ROLL CALL: The Chairman called the meeting to order at 6 : 00 P.M. COA 8-176 : 334 N.E. 1st Avenue; Tony Keller, Owner The applicant' s plans meet all the development standards (Section 4 .3 .4) with the exception of the proposed parking space on the southwest corner. A parking space requires a 5 ' setback and only 2 ' are provided. The applicant agreed to shorten the parking space to the minimum of 25 ' and to relocate it to the north to allow the required 5 ' setback on the south. The garage and apartment are to be painted and roofed to match the main house. The landscaping is to conform to City code. COA 8-180 : 401 N.E. 2nd Avenue; Robert Turner, Owner; Rodney Grice, Architect The Board approved the minor site plan modification based upon positive findings pursuant to Section 3. 1. 1 (Required Findings) . Wayne Campbell moved for approval of COA 8-180 (Site Plan) , seconded by Sandy Jamison. The Board approved the landscape plan based upon positive findings pursuant to Section 4 .6 . 16 . Daniel Carter moved for approval of COA 8-180 (Landscaping) , seconded by Sandy Jamison. The Board approved the design of the garage doors on the west wall of the garage. Doors were installed without a COA or Building Permit. 5 . 60 PALM SQUARE: David Clitter, Owner The Board moved to make recommendation to the Chief Building Official, based on the historic nature of the buildings, that the proposed work be considered as one rehabilitation project, and allow the accessory building to be restored. Pat Healy-Golembe moved for approval of making a recommendation to the Chief Building Official re 60 Palm Square, seconded by Buck Miller. The vote was as follows : Christine Bull - Yes; Wayne Campbell - Yes; Daniel Carter - Yes; Sandy Jamison - Yes; Pat Healy-Golembe - Yes; Buck Miller - Yes; Rose Sloan - Yes. REPORTS FROM HISTORIC DISTRICTS: Alieda Riley stated that she was disappointed in the Board for not backing the Palm Square Homeowners Association on the Palm Square street closing issue. It was noted that the Board was advised by the City Attorney' s office not to do so. Gene Fisher of the Old School Square Property Owners Association, stated that he felt Osceola Park would be a good candidate for incorporation into the Historic District. The Board requested that Pat Cayce check into having a field study done as to incorporating new areas into the Historic District. 7 . UNFINISHED BUSINESS: It was noted that construction on the Brandys ' parking lot has not proceeded as the Board thought it should. Thus, the Board felt Code Enforcement should check into the matter. Pat Healy-Golembe informed the Board that the National Trust' s plans for Heritage Month in October were on schedule. Rose Sloan stated that the Davis House would possibly be moved to the vacant lot next to Cason Cottage. The Board requested Pat Cayce check the windows on the rear facade of the Boyd Building to make sure they are the ones approved by the Board. It was noted that PIC and the HRS (offices only) could possibly be going into the old Winn Dixie building. The Board decided to award the first Preservation Recognition Sign to the Baxter House (the old Methodist Parsonage of 1912) . Pat Cayce informed the Board that Poly Noe will be coming before the Board in the near future for approval of a sidewalk cafe. 8. NEW BUSINESS: None 3 6/3/92 • 9 . APPROVAL OF MINUTES : May 6 , 1992 Meeting Daniel Carter requested that under Item No. 7 Wayne Carter be changed to Daniel Carter. Pat Healy-Golembe moved for approval of the minutes for the May 6 , 1992 meeting, seconded by Sandy Jamison. Old School square Historic District. BACKGROUND The house, located at 334 N.E. 1ST Avenue, Old School Square District, was built in 1907 . The owner, Tony Keller, has done a remarkable job of restoring this contributing house. Sometime in the 1920 ' s a garage was constructed on the rear of the lot adjacent to the alley. The garage was demolished in the 1950 ' s . ITEM BEFORE THE BOARD New construction of a 830 s . f. garage with a 700 s . f . guest apartment above. OSSHAD requires a minimum lot size of 8, 000 square feet for new construction. However, this 6,500 s . f . lot (Lot 20, Block 65) was platted before 1979 and is therefore a "lot of record" . The proposed construction is allowed for this lot. Section 4 . 4 . 24 (C) ( 1) (OSSHAD) Accessory Use and Structures allows a garage and guest cottage. A guest cottage may be affixed to an accessory structure, in this case the proposed garage. Guest cottages cannot exceed 700 square feet. Chief Building Official, Jerry Sanzone, calculates the square footage of a structure as "the number of square feet under roof" . Therefore a 700 square foot guest apartment can be built on the second story of the garage with a 130 square foot open deck for balance of the space. A canvas patio • awning may be installed over the deck. The attached plans meet all the development standards (Section 4 . 3 . 4 ) with the exception of the proposed parking space on the south west corner. A parking space requires a five foot setback and only two feet are provided. Mr. Keller is aware of this and plans to shorten the parking space to the minimum of 25 ' and to relocate it within the setback. The driveway on the north side of the property encroaches on the setback, however, because it is existing, improvement is allowed. Approved 7-0 • STAFF REPORT DATE: MAY 14 , 1992 TO: HISTORIC PRESERVATION BOARD FOR: MEETING OF JUNE 3, 1992 ITEM BEFORE THE BOARD COA 8-139C is presented for the purpose of granting a Certificate of Appropriateness to allow donor identification signs to be installed on each of the three buildings at Old School Square. BACKGROUND Sign Procedure. In Delray Beach, a sign applicant must first get the approval from the City' s Sign Review Committee. If the proposed sign is in an historic district the permit application is then sent to the HPB for aesthetic review. Consideration is given to style of lettering; color; material; size; type of illumination and location. The text of a sign is not within the purview of the HPB. Prior Action. On February 20, 1991 the HPB granted approval to the Old School Square Cultural Arts Center to install the following signs and plaques at the 1913 building. Two 2 ' x 2 ' bronze identification plaques; one at • the north entrance and one at the south entrance. One 7" x 9" bronze HPB oval marker One bronze National Register marker One 4 ' x 4 ' granite slab sign to be installed as part of the paving on the south entrance walkway. In November of 1991 a sign, consisting of flush wall mounted letters, was installed on the upper portion of the south facade of the 1913 building. This sign was installed without HPB approval and without a building permit. The sign was removed by Old School Square several days after its installation. The text of the sign was "Cornell Museum" . On November 20, 1991 the HPB discussed donor recognition signs but no action was taken. Staff Report COA 8-139C Page 2 STAFF COMMENTS The Cornell family made a sizable contribution to the Old School Square Foundation and requested that the museum be named for them. Thus the issue of donor identification signs came to the HPB for discussion purposes . Some feel that since public funds have supported Old School Square it belongs to the taxpayers and should present that message to the public. Others feel that major donors from the private sector should be given tangible recognition. State and City funding has supported the restoration of the buildings . The City is currently assuming a portion of OSS's operating expenses . It was never anticipated that OSS would be self-supporting, therefore the Old School Square Foundation was formed to create an endowment fund from the private sector to provide operating expenses, thus freeing the taxpayers from further burden. One of the tools most commonly used to attract substantial donors for this type of private/public facility is the donor recognition sign. Examples can be found in most communities . The City Attorney' s office has stated that regulating the content of the signs is beyond the scope of the HPB' s authority. The Board' s decision is therefore limited to aesthetic considerations regarding the style, size and placement of these signs . COMMENTS FROM OTHERS Fred Gaske, Preservation Supervisor, Florida Division of Historical Resources, has absolutely no objection to these signs . He cited the deHonerele sign at the Boca train • station as an example. Mr. Gaske also pointed out that the Division had approved the text for the official State Historic Marker at the depot which mentions "the deHonerle's generous donation" . John Johnson, Director of Historic Palm Beach County Preservation Board, regards the use of donor identification signs as standard practice in the preservation community. As a State employee he deals with many publicly funded projects and feels that benefactor recognition is necessary to attract private funding to a public project. ALTERNATIVE ACTION 1 . As a building treatment, it is easily reversible, and is a common practice in Florida and elsewhere. • Generally, we recommend that such signage be placed in an unobtrusive • location; certainly some place where it can be seen by people coming to the building, but it should not distract visitors' attention from the features of the building itself. The signage should also be tastefully designed in keeping with the style of building and not out of scale with any of its features, particularly any which are in close proximity. Very large signage may not be appropriate since it may be difficult to prevent it from competing with surrounding features. The method of attaching the signage to the building surface should result in the least possible modification of the building fabric. In general , signage of the sort you described to me is a great way to recognize major donors. It is the experience of this agency that it is usual and customary to install "donor identification" or any other type of sign i.e. title of building, address, donor identi- - fication, historic plaques and temporary banners to identify a historic building. Signage is necessary for public identification and recognition on any building, historic or contemporary. On a historic building, however, special care should be taken in the decision of style, color, size, materials and place- ment of signage, so that it does not detract from the architectural features of the designated historic building. The Board's power of architectural review is governed by its 1990 DESIGN GUIDELINES FOR HISTORIC PLACES. Special guidelines for signage is outlined on p. 47 and there is no specific guideline prohibiting the use of "donor identifica- tion" signs. Also, it may be helpful to remind your Board members that several local sites commemorate founders, donors and patrons. Just a few examples include Cason Cottage Museum, Morikami Museum, Flagler Museum, Norton Gallery of Art, Ann Norton Sculpture Gardens, and Count de Hoernle Pavilion. Ruby, Assistant City Attorney SUBJECT: Historic Preservation Review of Signs It is my understanding that the Historic Preservation Board reviews signs for compliance with the City's sign code for those signs that fall within their jurisdiction. Please advise the Board that their authority is limited to the code requirements regarding size, color, etc. The Historic Preservation Board does not have the authority to require that a particular sign contain particular words . The first amendment prohibits the City from dictating the content of the speech contained in a sign. The aforementioned general tenant of law holds true for any Board or Commission reviewing signs, except that the City Commission, in the case of Old School Square, may comment on the content of the sign because the City is the owner of the Old School Square property. The City Commission has not delegated their authority as owner of Old School Square to determine the content or wording of Old School Square signage to the Historic Preservation Board. The Historic Preservation Board, therefore may not regulate the wording of the sign. Water Service Existing 6" water main along N.E. 2nd Avenue and an existing 6" line along N.E. 4th Street. Sewer Service Existing 8" sanitary sewer line along N.E. 2nd Avenue and an existing 8" line along N.E. 4th #4 Street. t ITEM BEFORE THE BOARD : The item before the Board is that of consideration of the following aspects of the site plan as they pertain to property located at 401 N.E. 2nd Avenue (Robert Turner' s Building) : * a minor site plan modification; and * landscape plan * COA 8-#180 The subject property is located at the northeast corner of N.E. 4th Street and N.E. 2nd Avenue. The Director has determined the modification to be classified as "minor" in that it does not meet the test of a non-impacting modification and does not significantly impact findings made at the time of initial site plan approval. [Ref Section 2.4 .5(G) ( 1) (b) ] BACKGROUND : The subject property encompasses Lots 3 and 4, Block 7, Del-Ida Park subdivision. This property has an extensive history as far back as 1925 . The existing 8 unit apartment building is a Mediterranean Revival style structure which was constructed in 1925 . The existing garage/apartment structure is also Mediterranean Revival and was constructed in 1935 . The most recent land use activity on the property is explained in the following paragraphs. During. a weekend in May of 1991, the current property owner, Bob Turner, removed a fairly large landscape area at the southwest corner of the property, installed shellrock both on. the property and in the N.E. 2nd Avenue right-of-way and installed a 6 ' chain link fence along 2nd Avenue and 4th Street. The above changes were made without obtaining a Certificate of Appropriateness (COA) or a building permit. The following Monday, Mr. Turner submitted a building permit application to the City' s Community Improvement Department to get approval to allow the work that was completed over the previous weekend. At that time the applicant was made aware that the changes to the site constituted a site plan modification. On July 17th a request for a site plan modification was received. At that time, a determination was made that the changes constituted a minor site plan modification, which required submittal of an application for site plan approval, an application for a COA and a $500 application fee. A letter was transmitted to the applicant explaining the same. Processing of the request would proceed once the requested information was received. On August 16th, the Code Enforcement Division issued a Violation Notice for a number of items including the work that was completed without a permit. HPB Staff Report • Robert Turner' s Building (401 N.E. 2nd Avenue) - Minor Site Plan Modification Page 2 On April 15, 1992, an application for a minor site plan modification was received and is now before the Board for action. PROJECT DESCRIPTION : The development proposal incorporates the following: * Construction of an 8 space paved parking lot with associated landscaping. * Installation of a 3 ' high picket fence along N.E. 4th Street and N.E. 2nd Avenue and upgrading the landscaping on the site. * Relocating the driveway from N.E. 4th Avenue to N.E. 2nd Avenue. * Relocating an existing underground natural gas tank from the proposed parking area to the rear yard. The proposal involves redesigning the existing 4 space parking lot to accommodate an 8 space parking lot. SITE AND LAND S CAP E PLAN ANALYSIS : REQUIRED FINDINGS: (Chapter 3) Pursuant to Section 3. 1 . 1 (Required Findings) , prior to the approval of development applications, certain findings must be made in a form which is part of the official record. This may be achieved through information on the application, the Staff Report, or Minutes. Findings shall be made by the body which has the authority to approve or deny the development application. These findings relate to the Future Land Use Map Compatibility; Concurrency; Comprehensive Plan Consistency; and, Compliance with Local Development Regulations (LDRs) . The development proposal will not have an impact on findings with respect to Concurrency or Comprehensive Plan Consistency. . Compliance with the Future Land Use Map and the Land Development Regulations (LDR' S) are discussed in the following paragraphs . Future Land Use Map: (The use or structures must be allowed in the zone district and the zoning district must be consistent with the land use designation) . The subject property has a Land Use Plan designation of Transitional and a RO (Residential Office) zoning designation. Although the RO zone district is consistent with the land use plan designation, multiple family structures are not an allowed use within the RO zone district. HPB Staff Report Robert Turner's Building (401 N.E. 2nd Avenue) - Minor Site Plan Modification Page 3 However, the existing multiple family use was established when the site was developed and is recognized as a nonconforming use. Pursuant to Section 1 .3 .5 (Nonconforming Uses of Structures and Land) , where lawful use of a structure and land existed on September 1, 1990, that would not now be allowed, the use of a structure and land may be continued subject to the following provisions: (A) The nonconforming use may be extended internally throughout any part of the structure, provided the use is not extended to occupy any land outside the existing structure. (B) When a nonconforming use is discontinued or abandoned for a continuous period of 180 days, every subsequent use shall be in conformity with the requirements for the zoning district in which it is located. (C) Should the structure involving a nonconforming use be destroyed by any means to an extent exceeding 50% of its replacement cost, such structure shall not be reconstructed except in conformance with both the development and use requirements for the zoning district in which it is located. With the proposed modification, there will be no increase in the use area. The use has not been discontinued or abandoned, and proposed repairs to the structure do not exceed 50% of the replacement value. Based upon the above, a positive finding with respect to the future land use map can be made. Compliance with Land Development Regulations: Items identified in the Land Development Regulations shall specifically be addressed by the body taking final action on a land development application/request. Parking: There are 9 one bedroom apartments and 12 parking spaces (8 garage, 4 parking lot) existing on-site. Pursuant to Section 4 . 6 . 9 (C) (2) (c) , a one bedroom dwelling unit requires 1.5 spaces plus .5 spaces for guest parking. Thus, 18 parking spaces are required. The number of parking spaces existing on-site is an nonconforming situation in that 18 parking spaces are required and the existing parking lot design does not meet code. With the redesign of the parking lot to provide 16 total spaces on-site, the exiting nonconforming situation will be decreased. In addition, relocating the driveway to N.E. 2nd Avenue will eliminate an site distance problem for vehicles exiting onto N.E. 4th Street. Some of the parking spaces within the garage are being utilized for storage. On August 16, 1992, a Violation Notice was issued which stated that the required parking spaces are to be accessible at all times . Thus, the items being stored with the garages must be removed so the spaces can be utilized for parking purposes. Open Space: Pursuant to Section 4 . 3 .4 (K) , 25% of non-vehicular open space is required and 34% has been provided. OTHER I T E M S : A 3 ' high picket fence is proposed along N.E. 4th Street and N.E. 2nd Avenue. Although the picket fence is not consistent with the Design Guidelines for the Mediterranean Revival Style, Staff believes it has sufficient architectural elements to justify deviating from the Guidelines. In addition, the proposed Bouganvillia shrubs, which will be planted along the fence, are consistent with Mediterranean Revival and will enhance the fence. CODE VIOLATIONS : The following information, regarding the status of existing code violations related to this property, is being provided pursuant to direction given to the Planning and Zoning Department by the City Commission. These violations may be considered by the Board in its review of this development proposal, however, the Board is not compelled to base any of its decisions on this information. A Violation Notice was issued on August 15, 1991. The Notice outlined the following code violations;, , 1 . Land Development Regulations Chapter 7; Section 7 . 1 . 3(A) ( 103 . 1 . 1) & ( 103 .8 . 6) which requires obtaining permits and inspections including approval from historic board for fence and parking lot prior to making improvements . 2 . Land Development Regulations Chapter 7; Section 7 . 1. 3(A) ( 1106 . 1.2) , which requires interior exit stairs shall be protected with ( 1) hour protection construction. 3. Land Development Regulations Chapter 7; Section 7 .4 . 1(302) , which requires sanitary facilities shall be in good working condition. 4 . Land Development Regulations Chapter 7; Section 7 .4 . 1(302 .4) , which requires water, heating facilities shall be in goodworking condition. 5 . Land Development Regulations Chapter 7; Section 7 .4 . 1(302 . 7 ) , which requires garbage disposal containers to be provided. 6 . Land Development Regulations Chapter 7; Section 7 .4 . 1(305 .3) , which requires roofs to be structurally sound and maintained in a safe manner. 10 . Land Development Regulations Chapter 7; Section 7 .4 . 1(305 .5) , which requires stairs, porches and appurtenances shall be safe to use and in sound condition. 11. Land Development Regulations Chapter Section 7; 7 .4 . 1(305 .6) which requires protective railings shall be required on any unenclosed structure over 30" above the ground level or any steps containing 4 risers or more. 12 . Land Development Regulations Chapter 7; Section 7 .4 . 1(305 .7) which requires every window shall be weathertight and in sound working condition. 13. Land Development Regulations Chapter 7; Section 7 .4 . 1(305 . 13) which requires screens on all exterior openable windows and doors when unit does not have a central A/C system. 14 . Land Development Regulations Chapter 7; Section 7 .4 . 1(305 . 16) which requires interior floors, walls and ceilings shall be in sound condition. 15 . Land Development Regulations Chapter 7; Section 7 .4 . 1(307 .3) which requires garbage containers to be properly utilized and to contain all rubbish generated on the property. Items 1 and 5 are being addressed via this request for site plan modification approval. Once site plan approval is granted, the applicant can proceed to the Community Improvement Department to to process a building permit application, which must correspond with the approved site plan. The permit application must be submitted by June 24th. Items 7 and 8 are pending reinspection. The remaining violations are to be corrected by June 24, 1992 . Pursuant to the Code Enforcement Board Order, if the violations are not corrected by June 14th, a $25 per diem shall be reinstated until final compliance is achieved. In addition, any accrued but unassessed fine shall be presented to the Code Enforcement Board to record as a lien against the property. There shall be a presumption of noncompliance unless the violator notifies the Code Enforcement Division of compliance on a timely basis. Therefore, once the violations are corrected, the property owner should contact the Code Enforcement Division. HPB Staff Report Robert Turner' s Building (401 N.E. 2nd Avenue) - Minor Site Plan Modification Page 6 REVIEW BY O T H E R S : Community Redevelopment Agency The subject property is located within the City' s Community Redevelopment Area, thus requiring review of the development proposal by the C.R.A. At its meeting of May 12, 1992, the C.R.A. reviewed the proposal. The Agency was concerned that the site would be aesthetically degraded with the site plan modification. They expressed concern that open space was being reduced with the additional parking area. With the site plan modification, they felt it critical that the building site be adequately landscaped and that the perimeter fencing not be chain linked. A formal recommendation was not provided, however the above concerns have been addressed with the development proposal . Homeowner' s Associations Special notice was provided to the Del-Ida Park and Dell Park Homeowner' s Associations. Letters of objection, if any, will be presented at the Historic Preservation Board meeting. ASSESSMENT : The existing multiple family structure is a legal nonconforming use, in that it was established and has been operating prior to September 1, 1990 . The parking area is nonconforming with respect to the number of parking spaces provided ( 12) and design. The development proposal will provide 4 additional spaces, a parking lot whose design conforms to code requirements and upgrading of the landscaping, which will provide an aesthetically pleasing development. ALTERNATIVE ACT I O N S : 1. Continue with direction and concurrence. 2 . Approve the site plan, landscape plan and COA 8-#180 . 3 . Deny the request with basis stated. BACKGROUND This is a contributing Mediterranean Revival style single family residence and accessory structure, built in 1928. The property was listed on the Florida Master Site File when the original Delray Historic Site Survey was done in 1987 . The accessory building was probably built for a guest or maid's room as it was constructed with a bath. This small 12 ' x 16 ' building was built at the same time as the residence. Evidence of this can be seen in the matching roof parapets, one original window and the frame and stucco construction. It is indicated on the City's building cards in 1942, which is as far back as the official record goes for most properties . Also on the property, but not listed on the Master Site File, is a noncontributing 1950 ' s rental apartment. NONCONFORMING BUILDINGS The accessory building is nonconforming. It does not meet the setbacks for the RM zoning district which requires a 7 1/2 ' side setback and a 10 ' rear setback. It is located on the rear property line and encroaches 0 .5 'on the adjacent lot to the north. It is in very poor repair due to neglect and has had code violation citations . The Chief Building Official, Jerry Sanzone recommends that the building be demolished. Mr. Clitter has recently purchased the site and plans to do extensive remodeling and restoration to all three buildings. Pursuant to Section 1. 3 .4(B) a nonconforming building destroyed by any means to an extent exceeding 50% of its replacement cost cannot be reconstructed. The cost of reconstructing this building will exceed the 50% limit. However, if the cost is computed to include the cost of work done on the main house as well, it will be within the 50% limit. In other words, if the project is considered as one historic site the total expenditure for restoring the residence and the small building would not exceed 50% of the replacement cost for both buildings. There is precedent for this procedure, recent examples are Frank McKinney' s Executive Suites on S.E. 6th Avenue and the Charles Barretts ' guest cottage at 54 Marine Way. A letter, attached, from Gator Engineering states that the building is repairable if the owner wishes to incur the expense. Both buildings will be brought up to current building code Page 2 standards . An instrument, acceptable to the City, will be obtained from Richard Raab to permit the 0.5 'encroachment on his lot. Dear David: As per your request, a structural inspection of the rear shed in northwest corner of residence at 60 Palm Square in Delray Beach, FL was conducted. The structure consists of wood framed one story structure with a floor area of 200 square feet which was constructed in 1928. The following observations of the structural repairs which will be required to bring this structure to existing code were made during this inspection. They are as follows: 1) The existing roof rafter system must be replaced due to the undersize of the existing members to meet existing building code requirements. 2) The existing flooring rafter system must be removed and replaced with a poured monolithic slab with thicken edges at the structures perimeter. 3) Replace damaged structural member on the exterior walls as required. From my observations, it is this engineer's opinion that all of the above listed items are repairable if you are willing • to incur the expense to meet the intention of the existing building code.
