I. ROLL CALL:
The meeting was called to order by the Chairperson at 6:00 P.M. Upon roll call it
was determined that a quorum was present.

II. APPROVAL OF MINUTES:
The Minutes for the Regular Meeting of February 16, 2000 were before the
Board for consideration. Mr. Ames moved to approve the Minutes as presented.
The motion was seconded by Ms. Jamison and passed 5-0 (Johnson
abstaining).
III. PUBLIC HEARING ITEMS:
A. Variance 65 & COA 334-Continuation: Sundy Inn, 106 S. Swinton
Avenue, Old School Square Historic District. Michelle Balfoort, Balfoort
Finnvold Architects/Authorized Agents.
Item Bofore the Board: The action requested of the Board is that of
considering granting a variance pertaining to the side street building
setback requirements and approval of the associated COA.
Chairperson Hurlburt sated that this was a Quasi-Judicial item. Therefore,
anyone wishing to speak on this item would have to be sworn in.
Board Secretary Diana Mund asked that anyone wishing to speak raise
their right hand and then administered the oath.
Chairperson Hurlburt declared the Public Hearing open, as there was no
one wishing to speak the Public Hearing was closed.
It was moved by Mr. Ames, seconded by Mr. Keller and passed 6-0 to
grant Variance 65 based upon positive findings with respect to LDR
Section 4.5.1(J)(2), to reduce the side street setback to 3' 10", to allow a
walk-in freezer to be installed as indicated on the site plan, with the
following condition:
• That if the trellis and landscaping on top of the 6' high wall to the north
is ever demolished, so that the upper portion of the freezer is visible to
the street, the HPB may require that siding or another embellishment
be installed on the exterior of the freezer.
It was moved by Mr. Ames, seconded by Mr. Keller and passed 6-0 to
approve COA 334-Cotinuation as presented, based upon positive findings
with respect to LDR Section 4.5.1(E) for the Design Elements for the walk-
in freezer.
IV. CERTIFICATES OF APPROPRIATENESS:
A. COA 399-Continuation: Silberstein Architects International Office
Building, 219 NE 1st Avenue, Bankers Row, Old School Square Historic

Item Before the Board: The action requested of the Board is that of
considering a change of roof shingle material from the previously
approved light gray to black.
Mrs. Cayce informed the Board that Mr. Silberstein had with drawn his
petition.
V. DISCUSSION AND ACTION ITEMS:
A. Review of the City Marina Improvement Plan which is Located in the
Marina Historic District. Presented by Joe Dragon, Assistant Director of
Parks & Recreation and David Miller, architect for the project.
Mr. Miller stated that he welcomed the Board's comments and that as the
plans were not yet finalized he would take into consideration any
suggestions that were forthcoming. The Board had some concerns with
the concept of "driving through a parking lot" created by the one way
street with angled parking on either side. Mr. Miller will return for review
as the plans become more solidified and for a COA when the plan is
complete.

VI. REPORTS AND COMMENTS:
A. Reports from Historic District Representatives
Mrs. Riley expressed concern that the proposed parking lot for the City
Marina would be utilized by the Harbor House Apartment/Hotel and that
the existing green space within the marina would be reduced in size.
B. Board Members
Mr. Ames stated that 706 SE 2nd Street and the house to the north were
for sale and a prospective buyer wanted to demolish the homes on the
properties and build a larger house.
Mr. Ames stated that the Cherry house at the northwest corner of Nassau
Street and A-1-A was also for sale and as the property was zoned RM a
prospective buy wanted to move or demolish the existing house and build
a four-plex.
C. Staff
Mrs. Cayce informed the Board that the Police Department wanted to
demolish the 1902 Williams house at 114 NW 4th Avenue as it has
become a crack house. The Board felt that the house should be saved
and requested that a letter to this affect be written on their behalf.
Ms. Cayce informed the Board that the coral rock house at 86 SE 6th
Avenue will be a candidate for demolition. The Delray Beach Historical
Society is looking at it for relocation as an addition to the Cason Cottage
site.
VII. ADJOURNMENT:
There being no further business before the Board, Ms. Jamison moved to
adjourn the meeting at 7:15 P.M., seconded by Ms. McDermott and passed 6-0.

provided herein is the Minutes of the meeting of said body for March 1, 2000, which

The action requested of the Board is that of granting a variance to LDR Section
4.3.4(K), pertaining to the side street building setback requirements for property located
in the OSSHAD (Old School Square Historic Arts District) zoning district; and approval
of the COA associated with the variance request.

Variance
The request is to reduce the side street setback to 3' 10" where 15' is required. If
granted the variance will allow a walk-in freezer associated with the Sundy Inn
restaurant to be installed behind a 6' high privacy wall. The freezer is to be 8' 11" in
length, 6' 10" in width, 7' 8" in height, and will be painted to match the existing buildings
(yellow with white trim). On the top of the 6' high privacy wall is a 2' 6" high trellis, which
is heavily planted, thus the freezer will be effectively screened from the side (north
property line.
Pursuant to LDR Section 4.5.1(J) Historic Preservation Board to Act on Variance
Requests the Board is guided by two sets of criteria; 4.5.1 (J) (1) refers to maintaining
the historic character of the property, and 4:5.1(J)(2) which accommodates appropriate
adaptive reuse of the historic property. It is appropriate to use the latter criteria for this
variance request, as the freezer unit is related to the reuse of the property as a full-scale
restaurant and inn.
The criteria set forth in Section 4.5.1(J)(2) is as follows:
That a variance is necessary to accommodate an appropriate adaptive reuse of a
structure within an historic district or upon an historic site through demonstrating that:
(a) A variance would not be contrary to the public interest, safety, or welfare.
(b) The variance would not significantly diminish the historic character of the
historic district or site.

(c) That the variance requested is the minimum necessary to effect the
adaptive reuse of an existing structure or site.
Allowing the freezer to be located on the proposed site will not be contrary to the public
interest, safety of welfare. The area for the proposed freezer is separated from the
historic structure and its garden by the new kitchen addition on the south, and therefore
will have no impact on the character of the historic site. To the north the 6' high wall
plus trellis provides screening from the street and the north property line. Additionally,
the existing nonconforming "garage", now part of the kitchen, will screen the freezer
from the east. The walk-in freezer is the minimum size necessary to accommodate the
needs of the existing restaurant.
Design Elements
The freezer is rectangular in plan with a flat roof and is constructed of metal. It will be
painted to match the Sundy Inn restaurant, yellow with white trim.

The action requested of the Board is that of approval for a change in previously
approved roof shingle color, from light gray to black.
Light gray composition shingles were approved for this property by the HPB on
November 17, 1999. A request for change of shingle color was considered as an add-
on agenda item at the HPB meeting of February 2, 2000. Because of Mr. Silberstein's
pending appeal to the City Commission (February 15, 2000) with respect to the HPB's
denial of aluminum windows for the front façade, the Board voted to not act on the color
change for the roof shingles until the appeal was heard.
DESCRI.:PTION ! ANALYSIS
The Mackie Cottages are all constructed in the Minimal Traditional style. The roof is a
character defining feature of the style; a gable with a low pitch (approximately 40%
slope), usually with a cross gable facing the front; the eaves and gable ends are close
and low, rather than overhanging. As a prominent unifying feature of all the cottages,
the roofs should be consistent in color as well as form. The Bankers Row design
guidelines do not specify roof color. However, all of the Mackie Cottages have
historically had, and continue to have, pale colored roof shingles, which range from very
light to medium gray. Additionally, the color of the body of the house is to be pale
salmon with white trim. The light gray shingles, which were originally approved, are
more appropriate and compatible to this color scheme that the proposed black.
While the Bankers Row design guidelines do not specify roof color, they do, however,
recommend shingle styles as follows:
"Restoration of Mackle Cottages should use hexagonal or Dutch-lap patterns of
modern reproduction asbestos-like shingles where possible; other acceptable
common shingle patterns of the time are illustrated in Figure 23.
Reroofing with modern lightweight fiberglass composition should be discouraged
but not prohibited. Heavier flat, smooth, uniform color shingles laid with greater

exposure than is commonly done with fiberglass shingles would be preferred.
Hexagonal shingles are difficult to obtain in Florida currently, but manufacturers
are responding to increasing restoration demands for the material."
Two local roofing contractors have stated that hexagonal shingles are not readily
available but can be special ordered for a small additional cost. The Board should
recommend that the applicant make every effort to install one of the historically correct
shingle shapes if at all possible.

will be available at the meeting.

RECOMMENDATION .
Deny the change of roof color based on the fact that roofs are character defining
features of all of the Mackie Cottages and as such are an important unifying element of
the streetscape. A black roof is historically incorrect and will interrupt the rhythm of the
streetscape and create an inappropriate break in the visual aesthetics of the east side of
the Bankers Row block.

- ASBESTOS SHINGLES AND ASPHALT SHINGLES
Asbestos shingles laid in the hexagonal 1pattern -- remain on two
Mackle Cottages. Asbestos shingles were smooth, rigid, and
thicker than the standard fiberglass shingles in common current
use. Asbestos roofs are very long lived, and the asbestos fibers -
are trapped in place if the shingles remain undisturbed. Removal
and disposal of asbestos has become a complex and expensive
procedure.
HAsphalt shingles widely used at the time the Mackle Cottages were
` built are shown. While not original to these buildings, asphalt
composition and fiberglass composition shingles have been.used to
reroof nine of the eleven cottages.
