed and approved a COA request and associated waiver to reduce the five foot (5') driveway setback requirement to two (2') along the north property line in order to accommodate the construction of a 10' driveway with a 2' planting strip on the north side of the property. In association with the rehabilitation of the house, the driveway has been constructed and associated landscaping has been installed. The applicant is currently requesting consideration of a COA for the installation of a shed and is now before the Board for review and approval. PROJECT DESCRIPTION/ANALYSIS Project Description The proposed project involves the installation of a pre-fabricated storage shed. The shed measures 8'x10' and is approximately 8'8" in height at the apex of the roof. The aluminum frame shed displays a front access door and gable roof with aluminum lap siding throughout the exterior including the roof. The pre-fabricated exterior has an enamel coated white finish. Development Standards LDR Section 4.5.1(E)(4), (E)(7), and (E)(8)(a-k) "Development Standards" provides guidelines in evaluating Certificates of Appropriateness for the alteration or addition of exterior architectural features. The applicable standards are as follows: (E)(4) A historic site, or building, structure, site, improvement, or appurtenance within a historic district shall be altered, restored, preserved, repaired, relocated, demolished, or otherwise changed in accordance with the Secretary of the Interior's Standards for Rehabilitation, as amended from time to time. (E)(7) The construction of new buildings or structures, or the relocation, alteration, reconstruction, or major repair or maintenance of a non-contributing building or structure within a designated historic district shall meet the same compatibility standards as any material change in the exterior appearance of an existing non-contributing building. Any material change in the exterior appearance if any existing non-contributing building, structure, or appurtenance in a designated historic district shall be generally compatible with the form, proportion, mass, configuration, building material, texture, color, and location of historic buildings, structures, or sites adjoining or reasonably approximate to the non-contributing building, structure, or site. (E)(8) All improvement to buildings, structures, and appurtenances within a designated historic district shall be visually compatible. Visual compatibility can include but is not limited to: consistency in relation to materials, texture, and color of the façade of a building in association with the predominant material used in surrounding historic sites and structures within the historic district. McKeever/Fischer Shed COA 2003-188 255 North Swinton Avenue Page 3 Analysis Based on LDR Sections 4.5.1 (E)(8)(a), (b), (g), (h), and (j), the shed must compliment the existing historic dwelling in relation to height, proportion of the front facade, relationship to materials, colors, and textures, roof shapes, and scale. Currently, the structure meets the requirements as stated above and displays a continuity of design in relation to fabric, texture, color, roof shape, scale, and massing. The shed will be installed at the northeast corner of the property and will meet the minimum side (7'6") and rear (10') setback requirements and will not negatively affect the surrounding properties. Based on this analysis, positive findings can be made with respect to LDR Sections 4.5.1(E)(8)(a), (b), (g), (h), and (j) and the City's Design Guidelines. ALTERNATIVE ACTIONS A. Continue with direction. B. Approve COA 2003-188 for installation of a shed at 255 North Swinton Avenue, based upon positive findings with respect to LDR Sections 4.5.1(E)(4), (E)(7), and (E)(8)(a), (b), (g), (h), (j) and the Delray Beach Design Guidelines. C. Deny COA 2003-188 for installation of a shed at 255 North Swinton Avenue, based on a failure to find positive findings with respect to LDR Sections 4.5.1(E)(4), (E)(7), and (E)(8)(a), (b), (g), (h), (j) and the Delray Beach Design Guidelines with the basis stated. RECOMMENDATION Approve COA 2003-188 for the installation of a shed at 255 North Swinton Avenue based upon positive findings with respect to LDR Sections 4.5.1(E)(4), (E)(7), and (E)(8)(a), (b), (g), (h), (j) and the Delray Beach Design Guidelines. BACKGROUND The subject property consists of Lot 1, Block 60, Town of Delray and is zoned Old School Square Historic Arts District (OSSHAD). Located at the southeast corner of NW 1st Street and NW 1st Avenue, the property contains a 9,300 sq. ft. two-story office building. Constructed in 2000, the contemporary building displays detailed frame vernacular architectural details such as knee brackets, turned posts, and divided light windows and doors. During its meeting of May 3, 2000, the Historic Preservation Board reviewed and approved a Class V Site Plan, Landscape Plan, and Design Elements for the construction of a new 9,300 sq. ft., two-story office building. The COA included a request for demolition and an associated variance and waivers. The project was completed as approved. The applicant returned to the Board on August 1, 2001 for a modification to change the previously approved impact resistant metal shutters for decorative wood shutters. The shutters were subsequently approved and installed. The applicant is now before the Board for the installation of a free-standing sign. PROJECT DESCRIPTION The project consists of the installation of a single-sided, free-standing sign. The proposed sign will be constructed of urethane intended to mimic the look of wood with a sandblasted finish. The proposed color scheme includes white frame posts and font with a forest green background which will compliment the colors found on the building. Old School Square Office Building 2003-113-COA 75 NW 1st Avenue The sign's decorative, curvilinear frame will display the building's street number and text which will read "Historic District Old School Square Office Building." Five individual panels will be displayed below the frame (attached directly to the posts) listing the individual tenants. Decorative posts and caps will complete the design of the frame. The proposed sign measures approximately 80" (6'8") in height and 60" (5'0") in width totaling 33.3 sq. ft. The sign will be angled to face the street at the corner of NW 1st Street and NW 1st Avenue in order to meet the 40' site visibility triangle lying approximately 10' off of the building's northwest elevation. No lighting is proposed at this time. ANALYSIS The Board shall consider: SIGN REGULATIONS AND DESIGN GUIDELINES LDR Section 4.6.7 (G)(1)(b) addresses Sign Design Standards for "Free-standing signs" A free-standing sign is not affixed to any other structure. It may be either a pole sign or a monument sign. Neither the pole nor the base of the monument shall be considered in calculation of the area of the sign face. A free-standing sign may not have more than two faces. LDR Section 4.6.7 (G)(2)(b) addresses "Conformity with Surroundings" and states: The scale of the sign, in terms of area, shall be consistent with the scale of the building on which it is to be painted and the neighborhood and streetscape where it is to be located; but in no case shall it exceed the height limitations set forth in Subsection (7). LDR Section 4.6.7 (H)(2)(a)-(c) addresses "Aesthetic Qualifications and Standards" The aesthetic quality of a building, or indeed of an entire neighborhood, is materially affected by achieving visual harmony of the sign on or about a structure as it relates to the architecture or the building or the adjacent surroundings. In addition to the mechanical limitations on signs imposed in Subsections (G) and (I), the following aesthetic conditions must be met. Scale: The scale of the sign must be consistent with the scale of the building on which it is located or painted and the neighborhood in which it is located. Scale shall also be considered in terms of Subsection (G) with respect to height and area. Meeting Date: May 7,2003 Agenda Item: III.B. "Garish" signs are those that are too bright or gaudy, showy, glaring, and/or cheaply brilliant or involving excessive ornamentation. Conflict: The colors of a sign shall not conflict with other signs already on the building or in the immediate vicinity. Design Guidelines The Delray Beach Design Guidelines state the following pertaining to signage: Sign design and placement in an historic district or a historic site is an important element. While preservationists believe the building facade is the best sign an owner may have, the need for design guidelines refines the existing regulations adapting them to the particular character of the specific location and site. The district's character is maintained when signage does not cause visual disruption. The sign should not obscure any architectural feature or detail, or interrupt the views and appreciation of the building. Signage should compliment and not overwhelm or compete with the established architecture. The Secretary of the Interior's Standards for Rehabilitation No direct reference is made to signage affecting historic structures, sites, or districts, however, there is specific intent to project the importance of preserving "character- defining" and distinctive features, and discussing scale and compatibility with respect to new construction for historic structures and districts. One such standard states: New additions, exterior alterations, or related new construction shall not destroy historic materials that characterize the property. The new work shall be differentiated from the old and shall be compatible with the massing, size, scale, and architectural features to protect the historic integrity of the property and its environment. Conclusion The proposed sign design, dimensions, location, and color palette are appropriate in relation to the style, scale, massing, and design of the building as well as its relation to the surrounding commercial signage. The proposed overall sign height will be 80" (6'8") with an area of approximately 33.3 sq. ft for the sign body. Although the sign will not interfere with the line of sight of the two-story building's façade or interfere with the site visibility triangle, the proposed square footage will not meet the free-standing sign requirements pursuant to LDR Section 4.6.7(G)(7), which states that a sign may be placed within the front yard setback if the sign face measures no more than 30 sq. ft. Old School Square Office Building 2003-113-COA 75 NW 15t Avenue the proposed sign exceeds the 30 sq. ft. requirement, it is recommended that the text on the frame be reduced to accommodate the 30 sq. ft. requirement. Based on this condition, positive findings with respect to LDR Section 4.6.7, the City's Design Guidelines, and the Secretary of the Interior's Standards can be made. REVIEW BY OTHERS During its meeting of April 25, 2003, the Delray Beach Sign Review Committee reviewed and approved the free-standing sign as proposed with the condition that the frame area be reduced from 33.3 sq. ft. to 30 sq. ft. in order to meet the requirements of LDR Section 4.6.7(G)(7)(c). ALTERNATIVE ACTIONS A. Continue with direction. B. Approve COA 2003-113 for the installation of a free-standing sign for 75 NW 1st Avenue, Old School Square Office Building, based upon positive findings with respect to LDR Section 4.6.7.(G)(1)(b), (G)(2)(b), (G)(3)(d), (G)(7)(c), and (H)(2)(a-c), and the City's Design Guidelines, subject to conditions. C. Deny COA 2003-113 for the installation of a free-standing sign for 75 NW 1st Avenue, Old School Square Office Building, based upon a failure to make positive findings with respect to LDR Section 4.6.7.(G)(1)(b), (G)(2)(b), (G)(3)(d), (G)(7)(c), and (H)(2)(a-c) and the City's Design Guidelines with the basis stated.
