ROLL CALL: The meeting was called to order by the Chairman at 6:00 P.M. Upon roll call it was determined that a quorum was present. MEMBERS PRESENT: Chairman Vaughan, John Johnson, Debora Turner, Susan Hurlburt, Betty Diggans, Anthony Damiano MEMBERS ABSENT: Vera Farrington STAFF PRESENT: Pat Cayce, Diana Mund IL APPROVAL OF MINUTES: The Minutes for the Regular Meeting of March 5, 1997 were before the Board for consideration. Mr. Johnson moved to approve the Minutes as presented. The motion was seconded by Ms. Diggans and passed 6-0. III. ELECTION OF SECOND VICE-CHAIRPERSON: Chairman Vaughan declared the floor open for nominations for the position of Second Vice-Chairperson. Mr. Johnson moved to nominate Ms. Turner, seconded by Ms. Hurlburt. There being no other nominations on the floor, the motion was passed 6-0 to elect Ms. Turner as Second Vice-Chairperson of the Historic Preservation Board. By consensus the Board amended the agenda to add COA 8-111 Continuation. IV. CERTIFICATES OF APPROPRIATENESS: A. COA 8-111 Continuation: 102 N. Swinton Avenue; Old School Square Historic District; Law Offices of Weiner, Morici & Aronson; Michael Weiner, Owner. Item Before the Board: The action requested of the Board is that of approving a COA for a free standing sign to replace the existing free standing sign. It was moved by Ms. Turner, seconded by Mr. Johnson and passed 5-0 (Damiano abstained) to approve COA 8-111 Continuation for a free standing sign as present based upon positive findings with respect to LDR Section 4.5.1(E) and the Design Guidelines. B. COA 97-306: 6 S.E. 1st Street; Contributing Single Family Residence; Old School Square Historic District; Karl Hoffman, Owner. Item Before the Board: The action requested of the Board is that of approving a COA for demolition of a non-contributing cottage on the rear of the lot, and construction of a wood perimeter fence and an interior privacy fence. It was moved by Ms. Hurlburt, seconded by Ms. Turner and passed 6-0 to approve COA 97-306 for the demolition of the rear cottage, based upon failure to make positive findings to LDR Section 4.5.1(F) (Restrictions on Demolition) and guidelines (a)(b)(c)(d)&(e). It was moved by Mr. Johnson, seconded by Ms. Turner and passed 6-0 to table COA 97-306 for the perimeter and privacy fences, to allow the applicant time to provide elevations of the proposed gates and to indicate on the survey exactly where the fences will be located. Additionally, the Board requested that the fences be approved by the Building and Engineering Departments to ascertain that sight lines, easements, and stacking distances are compatible with the LDRs. C. COA 97-302 Continuation: 708 S.E. 3rd Street; Contributing Single Family Residence; Marina Historic District; Ron Bizick, Owner; Doug Bloss, Authorized Agent. Item Before the Board: The action requested of the Board is that of approving a COA for construction of a 4' high chain link fence in the front yard. It was moved by Ms. Turner, seconded by Ms. Hurlburt and passed 6-0 to deny COA 97-302 Continuation based upon failure to make positive findings to LDR Section 4.5.1(E), and the Design Guidelines, for a chain link fence in the front yard. Mr. Bloss requested that the Board approve a change in the plans for the north elevation as follows: • Three windows are to be installed on the north elevation with the middle window centered on the wall. It was moved by Ms. Turner, seconded by Ms. Hurlburt and passed 6-0 to approve COA 97-302 Continuation for the installation of three windows on the north elevation with the middle window centered on the wall, with the following condition: • That the applicant is to provide staff with a signed and sealed revised elevation reflecting the change. -2- 03/19/97 V. REPORTS AND COMMENTS: A. Reports from Historic District Representatives None B. Board Members The Board was of the consensus that the Burger Chin building should be demolished as soon as possible. Mr. Vaughan felt the Smith Film Drop building should be pursued to be listed on the Local Register of Historic Places. Mr. Johnson informed the Board that the house at 526 N. Ocean Boulevard would soon be a candidate for demolition or relocation, due to a five dwelling unit development that is proposed for the property which runs between N. Ocean Boulevard and Andrews Avenue. C. Staff Mrs. Cayce informed the Board that she had spoken on the phone to the new owners of 275 N. Swinton Avenue who stated that they would be requesting a fence permit for the property. Mrs. Cayce inquired whether the Board would want to revise the previously approved landscape plan to accommodate the fence. Ms. Turner, who drew up the landscape plans, felt the fence would not be compatible with the previously approved plans. The Board requested that a new plan incorporating the fence be reviewed before the fence permit is issued. VI. ADJOURNMENT: There being no further business before the Board, Ms. Turner moved to adjourn the meeting at 7:20 P.M., seconded by Ms. Diggans and passed 6-0. This single family frame vernacular residence was constructed in 1912, thus making it one of the oldest houses in the district. A cottage was constructed on the rear of the property in 1949. Last year a re-roof was staff approved for the main house. When the work commenced on the porch roof the porch supports collapsed. Staff approved the construction of the new porch columns. • The rear cottage has been condemned by the City. It is in very poor condition and is nonconforming with respect to setbacks. The applicant is requesting approval to demolish the structure. • The perimeter fence will be 42" high wood "Gothic" picket painted white. The fence will be set back several feet from the front property line along S.E. 1st Street and will be installed on the property line along Swinton and the south property lot line. Gates will be installed at the driveway on Swinton. • A 6' high wood "dog-eared" stockade fence is proposed to run between the southwest corner of the house and the south property line and from that point east to the east property line. The fence will be painted white and landscaping will be installed in front of the fence. The action requested of the Board is that of approval of COA-302-Continuation to allow a chain link fence to be constructed in the front yard. ................................................................................. The contributing single family residence was constructed in 1925 and was extensively remodeled in 1954. The exterior presents a Mediterranean Revival style, which was probably the original style. The subject property came to the Board for review at its meeting of January 8, 1997. At the meeting of January 22, 1997 a variance was granted to allow a garage to be constructed within the front setback and final approval for alteration to the residence was approved. The applicant is requesting approval to install a 4 or 5 foot high chain link fence across a portion of the front property line. The fence would connect with the wall on the east and continue 30' to the west along the front property line where it would return to the house. The return is to be chain link but the gate and posts would be decorative. • The applicant plans to install a hedge in front and behind the fence to screen it from the street and the residence. :.;;:.;:.;:.;:.;:.::.:;.:.:;.::.;:.;::.;;::.;:.;;;:.::.;;:;.:;::: The fence is being installed to keep the owner's dogs confined to the property. The owner prefers the look of a hedge along the property line as opposed to a to a decorative fence or wall. The owner's agent, Mr. Bloss, feels that chain link will be more easily hidden than other types of fencing. Meeting Date: March 19, 1997 Agenda Item: IV-B HPB Staff Report COA-302-Continuation Page 2 It is staffs opinion, and that of the City's horticulturist, that any type of fence can be obscured by a well tended hedge and that this is not a justification for the use of chain link, even when it is vinyl clad. Additionally the applicant proposes to use Podocarpus, which is a slow growing plant, for the hedging material. A wrought iron fence would be appropriate to the house. However, prefabricated aluminum fencing, which mimics wrought iron, is less expensive and would be an appropriate alternative. The inherent danger in approving a chain link fence, even though it is to be completely screened by a hedge, is that a future owner will not maintain the hedging and the fence will become visible. Once a building permit is issued for • the fence, the HPB has no authority to have it removed. Our Design Guidelines state that "chain link fences are inappropriate for any historic site." 1.
