COA 97-309: CRA Parking Lot; Lot 5, Block 28, Town of Delray; West • Settlers Historic District; Community Redevelopment Agency, Owner; Chris Brown, Authorized Agent. Item Before the Board: The action requested of the Board is that of approving a COA for new construction and landscaping of the proposed parking lot. It was moved by Mr. Johnson, seconded by Ms. Hurlburt and passed 6-0 (Turner abstained) to approve COA 97-309 for the following waivers: 1. Waiver from LDR Section 4.6.16(H)(3)(f) to reduce the required landscape strip along the south property line from 5' to 4.4'; and, 2. Waiver from LDR Section 5.3.1(D)(2) to not provide an additional 5' of right-of-way along N.W. 5th Avenue. It was moved by Mr. Johnson, seconded by Ms. Hurlburt and passed 6-0 (Truner abstaining) to approve COA 97-309 for the site plan for the Peach Umbrella North Parking Lot, based upon positive findings with respect to Chapter 3 (Performance Standards) of the Land Development Regulations, policies of the Comprehensive Plan, and Section 2.4.5(F)(5), subject to the following condition: • That the electrical service connection for the parking lot lights must be located under ground. Three copies of the revised plans which address this change are to be submitted to the Planning Department. It was moved by Ms. Hurlburt, seconded by Ms. Diggans and passed 6-0 (Turner abstaining) to approve COA 97-309 for the landscape plan for the Peach Umbrella North Parking Lot as presented, based upon positive findings with respect to LDR Section 4.6.16. B. COA 97-310: 275 N. Swinton Avenue; Single Family Residence; Old School Square Historic District; Mr. & Mrs. McKeever, Owners. Item Before the Board: The action requested of the Board is that of approving a COA for a landscape plan, which includes a driveway and fence. It was moved by Ms. Hurlburt, seconded by Ms. Diggans and passed 6-0 (Turner abstaining) to approve COA 97-310 for the landscape plan based upon positive findings to Section 4.5.1(E), with the following condition: • Verification by the City Engineer that the gate on N.E. 3rd Street provides a sufficiently clear sight line for vehicles crossing the sidewalk. If not, the gates will be installed at a 45° angle. At this point on the agenda Ms. Turner returned to the Board. IV. REPORTS AND COMMENTS: A. Reports from Historic District Representatives None B. Board Members Chairman Vaughan stated that he had accepted a proclamation from the City Commission declaring that the City had designated the week of May l itn thru 15th as National Historic Preservation Week, which is sponsored by the National Trust for Historic Preservation. -2- 05/07/97 C. Staff Mrs. Cayce informed the Board that 708 S.E. 3rd Street was requesting a change of roof paint color from the previously approved dark green to a terra-cotta color. The Board requested that the applicant submit a painted sample of the new tile and a painted sample of the old tile (dark green) so that staff could determine that the two terra-cotta paint samples matched before painting the roof terra-cotta. VII. ADJOURNMENT: There being no further business before the Board, Ms. Turner moved to adjourn the meeting at 7:00 P.M., seconded by Ms. Farrington and passed 7-0. ITEM BEFORE THE BOARD The action before the Board is that of approval of the site plan and landscape plan for the proposed Peach Umbrella North Parking Lot. The subject property is located within Block 28, Town of Delray, between NW 4th and NW 5th Avenues, approximately 166' north of Atlantic Avenue. PROJECT DESCRIPTION AND BACKGROUND I The proposal involves the development of a 22 space parking lot with associated landscaping. The subject property is 69.4' wide and consists of the north 44.7 feet of Lot 6, and the south 24.7 feet of Lot 5 Block 28, Town of Delray. The site previously contained an apartment building which was demolished by the City in 1996. The parking lot will provide parking for redevelopment of Atlantic Avenue. The property is located within the West Settlers Historic District established by the City Commission on February 18, 1997. SITE PLAN ANALYSIS I COMPLIANCE WITH LAND DEVELOPMENT REGULATIONS Items identified in the Land Development Regulations shall specifically be addressed by the body taking final action on site and development application/request. Right-of-Way Dedication: Pursuant to LDR Section 5.3.1.(D)(2), the required right-of-way width for NW 5th Avenue is 50 feet. Since only 40 feet exists, this development is required to dedicate an additional 5 feet of right-of-way. However, pursuant to Section 5.3.1(D)(4) Reduction in Width, reduction in the required right-of-way width may be granted by the body having the approval authority of the associated development application provided the City Engineer is supportive of such a request. The existing roadway section consists of curb and gutter with paverbrick sidewalks. There are also street trees in the sidewalks set within tree grates. Given these existing conditions and the fact that only 40' of r/w exists to the north and south on improved properties, the City Engineer has no objections to granting a waiver to this requirement. Based upon the above, it is appropriate to grant a waiver to this code requirement. LDR Section 4.3.4(K) Development Standards Matrix: Since no buildings are proposed, the setback, building height, and lot coverage requirements of the GC district are not applicable. There are no minimum lot size, - depth, frontage, or width requirements for the GC district. • • HPB Staff Report Peach Umbrella North Parking Lot-Site Plan Page 2 Open Space: Current regulations require a minimum of 25% of the total site area to be devoted to non-vehicular open space area. The submitted landscape plan indicates 26% of the subject property is devoted to open space. Therefore, the minimum 25% requirement is met. LDR Chapter 4.6 Supplementary District Regulations: Landscape Buffer: Per LDR Section 4.6.16(H)(3)(f), a 5 foot perimeter landscaping strip is required while only 4.4 foot has been provided along the south property line. A waiver to the perimeter landscape requirement is appropriate. An analysis of this waiver request is included within the Landscape Analysis section of this report. Lighting: The proposed parking lot will be used during evening hours, therefore, it is appropriate to provide on site lighting. The site and landscape plans depict typical parking lot lights throughout the proposed parking lot. The light fixtures are consistent with those provided at the CRA/Peach Umbrella South parking lot, located south of Atlantic Avenue on SW 4th Avenue. Power will be supplied by an on-site meter and control box located in one of the terminal islands. The lighting plans indicate an overhead electrical service connection, and must be revised to indicate underground service. Off-Street Parking: The plan provides for 22 parking spaces (including one handicap parking space), and two points of ingress/egress (NW 5th Avenue and the north/south alleyway). All design standards for off-street parking have been met. Comprehensive Plan Policies: A review of the objectives and policies of the adopted Comprehensive Plan was conducted and the following applicable Objective is noted: Land Use Element Objective A-1 - Vacant property shall be developed in a manner so that the future use and intensity is appropriate and complies in terms of soil, topographic, and other applicable physical considerations, is complimentary to adjacent land uses, and fulfills remaining land use needs. The property is currently vacant and was previously occupied by an apartment building. There are no special physical or environmental characteristics of the land that would be negatively impacted by the proposed parking lot. The proposed landscaping associated with the parking lot will be an enhancement to the area and will be complimentary to the adjacent uses. The proposal will fulfill a need for parking to - support existing and future commercial uses of the West Atlantic Avenue Redevelopment Plan. HPB Staff Report Peach Umbrella North Parking Lot-Site Plan Page 3 LANDSCAPE PLAN ANALYSIS... Coconut Palm trees with Spider Lily underplantings are proposed within the terminal landscape islands at the parking lot entrance from NW 5 h Avenue. The perimeter of the lot along the north and south property lines will be planted with a Cocoplum hedge, Gumbo Limbo trees and Fern underplantings. The two interior landscape islands will be planted with Mahogany trees and Spider Lily underplantings and the terminal islands located at the entrance to the alley will be planted with a Cocoplum hedge, Mahogany trees and Fern underplantings. The City Landscape Inspector has reviewed the proposed landscape plans and has determined that they will meet all the requirements of Section 4.6.16. One 8" diameter Mahogany tree will be relocated within the site and several Black Olive and Tabebula trees will be removed. A tree removal permit will be required. WAIVER ANALYSIS: Associated with this development proposal is a waiver request to LDR Section 4.6.16(H)(3)(d), "Perimeter landscaping requirements relating to abutting properties." Pursuant to LDR Section 4.6.16(H)(3)(d), the required landscape barrier located between the common lot line and the off-street parking area or other vehicular use area shall be located in a planting strip of not less than five (5) feet in width. A waiver is requested to reduce the required 5 foot landscape strip to 4.4' feet along the south property boundary. The applicant will install and maintain the required landscape barrier within the reduced landscape strip. Required Findings: Pursuant to LDR Section 2.4.7(B)(5), prior to granting a waiver, the approving body shall make a finding that the granting of the waiver: (a) Shall not adversely affect the neighboring area; (b) Shall not significantly diminish the provision of public facilities; (c) Shall not create an unsafe situation; or (d) Does not result in the grant of a special privilege in that the same waiver would be granted under similar circumstances on other property for another applicant or owner. The waiver is to be applied to the south property boundary along adjacent vacant property where there is insufficient room to accommodate both parking spaces and the full 5' landscape strip. Provision of this landscape strip would result in a loss of eleven parking spaces if the preferred two-way traffic aisle with 90° parking is utilized. The applicant is not seeking a reduction in the required landscape materials. The _ development proposal provides significant upgrades throughout the site which currently is in poor condition. HPB Staff Report Peach Umbrella North Parking Lot-Site Plan Page 4 The waiver request will not adversely affect the neighboring area, diminish the provision of public facilities, nor create an unsafe situation. Since the waiver is being applied to only a small area and the landscape code is being met throughout the site, it appears to be appropriate to approve the request. Given the conditions under which this waiver is being requested, it is reasonable to believe that the waiver would be granted elsewhere under similar circumstances. Except for the above waiver request, the proposed landscape plan complies with the requirements of LDR Section 4.6.16 and provides an attractive landscape design. REQUIRED FINDINGS Pursuant to LDR Section 3.1.1 (Required Findings), prior to the approval of development applications, certain findings must be made in a form which is part of the record. This may be achieved through information on the application, written materials submitted by the applicant, the staff report, or minutes. Findings shall be made by the body which has the authority to approve or deny the development application. These findings relate to the following areas: Section 3.1.1(A) - Future Land Use Map: The use or structures must be allowed in the zone district and the zoning district must be consistent with the land use designation. The subject property has a Future Land Use Map designation of General Commercial and a General Commercial zoning designation. The GC zoning district is consistent with the Future Land Use Map designation. Pursuant to Section 4.4.9(B)(4), within the General Commercial District, commercial or public parking lots not associated with a use are listed as a permitted use. Based upon the above, it is appropriate to make a positive finding with respect to the Future Land Use Map. Section 3.1.1(B) - Concurrency: As described in Appendix A, a positive finding of concurrency can be made as it relates to water, sewer, streets and traffic, drainage, parks and recreation, open space, and solid waste. Section 3.1.1(C) - Consistency (Standards for Site Plan Actions): As described in Appendix B, a positive finding of consistency can be made as it relates to Standards for Site Plan Actions. Section 3.1.1(D) - Compliance with the Land Development Regulations: As described under the Site Plan Analysis Section of this report, a positive finding of compliance with the LDRs can be made, when all outstanding items attached as conditions of approval are addressed. Section 2.4.5(F)(5) - Compatibility (Site Plan Findings): The approving body must make a finding that development of the property pursuant to the site plan will be _ compatible and harmonious with adjacent and nearby properties and the City as a whole, so as not to cause substantial depreciation of property values. • HPB Staff Report Peach Umbrella North Parking Lot-Site Plan Page 5 The proposed use is to be developed on currently vacant property. To the north is a fenced in play area for a daycare operation located at Mount Olive Missionary Baptist Church, to the east is a parking lot for Mount Olive, to the south is a 30' vacant parcel that is designated for acquisition and redevelopment in the CRA's Redevelopment Plan, and to the west is the Delray Beach Fire Station Headquarters. Zoning to the north, east and west of the subject property is CF (Community Facilities), and to the south is GC (General Commercial). The parking lot is part of the City's and CRA's strategy for the revitalization of West Atlantic Avenue. The need for parking in this area was identified during preparation of the West Atlantic Avenue Redevelopment Plan, and in the CRA's adopted plan. The general area consists of commercial and community facilities type uses. The parking lot will provide parking for the existing uses and foster additional redevelopment, thereby continuing the revitalization of the area. Based on the above, a finding can be made that the proposed use will not have an adverse impact on the surrounding area, nor will it hinder development or redevelopment of nearby properties. REVIEW BY OTHERS I Community Redevelopment Agency: By their submission of the subject development, the Community Redevelopment Agency has given its approval of the plan. West Atlantic Avenue Architectural Review Committee: At its meeting of May 1,1997, the Board reviewed and recommended approval of the development proposal. The proposed lot will provide parking spaces that will be required to accommodate future development and redevelopment projects in the area. RECOMMENDED ACTION By Separate Motions: A. Waivers: 1. Approve the waiver request from LDR Section 4.6.1 6(H)(3)(f) to reduce the required landscape strip along the south property line from 5 feet to 4.4 feet. 2. Approve the waiver request from LDR Section 5.3.1(D)(2) to not provide an additional 5 feet of right-of-way along NW 5th Avenue. B. Site Plan: Approve the site plan for the Peach Umbrella North Parking Lot based upon positive findings with respect to Chapter 3 (Performance Standards) of the Land Development Regulations, policies of the Comprehensive Plan and Section 2.4.5(F)(5) subject to the following conditions: 1. The electrical service connection for the parking lot lights must be located underground. Submit 3 copies of revised plans addressing this change. C. Attachments: ❑ Appendix A ❑ Appendix B ❑ Site Plan ❑ Landscape Plan Report prepared by: Ronald Hoqgard, Senior Planner APPENDIX A CONCURRENCY FINDINGS Pursuant to Section 3.1.1(B) Concurrency as defined pursuant to Objective B-2 of the Land Use Element of the Comprehensive Plan must be met and a determination made that the public facility needs of the requested land use and/or development application will not exceed the ability of the City to fund and provide, or to require the provision of, needed capital improvements for the following areas: Water and Sewer: The development of a parking lot will create no additional demand on water and sewer service as it relates to this level of service standard. Streets and Traffic: No additional demands will be created with respect to streets and traffic as the parking lot use does not generate any traffic. Parks and Recreation Facilities: Park dedication requirements do not apply for non- residential uses. Thus, the proposed development will not have an impact with respect to this level of service standard. Solid Waste: No solid waste will be created from the development of a parking lot. Therefore, a positive finding can be made. Drainage: On-site retention will be provided via construction of an exfiltration system. No problems are anticipated from the design and use of the system. Open Space: Current regulations (LDR Section 4.3.4(K) (Development Matrix)) requires a minimum of 25% of the total site area to be devoted to non-vehicular open space area. Swinton Avenue > > .E...t31 The action requested of the Board is that of approval of COA-310 for landscape plans which include driveway and fence. The building was moved from 15 N.W. 1st Street to the present site in October 1995. On May 1, 1996 the HPB approved a partial landscape plan. The partial landscape plan was presented to the Board as an accommodation to the then owner, Michael Owner. At the time of approval Mr. Weiner planed to construct an office building on the vacant lot to the south. In order to provide parking in the rear of the proposed structure, Mr. Weiner intended to construct a driveway across the rear of the subject property's lot to allow cars from the office building to enter off Swinton and exit onto N.E. 3rd St. Therefore, the landscape improvements were only for the front yard and for the installation of a hedge along N.E. 3rd Street, however, none of the landscape improvements were implemented. The applicants are presenting a landscape plan which is consistent with the LDR requirements for new construction of single family residences (as the house was • moved to the site it is considered, for landscape compliance, new construction) • A 6' high wood shadow box fence to be painted white will be installed as follows: • Along the south property; from the existing rear chain link fence to the southwest corner of the house where it will return with a wood pedestrian gate installed. Three feet from the north property line; from the existing rear chain link fence to the northwest corner of the house where it will return to the to the house. A driveway gate will be installed on N.E. 3rd Street. The driveway will be 36' long. • The front entrance stoop will be enlarged to 8' in width. Walkways connect the front entrance to the Swinton Avenue sidewalk and the driveway. The stoop and walkways will be finished in matching Chicago brick. • A Cocoplum hedge will be installed as foundation planting on the west elevation and along the outside of the N.E. 3rd St. fence. • A Ficus hedge with Keys lilies in front will be planted in the 5' landscape strip along the driveway. • Two Coconut Palm trees will be planted in the front yard. The enlarged stoop will improve the proportion front entrance. The use of Chicago brick is appropriate to the site.
