ROLL CALL: The meeting was called to order by the Chairperson at 6:05 P.M. Upon roll call it was determined that a quorum was present. MEMBERS PRESENT: Chairperson Turner, Susan Hurlbut, William Griffin, Tony Keller, and new member, Mary Lou Jamison. Shane Ames arrived at 6:15. MEMBERS ABSENT: John Johnson. • STAFF PRESENT: Pat Cayce. Jay Jamback, Assistant City Attorney. II. APPROVAL OF MINUTES: It was moved by Mr. Griffin and seconded by Mrs. Hurlbut passed 5-0 to approved the minutes from March 3, 1999 and March 17, 1999, with the following correction: the March 3, 1999 minutes should reflect that Tony Keller was present at the meeting. III. PUBLIC HEARING ITEMS. A. Variance 58: 300 N. Swinton Avenue, a vacant lot at the northwest corner of N. Swinton and NW 3rd St. Old School Square Historic District. Tony Keller, Owner. Mr. Keller stepped down. The action requested of the Board is that of granting a variance to LDR Section 4.3.4(K) to reduce the rear building setback from 10' to 5'; and, Granting a waiver to LDR Section 6.1.4(B)(3)(b) to reduce the side interior setback requirement for a swimming pool deck from 5' to 3'. Variance 1 - 4/21/99 Based on positive findings to LDR Section 4.5.1(J), the Board approved the variance to LDR Section 4.3.4(K) to reduce the rear setback from 10' to 5'. Motion: Hurlburt, Second: Griffin 4-0 Waiver Based on positive findings to LDR Section 2.4.7(B)(5), approve the waiver to LDR Section 6.1.4(B)(3)(b) with the following condition: • That the 3' setback reduction be limited in length along the north property line to the length of the distance between the house and the garage. Motion: Hurlburt, Second Griffin 4-0 B. Variance 59 and COA-380: 117 NE 7th St, Del-Ida Park Historic District, single family residence. The action requested of the Board was as follows: • Granting a variance request to LDR Section 4.3.4(K) side setback requirements. • Approval of COA-380 for the design elements for the renovation of a single family residence and associated garage. Variances Based upon positive findings to LDR Section 4.5.1(J), the Board proved the variances to LDR Section 4.3.4(K) to reduce the side street setback from 15' to 14' 3"; and, to reduce the side interior setback from 10 to 4.5' for a roof deck to be lengthened 14' to the east. Motion: Keller, Second: Ames 5-0 Design Elements Based upon positive findings to LDR Section 4.5.1(e), approve the design elements associated with COA 9-380 with the following condition: • That the garage be reduced in width by 2' and that a 9' wide paved parking space be constructed to the west of the garage. The proposed 2- 4/21/99 parking space will encroach 1.5' into the required 5' landscape strip. The Board approved a waiver to LDR Section 6.1.4(B)(3)(b) to reduce the landscape strip to 3.5'. The reconfigured garage and paved parking area may be staff approved. Waiver: Motion, Keller, Second, Griffin 5-0 Design Elements: Motion, Ames, Second, Griffin 5-0 IV. The action before the Board is that of approval of a Class II Site Plan Modification for Brian Lipshy, P.A./Banker's Row Title, pursuant to LDR Section 2.4.5(G)(1)(b): ❑ Site Plan; ❑ Landscape Plan; and, ❑ Architectural Elevation Plan. Site Plan Modification The Board approved COA 9-365 for the Class II Site Plan Modification for Brian Lipshy, P.A./Banker's Row Title based upon positive findings with respect to Chapter 3 (Performance Standards) and the Land Development Regulations, subject to the following conditions: 1. Provide Site Data information on the site plan. 2. Provide City Standard Parking Detail on the site plan. Motion: Ames, Second: Griffin 5-0 Landscape Plan The Board approved COA 9-365 for the Landscape Plan for Brian Lipshy, P.A./Banker's Row Title based upon positive findings with respect to Section 4.6.16 of the Land Development Regulations, subject to the following conditions: 1. That a revised landscape plan be submitted addressing the landscape plan technical items and other conditions of approval. Motion; Ames, Second, Keller 5-0 3- 4/21/99 Note: The Board did not require item 2 of the staff recommendation: that Queen Palm groupings with underplantings be provided at the southeast corners of the two structures, as a condition of approval. Elevations The Board approved COA 9-365 for the Elevations for Brian Lipshy, P.A./Banker's Row Title based upon positive findings with respect to LDR Section 4.5.1(E). Sign The Board approved the style, size and location of the sign. At the owner's request, the sign background and posts are to be cream color, see attached business card for color sample. Motion: Ames, Second Keller 5-0 C. COA-346-Continuation: Rectory Square, 10 W. Atlantic Avenue, Old School Square Historic District. John Szerdi &Associates, authorized agent, Michelle Balfourt. Debora Turner stepped down. The action requested of the Board was that of approval for architectural details which were not included in the originally approved plans. Based on positive findings to Section 4.5.1(E), the Board approved the architectural details associated with COA-346 as presented; and approved the exterior light fixtures which were presented at the meeting. Motion: Ames, Second, Keller 5-0 D. COA-9-381: 242 N. Swinton Avenue, single family residence, Old School Square Historic District. Sally Gebo, Owner. The action requested of the Board was that of approval to replace 4 original double hung wood windows with aluminum single hung windows. Based on positive findings to Section 4.5.1(E), the Design Guidelines and The Secretary of the Interior's Illustrated Guidelines, continue with the following direction: • That the owner obtain estimates for repairing the original windows or consider wood replacement windows. The Board also suggested that if aluminum windows are considered they should have dimensional 4- 4/21/99 frames and muntins. The applicant will return for review of the proposed windows. • Additionally, the Board approved new paint colors as follows: Body color pale green, Behr paint, Dainty Green. Trim, Glidden paint, Fiji Green with porch awning to match trim color. Motion: Ames, Second: Griffin 6-0 E. Pre-application for the Spady House Museum, 170 NW 5th Avenue, West Settlers Historic District. Gary Eliopoulos, architect and agent. The action requested of the Board was to give comments and direction; no formal action was required. The Board generally approved of the elevator shaft extension and stairway to the rear elevation. They recommended that the stairway have a landing so that the lower stairs do not project to the south of the structure and will not be visible from the street. The Board agreed that the windows should have their original fenestration restored. The Board suggested that the applicant obtain early photographs of the building for reference before the final plans are presented for review. V. REPORTS AND COMMENTS: A.
