Item Before the Board: The action requested of the Board is that of considering the paint color for a staff approved wood fence along the east and north property lines. It was moved by Ms. Jamison, seconded by Ms. McDermott and passed 6-0 (Bodker abstaining) to approve COA S-60 to allow the fence to be stained dark green, based upon positive findings with respect to LDR Section 4.5.1(E) and the Design Guidelines. Board Members Gail Lee McDermott requested that a letter be sent to the property owners in Osceola Park with respect to their interest in, or approval of, establishing an historic district within the subdivision. Project Location: 525 E. Atlantic Avenue ITEM BEFORE THE BOARD The action requested of the Board is that of reconsideration of a condition of approval, which required that, double transom windows be installed above the new French doors on the south façade of the Colony Hotel, pursuant to LDR Section 2.4.6(J). At the meeting of October 4, 2000 the Board approved the installation of fixed single pane windows, with double transom above, for the east facade of the building and new French doors to be installed on the south façade. The windows were approved as presented, however the following condition was imposed on the approval of the new doors: That double transom windows to match the windows of the east façade be installed above the new French doors. ANALYSIS In order to install the transom windows above the doors on the south facade, it will be necessary to construct a new header at the top of the proposed transom windows. GSA, Inc., the contractors for the job, have determined that installing the header will interfere with the two decorative medallions on either side of the existing door. If the transom windows are installed, the medallions will be probably be demolished, as it is doubtful that they can be removed intact and relocated. The medallions are typical of the embellishments applied to Mission Revival and Mediterranean Revival buildings built in the 1920s. The more typical medallions have a simple quatrefoil, fleur-de-lis or heraldic shield. However, the existing medallions are especially unusual and interesting for their detail and content, as they depict a Spanish galleon under full sail on a choppy sea. It is inappropriate to remove, and in so doing possibly demolish, the detailed medallions from the facade. As the proposal is to reinstall the awning above the new door, the awning will essentially obscure the proposed new transom windows. DESCRIPTION / ANAI-YS1 The fence was approved administratively on 8/3/00. It is board on board and is installed along the rear (north) and east property lines. The fence is 8' high on the rear. The east portion of the fence is also 8' high for a distance of 110' then it steps down to 6' for a length of 30' where it joins the front property line and the Dixie Boulevard right-of-way. The house is painted pale yellow and the shutters will be painted dark green. At the time of approval the applicant was told that it would be necessary to paint or stain the fence, however the fence color had not been decided. The applicant is requesting approval to stain the fence dark green to match the shutters. The dark green stain requires Board review. The fence encloses a vacant lot to the east of the main house and cottage, which makes it visible from the street. To paint it pale yellow or traditional white will make it more noticeable and will tend to draw attention away from the contributing main house. The dark green stain is compatible as the fence is adjacent to a tall ficus hedge surrounding the property to the east. The Board might want to suggest that flowering vines be planted to climb up the fence to add interest and color to the streetscape. ALTERN.ATIVE ACTIONS 1. Deny, with reasons stated 2. John Johnson, Florida Division of Historical Resources, stated that he was in agreement with staffs assessment that the 1937 house does not have much historic significance, to move it is cost prohibitive and that the applicant has made a good faith effort to relocated the house. O.N /:ANA!L:YSI,S: BACKGROUND At its meeting of October 18, 2000, the Historic Preservation Board approved the site plan for Marina Bay subject to conditions, which included installation of a 6' high stucco wall along the north and south property lines. In addition, the Board tabled the demolition of the apartment building at 132 Marine Way until the Board's January 3, 2001 meeting, in order to give the applicant adequate time to try and save the structure. FENCE The staff report for the Marina Bay development for the October 18, 2000 HPB meeting recommended as a condition of approval that the 6' high wood privacy fence proposed for the north and south property lines be changed to a 6' high c.b.s. wall. Some of the adjacent residences also requested that the wall be provided. Thus, the Board approved the site plan subject to the condition of installing a wall. The applicant is requesting that approval be given to install a 5' high decorative white aluminum fence rather than the 6' high c.b.s. wall. The applicant feels the aluminum fence is more in keeping with the architectural theme and relates more closely to historic wood fences which have been more prevalent in the Marina Historic District. Marina Bay Page 2 DEMOLITION OF 132 MARINE WAY The structures located at 135 SE 7th Avenue and 124&135 Marine Way were approved for demolition. As stated previously, the Board requested that the demolition of 132 Marine Way (built as a single-family residence in 1937) be tabled in order to give the applicant adequate time to try to save or relocate the structure. The applicant has done due diligence with respect to the relocation of the structure and that information is available in the attached letter from Gary Eilopoulos, the project's Authorized Agent. The letter states that the developers of the project have agreed to pay $20,000, not to exceed $30,000 to assist with the moving of the building. The offer is valid for a period of 30 days (until December 15, 2000). Additionally, the letter states that 6 agencies and individuals have been contacted with respect to the relocation, and their letters of response will be provided at the meeting. The Agent's letter does not request a definite date for demolition approval. However, as the offer of financial assistance is for a period of 30 days from the HPB meeting date, one would surmise that he is proposing December 15, 2000 as the demolition date. Pursuant to LDR Section 4.5.1(F)(1) the Board is provided with 5 guidelines with which to help evaluate the historic significance of a structure whose demolition has been requested: (a) Whether the structure is of such interest or quality that it would reasonably fulfill the criteria for designation for listing in the National Register. (b) Whether the structure is of such design, craftsmanship, or material that it could be reproduced only with great difficulty or economically nonviable expense. (c) Whether the structure is one of the last remaining examples of its kind in the designated historic district within the city. (d) Whether retaining the structure would promote the general welfare of the city by providing an opportunity to study local history, architecture, and design, or by developing an understanding of the importance and value of a particular culture and heritage. (e) Whether there are definite plans for immediate reuse of the property if the proposed demolition is carried out, and what effect those plans will have on the character of the surrounding area. The single-family residence was constructed about 1937 by builders Lawson & Waters for Mr. William Tiers. The building plans are on file but the architect is unknown. Shortly after the building was constructed a bedroom and bath addition was built on the northwest corner of the house and a freestanding HPB Staff Report COA-417 Contd. Marina Bay Page 3 garage with storeroom was constructed to the southwest of the addition. The structure is designed in the Minimal Traditional style, which was popular in the City during the 1930s and 40s. It is of frame construction with a stucco finish and set on a concrete foundation; the gable roof is finished with composition shingles. Some of the original windows and shutters are existing, however, the original screened front porch has been enclosed and the entrance door has been relocated from the east to the south elevation. Staffs evaluation of the guidelines is as follows: The building would not be eligible for individual listing in the National Register, but would be considered as part of a National register district. The original building could be reproduced for an economically viable expense. This is not one of the last examples of 1930s winter cottages located in the Marina District. However "demolition is forever" and as we lose these resources we lose the ability to understand the period and culture of the Great Depression as it related to the built environment of the City. There are definite plans for immediate use of the property, which the Board has determined to be appropriate for the character of the historic district and the surrounding area.' Thus, demolition is recommended. As previously stated the Board tabled the demolition to the meeting of January 3, 2001. Therefore it is appropriate to delay the demolition until January 3, 2001 unless all of the letters of inquiry indicate no interest in relocating the structure, despite the offer of financial assistance from the developer. If this is the case the Board may wish to consider a demolition date of December 15, 2000. Based upon the Board's evaluation of the guidelines and determination of the relative merits of the structure, the Board may opt to delay the demolition for a period of up to 6 months. AtTERNATIVE ;ACTIONS _ FENCE 1. Continue with direction. 2. Approve as presented. 3. Deny, with reasons stated. DEMOLITION 1. Continue with direction. 2. Assuming the applicant is proposing a demolition delay of 30 days, approve as requested. 3. Of primary consideration are the following items. Item#1: Design Element- That in lieu of a 6'-0" high stucco wall be constructed along the north and south property lines, that a 5'-0" high white aluminum decorative fence be installed. See exhibit 'A'. As stated to the Board on October 18, 2000, our proposed development is design to be integrated into the neighborhood with a variety of street-scape and building design. We feel that our proposed fence is pedestrian friendly, more in keeping with the architectural theme, along with relating more closely to historic wood fences which would have been more prevalent in the Historic Marina District. The existing properties are currently inconsistent with regards to privacy, ranging from the following; landscaping, 4'-0" chain link fencing, 6'-0" shadow box fencing and a 2'-0" high painted concrete block knee wall. See exhibit `B'. Item#2: Demolition-Reconsideration of the demolition of 132 Maine Way(Harbor Inn). At the October 18, 2000 meeting, the boards direction was for us to do some more researching with regards to alternative options for this particular structure. It should be noted, that this development was presented in May, 2000, to the Historic Preservation Board for a cursory review. This particular structure was discussed and staff stated that research needed to be done, due to the fact that the structure was old, but probably not considered a contributing structure. As for the October meeting, suggestions ranged from incorporating the existing house into our proposed development, to relocating it out of the district. Saturday March 11, 2000 Our office asked Naultilus Contracting (Mr. Thomas Dyer) and Modern Moving(Mr. Pat Burdette)to review the above referenced structure to be relocated. With regards to moving, Modern Moving will prep the structure to be lifted,Naultilus Contracting will cut the structure into two pieces and then put the structure on to trailers which will carry the structures to a new site. The cost associated with this part of the move are as follows; A. Modern Moving charges $20.00 square foot to move a structure. The existing structure is approximately 1,592 square feet for the front structure and 590 square feet for the rear building. Although the area calculations comes to $43,640.00,Modern Moving felt it would come closer to a estimated $30,000.00. This number is based on a 6 to 10 mile radius west of the intra- coastal (this number does not reflect going to the east side of the intra-coastal). B. Naultilus calculated cutting the structure one time, separating the front building, for a estimated$15,000.00 (this number includes putting it back together). C. Although the new site location is not known, we have calculated a estimated $12,000.00 for utility companies to drop lines during the move. This would involve the following;FP&L, Adelphia Cable, Bell South, Palm Beach County for traffic lights and Delray Beach Police Department for traffic control. It should be noted that the above numbers do not include any cost for abatement, with regards to asbestos or lead paint removal. Or tree cutting (route of move) and or any site clearing or preparation for the new location. 2. At the new site the structure will be raised approximately 48" above finish grade, on a temporary structure. Naultilus has estimated $30,000.00 for the foundation, approximately$100.00 a linear foot. The new foundation will put the new finish floor elevation of the house+/- 36" above finish grade. The foundation construction will consist of the following; A. 12"d x 24"w continuous concrete footing w/(3)# 5's continuous (reinforcing steel). Approximately 4 coarse of 8" concrete block w/(1)#5's @ 4'-0" o.c. in filled cells. B. Continuous 2 x 6 p.t. wood sill plate anchored to new foundation w/1" dia. anchor bolts @ 4'-0" o.c. • C. Anchor the house down to the new foundation with, 2" w x 48"1, 18ga. hurricane straps @ 4'-0" o.c. w/(3) 10d nails @ existing structure and (7)DS (.177" dia)power actuated studs @ new concrete block wall. D. Interior concrete piers approximately(8)w/2'-0" x 2'-0" x 1'-0" concrete footings w/(3)# 5's and 4 coarses of concrete block w/(1)#5 in filled cells. • ti It should be noted that the above number and foundation do not include the following; finishing off the block foundation wall (stucco or paint), ventilation vents, accesses panels and or any stairs up to the new finish floor. E. New service to the structure will cost approximately$12,000.00 and will consist of connecting a minium of the following; 1. Electrical (underground service), plumbing, cable and air conditioning if any. It should be noted that the above number does not include replacing any of the existing electrical panels, wiring(switches, outlets etc.) or any plumbing lines which are old and or which might crack during the move. 3. Site preparation and other elements which are not part of the move and or foundation would include but not limited to the following; A Soil borings from a Florida registered engineer. B. Driveway and walkways. C. Landscaping and irrigation. 4. In addition to the above associated costs are the soft cost; architect, landscape architect, survey, civil engineer(if required), structural engineer, mechanical, electrical and plumbing engineer. As far as the above referenced cost, Marine Way LLC has agreed to pay for the moving of the above reference structure in the amount of$20,000.00 , not to exceed $30,000.00. All other associated costs shall be paid and coordinated by the parties taldng the structure. This offer will be good for a period of 30 days(December 15, 2000). The interested buyer must apply for a moving permit and or provide proof of ownership of a buildable site within this time frame. We are requesting approval for the demolition of 132 Marine Way from HPB, with commencement of demolition occurring no earlier then December 15, 2000. ITEM BEFORE THE BOARD The item before the Board is that of making a recommendation to the City Commission on the proposed abandonment of the north-south alley lying within Block 61, Town of Linton (now Delray) Plat. This right-of-way abandonment is being processed pursuant to LDR Section 2.4.6(0), Abandonment of Rights-of-Way. BACKGROUND The subject alleyway was dedicated with the recordation of the Town of Linton (now Delray) Plat (Plat Book 1, Page 3, of the Public Records of Palm Beach County, Florida), in 1895. t' Please see Reference Maps "A"and "B"for the following section. Currently the subject alley is paved and is part of an alley system which provides a secondary means of access to all parcels fronting on Swinton Avenue, S.W. 1stAvenue and S.W. 1st Street. In addition to the alleyway proposed for abandonment, there is an east-west alleyway which extends from S.W. 1st Avenue to mid block, or the northern terminus to the north-south alleyway. Previously this alley extended from S.W. 1st Avenue to Swinton Avenue. Two separate motions abandoned the portion east of mid-block. The first, in 1986, abandoned the south 3 feet. The second, in 1999 abandoned the north 13 feet, which was tied to the overall site plan for the Rectory Park Development. ANALYSIS Block 61 is located in the OSSHAD Zone District. Future Land Use Element Policy C-3.3 of the City's Comprehensive Plan states: Alleys located within the Old School Square Historic District on either side of Swinton Avenue shall remain and be made available for access to abutting properties. Accordingly, these alleys shall not be abandoned to private interests. In addition, the Land Development Regulations directs parking in the OSSHAD to be located in the side or rear yard and/or adjacent to a rear alley. Although the applicant has previously shown concept plans to staff and the Board, which would seem to achieve the stated objectives, to date they have not formally submitted a Master Development Plan, or. a Boundary Plat. Therefore, if the proposed abandonment goes forward there would be no mechanism to hold the applicant to doing any improvements of the concept plan. RECOMMENDATION Staff feels it is premature to move forward with the abandonment, and recommends this project be "continued", until such time that a Master Development Plan or Boundary Plat, which incorporates all adjacent parcels, is processed concurrently.
