APPROVAL OF MINUTES: The Minutes for the Regular Meeting of November 16, 1994 were before the Board for consideration. Mr. Williams moved to approve the Minutes as presented. The motion was seconded by Ms . Morgan and passed by a vote of 5-0 . The Minutes for the Regular Meeting of December 7 , 1994 were before the Board for consideration. Ms . Devitt moved to approve the Minutes as presented. The motion was seconded by Mr. Williams and passed by a vote of 5-0 . III . PUBLIC HEARING ITEMS: None As the applicant had not yet arrived for Item IV.A. COA 8-239 the Board heard Item IV.B. COA 8-240 . IV. CERTIFICATES OF APPROPRIATENESS: B. COA 8-240 : New Construction; Northeast Corner of N. Swinton Avenue & N.E. 6th Avenue; Tullia Taylor, Owner. It was moved by Ms . Devitt, seconded by Mr. Vaughan and passed 5-0 to approve COA 8-240 based upon positive findings with respect to LDR Section 4 .5 . 1(E) (8) New Construction in Historic Districts, with the following conditions : * That the two columns supporting the front entrance roof be set further apart and be positioned to correspond structurally with the gable roof, as shown on the plans dated December 7, 1994 which were reviewed at the pre-application hearing of the same date; and, * That the landscape plans presented at the meeting be given final approval by the City Horticulturist. The Board amended the agenda to add a Discussion Item. V. DISCUSSION ITEMS: A. Abandonment of Right-of-way for S.E. 4th Street lying between S.E. 7th Avenue and the Intracoastal Waterway. The Board held a brief discussion on the abandonment and decided to table the item to their next meeting as all of the Board members were not familiar with the site. As the applicant had arrived for Item IV.B. COA 8-239 the Board return to this item. IV. CERTIFICATES OF APPROPRIATENESS: A. COA 8-239 : Villa Delray; 127 S .E. 7th Avenue; Youliy & Magdalena Popov, Owners. The action requested of the Board is that of approving a free standing sign to be located 5 ' from the sidewalk in front of the Villa Delray Seasonal (weekly and monthly) Rentals . It was moved by Mr. Vaughan, seconded by Ms . Morgan and passed 5-0 to approve COA 8-239 for the sign face as designed if it were installed on the building as a flat wall sign. The Board' s decision was based on the following considerations : * The building is located in the RM (Medium Density Residential) zoning district, which does not allow weekly rentals as they are commercial in nature. Thus, the current use is non-conforming; - 2 - 12/21/94 * There are other non-conforming seasonal rental buildings in the historic district but only one has a free standing sign. Signs are commercial by nature and are basically inappropriate for residential districts; * A non-conforming situation exists with respect to the parking as no designated parking spaces are provided and cars park at random in the front yard. Additionally, no landscaping buffer is provided between the parked cars and the sidewalk. Therefore, adding a free standing sign to the front yard would create additional visual disruption and clutter to the streetscape and would detract from the residential character of the neighborhood; and, * The applicant stated that her tenants know of the apartments by referral or from ads in the paper and that the sign was not a factor in attracting business from people driving past the building. It was moved by Mr. Vaughan, seconded by Mr. Jamison and passed 6-0 to approve COA 8-191 for the sign based upon positive findings with respect to the Design Guidelines; Signage. A. COA 8-237 : 134 N.E. 1st Avenue Old School Square Historic District; Robert Currie, Owner. It _ was moved by Mr. Jamison, seconded by Ms . Farrington and passed 6-0 to recommend that the City Commission approve the Waiver request for COA 8-237 for the Currie Residence/Office to waive the requirement to provide a 5 ' landscaped area adjacent to the abutting property along a portion of the north property line. It was moved by Mr. Jamison, seconded by Mr. Williams and passed 6-0 to approve COA 8-237 for the Currie Residence/Office for the following Special Actions : 1 . The waiver to allow parking within the front yard as illustrated on the site plan; 2 . The use of concrete paver blocks for the front yard parking area as shown on the proposed site plan; 3 . The internal adjustment to reduce the driveway width to 12 ' , with the caveat that either concrete or paver blocks be provided 1' on each side of the driveway after consulting the City Engineer; and, 4 . Provide a brick or paver block sidewalk rather than standard concrete, if approved by the City Engineer. It was moved by Mr. Jamison, seconded by Ms. Farrington and passed 6-0 to approve COA 8-237 for the Site Plan for the Currie Residence/Office based upon positive findings with respect to Chapter 3 (Performance Standards) of the Land Development Regulations, policies of the Comprehensive Plan and Section 2 .4 .5(F) (5) subject to the following conditions : 1 . That a revised site plan be submitted which provides 2 ' of clear space adjacent to the handicapped space; and, 2 . That an engineering plan be submitted which adequately addresses drainage on the subject property. It was moved by Mr. Jamison, seconded by Ms. Morgan and passed 6-0 to approve COA 8-237 for the Landscape Plan for the Currie Residence/Office based upon positive findings with respect to LDR Section 4 . 6 . 16 . - 2 - 11/16/94 It was moved by Mr. Jamison, seconded by Mr. Vaughan and passed 6-0 to approve COA 8-237 the Design Elements for the Currie Residence/Office based upon positive findings with respect to LDR Section 4 . 5 . 1, with the following modifications to the plan as presented: 1 . The roof is to be gray asphalt flat shingles; and, 2 . Corner boards will be installed on the new construction. V. REPORTS AND COMMENTS: A. Reports from Historic District Representatives None B. Cayce informed the Board that the Florida Preservation Advisory Council had meet re: the Grant for the American Legion, but she had not heard yet whether or not they were awarded the Grant. Ms . Cayce passed out the National Register Brochure to the Board. VI . Williams and known as the Solomon David Spady House be designated as a Local Historic Site and listed on the Local Register of Historic Places . The property consists of a historic residential, single family home located at 170 N.W. 5th Avenue. There were no comments from the public in favor or opposing the designation. It was moved by Ms . Farrington, seconded by Ms. Morgan and passed 6-0 to recommend to the City Commission approval of the ordinance designating the property owned by Douglas T. Williams and known as the Solomon David Spady House as a Local Historic Site. B. Recommend to the City Commission that the property owned by Douglas T. Williams and known as the Susan Williams House be designated as a Local Historic Site and listed on the Local Register of Historic Places. The property consists of a historic residential, single family home located at 30 N.W. 3rd Avenue. There were no comments from the public in favor or opposing the designation. It was moved by Mr. Jamison, seconded by Ms . Farrington and passed 6-0 to recommend to the City Commission approval of the ordinance designating the property owned by Douglas T. Williams and known as the Susan Williams House as a Local Historic Site. III . CERTIFICATES OF APPROPRIATENESS: A. COA 8-239 , Villa Delray, 127 S.E. 7th Avenue. Youliy & Magdalena Popov, Owner. As the applicant did not attend the meeting it was moved by Mr. Williams, seconded by Mr. Jamison and passed 6-0 to continue COA 8-239 to the Board's December 21, 1994 meeting. IV. DISCUSSION AND ACTION ITEMS: Discussion of the establishment of a convenience store use at the southwest corner of Atlantic Avenue and Swinton Avenue. The Board held a discussion with the property owner and Bob Abdin, applicant. The Board stated that although they did not feel a convenience store was an appropriate use for such an important corner of the City they would review a formal submission. The Board revised the agenda to add the following Discussion Item: Discussion for new construction of a single family residence at the northeast corner of N. Swinton Avenue and N.E. 6th Street. Tullia Taylor, applicant, presented plans for the Board' s review. The Board felt with a few minor elevation changes to the plan and with a submission of a landscape plan they would be able to approve a formal submission for the proposed residence. V. COA 8-239 Villa Delray Seasonal Rentals 127 S.E. 7th Avenue Marina Historic District Youliy and Magdalena Popov, Owner ITEM BEFORE THE BOARD The action requested of the Board is that of approving a free standing sign to be located at the entrance to the parking lot associated with the Villa Delray Seasonal Rentals. BACKGROUND Villa Delray Seasonal Rentals is located on the east side of S.E. 7th Avenue, south of S.E. 1st Street. According to City records, the building was constructed in 1951 for use as an apartment complex. The building has been used as a seasonal rental (weekly, monthly) by various owners since 1956 . The property is currently zoned RM (Medium Density Residential) , which does not allow weekly rentals as they are commercial in nature. Thus, the current use is non-conforming. No further development history exists for the subject property. ANALYSIS OF THE PROJECT The proposal is to erect a double faced free-standing wood sign. The sign face is approximately 3' x 2 ' and will stand 6 ' high. The background of the sign is white with gold and green text, and pink, yellow, green, and peach flowers and leaves. The sign will not be illuminated. There is no indication that a previous sign existed on the subject property. The sign and its location were approved by the Community Improvement Department's Sign Review Committee, at its December 2nd meeting, subject to review by the Historic Preservation Board. Staff Comments The sign will be located 5' from the western property line and 29 ' from the southern property line (see attached survey) . As such,- staf has concerns whether a free-standing sign infers a commercial use and therefore, may cause_ proliferation of additional signs in the district for similar uses. It may be more appropriate to locate the sign on the building so as not to detract from the residential character of the neighborhood. If relocated, a positive finding to the Design Guidelines can be made. ALTERNATIVE ACTION 1 . Continue with direction. 2 . ' Approve the sign associated with COA 8-239 based upon positive findings to the Design Guidelines; Signage. 3 . Deny the sign associated with COA 8-239 based upon failure to make positive findings to the Design Guidelines; Signage. RECOMMENDED ACTION By motion, approve the sign associated with COA 8-239 with-the condition that the sign be relocated onto the building.
