I. ROLL CALL:
The meeting was called to order by the Chairman at 6:00 P.M. Upon roll call it
was determined that a quorum was present.

IL APPROVAL OF MINUTES:
The Minutes for the Regular Meeting of February 21, 1996, and March 6, 1996
were before the Board for consideration. Ms. Morgan moved to approve the
Minutes as presented. The motion was seconded by Ms. Farrington and passed
by a vote of 4-0.
III. PUBLIC HEARING ITEMS:

As the applicant for Agenda Item IV.A. was not yet present, Agenda Item IV.B. was
heard first.
IV. CERTIFICATES OF APPROPRIATENESS:
B. COA Pre-Application: 48 W. Atlantic Avenue (Check Cashing Store);
Old School Square Historic District; William J. Holtel, Authorized Agent.
Item Before the Board: The action requested of the Board is that of a pre-
application review of modified site plan and elevations.
Action Taken by the Board: No formal action was required. The following
is a brief narrative of the pre-application discussion.
Staff presented the following comments from the Planning Department
with respect to the parking lot design:
• 45 degree angled parking should be provided. This would eliminate
the need to reduce the 5' landscape strip along the east property line
as well as providing the minimum 4' wide walkway on the west;
• The parking space at the northeast corner of the site must be
eliminated to provide the required 20' stacking distance;
• Two handicapped spaces may be required;
• The dumpster must be angled to accommodate Waste Management
vehicles.
• The sidewalk should be extended from the rear parking area to the
sidewalk along S.W. 1st Avenue; and,
• In order to accommodate the required drainage retention,
approximately 5 of the rear parking spaces may need to be eliminated.
The Board suggested that the applicant revise the parking lot plan to
conform to the above comments.
The elevations were not well received. The Board recommended that the
applicant select a specific architectural style and design the building
accordingly, as opposed to trying to incorporate an eclectic range of
facade elements which exist along Atlantic Avenue.
Staff pointed out that the revised plans had not been reviewed by the
Community Redevelopment Agency or the West Atlantic Architectural
Review Commission. However, both reviews will be necessary before the
applicant submits plans for a formal COA application to the Historic
Preservation Board.
A. COA 8-278: Cinnamon Cafe; 85 S.E. 6th Avenue; Contributing Building,
The Blank House, Individually Listed in the Local Register of Historic
Places; Frank & Nancy Leopoldo, Owners.
Item Before the Board: The action requested of the Board is that of
approving a COA for and exterior staircase and egress door, a new
entrance on the east elevation, exterior paint colors, and modifications to
the existing landscaping.
It was moved by Ms. Morgan, seconded by Ms. Farrington and passed 4-
0 to approve COA 8-278 based upon positive findings with respect to LDR
Section 4.5.1(E)(7) for the exterior staircase*with the following conditions:

• That a trellis be installed on the west side of the staircase and be
planted with a climbing vine to screen the staircase from the street;
and,
• That the egress door at the top of the stairs meet all life safety code
requirements.
• The Blank House has been a two story single family residence since its
construction; the new owners (the applicants) are in the process of
converting it for use as a coffee bar and bakery, and hope to utilize the
second floor of the building as part of the public seating area. Use of the
second floor for this purpose, according to the ADA rules, requires and
elevator to be installed. The applicants have requested a consultation
regarding an exception to the ADA elevator requirement based upon the
historic nature of the structure. If the exception to the elevator
requirement is granted, the public will have access to the second floor and
it will be necessary to construct an exterior staircase as a means of
egress according to the life safety code. If the exception to the elevator is
not granted the public will not be able to use the second floor and,
depending on the proposed use of the space, it may not be necessary to
construct the staircase. The staircase will only be constructed if it is
deemed necessary by the Chief Building Official.
It was moved by Ms. Morgan, seconded by Ms. Farrington and passed 4-
0 to approve COA 8-278 based upon positive findings with respect to LDR
Section 4.5.1(E)(7) for the new entrance on the east elevation as follows:
• Closure of the Existing Entrance: The metal louvers and door on the
existing entrance are to be removed and to be replaced with the
existing double windows which are located just to the north of the door.
The balance of the opening is to be finished in wood clapboard to
match the existing.
• Construction of the New Entrance: The new entrance is to be
constructed as presented.
It was moved by Ms. Morgan, seconded by Ms. Farrington and passed 4-
0 to approve COA 8-278 based upon positive findings with respect to LDR
Section 4.5.1(E)(7) for the exterior paint colors and landscape plan as
follows:
• That the body of the house is to be bisque. All trim, including the
cornerboards, staircase and handicapped ramp is to be white. The
new shutters are to match the existing and will be installed where
missing, and all shutters will be painted terra cotta; and,
• The modified landscape plan is to be approved by the City
Horticulturist.

V. DISCUSSION AND ACTION ITEMS:
A. Make a Recommendation to the Planning and Zoning Board with Respect

Action Taken by the Board: The Board felt that all of the Board members
should be present before taking action on this item.
It was moved by Mr. Johnson, seconded by Ms. Morgan and passed 4-0
to table the recommendation to the Planning and Zoning Board with
respect to a text amendment to LDR Section 2.2.6(B)(2), Special
Qualifications for Historic Preservation Board Membership, until such time
as all of the Board members could be present.

The action requested of the Board is that of approval of COA 8- 278 for an
exterior staircase and egress door on the north elevation; a new entrance on the
east elevation; exterior paint colors; and modification to the existing landscaping.
BACKGROUND
The Blank house was constructed c. 1907 and was listed in the Local Register of
Historic Places on June 6, 1995, and in staffs opinion is eligible for listing in the
National Register; a copy of the designation report is attached Some renovation
to the structure was done prior to its designation; after designation the HPB
approved the construction of the handicapped access ramp on the east elevation
of the structure. The building has been purchased by the applicants, Mr & Mrs
Leopoldo, who are planning to convert the structure from a single family
residence to a coffee bar and bakery which will be known as the Cinnamon Cafe.
Because of the conversion, an exterior staircase is required by the life safety
code.
Exterior Staircase
The proposed staircase is to be constructed of wood and installed on the north
facade, with the staircase entrance facing east. The existing window on the
second floor north elevation will be removed and replaced with a wood door with
a glass vision panel on the upper portion.
New entrance on the east elevation
The new entrance door will be installed to the north of the existing door on the
east facade; the north portion of the double window to the right of the existing
door will be removed to accommodate the new entrance. The door is to be wood .

with a glass vision panel on the upper portion. The shed roof will have a gable
installed over the entrance. The existing handicapped ramp will be extended to
the north to provide access to the new door.
Exterior paint colors.
The body of the house will be beige. The trim including the cornerboards and
porch railing will be white. Tangerine is proposed for the shutters and possibly for
the window surrounds. A sample of the color scheme is painted on the south
side of the building. The Board should disregard the alternating clapboard
stripes, these were painted for samples only; the body of the building will be a
beige. Color chips will be available at the meeting.
Landscaping
The site contains mature landscaping and will be modified according to the
attached plan.

Staircase
Because the proposed staircase significantly alters the original north elevation,
staff recommended that the architect locate it to the rear (east elevation) of the
structure. However, in reviewing the project with the City's building department, I
am told that a emergency stair exit cannot traverse a roof unless the roof has
been built to withstand a two hour fire. In view of these requirements it seems
unlikely that the staircase can be relocated to the rear. Staff suggests that a
drawing with measurement of the existing north facade be made and placed in
the file for future reference. Staff also suggests that a trellis be constructed on
the west portion of the staircase (visible from N.E. 6th Avenue) and be planted
with a vine which will screen the rear of the stair from the street. -
New entrance on the east (rear) elevation.
The Secretary of the Interior's Guidelines state:
Identify, retain and preserve windows and their functional and decorative
features which are important in defining the overall historic character of
the building. Not recommended; Removing or radically changing
windows; changing the number, location, size of glazing pattern of
windows.

Identify, retain and preserve roofs, this includes the roof's shape. Not
recommended; Changing the configuration of a roof by adding new
features so that the historic character is diminished.
The Delray Beach Design Guidelines state:
It is inappropriate to block in windows.
It is inappropriate to change the configuration of a roof by adding new
features.
The new entrance door alters the original elevation by removing one of the
double windows and by the addition of the superimposed gable on the original
shed roof. Additionally the handicapped access is enlarged and becomes more
prominent. The lowest level of impact on the rear elevation would be provided if
the existing entrance were utilized. -
However, the original entrance enters into a 12' x 6.5' room which, while not
specified on the floor plan, will probably be used for storage and associated
equipment. If the existing entrance is maintained, this room becomes a foyer to
the cafe and results in essentially wasted space which cannot be utilized. The
first floor of the Blank House is only 970 s.f. and the loss of 78 s.f. might cause a
hardship to the proposed restaurant facility. Additionally, there is a step between
the room and the rest of the floor area which would have to be ramped for
handicapped access.
All of the changes mentioned above relate to the rear facade, and while visible to
the interior of the site, are not visible from the street. The Secretary of the
Interior's Guidelines state that the Standards are to be applied to specific
rehabilitation projects in a reasonable manner, taking into consideration
economic and technical feasibility.
Exterior paint colors.
The beige and white and tangerine color scheme is appropriate, providing the
tangerine is used only on the shutters.

While owners of designated historic properties should have a range of appropriate colors
from which to choose. the selected color shouldn't detract from the integrity of the
building or subvert the historical contribution of the building to the community. And even
though paint color is considered cosmetic and a non-material change, preservation board
members should be mindful of the consequences of permitting an inappropriate change,
whenever a choice is made that seriously uu.dennines the credibility of a contributing
historic building.
Worthy of being listed in the National Register of Historic Places,the Blank House serves
as a-reminder of the area's agricultural and rural nature - a time without style or formal
architectural references. Horizontal weatherboards serve as its exterior wall surface
material. without decoration. Except for the sparse detailing of wood shutters, porch
columns. screen door: or roof brackets, designated vernacular buildings, such as the
Blank I locust, shouldn't be decorated. Colors more appropriate for an American Colonial,
or Colonial Revival style, are not appropriate for the Blank House.
The -application of coats of color, other than white, to the weatherboards causes the
building: 1) to Iusc its historical name of reference; 2) relinquish its almost century-old
identity: 31 and cantoullage its important contribution the south_Florida historical
landscape.
- I urge the Hoard to recommend that the a fisting white weatherboards be retained and that
the cinnamon color ranee be permitted for trim only.

A COA pre-application for site plan and design review. No formal action is

This project came to the Board for a pre-application review at the meting of
February 21, 1996. A copy of the findings from the meeting are attached to this
report.
The site plan has been considerably revised and improved. A one way entrance
to the parking lot from Atlantic Avenue is proposed; angled parking prohibits
vehicular egress to Atlantic Avenue.
The building has been enlarged and relocated on the property and front
entrances have been provided. The elevations are conceptual and will be
revised with direction and suggestions from the Board.

The twelve foot entrance to the parking lot significantly reduces its visual impact
and the increased landscape buffer provides additional screening.
The relocation and increased size of the building helps to mitigate the visual
impact of the parking area from Atlantic Avenue.

A COA pre-application for demolition; and design review of the elevations and
site plan for proposed new construction. No formal action was required.
ACTION TAKEN BY THE BOARD
No formal action was required. The following is a brief narrative of the pre-
application discussion.
Staff explained that the primary area of discussion and direction would be the
building elevations, as the planning staffs comments and recommendations
regarding the site plan had already been transmitted to the applicant. Jeff
Costello, Senior Planner explained that, when revised, the site plan would
conform to the development standards. However, the Board felt that there were
serious problems with the site plan and suggested that they should address their
concerns with the applicant at the pre-application review.
The Board's major concern with the site plan was the prominence and location of
the parking lot on Atlantic Avenue and fact that the entrance to the lot was
accessed from Atlantic Avenue.
The applicant stated that he was willing to work with the staff and the Board to
revise the building elevations, landscaping, etc., but that it was imperative that
his business have a parking lot on, and accessible from, Atlantic Avenue.
There was some discussion regarding the building elevations; the Board
suggested that the applicant's architect look at the Block 76 Atlantic Avenue
facade and the proposed renovation for the Haitian Art Center building for
examples of suitable urban styles which are appropriate to the Old School
Square Historic District.

However, it became apparent that the site plan was of major concern as it would
relate to the revised design of the building. The applicant and staff suggested
that the Board indicate how it would vote if the parking lot and entrance
remained on Atlantic Avenue, before the applicant went to the expense of
redesigning the building. Three of the members felt that approval would depend
on the redesign and possible relocation of the building on the site and the
relationship of the building to the parking lot and Atlantic Avenue access. The
remaining three members said they could not support the parking lot and access
on Atlantic Avenue regardless of the building's design. At this point the applicant
stated that he would withdraw the proposal and continue his business in the
existing building as it would be impossible for him to have a profitable Check
Cashing Store without Atlantic Avenue parking and access.

Subject: Amendment to the Land Development Regulations Section
2.2.6(B)(2), Special Qualifications for Historic Preservation Board
Membership.
The action requested of the Board is that of recommending to the Planning &
Zoning Board that the following text amendment to Section 2.2.6(B)(2) be
recommended to the City Commission.
In 1980 Congress amended the National Historic Preservation Act to provide for
a process of certifying local governments to participate in the federal historic
preservation program. This amendment extended the federal/state partnership
to include qualified local governments, enabling them to participate more directly
in the federal preservation program, becoming essentially a third member of the
partnership, and offering them a better opportunity to direct preservation efforts
at the local level. According to the regulations, each State Historic Preservation
Office is responsible for preparing state guidelines for certifying local
governments.
Delray Beach became a Certified Local Government (CLG) on November 22,
1988. In order to maintain certification a local government must meet certain
prescribed criteria as set forth by the Florida Bureau of Historic Preservation.
One of the criteria is to maintain a qualified historic preservation board. The
current Board meets all of the criteria for qualification, but to insure that this
standard is maintained it is necessary to amend the LDRs to clarify qualification
for membership.
The current LDR text, Section 2.2.6(B)(2), was drafted when the HPB Ordinance
was adopted and before the City became a CLG and was adequate at the time.
It reads as follows:
It is intended that members of the Board will be persons of knowledge,
experience, judgment, and background, and have personal or
professional interest or experience in historic restoration and preservation.
And that they will have the ability and desire to act in the public interest
and represent, insofar as possible, the various special personal and

professional interest required to make informed and equitable decisions
concerning the preservation, and conservation, and protection of historic
districts and structures.
The Florida Bureau of Historic Preservation's Guidelines state that CLGs shall
establish an historic preservation review board composed of professional and lay
members in accordance with the paragraph below.
To the extent available in the community, the local government shall
appoint professional members from the disciplines of architecture, history
architectural history, planning archaeology, or other historic preservation
related disciplines such as urban. planning, American Studies American
Civilization, cultural Geography or Cultural Anthropology. Lay persons
who have demonstrated special interest, experience, or knowledge in
history, architecture, or related disciplines shall make up the balance of
Board membership, in the event that there are not enough professionals
in the community.
The proposed text amendment to Section 2.2.6(B)(2) is compatible to the
CLG guidelines and reads as follows:
To the extent that they apply, the City commission shall appoint
professional members from the disciplines of architecture,
landscape architecture, history , architectural history, licensed
contractor familiar with restoration, planning, archaeology, or other
historic preservation related disciplines such as design, urban
planning, American studies, American civilization or cultural
geography. Lay persons of knowledge, experience and judgment
who have an interest in historic preservation shall make up the
balance of the Board, in the event that there are not enough
professionals who are willing to serve. Preference should be given
to professional and lay persons who own property within historic
districts or whose property is individually listed on the Local
Register of Historic Places.
This item came before the Board at its meeting of January 18, 1995. It was
suggested that revisions to the language of the proposed text amendment be
made with respect to the appointment of historic property owners to the Board.
The text was revised and presented to the Board at the meeting of February 15,
1995. As there were only four members present and there was no consensus on
the wording of the text, the item was tabled. The lack of consensus revolved
around the fact that the State requires a CLG to have a professional review
board to the extent that they are will to serve, with the balance of the board being

made up of knowledgeable lay people. The four members present felt that
professional status should not be a requirement of Board membership.

• The CLG agreement between the City and the Florida Bureau of Historic
Preservation states in paragraph 3(a) that the City shall establish an
adequate and qualified historic preservation review board composed of
professional members (to the extent that they are willing to serve) as per
Florida CLG Guidelines (B)(2)(a).
• Current qualifications for appointment are not as specific in terms of
professional historic preservation disciplines as those set forth by the CLG
Guidelines. Nor do they reflect the fact that professionals in those disciplines
be appointed, to the extent that they are willing to serve.
• As the Board serves as a representative of a CLG, the qualifications required
for appointment, as stated in the LDRs, should be updated to conform to the
State's guidelines for qualification.
• In reviewing the City's preservation ordinance, the State's CLG coordinator
strongly suggested that our qualification for membership be brought into
conformity with the CLG Guidelines.
