The action requested of the Board is that of granting a
variance from LDR Section 4 .3 .4 (K) to allow a canvas awning
carport to be constructed 1 ' from the side (east) property
line, where a minimum setback of 7 .5 ' is required.
The Board moved to approve the variance to Section 4 .3.4(K)
to reduce the side setback requirement from 7 .5 ' to 1 '
based upon positive findings with respect to Section
4 .5 . 1(J) ( 10(a) (b) (c) (d) and Section 4 .5. 1(J) (2) (b) with the
following condition:
* That the variance is granted solely for the purpose of
constructing a pipe supported canvas awning carport
and that no other type of structure or addition is to
be built within the required 7 .5 ' side setback.

Based upon positive findings with respect to Section
4 .5 . 1(E) (8) , Visible Compatibility, the Board moved to
approve COA S-040 as follows:
* The construction an an 8 'x20 ' awning carport.
* The awning is to be located on the east side of the
house, 41 ' from the front property line and 1 ' from
the side property line. Variance 88-33 was granted to
allow the 1 ' setback from the side (east) property
line.
* The carport is to have 1.5" pipe supports and 1" pipe
roof truss supports .
* The roof style is to be a central gable running
lengthwise, north to south.
* The color of the canvas is solid blue.

V. DISCUSSION AND ACTION ITEMS:
A. Status of the Relocation of the Two Historic Houses
from the Hillcrest Subdivision of West Palm Beach to
the Old School Square Historic District.
Per a letter submitted by John Johnson, Director,
HPBCPB the Hillcrest homes will be moved from West
Palm Beach on January 25th and arrive in Delray Beach
on January 27th via the Intracoastal Waterway. They
will then be moved to a temporary site at the
northwest corner of S.W. 1st Street and S.W. 1st
Avenue on January 28th. The homes will be enclosed by
a security fence with a locking gate until such time
as they are moved to their permanent lots.
B. Staff Comments Regarding the Status of the Survey of
Historic Properties Located on the East Side of South
Ocean Boulevard.
After some discussion with staff, the Board and
Carolyn Patton it was decided that Ms. Patton would
approach the Beach Property Owner' s Association about
putting a notice in their newsletter re starting a
historic district on S. Ocean Boulevard. The Board
would then be willing to hold an informal workshop
with the homeowners to answer any questions they might
have about becoming a historic district.
VI . REPORTS AND COMMENTS:
A. Reports from Historic District Representatives
Mrs. Riley, president of the Palm Square Home Owners
Association, informed the Board that her association
was in the process of creating a sign for the Marina
Historic District and would be bringing it before the
Board in the near future.
Mrs. Riley informed the Board that the City was
planning on putting a pump-out for boat sewage on the
dock at the City Marina. The location for the pump is
directly across from the lift station which is located
in the triangle at S.E. 7th St. and Marine Way. Mrs .
Riley felt this was not an appropriate place for the
unit to go and that it would be better suited at the
south end of the dock. Jeff Costello informed the
Board that a pump is required to dispose of sewage
waste from the boats in the marina and the cost for
installing the unit at the south end of the marina
would be substantially more than installing it at the
north end because of the proximity to the lift

station. A petition signed by residents of the Marina
Historic District opposed to the pump ' s location was
shown to the Board. After some discussion the Board
asked Dan Carter and Buck Miller to visit the site to
determine if the south location was feasible and to
report their findings to staff . The Board requested
staff to send a recommendation to the Parks and
Recreation Department based on Mr. Carter' s and Mr.
Miller' s site visit.
B. Board Members
Mr. Carter presented the landscape plans to the Board
for the Banker' s Row Beautification project.
C . Staff
None.
Mr. James Kolleda came before the Board in reference to the
removal of a storage room and the construction of a garage
at 325 S .E . 7th Avenue. Though the Board reviewed the
plans that Mr. Kolleda brought with him, they felt he
should make a formal submission, indicating the north, west
and south elevations of the garage addition and come before
the Board at its next meeting.
VII . ADJOURNMENT:

ITEM BEFORE THE BOARD
The action requested of the Board is that of granting a variance
from LDR Section 4 .3.4(K) to allow a canvas awning carport to be
constructed 1 foot from the side (east) property line, where a
minimum setback of 7 .5 feet is required.
BACKGROUND
The tract of land which is now Nassau Park was originally owned
by Mr. W.K. Gardner of Virginia Beach, VA. In 1915 when Mr
Gardener subdivided the property and named it Asbury Park
Heights, most of the lots in the subdivision were 25 ' wide and
Nassau Street was named Gardener Avenue. As the land east of
the canal was not incorporated into the City until 1923, no
building records are available prior to that date to indicate if
any homes in Asbury Park Heights were built and subsequently
demolished. Records show that the land was vacant in 1935 when
Mr. F.T. Bedford purchased Asbury Park, replatted the lots to a
width of 50 ' and renamed the subdivision Nassau Park. Gardener
Avenue became Jo-Jo Avenue. A prominent Delray businessman,
R.C. MacNeil joined with Mr Bedford to market the property and
prevailed on Mr. Bedford to change the name of the street from
Jo-Jo Avenue to Nassau Street. Mr. MacNeil commissioned
architect Sam Ogren to design the first house in the subdivision
which was completed in 1935.
The subject property is one of 4 houses built on Nassau Street
in 1935, the year construction commenced in Nassau Park. It may
be an adaptation of the original Ogren design, or may indeed
have been executed by Ogren. It is of frame construction in the
resort-cottage style which typifies the houses in the Nassau
Park Historic District. It was built with a freestanding garage
on the northeast corner of the lot. In 1941, as was common
practice at the beginning of WWII, the garage was converted to a
bedroom and bath and connected to the house.
ANALYSIS OF THE VARIANCE REQUEST
This variance relates to the construction of a canvas roofed,

pipe supported 8 ' x 16 ' carport to be located on the east side
of the house. The east supports of the proposed carport will be
placed 1' from the east property line. The front of the carport
will be set back 41 ' from the front property line. The original
ribbon strip driveway will remain intact, (see the attached
survey and site plan for explanation) . The purpose of the
carport is to provide shelter for automobiles, it will not be
used for general storage.
Pursuant to Section 4 .5. 1(J) Historic Preservation Board to act
on Variances; when the Historic Preservation Board acts on
variance requests it is guided by the following as an
alternative to the criteria normally used by the Board of
Adjustments.
( 1) That a variance is necessary to maintain the historic
character of property through demonstrating that:
(a) A variance would not be contrary to the public
interest, safety , or welfare.
This type of carport is actually an awning and does not prevent
air circulation or obstruct views. Built to the City's building
code requirements, it would not be contrary to the public
interest, safety or welfare.
(b) Special conditions and circumstances exist, because of
the historic setting, location, nature, or character
of the land, structure, appurtenance, sign, or
building involved, which are not applicable to other
lands, structures, appurtenances, signs, or buildings
in the same zoning district, which have not been
designated as historic sites or a historic district
nor listed on the Local Register of Historic Places.
The special conditions and circumstances were created in 1935
when the lots on Nassau Street were platted with 50 ' widths and
the houses were constructed to within 3 or 4 feet of the lot
lines. Additionally, most of the cottages were built as winter
resort residences and garages were not thought to be of primary
consideration. Of the few garages built on Nassau Street during
1930 's and 40 ' s most have been converted to additional living
space and do not meet the current setback requirements. The
garage which was originally constructed on the northeast corner
of this lot has a 3 ' side setback.
(c) Literal interpretation of the provisions of existing
ordinances would alter the historic character of the
historic district, or historic site to such an extent
that it would not be feasible to preserve the historic
character, of the historic district or historic site.

Unless a portion of the house were demolished, it would not be
possible to construct a carport which conforms to the current
setback requirements for the R-1-A zoning district.
(d) The variance requested is the minimum necessary to
preserve the historic character of an historic site or
of an historic district.
This variance request is the minimum necessary to construct a
usable carport.
How a minimum variance request for construction of a carport
relates to preserving the historic character of the historic
district and streetscape bears discussion and aesthetic
consideration.
Staff proposes the following considerations:
1. With respect to the Secretary of the Interior's
Guidelines, onsite parking should be as unobtrusive as
possible and assure the preservation of the historic
relationships between the building and the landscape.
Further, the Delray Beach Design Guidelines state that
every attempt should be made to obscure vehicular use
areas from pedestrian view. One of the ways to
accomplish this is to provide a sheltered and
designated parking place which is integral to the site
or structure and tends to mitigate the presence of a
parked car in the front yard. In this case the awning
carport is integrated to the facade of the house and
is further enhanced by the original ribbon strip
driveway.
2 . The historic house originally had a garage so that the
automobile had a sense of "place" and was screened
from the street.
3. The original driveway is existing and the house was
positioned on the lot to accommodate a car housed in a
garage to the east side of the house.
Pursuant to Section 4 .5. 1(J) (2)
(b) The variance would not significantly diminish the
historic character of the Historic District or site.
It is staff' s opinion that by adhering to the Secretary of the
Interior's Guidelines and the Delray Beach Design Guidelines
with respect to parking being as unobtrusive as possible to the
historic site and streetscape, this carport will enhance rather
than diminish the Nassau Park Historic district.

ITEM BEFORE THE BOARD
The action requested of the Board is that of conceptual
design approval for a pipe supported canvas awning carport.
BACKGROUND
Technically, this carport is considered an awning with
exterior supports and does not require Board review. If its
location had not required a variance from the side setback
requirements it would have be been reviewed by staff. If the
variance is granted to allow the carport's construction the
applicant will provide color samples and details for staff's
consideration. Appropriate awnings are detailed in the
Design Guidelines.
DESIGN ANALYSIS
Simple awning carports are appropriate to the Nassau Park
Historic District. They were widely used in south Florida
in the 1930 ' s and 40 's before carports became a part of the
physical roof line of the 1950 's Florida "ranch-house"
vernacular. These awning structures present an open and
airy pavilion which blends well with tropical landscaping,
and while allowing light and air to circulate, give shelter
and a designated "place" for cars to be parked. More
importantly, they do not intrude on the principal
structure's original roof line and chimney configuration but
merely appear as a colorful awning projection.
This proposed carport awning is of the shed style, it has a
single slope roof from the house to the east supports. The
shed style is appropriate as it does not detract from the
roofline of the historic residence.
The fabric is to be canvas and the color will be solid blue
to match the house trim or possibly blue and white stripe.
The pipe supports are to be painted white.
RECOMMENDED ACTION
Based on making positive findings with respect to aesthetic
compatibility to the Delray Beach Design Guidelines, approve
the carport design elements subject to staff approval.
