ROLL CALL: The meeting was called to order by the Chairperson at 6:00 P.M. Upon roll call it was determined that a quorum was present. MEMBERS PRESENT: Chairperson Hurlburt, Tony Keller, Shane Ames (arrived 6:20), Mary Lou Jamison, John Johnson, Gail-Lee McDermott (arrived 6:05) MEMBERS ABSENT: Dave Bodker STAFF PRESENT: Pat Cayce, Diana Mund, Jay Jambeck (Assistant City Attorney) II. APPROVAL OF MINUTES: The Minutes for the Regular Meeting of November 17, 1999 were before the Board for consideration. Mr. Keller moved to approve the Minutes as presented. The motion was seconded by Mr. Johnson and passed 4-0. At this point on the agenda Ms. McDermott arrived at the meeting. Mrs. Cayce asked the Board to amend the agenda to add Item IV.B. The Board was of the consensus to do so. As the applicant had not yet arrived for Agenda Item III.A. the Board heard Item IV.A. first. IV. CERTIFICATES OF APPROPRIATENESS: A. COA 9-402: Penelope's Breads & Threads, 353 N. Swinton Avenue, Old School Square Historic District. Item Before the Board: The action requested of the Board is that of considering approval for a two faced sign. It was moved by Mr. Johnson, seconded by Mr. Keller and passed 5-0 to approve COA 9-402 for two freestanding signs, as follows: • One sign is to be located on N. Swinton Avenue with the other sign on NE 4th Street, at least several feet away from the FP&L post. With the exact location to the owner's discretion, providing the signs conform to the required setbacks. If allowed by the Sign Code, the signs may have text on either side (two faced). The signs are to have some form of landscaping at the base. The site plan modification required by the relocated signs can be approved administratively. III. PUBLIC HEARING ITEMS: A. Variance 9-63 & COA 9-401: Fellowship Hall and Courtyard of the First Presbyterian Church, 36 Bronson Avenue, Individually Listed in the Local Register of Historic Places. Robert Currie Partners, Architect/Authorized Agent. Item Before the Board: The action requested of the Board is that of considering approval for a variance from LDR Section 4.3.4(K), pertaining to the front (East) setback requirements and Design Elements associated with the construction of a colonnade. Chairperson Hurlburt stated that this was a Quasi-Judicial item. Therefore, anyone wishing to speak on this item would have to be sworn in. Board Secretary Diana Mund asked that anyone wishing to speak raise their right hand and then administered the oath. Chairperson Hurlburt declared the Public Hearing open, as there was no one wishing to speak the Public Hearing was closed. It was moved by Mr. Johnson, seconded by Mr. Keller and passed 5-0 to approve Variance 9-63, based upon positive findings with respect to LDR Section 4.5.1(J)(1), to reduce the required 25' front setback to 20', to allow a colonnade to be constructed in front of the courtyard. At this point on the agenda Mr. Ames arrived at the meeting. It was moved by Mr. Johnson, seconded by Mr. Keller and passed 6-0 to approve COA 9-401 for the Design Elements associated with the colonnade and courtyard as presented. V. DISCUSSION AND ACTION ITEMS: A. Consider Making a Recommendation to the Planning & Zoning Board with Respect to the Approval of a Similarity of Use Request to Allow a Catering Business to be Established in the Old School Square Historic Arts District. It was moved by Ms. Jamison, seconded by Mr. Ames and passed 6-0 to recommend to the Planning & Zoning Board that a catering establishment be allowed in the OSSHAD Zoning District. -2- HPB Minutes 12/01/99 IV. CERTIFICATES OF APPROPRIATENESS: B. COA 9-377 Continuation: Rhoden Building, 2 E. Atlantic Avenue, Old School Square Historic District. Steve Cohen, Owner; Kelly Maudsley, Authorized Agent. Item Before the Board: The action requested of the Board is that of considering approval for a change in approved shutter style and placement. The Board was of the consensus to approve placing a single "fold-back" shutter on the east and west windows of the second floor of the front elevation. The shutters will be mounted to the east and west of the windows. VI. REPORTS AND COMMENTS: A. Reports from Historic District Representatives Ms. Riley reported that a Jaca Randa tree had been removed from the front yard of a house on SE 7th Avenue. She will get the address to Mrs. Cayce. B. Board Members Mr. Ames stated that he photographed the buildings on Atlantic Avenue from the Check Cashing Store to the Atlantic Ocean including the side streets in preparation for proposing an historic district in this area. Mr. Ames stated that he heard they were considering demolition of Benardo's restaurant in order to construct a parking lot on the site. The Board was of the consensus to send a letter to the property owner about registering the restaurant in the Local Register of Historic Places. C. Staff Mrs. Cayce informed the Board that the Check Cashing Store would be going before the Code Enforcement Board on February 7, 2000 in reference to their non-approved exterior neon lighting. VII. They will become so after review and approval, which may involve some changes. -4- HPB Minutes 12/01/99 HISTORIC PRESERVATION BOARD STAFF REPORT Project Name: Variance 63 and COA-401, Fellowship Hall Courtyard, First Presbyterian Church Project Location: 36 Bronson Avenue, individually listed in the Local Register of Historic Places ITEM BEFORE THE BOARD The action requested of the Board is that of granting a variance to LDR Section 4.3.4(K), pertaining to the front setback requirement for property located in the RM (Multiple Family Residential) zoning district; and approval of the associated design elements. BACKGROUND The subject property is legally described as follows: Lots 16,17,18 & 19, Block 3, Ocean Park Subdivision, as recorded in Plat Book 5, Page 15 of the Public Records of Palm Beach County, Florida. Fellowship Hall, and its courtyard adjacent to the north, were listed in the Local Register of Historic Places on November 16, 1999. The designation report is available with respect to the history of the building and the courtyard. PROJECT DESCRIPTION /ANALYSIS The proposal consists of enclosing the existing courtyard, formed by Fellowship Hall to the south, the church to the west and the church school to the north, with a covered colonnade. Fellowship Hall and the associated courtyard are located in the RM zoning district where a 25' front setback is required. The hall is set back 33.6' from the front property line. The area in front of Fellowship Hall originally had a 20' x 25' concrete entrance area with stairs leading from it to the double front doors. This is being replaced by a graceful and well proportioned entrance consisting of a set of 3 broad (27' wide) stairs leading to a large landing area followed by a second set of 5 steps to the entrance doors of the hall. During the 1940s a low retaining wall (approximately 3' high), was constructed in front (east) of the courtyard 10' from the front property line along Bronson Avenue. This wall has been demolished. There was a central entrance to the courtyard from the street and a secondary entrance to the south. The south entrance consisted of a narrow curved walkway to the right of the concrete entrance area. See the attached survey for clarification. Meeting Date: December 1, 1999 Agenda Item: Ill-A HPB Staff Report Variance-63 Page 2 VARIANCES AND DESIGN ELEMENTS East elevation The proposal consists of constructing a covered colonnade along the front (east) and south side of the courtyard. The east portion of the proposed colonnade will be set back 20' from the property line, if the variance is granted. The proposed colonnade runs the width (64') of the courtyard, and consists of 3 arches on each side of the center arch. In front of the center arch a curving staircase of 10 steps leads to the decorative entrance gates. A curved parapet covers the arches. In front of the colonnade is a double tiered planting area, with a curved wall in front of the lower planter. All walls will be finished in stucco and painted. South elevation On the right of the new landing in front of Fellowship Hall, 5 steps will lead to the south entrance of the courtyard. The staircase will be 12' wide and flanked at the top by the columns of the colonnade. A double decorative gate will be installed at the entrance. Courtyard The original courtyard consisted mainly of a paved center patio area with plantings around the perimeter. It is being completely redesigned to incorporate amenities such as a fountain, brick pavers and associated landscaping. VARIANCE Pursuant to LDR Section 4.5.1(J) Historic Preservation Board to Act on Variance Requests: the Board is guided by the following criteria. (1) That a variance is necessary to maintain the historic character of property through demonstrating that: (a) A variance would not be contrary to the public interest, safety, or welfare. (b) Special conditions and circumstances exist, because of the historic setting, location, nature, or character of the land, structure, appurtenance, sign, or building involved, which are not applicable to other lands, structures, appurtenances, signs or buildings in the same zoning district, which have not been designated as historic sites or a historic district nor listed in the Local Register of Historic Places. (c) Literal interpretation of the provisions of existing ordinances would alter the historic character of the historic district, or historic site to such an extent that it would not be feasible to preserve the historic character, of the historic district or historic site.' HPB Staff Report Variance-63 Page 3 (d) The variance requested is the minimum necessary to preserve the historic character of a historic site or of a historic district. The variance will not be contrary to the public interest, safety or welfare. The variance will create a 12' wide separation between the front wall of Fellowship Hall and the colonnade, and will increase the width of the south entrance opening from 7' to 12'. The additional 5' of width on the south entrance will create a well proportioned and inviting stairway and arch leading to the courtyard. Staff supports the variance based upon the following: 1) the additional 5' of space clearly differentiates the new colonnade from the front wall of Fellowship Hall; and, 2) it creates a correctly proportioned and architecturally attractive entrance, which appropriately links Fellowship Hall to its historic courtyard. ALTERNATIVE ACTIONS VARIANCES 1. Deny, with reasons stated. 2. Approve as presented. DESIGN ELEMENTS 1. Continue with direction. 2. Deny, with reasons stated. 3. Approve as presented. RECOMMENDATION By separate motion: 1. Based on positive findings to LDR Section 4.5.1(J)(1), grant the variance to reduce the required 25' front setback to 20', to allow the colonnade to be constructed in front of the courtyard. 2. Swinton Avenue, Old school Square Historic District ITEM BEFORE 'THE, BOiVRD. : The action requested of the Board is that of approval for a free standing sign with 2 faces. BACKGROUND. Penelope's Breads & Threads was formerly located on East Atlantic Avenue, and has relocated to the building on the southeast corner of N. Swinton Avenue and NE 4' Street (Lake Ida Road). The building was converted from a single family residence to commercial use several years ago. However, the structure has remained as a single family residence since the conversion, this will be its first commercial use. The location of the sign was approved when the site plan was approved by the HPB. DESCRIPTION ! ANALYSIS The proposed sign is comprised of 2 single faces, which will be installed on a "V" angle with 3 posts. It is 5' from the ground and each face is 4' wide. The sign faces are alumacore painted panels with applied graphic film text. The signposts are painted wood. The colors are butter yellow with royal blue text and trim. Because the property is located on a corner, 2 freestanding signs are allowed. Staff suggests that the signs be separated and not joined as a "V". Perhaps one sign could be located on an angle facing N. Swinton and the other on an angle facing NE 4' Street, at least several feet away from the FP&L post. To further disassociate the post from the signs staff suggests that the visual intrusion of the light post could be mitigated by placing a low hedge or some landscaping in front of the post and under the signs. If the signs are relocated the site plan modification can be approved administratively. REVIEW BY .OTHERS The Building Department sign review committee approved the sign but recommended that some planting be installed beneath the signs. Catering Project Location: 130 SE 1st Avenue ITEM BEFORE THE BOARD The action requested of the Board is that of making a recommendation to the Planning & Zoning Board with respect to the approval of a Similarity of Use request to allow a catering business to be established in the OSSHAD zoning district. ANALYSIS The property is located in the OSSHAD zoning District where catering is not listed as a permitted use. However, the intensity of the use is similar to other permitted uses in the district, such as Restaurants of a sit down nature, Business and Professional Offices, and Arts related business such as craft shops, galleries, etc. The proposed catering establishment will be located in a nonconforming duplex. The location is appropriate for this type of business and there is sufficient space for parking on site. The planning staff supports the use, however, the P&Z Board must make the Similarity of Use determination. RECOMMENDATION' Make a positive recommendation to the P&Z Board that a catering establishment be considered similar to other uses permitted in the OSSHAD zoning district. file/s/pz/hpb/catering-sr Meeting Date: December 1, 1999 Agenda Item: V-A MEMORANDUM DATE NOVEMBER 24, 1999 TO: HPB MEMBERS�j Gb FROM: PAT CAYCE SUBJECT: SHUTTERS FOR THE FRONT OF THE RHODEN BUILDING, 2 EAST ATLANTIC AVENUE Please drive by the Rhoden building and note the shutters on the second floor of the E. Atlantic Avenue façade. The center window shutters have been installed. However, there is a problem with the spacing of the windows on either side. The windows are all the same size but the spacing between them is different and the difference was not noted on the architect's plans. There is insufficient room between the west and center windows for the shutters to fold back against the wall. These shutters are used for hurricane protection and therefore must fit and close. The contractor is proposing to put a double fold shutter on the outer frame of the east and west windows. File/s/pz/hpb/rhoden-shutters
