A. Pursuant to LDR Section 4.5.1(C)(3)Designation Procedures, the Board will
conduct a preliminary evaluation with respect to the historic status of six
contiguous properties located at 501, 511, 521, 601, 611 and 701 S. Ocean
Boulevard. The purpose of the evaluation is to determine if the properties
generally conform to the historic criteria necessary to initiate nomination to the
Local Register of Historic Places as a historic district.

I. ROLL CALL:
The meeting was called to order by the Chairman at 6:00 P.M. Upon roll call it
was determined that a quorum was present.
MEMBERS PRESENT: Buck Miller, John Vaughan, John Johnson, Vera
Farrington, Julie Morgan, Debora Turner
MEMBERS ABSENT: Pat Healy-Golembe
STAFF PRESENT: Pat Cayce, Diana Mund
II. ELECTION OF OFFICERS:
A. Chairman
Chairman Miller declared the floor open for nominations for the position of
Chairman. Mr. Miller moved to nominate Mr. Vaughan, seconded by Mr.
Johnson. There being no other nominations on the floor, the motion was
passed 5-0 to elect Mr. Vaughan as Chairman of the Historic Preservation
Board.
B. Vice-Chairman
Chairman Vaughan declared the floor open for nominations for the
position of Vice-Chairman. Ms. Morgan moved to nominate Ms.
Farrington, Ms. Farrington declined the nomination. Mr. Johnson then
moved to nominate Mr. Miller, seconded by Ms. Turner. There being no
other nominations on the floor, the motion was passed 5-0 to elect Mr.
Miller as Vice-Chairman of the Historic Preservation Board.
C. Second Vice-Chairperson
Chairman Vaughan declared the floor open for nominations for the
position of Second Vice-Chairperson. Ms. Farrington moved to nominate
Ms. Morgan, seconded by Mr. Miller. There being no other nominations
on the floor, the motion was passed 5-0 to elect Ms. Morgan as Second
Vice-Chairperson of the Historic Preservation Board.
III. APPROVAL OF MINUTES:
The Minutes for the Regular Meeting of August 16, 1995 were before the Board
for consideration. Mr. Miller moved to approve the Minutes as presented. The
motion was seconded by Ms. Morgan and passed by a vote of 5-0 (Ms. Turner
abstained).
IV. PUBLIC HEARING ITEMS:
None
As Mr. Little had to attend the Site Plan Review and Appearance Board meeting, Ms.
Cayce asked that the agenda be amended to hear Item V.D. first.
V. CERTIFICATES OF APPROPRIATENESS:
D. COA 8-258: 201 N.E. 1st Avenue; Banker's Row; Utopia Hair Salon;

Item Before the Board: The action requested of the Board is that of
approving a COA for a free standing sign which is 12 sq.ft. (4' x 3'), 6'
high and will be setback 6' from the property line. The sign will have a
gray/white back ground with black copy.
It was moved by Ms. Farrington, seconded by Ms. Turner and passed 6-0
to approve COA 8-258 as presented based upon positive findings with
respect to LDR Section 4.5.1(E)(8), and Section 4.6.7(E)(7), and the
Delray Beach Design Guidlelines for Historic Places, Signage.
A. COA 8-257: 232 S.E. 7th Avenue; Marina Historic District; Contributing
Single Family Residence: Guenther Looft, Owner; George Brewer,
Architect &Authorized Agent.
Item Before the Board: The action requested of the Board is that of
approving a COA to allow the construction of a 384 sq.ft. second floor
addition to be constructed above the existing carport. This is a 12' x 32'
addition which contains a bedroom, bathroom and closet. It has a gable
roof running east and west. An 8' x 2' balcony with French doors facing
east on the front elevation. A triangular pediment window is centered
under the gable and two small triangular windows are placed at the top
corners of the French doors. An identical balcony, French doors and
corner windows are located on the north facade. The north balcony
encroaches 2' into the side setback, however this is permitted as a
balcony may encroach into the setback for up to 3'. All the windows and
doors will be wood, as will the balcony and stair railing. The siding, roof
material, shutters and paint colors are to match the existing. The addition

will be accessed by a rear exterior stairway. French doors will replace an
existing window on the rear elevation of the main structure which will
open to a new 8' x 16' wood deck.
It was moved by Ms. Farrington, seconded by Mr. Miller and passed 6-0
to approve COA 8-257 as presented based upon positive findings with
respect to LDR Section 4.5.1(E)(8), and the Delray Beach Design
Guidlelines for Historic Places.
Mr. Johnson stepped down for the following item.
B. COA 8-228 Continuation: 20 N. Swinton Avenue; Judge Knott Center
(Historic Monterey House); Historic Palm Beach County Preservation
Board, Owner; John Johnson, Authorized Agent.
Item Before the Board: The action requested of the Board is that of
approving a COA for a free standing sign which is 6 sq.ft. (30" x 30"), 7' in
height and will be setback 18' from the property line. The sign will have
an ivory background with green copy, matching the building colors.
It was moved by Ms. Turner, seconded by Mr. Miller and passed 5-0 to
approve COA 8-228 Continuation as presented based upon positive
findings with respect to LDR Section 4.5.1(E)(8), and Section 4.6.7(E)(7),
and the Delray Beach Design Guidlelines for Historic Places, Signage.
Mr. Johnson returned to the Board.
C. COA 8-139 Continuation: 51 N. Swinton Avenue; Old School Square,
Owner; Joe Gillie, Authorized Agent.
Item Before the Board: The action requested of the Board is that of
approving a COA for three temporary free standing signs which will be
installed behind the existing pillars at the corners of Atlantic Avenue/N.E.
1st Avenue, Atlantic Avenue/Swinton Avenue, and Swinton Avenue/N.E.
1st Avenue. The signs will be 16 sq.ft. (44" x 50"), 6' high and designed
to be harmonious with the adjoining Cason Cottage sign. The signs will
have a white and/or gold background with aqua copy.
It was moved by Mr. Miller, seconded by Ms. Morgan and passed 6-0 to
approve COA 8-139 Continuation based upon positive findings with
respect to LDR Section 4.5.1(E)(8), and Section 4.6.7(E)(7), and the
Delray Beach Design Guidlelines for Historic Places, Signage, with the
following conditions:
1. That "1925" be removed from the Gymnasium sign. When the name
for the gym has been decided upon, the name may be added in place
of"1925" without further Board review; and,

2. Approval was granted based upon the fact that the signs are
temporary, to be replaced when the N. Swinton Avenue parking lot is
ready for use. The signs are to be reviewed again in September, 1996
if the parking lot is not in place by that date.
E. COA 8-237 Continuation: 134 N. E. 1st Avenue; Bob Currie, Owner;
Jess Sowards, Authorized Agent.
Item Before the Board: The action requested of the Board is that of
approving a COA for a free standing sign which is 2 sq.ft. (23" x 15"), 7' in
height and will be set back 6' from the property line. The sign will have a
hunter green background, with a white copy and border.
It was moved by Ms. Turner, seconded by Mr. Miller and passed 6-0 to
approve COA 8-237 Continuation as presented based upon positive
findings with respect to LDR Section 4.5.1(E)(8), and Section 4.6.7(E)(7),
and the Delray Beach Design Guidlelines for Historic Places, Signage.
F. COA 8-251 Continuation: 1010 Nassau Street; Nassau Historic District;
Mr. & Mrs. Peter Byron, Owners.
Item Before the Board: The action requested of the Board is that of
approving a COA for the front facade elevations and landscape plan
associated with a two car carport to be constructed on the east portion of
the front yard.
It was moved by Mr. Johnson, seconded by Ms. Farrington and passed 4-
2 (Ms. Turner& Mr. Miller dissenting) to approve COA 8-251 Continuation
as presented based upon positive findings with respect to LDR Section
4.5.1(E)(8), and the Delray Beach Design Guidlelines for Historic Places,
as follows:
1. Construction of the carport;
2. Construction of a new front porch with a canvas awning roof;
3. Expansion of the garage for living space, including the removal of the
garage door and installation of a window;
4. All exterior wood trim, which includes lattice work, wood supports for
the carport, window trim, shutters, and porch railings are to be white,
with the exterior of the house to be cream;
5. The carport awning roof and porch awning roof are to be solid dark
green canvas;
6. Replacement windows are to be double hung, divided light, white
aluminum; and,
7. The carport roof is to be guttered to direct water run off to the storm
drain in front of the property.

It was then moved by Ms. Turner, seconded by Mr. Johnson and passed
6-0 to approve the landscape plan for COA 8-251 Continued with the
following conditions:
1. That a lower ground cover be used in association with the Variegated
Ginger inside the walkway;
2. That the Zanadu ground cover be provided in sufficient quantity to
cover the ground; and,
3. The front yard is to be fully irrigated.
VI. DISCUSSION AND ACTION ITEMS:

Mrs. Cayce informed the Board that the City Manager's memo to the City
Commission re: Appealable Land Development Board Actions expressed
his concern in reference to the Board's action on Variance 88-40 (1010
Nassau Street), i.e. setting a bad precedent by approving a front setback
variance in a single family district.
VIII. ADJOURNMENT:
There being no further business before the Board, Ms. Turner moved to adjourn
the meeting at 7:45 P.M., seconded by Mr. Miller and passed 6-0.

ITEM BEFORE THE BOARD
The action requested of the board is that of approval of COA 8-257 to allow the
construction of a 384 s.f. second floor addition to be constructed above the
existing carport.
BACKGROUND
This house was constructed in 1935 in the resort cottage style. It is of wood
frame construction on a concrete foundation. The roof is composition shingle;
the siding is horizontal wood clapboard. The addition will be built above the
carport, which was constructed in 1958.
ANALYSIS OF THE PROJECT
The project is located-in the Marina Historic District in the R-1-AA Zoning district
where the setback requirements are as follows:
• front 30'
• side 10'
• rear 10'
The project is within the setback requirements
This is a 12' x 32' addition which contains a bedroom, bathroom and closet. It

The items before the board is aesthetic consideration of 3 free
standing signs pursuant to 4. 6.7(E) (7) of the LDR's.
II. BACKGROUND:
The applicant wishes to install 3 temporary free standing signs
which will be installed behind the existing pillars at the corners
of (1) Atlantic Ave./NE First Ave. , (2) Atlantic Ave./Swinton Ave. ,
and (3) Swinton Ave. /NE First Ave.
The signs will be 16 sq. ft. (44" x 50" ) , 6 ft. high and designed
to be harmonious with the adjoining Cason Cottage sign.
The signs would be white with blue copy as indicated. The color in
the center of the sign, which is now gold, has yet to be
determined. The applicant has indicated the Board's color
recommendation would influence the final color determination.
The temporary signs will remain until the surrounding parking lots
are complete and the permanent sign package is approved for the
site.
III . RECOMMENDATION:
The Board has the following options:
1. Approve as presented.
2 . Deny request as submitted.
3 . Staff recommends the signs center color,
currently indicated as gold, be white on a blue background. Staff
recommends approval based upon positive findings with respect to

RE: Temporary Signs at Old School Square
Old School Square Inc. is requesting a temporary sign package for the site.
We are requesting 3 signs one each to be placed between the columns as
shown at the corner of Atlantic and Swinton, the corner of N.E. 1st Avenue
and Atlantic and the corner of Swinton and N.E. 1st Street.
The temporary signs would be placed in September 1995 and remain until the
surrounding parkings lots are complete and the permanent sign package is
approved for the site.
The signs would be white with blue coloring as indicated, the alternate color
where the gold is has not been determined. Final color selection would be sent
for approval.
We are also planning to light the signs.

ITEM BEFORE THE BOARD
The action requested of the Board is that of granting a variance from LDR •
Section 4.3.4(k) to allow a 20' X 20' canvas awning carport to be constructed 3'
from the east (side) property line, where a minimum setback of 7.5 feet is
required; and to allow the carport to be constructed 10' from the north (front)
property line where a minimum setback of 25 feet is required.
SUMMARY OF THE MEETING
The Chairman identified the variance request. The applicant's letter of
justification was not read into the record as the letter was included in the Board's
packets and the Board signified that they had read it. It was determined that the
public hearing had been properly noticed. The Chairman asked for staffs
presentation. Staff explained the action taken with respect to a previous
variance which was granted for the western portion of the property (see the staff
report for a full explanation). Using the overhead projector, staff presented the
existing and proposed floor plan. Staff pointed out that the existing plans
indicated that there was sufficient space to accommodate one car in the garage
and that if the plans were accurately drawn there was no justification for granting
a variance for a double carport.
The Chairman called for the applicant's presentation. The applicant stated that
there is a 7.5" difference in height between the garage floor and the floor of the
house. He pointed out that the garage measurements are correct but that the
lower level of the garage extends only for a distance of 17.5' before it joins the
7.5" step-up; therefore, there is insufficient length to park a full sized car. The
applicant described the method of guttering to be used on the carport but stated
that water run-off from a carport roof was not the main concern for the property
as the street itself flooded when it rains. With respect to the size of the carport
the applicant said the majority of the property owners on Nassau Street approve
of the double wide carport.

The Chairman then asked for comments from the public in favor of granting the

Staff informed the Board that Mr. Henry Satchwell had telephoned in the
affirmative.
The applicant had circulated a petition requesting support for the carport from
property owners on Nassau Street. The petition was included in the Board's
packets.
The Chairman asked for comments from those opposed to the variance. Steven
Warm, an attorney practicing in Boca Raton who is representing the property
owners directly to the east of the project., Dr. Larry Billion and his wife Meredith
St. Pierre, 1018 Nassau St., spoke first. Mr. Warm asked if the letter written by
Meredith St. Pierre was included in the Board packets. Staff explained that the
letter had not been received in time for inclusion. It was decided to read the
letter and then let Mr. Warm continue so as not to duplicate what was said in the
letter. Mr. Warm spoke of his client's concerns and of possible damage to their
property if the variance were granted.
The Chairman read a letter in opposition to the variance from Nancy and Roman
Mrozinski, 300 S. Ocean Blvd.

Three of the six property owners have requested that the area become an
historic district. Staff has previously researched these houses; photos and
additional information will be available at the meeting. The preliminary review is
the first step in designating a district, please read the attached portion of the
ordinance for clarification on designation criteria and procedures.

Dear Pat:
I have been retained by the owners of 511 (Touhey), 521 (Black), and 701 (Alfring)
(collectively hereinafter the"Owners") to seek designation recommendation by the Board
of this District. In that regard, I will be making a short presentation on the September 9,
1995 Board Agenda to show how the District meets the initial criteria for further Board
consideration and thereafter the criteria for the preparation of the formal designation
report, both as called for under Section 4.5.1.(C)(3) of the City's Ordinance.
I believe that the information to be provided on the Owners'behalf, coupled with the
factual data compiled in your offices (which I reviewed in depth today),will easily allow
the Board to meet the initial threshold that the information "generally conforms with
historic status criteria". Further, same will provide the Board with the requisite body of
data, together with the designation report, necessary for its written findings of fact.
Please let this letter also serve as my request that I receive copies of all notices, agenda,
and the designation report(when prepared); this would be in addition to whatever notice
you give to the owners directly. I request that this letter be included in the Board's
information packet with respect to the District. I expect to make additional filings with
the Board, either at(in which case I shall provide sufficient copies of any written material)
or prior to the various meetings/public hearings to be held and may call, examine and
cross-examine witnesses, and reserve the right to do all or any of the above.
I look forward to presenting this interesting designation proposal for your review and con-

ARTICLE 4.5 OVERLAY AND ENVIRONMENTAL MANAGEMENT DISTRICTS
The Districts described in this Article do not establish uses or .
categorize uses . These Districts, however, do regulate allowable
uses in a manner to mitigate adverse impacts of such uses upon
the natural or man-made environment; or regulate development so
as to mitigate potential dangers to the use of such developed
land, or to otherwise implement policies and objectives of the
Comprehensive Plan. Overlay and environmental management
districts need not be shown on the Official Zoning Map.
Section 4.5.1 Historic Preservation Sites and Districts:
(A) General: In recognition of findings as set forth in
the original enactment of Ordinance 13-87, passed March 10, 1987,
this Section is created in order to provide for the
identification, preservation, protection, enhancement,
perpetuation, and the use of districts, archeological sites,
buildings, structures, improvements, and appurtenances that are
reminders of past eras, events, and persons important in local,
state, and national history; that provide significant examples of
architectural styles of the past; that are unique and
irreplaceable assets to the City and its neighborhoods; or that
( provide this and future generations with examples of the physical
surroundings in which past generations lived; and other purposes.
(B) Criteria for Designation of Historic Sites or
Districts:
( 1) To qualify as a historic site, or - historic
district, or historic interior, individual properties,
structures, sites, or buildings, or groups of properties,
structures, sites, or buildings must have significant character,
interest, or value as part of the historical, cultural,
aesthetic, and architectural heritage of the city, state, or
nation. To qualify as a historic site or historic district, the
property or properties must fulfill one or more of the criteria
set forth in division (2) or (3) below; to qualify as a historic
interior the interior must fulfill one or more of the criteria
set forth in division (2) and meet the criteria set forth in
divisions (3) (b) and (3) (d) .
(2) A building, structure, site, interior, or district
will be deemed to have historical or cultural significance if it
meets one or more of the following criteria:
(a) Is associated in a significant way with the
life or activities of a major person
important in city, state, or national
history ( for example, the homestead of a
local founding family) ;

(b) Is the site of a historic event with
significant effect upon the city, state, or
nation;
(c) Is associated in a significant way with a
major historic event, whether cultural,
economic, social, military, or political;
(d) Exemplifies the historical, political,
cultural, economic, or social trends of the
community in history; or,
(e) Is associated in a significant way with a
past or continuing institution which has
contributed substantially to the life of the
city.
(3) A building, structure, site, or district is deemed
to have architectural or aesthetic significance if it fulfills
one or .more of the following criteria; except that to qualify as
a historic interior, the interior must meet the criteria
contained within divisions (3) (b) and (3) (d) :
(a) Portrays the environment in an era of history .
characterized by one or more distinctive
architectural styles;
(b) Embodies those distinguishing characteristics
of an architectural style, period, or method
of construction;
(c) Is a historic or outstanding work of a
prominent architect, designer, landscape
architect, or builder; or
(d) Contains elements of design, detail,
material, or craftsmanship of outstanding
quality or which represented, in its time, a
significant innovation or adaptation to the
South Florida environment.
(4) A building, structure, site, interior, or district
will be deemed to have historic significance if, in addition to
or in the place of the previously mentioned criteria, the
building, structure, site, or zone meets historic development
standards as defined by and listed in the regulations of and
criteria for the National Register of Historic Places, as
prepared by the United States Department of the- interior under
the Historic Preservation Act of 1966 , as amended. A copy of
these standards for the National Register is made part of this (
section as if fully set forth herein.

(C) Designation Procedures:
( 1) Buildings, structures, archaeological sites, or
districts which meet the criteria for historic sites or districts
set forth in Section 4 .5. 1(B) may be designated as historic sites
or districts, and may be listed on the Local Register of Historic
Places.
(2) Nominations for historical site or district
designation shall be made to the Historic Preservation Board on
an application form developed and approved by the Board.
(a) Nominations for historic site status may be
initiated by:
( 1) The Historic Preservation Board;
(2) The City Commission; or
(3) The property owner..
(b) Nominations. for historic district status may
be initiated by:
( 1) The Historic Preservation Board; or
(2) The City Commission.
(3) The Board shall conduct a preliminary evaluation
of the information provided on each nomination application to
determine if it generally conforms with historic status criteria.
• The Board shall then prepare a designation report which shall
contain the following:
(a) proposed legal boundaries of the historic
building, archaeological site, structure, or
district;
(b) any proposed conditional zoning regulations
designed to replace or complement existing
zoning regulations with regard to, but not
limited to use, floor area, density, height,
setbacks, parking, and minimum lot size;
(c) analysis of the historic significance and
character of the nominated property; and
(d) analysis of optional historic interiors for
those buildings and structures with interior
features of exceptional architectural,
aesthetic, artistic, or historic
significance.

(4) Upon completion and formal review of the report,
the Board shall set a public hearing on each proposed
designation. Notice of said hearing shall be made to the owner
of affected property at least ten days prior to the hearing by
certified mail. Additional notice shall be given in the same
manner as provided ' for a rezoning action [see Section
2.4.2(B) ( 1) (b) ] and by notice published in the newspaper at least
ten days prior to the hearing.
(5) Once the public hearing date is established, no
permits shall be issued for any new construction, alteration,
relocation, or demolition of the real property included in the
nomination. This delay in the issuance of permits will remain in
effect until one of the following takes place:
(a) The Historic Preservation Board denies the
nomination and no appeal is filed pursuant to
Section 2 .4 .7(E) ; or,
(b) The City Commission formally approves or
denies the nomination.
(6) After conducting the public hearing, if the
Historic Preservation Board finds that the nomination fulfills
the proper designation criteria and all procedures have been (
followed correctly, it shall vote on the designation. A majority
of the entire Board, present and voting, must act in the
affirmative to transmit the nomination and the Board's findings
to the City Commission. The City Commission shall consider the
recommendation through its standard ordinance adoption
procedures, except that at least three affirmative votes of the
City Commission is necessary to make a designation. In the event
that a directly affected property owner objects to the historic
designation, the Commission approval shall require a super
majority vote of four votes .
(7) After conducting the public hearing, if the
Historic Preservation Board does not find that the request fills
the criteria, no further action will be required and the request
will be deemed denied. However, an appeal may be filed and
processed pursuant to Section 2 .4 . 7 (E) .
(8) The Board will issue an official "certificate of
historic significance" to the owner of properties listed
individually on the local historic register or judged as
contributing to the character of a historic district listed on
the local historic register. The Director acting as City
Preservation Officer, or his appointee, is authorized to issue
and place official signs denoting the geographic boundaries of
each historic district listed in the local historic register.
