ROLL CALL: The meeting was called to order by the Chairman at 6:00 P.M. Upon roll call it was determined that a quorum was present. Ms. Farrington moved to approve the Minutes as presented. The motion was seconded by Ms. Golembe and passed 4-0. Ms. Taylor asked that the Board hold off on her Variance until Ms. Diggans arrived. IV. CERTIFICATES OF APPROPRIATENESS: C. COA 8-275: TED Center in the Masonic Lodge Building; 22 S.E. 1st Avenue; Contributing Building; Old School Square Historic District; Elizabeth Debs, Architect; Sherry Johnson, Authorized Agent. Item Before the Board: The action requested of the Board is that of approving a COA for renovation to the facade, including the paint colors, sign, and awnings. This proposal concerns only the south portion of the first floor of the building. It was moved by Ms. Golembe, seconded by Ms. Farrington and passed 4-0 to approve COA 8-275 based upon positive findings with respect to LDR Section 4.5.1(E) as presented, with the following condition: • That the sign be approved by the Building Department's Sign Review Committee. B. COA 8-289 Continuation: 42 N. Swinton Avenue; Vacant Parcel; Old School Square Historic District; Randall Stofft, Owner. Item Before the Board: The action requested of the Board is that of reconsideration of the following condition of approval: that the applicant pursue purchasing a handicap accessible parking space from the CRA, thus eliminating the on-site handicap space; or, that the building be "flipped" so the handicap space and sidewalk is located on the north side of the building/property, unless the applicant can provide justification which conclusively demonstrates that "flipping" the building is not feasible. The handicap accessible parking space could not be purchased from the CRA. The building cannot be reversed because the walkway on the north side would affect the water retention areas. Further, the handicap space will be more convenient on the south side, as it would better serve clients and others who will utilize the parking lot. It was moved by Ms. Golembe, seconded by Ms. Farrington and passed 3-1 (Turner dissenting) to approve the revised plans which provide the required 4' wide handicapped accessible sidewalk and a 2' wide landscape strip along the south side of the proposed building. The Board also approved the use of an Ixora hedge and 2 Alexander Palms for landscape material in the planter strip, with the following condition: • That a 5'x5' wheelchair turning area be provided on the walkway if required by ADA regulations. At this point on the agenda Ms. Diggans arrived at the meeting. III. PUBLIC HEARING ITEMS: A. Variance 88-46: Lot 18, Block 10, West Side of Royal Court Approximately 20' North of N.E. 5th Terrace; Del-Ida Park Historic District; Vacant Parcel; Tullia Taylor, Applicant. Item Before the Board: The action requested of the Board is that of granting a Variance request to LDR Section 4.3.4(K) to allow a reduction of the side setbacks associated with the construction of a new single family residence. Chairman Vaughan stated that this was a Quasi-Judicial item. Therefore, anyone wishing to speak on this item would have to be sworn in. Board Secretary Diana Mund then asked anyone wishing to speak to raise their right hand. The Board Secretary then administered the oath to those who wished to speak. -2- 11/20/96 Ms. Cayce entered the project file into the record. Chairman Vaughan then asked if there was anyone wishing to speak for or against the Variance. As there was no one wishing to speak Chairman Vaughan then closed the Public Hearing. Ms. Diggans declared that prior to becoming a Board member she spoke with the applicant about the new home that she was proposing to build. However, she did not feel this would prejudice her vote in any way. It was moved by Ms. Golembe, seconded by Ms. Turner and passed 5-0 to approve Variance 88-46 to LDR Section 4.3.4(K) to allow a reduction of the side setbacks from 15' to 7.5' based upon positive findings with respect to Sections 4.5.1(J)(2) and 2.4.7(A)(5). IV. CERTIFICATES OF APPROPRIATENESS: A. COA 8-292: Lot 18, Block 10, West Side of Royal Court Approximately 20' North of N.E. 5th Terrace; Del-Ida Park Historic District; Vacant Parcel; Tullia Taylor, Applicant. Item Before the Board: The action requested of the Board is that of approving a COA for new construction of a single family residence. It was moved by Ms. Golembe, seconded by Ms. Farrington and passed 5-0 to approve COA 8-292 for the design elements as presented based upon positive findings with respect to LDR Section 4.5.1(E), with the following conditions: 1. That a 5' to 6' wood fence painted white be installed along the south property line from the corner of the house to the rear of the property line; 2. That all of the windows are to be single hung 1/1 pane configuration of factory finished white aluminum, and that the shutters on the front window be made of wood and be operable; 3. The exterior paint colors are as follows: main color, Sears 267 Turkish Peach; trim color, Sears 091 Los Alamos Pink; and, 4. The roof is to be metal standing seam with a natural (unpainted) factory finish. The landscape plans submitted with the application were reviewed by the City Horticulturist for conformity with the minimum landscape requirements for single family homes. Nonconformity's were identified and the plans were returned to the applicant for revision. The applicant will return to the Board with conforming landscape plans, a plot plan, and elevations for the required fencing. -3- 11/20/96 At this Point on the Agenda Ms. Turner left the meeting. D. COA 8-299: Seaboard Airline Railroad Station; 80 Depot Avenue; Contributing Building; Individually Listed in the National and Local Register of Historic Places; George Wittmer, Wittmer Environmental Services, Owner. Item Before the Board: The action requested of the Board is that of approving a COA for a sign, installation of a new loading door, and exterior paint colors. It was moved by Ms. Golembe, seconded by Ms. Farrington and passed 4-0 to approve COA 8-299 based upon positive findings with respect to LDR Section 4.5.1(E) as follows: 1. A 12' x 12' roll up loading door to replace the double doors on the north elevation; 2. New double doors, wood frames with true divided lights, to fit the original center opening on the front facade; 3. Removal of a metal canopy on the southwest corner of the building which connects the west arches to the track side canopy; 4. A wall sign on the east elevation of the Freight Room with either painted or raised foam letters; and, 5. Exterior paint colors as follows: main door, Damascus Rose 28-E; trim colors, Lichen White 228-D; all of the wood paneling, the doors, and the sign, will be painted Conifer Forest (dark green) 228-C. E. COA 8-215 Continuation: Sloan Hammock; 106 S.E. 7th Avenue; Marina Historic District; Dan Sloan, Hammock Partners, Owners. Item Before the Board: The action requested of the Board is that of approving a COA for the design and location of a permanent sign for the rental complex. It was moved by Ms. Golembe, seconded by Ms. Diggans and passed 3-1 (Farrington dissenting) to approve COA 8-215 Continuation based upon positive findings with respect to LDR Section 4.5.1(E) for the sign design and location as presented with the following condition: • That the lower portion of the sign "Vacancy" be removable and will be attached only when a vacancy occurs. F. COA 8-251 Continuation: 1010 Nassau Street; Nassau Park Historic District; Noncontributing Single Family Residence; Peter Byron, Owner. Item Before the Board: The action requested of the Board is that of approving a COA for window modifications from previously approved plans. -4- 11/20/96 It was moved by Ms. Golembe, seconded by Ms. Farrington and passed 4-0 to approve COA 8-251 Continuation for the installation of 3 windows to the right of the front door, and the use of double hung factory finished white aluminum windows with a 1/1 pane configuration. When this project came to the Board in 1995, a variance was granted to allow a 2 car carport to be installed in the front yard setback. A condition of the variance was that the existing garage, which is being converted to living space, had to be granted a Certificate of Occupancy before the carport could receive a building permit. At the request of the owner, the Board agreed to amend this condition. It was moved by Ms. Golembe, seconded by Ms. Farrington and passed 4-0 for COA 8-251 Continuation that there be no finals (Certificate of Occupancy) for the carport until the garage conversion is complete. G. COA 8-300: 30 S.E. 1st Avenue; Old School Square Historic District; Contributing Single Family Residence; Michael Strauss, Owner. Item Before the Board: The action requested of the Board is that of approving a COA for window replacements, and exterior paint colors. It was moved by Ms. Golembe, seconded by Ms. Farrington and passed 4-0 to approve COA 8-300 for the installation of PGT Series 400 factory finished white aluminum or wood single hung windows with a 6/1 pane configuration. The applicant will select exterior paint colors from the approved color chart at a later date. V. DISCUSSION AND ACTION ITEMS: None VI. REPORTS AND COMMENTS: A. Staff Ms. Cayce informed the Board that the entrance sign to Del-Ida Park was in the process of being repaired by the City's Parks and Recreation Department. Ms. Cayce informed the Board that due to the New Year's Day Holiday the January 1, 1997 meeting has been changed to January 8, 1997. VII. ADJOURNMENT: There being no further business before the Board, Ms. Golembe moved to adjourn the meeting at 8:30 P.M., seconded by Ms. Diggans and passed 4-0. They will become so after review and approval, which may involve some changes. -6 - 11/20/96 Project Name: COA 8-292-Continuation Project Location: Lot 18, Block 10 Del-Ida Park, Royal Court & NE 5th Terrace. The action requested of the Board is that of approval of COA 8-292 which incorporates the following aspects of the development proposal for a single family residence to be constructed for Tullia and Scott Taylor. • Variance 88-46 Variance to LDR Section 4.3.4(k) to allow 7.5' side setbacks where 15' is required. • Design Elements • Landscape Plans The subject property is a vacant lot located on the west side of Royal Court, approximately 20' north of N.E. 5th Terrace, in the Del-Ida Park Historic District. The subject property is located in the RO (Residential Office) zoning district. Pursuant - to LDR Section 4.3.4(K) the side setback requirement is 15'. As the proposed structure is set back only 7.5' from the side property lines, a variance for relief from the requirement is required to construct the residence. A 7.5' side setback is allowed for single family dwellings in the RM (Residential Medium High Density) and RL (Residential Low Medium Density) zoning districts; but not in the RO (Residential Office) where the subject property is located. At its meeting of September 18, 1996 the Board reviewed the floor plan and elevations and felt that-the design was inappropriate and that positive findings could not be made to LDR Section 4.5.1(E) Development Standards and recommended that the applicant not proceed with a variance request until the elevations had been revised. The Board suggested that the applicant discuss the plans with an architect who was sympathetic to new construction in historic districts. Additionally, the Board pointed out several award winning affordable house designs which had been commissioned by the CRA, which would be compatible with the historic district. The Board voted unanimously to table the review to a future date to give the applicant sufficient time to revise the elevations. HPB Meeting: November 20, 1996 Agenda Item: III.A. • HPB Staff Report • Tullia Taylor Variance 88-46&COA 8-292 Page 2 On October 16, 1996 the Board reviewed a revised plan at a pre-application hearing. After reviewing the elevations the board felt that the front facade was sufficiently similar to one of the CRA approved affordable houses to recommend that the applicant proceed with a formal COA and variance submittal. However, the Board recommended that an appropriate painted wood fence 5' or 6' in height be installed along the south property line from the front corner of the house to the rear property line to screen the south elevation from the streetscape. The proposed structure contains 2,013 s.f. of living space. It will be constructed of concrete block with a stucco finish. The roof has a single gable running the length of the house and will have a metal standing seam finish. A lower secondary gable roof covers the rear patio porch. The windows and sliding doors are to be factory finished white aluminum. The building is to be painted pale peach with a darker coral/peach trim. The roof is to be gray or light green. The garage projects 2' from the front wall with a gable roof over the projection. A 6' X 14' front porch is located on the south portion of the front wall, it will have a shed type roof supported by 3 columns. The house is located 7.5' from the side property lines; 25' from the rear property line and 29' from the front property line. VARIANCE It is appropriate to grant the variance to allow a single family residence to be constructed on the lot 7.5' from the side property lines. As the single family homes adjacent to the north on Royal Court all have 7.5' (or less) side setbacks, it would greatly alter the streetscape to have a 20' wide structure with 15' of space on each side. Granting the variance will maintain the massing of the existing structures on the street will provide visual continuity to Royal Court. DESIGN ELEMENTS OF THE STRUCTURE • As shown on the plans, the windows are a combination of awning, sliders or casement, and sash. Staff recommends that the windows have a uniformity of style; a double or single hung sash window with 6/6 or 1/1 panes would be most appropriate to the metal roof, which is the building's foremost stylistic element. HPB Staff Report Tullia Taylor Variance 88-46 &COA 8-292 Page 3 • French doors, as opposed to sliding glass would be more appropriate, at least on the south elevation. • The shutters on the front window are the correct size, but the COA approval should specify that they are operable and made of wood. • The building colors are compatible with the approved pallet. However staff suggests that a white or natural metal roof would be more appropriate than the suggested green. • The COA approval should also specify that a white painted wood fence 5' to 6' in height be installed along the south property line from the corner of the house to the rear property line. LANDSCAPE PLANS The landscape plans submitted with the application were reviewed by the City Horticulturist for conformity with the minimum landscape requirements for single family homes. Nonconformities were identified and the plans were returned to the applicant for revision. At this time, the landscape revisions have not been submitted. Therefore, the Board may, at the Chairman's discretion, review and act upon the revised plans, if the applicant presents them at the meeting. Alternatively, the applicant will need to return to the Board for final landscape approval. A courtesy notice has been sent to the Del-Ida Park Neighborhood Association representative. Comments, if any, will be available at the meeting. Variance 1. Approve or deny COA 1. Continue with direction. 2. Deny, with reasons stated. 3. Approve as presented. 4. The action requested of the Board is that of reconsideration of a condition of approval for COA-289 for the Stofft/Hasey Office Building. The subject property is located on the west side of N. Swinton Avenue, approximately 450 feet north of Atlantic Avenue, within the OSSHAD (Old School Square Historic Arts District) zone district. The project involves the relocation of the offices for Randall E. Stofft, Architects and law offices for Martin Hasey from Boca Raton to 42 N. Swinton Avenue. The development proposal incorporates the following: ❑ Construction of a 2-story 5,400 sq.ft. office building; ❑ Installation of 13 parking spaces (4 required spaces to be purchased from the City), 6 of which will beneath the second floor extension; ❑ Provision of roll-out carts to accommodate trash generated by the office use; and, ❑ Installation of associated landscaping. At its meeting of October 16, 1996, the Historic Preservation Board (HPB) approved Variance 88-45 and COA-289 along with the associated waivers, site plan, landscape plan and building elevations for Stofft/Hasey Office Building with conditions. One of the conditions was that the applicant pursue purchasing a handicap accessible parking space from the CRA, thus eliminating the on-site handicap space; or that the building be "flip-flopped" so the handicap space and sidewalk is located on the north side of the building/property, unless the applicant can provide justification which conclusively demonstrates that"flipping" the building is not feasible. The applicant, Randall Stofft, has submitted a justification statement (copy attached) regarding the basis for locating the sidewalk on the south side of the building. The building cannot be reversed because the walkway on the north side would affect the water retention areas. Further, the handicap space will be more convenient on the south side, as it would better serve clients and others who will utilize the parking lot. The concern regarding the lack of landscaping has been addressed by the provision of a 2' wide landscape strip with hedges and palms. • T >:>:':.;.:::::::.<N : . > >"> <> >isi>' > >``>'>_ i>' >< mmeimm ' «1 Pursuant to Section 4.1.2(5) of the Florida Accessibility Code for Building Construction requires that any commercial real estate property owner offering parking for the general public shall provide specially designated and marked motor vehicle parking spaces for the exclusive use of physically disabled persons pursuant to s. 316.1958 or s. 320.0848, or a license plate pursuant to s. 320.084, s.320.0842, s. 320.0843, or s. 320.0845. Further, accessible spaces shall comply with Section 4.6 of the Florida Accessibility Code for Building Construction. Based upon the above, the handicap accessible parking space must be located on site and access provided to the main entrance. While the CRA was considering providing an additional handicap parking space, in order to do so would require modifying recently constructed improvements and obtaining a variance to decrease the required stacking distance adjacent to Swinton Avenue. If the sidewalk is located on the north side of the property, the water retention areas will need to be modified. The City Engineer has stated that the retention areas are needed in order to meet South Florida Water Management District (SFWMD) criteria for . water quality. The applicant's engineer has submitted a letter (copy attached) stating that locating the sidewalk on the north side of the building would require deepening the retention areas, which would be a detriment to the aesthetics as well as create a hazard. - The revised plans provide the required 4' wide sidewalk as well as a 2' wide landscape area adjacent to the building. The proposed landscaping consists of an Ixora hedge and two Alexander Palms. The ability to provide landscaping may be further limited due to the footer of the building, which may encroach within the landscape area. Also, as the Alexander Palms mature, they will be in conflict with the eave. If the building is reduced in width by 2' and the building shifted to the north by 2', the desired landscape strip width could be accommodated and appropriate landscaping provided. In order to design it in this manner, would require the reduction of the perimeter landscape strip at the northwest corner of the building, as the adjacent parking will need to shift with the building. The only issue in question was the location of the handicap walkway if we could not purchase the CRA handicap space. This option was not possible. The question was raised to try to put this walkway on the north side, because it appeared we could not landscape between the building and parking lot. This is no longer an issue because we have created a two-foot landscape strip with a continuous hedge and palms, as shown on the side elevation, landscape plan and site plan. The building cannot be reversed because the walkway on the north side would cut into the water retention area. It should also be noted that the handicap space is more convenient on the south side. The walkway on the south side is better for our clients and others who will be in the parking lot area. As stated,we have provided the landscape areas shown between our building and the CRA parking lot, which is the only issue. Please approve this modification to the site plan. Our firm has designed a building that will be a level above any others in the area. It will be a showcase for my work and a building that you should be proud of. Project Name: COA-275 - Project Location: TED Center in the Masonic Lodge Building, 22 S.E. 1st Avenue. The action requested of the Board is that .of approval of COA-275 for renovation to the facade, including paint colors, awnings and sign. This proposal concerns only the south portion of the first floor of the building; the front facade of this portion faces east on S. E 1st Avenue. The south half of the first floor of the building has been leased to the TED center and is in the process of being remodeled for use as an office. The building is owned by Michael Weiner. The Masonic Lodge building was constructed in 1926 in the commercial Mission Revival style. During the 1950s the windows and doors (with the exception of the central entrance door) on the first floor of the east facade were boarded up and covered with faux brick. Several months ago the faux brick finish was removed from the southeast portion of the first floor and the original wood storefront windows and doors were exposed. The TED Center plans to rehabilitate and paint the facade, add awnings, and a projecting wall sign. • The faux brick will be stuccoed to approximately 1' north of the north storefront window. See the demarcation line on attached drawing. • Wood windows and doors will be repaired and painted white. • The stucco will be painted pale yellow. • Dark green awnings will be installed over the 2 double doors. The renovation restores some of the original features to the building, is appropriate to the historic district, and will greatly enhance the S.E. 1st Avenue facade. The building was listed in the National Register in September, 1986 and in the Local Register of Historic Places in October, 1988. The former freight room has been inappropriately enclosed and the canopy and loading dock on the east elevation have been removed. The building was last used as an architect's office and has been vacant since approximately 1990. The site plan and COA for the Sloan Hammock proposal was approved by the Board on December 6, 1995. However, neither the location of the sign nor its design was included in the approved site plan or COA. .... ....... ......... .......... ............ ....... This is a free standing, 2 faced wooden sign. It is 2'8" long, 4'9" high and the top of the sign post will be 7' from the ground. The background is blue and white and the text will be gold letters. It will be illuminated by 2 small spotlights. The sign will be located in the landscape island just north of the handicapped parking space and will be set back 10' from the property line. The sign was approved by the sign review committee on October 25, 1996. Staff recommends that the "vacancy" text be removed and that the phone number be made larger. The plans were approved by the HPB at its meeting of September 6, 1995 for renovations to the front facade and the addition of a canvas awning carport. When the project came for a building permit application on November 7, 1996, I noted the window changes. The applicant is requesting approval for the revised windows. The applicant is seeking approval to install 3 windows to the right of the front door; only 2 windows were approved. The new/replacement windows on the front facade are shown on the revised plans with a 1/1 pane configuration. The approved windows were double hung 6/6 divided light factory finished white aluminum.
