Based upon positive findings pursuant to Section
4 .5. 1, (Historic Preservation) the Board moved to
approve COA 8-211 for exterior modifications to the
west (rear) elevation with the following condition:
* That the internal pedestrian path which connects
Lot 3 to the Sundy House be completed as soon as
possible.
Sandy Jamison moved for approval of COA 8-211, seconded by
Pat Healy-Golembe. The vote was as follows: Christine
Bull - Yes; Daniel Carter - Yes; Sandy Jamison - Yes; Pat
Healy-Golembe - Yes; Buck Miller - Yes; Margie Miller -

Mrs . Miller requested the status on 303 N. Swinton
Avenue. Mrs. Cayce provided the Board with a copy of
the letter she had sent to Mr. Landman (property
owner) and stated that she had spoken with him and he
would be coming before the Board at their next meeting
for approval on his modifications.
Mrs. Sloan inquired about the "orange peel" style
stucco on the wall at 401 N.E. 2nd Avenue (Robert
Turner, owner) . Mrs . Cayce stated that she would
check to see if it had been approved by the Board.
C. Staff:
Mrs . Cayce informed the Board that the City Commission
has authorized the Community Redevelopment Agency to
make application for and accept as agent for the City
the State Historic Preservation Grant for the Florida
Atlantic University Complex project for $242,800. 00.
The grant will provide for the relocation of 1 or more
historic residential structures from the Hillcrest
Neighborhood in West Palm Beach to a site within the
City, renovation of the buildings, and the utilization
of the buildings, with one building to be used as a
State office for the Historic Palm Beach County
Preservation Board.

Sundy House

Modifications to the west elevation to accommodate an
enlarged kitchen.
ITEM BEFORE THE BOARD
The action before the Board is that of granting approval of
COA 8-211 for a non-impacting site plan modification and
exterior design modifications to, the Sundy House. The
property is located at the southwest corner of S. Swinton
Avenue and S.W. 1st Street, in the Old School Square
Historic District.
BACKGROUND
The Sundy House was built in 1902 . It is located in the Old
School Square Historic District and was listed in the
National Register of Historic Places on January 16, 1992 .
Louis Jenson bought the property, previously residential,
with the intention of converting its use to a retail antique
gallery. A few months after the restoration project
commenced, Mr. Jensen proposed to incorporate a tearoom with
luncheon service into the plans. On September 23, 1991 the
Historic Preservation Board approved the mixed use concept
and through the COA process granted approval for the
construction of a dining deck and granted associated
variances for parking and landscaping. The mixed use to
accommodate a tearoom and a retail antique gallery has been
successful and Mr. Jensen is proposing to enlarge the
original kitchen area by enclosing a 10 ' x 8 ' rear porch.
The expanded kitchen will allow the restaurant to prepare
hot food on site. The current menu is limited to sandwiches,
salads and soups.
PROJECT DESCRIPTION
The modifications relate chiefly to the west (rear)
elevation. If approved, the modifications will allow the
existing kitchen to be enlarged; construction of more
appropriate entrances to the toilet facilities; and permit a
more efficient traffic flow between the interior rooms and
the dining porch and deck. The outdoor dining area is
currently accessed through the kitchen.

Visibility From the Street
The only exterior change which will be visible from the
street (S.W. 1st Street) is the installation of two kitchen
ventilator stacks on the northwest portion of the first
floor roof:
Exhaust vent, 2 'x 2 ' Air intake, 2 'x 4 '
The vents will project 3 ' 8" above the roof.
Visibility On-site ( Rear Parking Lot and South Dining
Areas)
The exterior changes which are not visible from the street
are as follows (see plans for explanation) :
( 1)Reopen a window on the west wall of the kitchen which
is currently boarded up and covered with aluminum
jalousies . The aluminum jalousies are to remain which
results in no change to the exterior.
(2)Enclose an 10 ' x 8 ' porch on the west
facade adjacent to the south wall of the kitchen as
follows :
Extend the west wall of the kitchen 10 ' to the
south.
Remove the existing south wall and window of the
kitchen which face the porch.
Construct a new wall and door 10 ' to the south.
(3) Remove a window in the ladies toilet room which faces
the dining porch and replace with a door.
(4) Remove a window in the room to the east of the dining
porch and replace with a door.
All new exterior walls are to be finished in clapboard
siding to match the existing. New exterior doors to be wood
to match existing.
ANAL Y S I S O F EXTERIOR CHANGES
The exterior modifications do not impact the building's
visibility from the street with the exception of the roof
vents .
The porch enclosure changes the massing of the building's
west facade. It creates a solid wall where none existed and
obliterates that portion of the original porch which still

remains . However, its visual impact to the surrounding
site is minimal, and the required fire escape already
changes the massing and compatibility of the west facade.
The porch enclosure is not an irreversible alteration. This
modification can be considered consistent with reasonable
compromises when the viability of an historic structure is
dependant on successful adaptive reuse.
Replacing windows with doors, when the replacement does not
effect the rhythm of a wall 's fenestration, and is not
visible from the street, is deemed acceptable.
Exterior changes with respect to the building's National
Register Designation.
When a building is listed in the National Register and is
located within an historic district, or individually listed
in a local register, the local guidelines for preservation
apply. However, when the owner of such a building seeks
federal tax certification for rehabilitation expenses, (which
is available for commercial properties) , he may be more
strictly accountable to the Secretary of the Interior's
Guidelines than local guidelines require. Therefore, the
rehabilitation of properties eligible for federal tax
credits is certified by the National Park Service through
the State Historic Preservation Officer for compliance with
the Guidelines.
The Sundy House has been certified for federal tax purposes
and all previous alterations have been approved by the
National Park Service as being consistent with the Secretary
of the Interior's Standards. Staff recommends that Mr.
Jensen consult with the Florida Division of Historical
Resources to determine that the proposed alterations are
consistent with the Park Service's interpretation of the
Secretary's Guidelines and would not result in a loss of
the previous tax certification.
OTHER ITEMS
Parking Spaces
The following analysis is being provided to clarify the
number of parking spaces required, and the number provided,
for the Sundy House and the Sundy Estate.
The Sundy Estates property is comprised of 3 lots, all of
which are owned by the applicant, Louis Jensen. Utilization
of the 3 lots is as follows:
LOT 1
* Sundy House Restaurant and Antique Gallery.

* Sundy Apartments: 8 units (4 one bedroom & 4
efficiencies)
* Two parking lots : 4 spaces facing S.W. 1st
Avenue & 24 spaces between the two buildings
(total parking on Lot 1 = 28 spaces) .
LOT 2
* One single family residence.
* One 4 unit apartment: (4 one bedroom apartments) .
LOT 3
* One 21 space parking lot
Pursuant to Section 4 . 6 .9 (C) (3) (d) , Parking for Restaurants,
12 spaces are required per 1,000 sq. ft. of total floor
area. The Sundy House restaurant area, including the
enlarged kitchen comprises 1,327 sq. ft. , which requires 16
parking spaces for the restaurant.
Pursuant to Section 4 .4 .24(G) (4) Retail Parking in OSSHAD, 1
space per 300 sq. ft must be provided. The Sundy House
retail area, including the 2nd story, comprises 1,536
sq.ft. ,which requires 6 parking spaces
Restaurant use, 1,327 sq. ft.
@ 12 spaces/1,000 sq,ft 16 spaces
Retail Use, 1,536 sq. ft. ,
@ 3 spaces/300 sq. ft. 6 spaces
Total retail/restaurant parking 22 spaces
Required parking pursuant to Section 4. 6.9(C) (2) ( (c) ,
Multiple Family Structures, and Section 4.6 .9(C) (2) (a) ,

Sundy Apartments 14 spaces
Sundy Apartment Annex 8 spaces

Total residential parking 24 spaces
The number of parking spaces required for the Sundy Estate
is 46 .
When approval was granted for mixed use retail/restaurant,
insufficient parking was provided to serve the Sundy House
and the Sundy Apartments, located on Lot 1. Lot 3 was

vacant and had not been developed for parking. A variance
was granted by the HPB to reduce the number of spaces for
Lot 1 by 9 . One of the criteria for granting the variance
was the concept of shared parking. As the tearoom would
serve only lunch and tea, the parking demand would be the
maximum during the hours when the apartments required less .
With the development of Lot 3 into a 21 space parking lot
the shared parking concept is no longer relevant
In summary:

The site plan for Lot 3 was approved by the HPB on February
19 , 1992 with the condition that an internal mulch surfaced
pedestrian walking path (as shown on the site plan) would be
constructed to connect Lot 3 with the Sundy House on Lot 1 .
This path has not been installed. It is appropriate to make
its installation a condition of approval for COA 8-211 .
RECOMMENDED ACTION
Based on making positive findings pursuant to Section 4 . 5 . 1,
Historic Preservation, that the exterior alterations are
appropriate for the structure and for its adaptive reuse,
Approve COA 8-211 with the following condition:

Avenue.
Dear Mr. Landman,
On January 20, 1993 the Historic Preservation Board approved
Certificate of Appropriateness 8-201 for your rehabilitation
project at 303 N. Swinton Avenue. Exterior elements (e.g.
windows, doors, roof styles) must conform in every respect
to the elevations approved with the Certificate of
Appropriateness. The approved plans call for clear glass
windows on the west facade above the decorative wall and
under the area where a new hip roof was installed. Glass
blocks have been installed in place of the approved windows.
In a letter to you dated January 27, 1993 I explained that
if you altered any of the approved exterior elements it
would be necessary for the Historic Preservation Board to
approve the changes. A Certificate of Occupancy will not be
granted for the project until the Historic Preservation
Board has approved the glass blocks, or the approved windows
have been installed.

REDEVELOPMENT AGENCY OF THE CITY OF DELRAY BEACH TO
MAKE APPLICATION FOR AND ACCEPT AS AGENT FOR THE CITY
OF DELRAY BEACH THAT CERTAIN STATE HISTORIC
PRESERVATION GRANT FOR THE PROJECT KNOWN AS THE
FLORIDA ATLANTIC UNIVERSITY COMPLEX IN THE AMOUNT OF
$242,800. 00 WHICH GRANT WILL PROVIDE FOR THE
RELOCATION OF ONE OR MORE HISTORIC RESIDENTIAL
STRUCTURES FROM THE HILLCREST NEIGHBORHOOD IN WEST
PALM BEACH, FLORIDA, TO A SITE WITHIN DELRAY BEACH,
RENOVATION OF SAME, AND ULTIMATE UTILIZATION FOR
AMONG OTHER PURPOSES A STATE OFFICE FOR THE HISTORIC
PALM BEACH COUNTY PRESERVATION BOARD; PROVIDING AN
EFFECTIVE DATE AND FOR OTHER PURPOSES.
WHEREAS, the Community Redevelopment Agency of the City of
Delray Beach ("CRA") , pursuant to its Resolution No. 93-14 , has
requested the City Commission of the City of Delray Beach to authorize
the CRA to make application for and accept as Agent for the City of
Delray Beach that certain State Historic Preservation Grant (the
"Grant") for the project known as the Florida Atlantic University
Complex in the amount of Two Hundred Forty-Two Thousand Eight Hundred
Dollars ($242,800.00) which such Grant would provide for the
relocation of one or more historic residential structures from the
Hillcrest neighborhood in West Palm Beach, Florida, to a site within
{ Delray Beach, Florida, the renovation of same and the ultimate
utilization for among other purposes a State office for the Historic
Palm Beach County Preservation Board; and
{
WHEREAS, the City Commission of the City of Delray Beach
recognizes that the CRA currently does not have a provision in its
Community Redevelopment Plan for it to directly apply for and accept
said Grant on its own behalf and that the CRA has indicated its
intention to commence the processing of an Amendment to its Community
Redevelopment Plan to incorporate a Historic Preservation component
whereby it would in the future be able to apply for and receive such
Grants on its own behalf; and
WHEREAS, the CRA has indicated its desire to administer as
the agent of the City of Delray Beach the subject State Historic
Preservation Grant for the project known as the Florida Atlantic
University Complex pursuant to an Interlocal Agreement to be
negotiated between the City of Delray Beach and the CRA; and
WHEREAS, the Grant, if awarded, would require the City of
Delray Beach to fund the moving expenses for such historic
structure (s) up to a maximum cost of Seventy Thousand Dollars
($70,000.00) to Lot(s) within the City of Delray Beach, owned by the
City of Delray Beach, or alternatively to authorize the CRA to provide
Lot (s) owned by it for such purpose to relocate such historic
structure(s) to CRA-owned Lot(s) ; and
WHEREAS, the City Commission of the City of Delray Beach
hereby indicates its intention, as a part of said Grant application,
to enter into a Lease for the subject historic structure and Lot to
which it is relocated with the Historic Palm Beach County Preservation
Board of the Department of the State of Florida upon terms to be
negotiated between the parties with the underlying premise that the
rent would be One Dollar ($1 .00) per year for a minimum of ten (10)
years and the tenant would be fully responsible for all maintenance
and repairs to the structure and grounds and to carry all such
insurance on the subject property and structure as the City of Delray
Beach would reasonably require.
• NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1 . That the City of Delray Beach, Florida, hereby:
(a) Authorizes the CRA to apply for, receive the award of
and administer the Florida Atlantic University Complex
Grant from the State of Florida as the Agent for the
City of Delray Beach, Florida, in the amount of Two
Hundred Forty-Two Thousand Eight Hundred Dollars
($242,800.00) ;
(b) Agrees to provide funding for the moving expenses of up
to - a maximum cost of Seventy Thousand Dollars
($70,000.00) for historic structure (s) from the
Hillcrest neighborhood in the City of West Palm Beach,
Florida, to Lot(s) within the City of Delray Beach or
to Lot(s) owned by the CRA within the City of Delray
Beach. The CRA will amend their Redevelopment Plan to
authorize the foregoing.
Section 2. That the City Manager is hereby authorized to
negotiate the terms of an Interlocal Agreement with the CRA to provide
for the CRA' s participation in this project as the Agent of the City
of Delray Beach.

Section 3 . That the City of Delray Beach hereby requests
the Community Redevelopment Agency of the City of Delray Beach to
prepare an Amendment to its Community Redevelopment Plan to provide a
Historic Preservation Grant Project to allow the CRA to fully
participate in this Grant, to provide Lot(s) owned by the CRA for the
relocation of such historic structure (s) and to provide for
reimbursement to the City of Fifty Thousand Dollars ($50 , 000 . 00) of
the moving expenses incurred pursuant to such Grant.
Section 4 . That this Resolution shall take effect
immediately upon passage.
PASSED AND ADOPTED in regular session on this the 8th day of
June, 1993.
