Over • DATE: SEPTEMBER 13 , 1990 TO: INTERIM HISTORIC PRESERVATION BOARD MEMBERS FROM: PAT CAYCE, HISTORIC PRESERVATION PLANNER SUBJECT: STAFF COMMENTS ON ITEMS BEFORE THE BOARD AT THE MEETING OF SEPTEMBER 19 , 1990 1 . Roll Call 2 . Election of Officers: Chairman and Vice-Chairman 3 . Public Hearing: Variance 88-18 . 54 Marine Way, Charles and Martha Barrett, Owners. The effect of this variance will be to allow an existing 8x6 foot wooden utility building to be moved from the center of the back yard to the north west corner of the lot. According to code the . setback requirements in the RM10 zoning district are: side interior 15 ' ; rear 25 ' . The applicant is requesting 3 ' setbacks from property line, both side and rear. The structure is currently sitting on skids in the center of the yard and only a few feet from one of the walls of the main house. ( Please refer to survey) It was in this location when the applicants purchased the house several months ago. The building is wood with a gable roof. It will be painted white with dark green wooden shutters. The applicant plans to plant vines on the west side of the building to soften and screen the view. The 300 ' radius letter to property owners was mailed on September 6 , 1990 and the public notice was published in the Delray News on September 8 , 1990. With the exception of the attached letter from Alex Campbell, there has been no public comment. Mr Campbell expresses his concern for the fact that the building will be visible from his dining room and patio. He feels that to grant the variance will have a negative effect on the resale value of his property. Mr. Campbell ' s property is located directly behind 54 Marine Way, at 53 Palm Square. It is the opinion of the staff that the vista from Mr. Campbell ' s yard will be improved, rather than diminished, by placing the utility building off in the corner. I have told Mr & Mrs Barrett, the applicants , that you will be coming to look at the back yard. Please knock at the door and introduce yourselves first, but if no one is home you may look at the yard anyway. You may also walk over to Mr. Campbell ' s terrace Pig" 2 to further view the property. No one is living in the Campbell house at present. Pursuant to Code Section 174 . 54 (B) ( a) (b) Variances: Special conditions do exist because of lot size, setbacks of two other existing buildings on the property and the historic nature of the house. None of the properties located on Marine Way conforms to current setback requirements and to grant the variance would in no way be detrimental to the historic character of the street or neighborhood. Staff recommends approval. 4 . COA 8-073A Continuation, 105 N.E. 1st Street, Neal Farms Market, Victor Neal, Owner. Install 6 foot tall decorative aluminum picket fence and gate along front (north) of property. Mr. Neal requests approval to install a fence from the east front. corner of his building running east to the alley and returning north to join the existing fence. A gate will be installed in front of Jo' s Back Yard, the shop on the east of his property. Please see the attached survey. The fence is aluminum, pickets to be spaced 6" apart on 6 ' centers , pickets have decorative "spear" finials on top. The fence will be 6 ' tall. The gate to be the same as the fence. Color will be black to give the effect of wrought iron. The fence will replace the ficus hedge which currently blocks the view into the plant department of the market. With the hedge removed the vista from the street will be greatly enhanced. The plant department will be visible from the east as well as the south. A decorative 3 ' hedge will be planted at the base of the fence. Staff recommends approval. 5 . COA 8-133 4 East Atlantic Avenue, Tammy Eakle, Tropical Awnings, Authorized Agent. Install 3x22 foot canvas awning on front of building. Proposed is a 3 'x22 ' green canvas awning, the same "bubble" style as the awning at 32 E. Atlantic, Polly Noe Antiques. The awning is to be installed under the existing sign. It will adjoin the traditional side drop style striped awning over the store to the west in the same building. 3 If approved the results will be to have two entirely different styles of awnings on one facade. The owner should be encouraged to install an awning to match the existing one to the west. Staff recommends denial. 6. COA 8-134 45 N.W. 1st Avenue, James or Rachel D'Angelo, Owners. Repaint exterior with change of color. Applicant requests approval to paint exterior a warm beige, color chip was submitted with COA. The trim color was not specified. Applicant will specify trim color at the meeting. Main color sample will be available at the meeting. Recommend approval of main color selection. Trim color to be approved at meeting. 7 . COA 8-135 12 S.E. 1st Avenue, Lyle McNeely Agencies, Lyle McNeely , Owner. Install free standing sign. This sign is wooden, free standing, mounted on wood posts and will be 6 ' 6" from ground to top. The sign face is approximately 3 'x3 ' . Colors; white background, black letters, gray posts to match trim of building. Lettering to be same as attached drawing. Sign is not illuminated. The sign will be placed at the west edge of the sidewalk and will straddle the hedge a few feet to the north of the center walkway. It will read from north and south. The engineering department has approved this location. Recommend approval subject to sign department approval. 8 . COA 8-136 117 Fern Court, Jose or Gloria Sanchez , Owners. Repaint exterior with change of color. Applicant will bring paint samples for your approval. The applicants had a COA on file but it expired in May of this year. As a result a new COA and fee are required. In the interest of good public relations for the HPB, I filled out the COA, added a couple of Polaroids and dropped it off at the house. Mrs . Sanchez phoned the next day to thank me but said she refuses to pay the fee. This is the first time that this situation has occurred. The Board has two options: this item can be removed from the PPM, agenda as an incomplete application OR the COA can be approved subject to payment of fee. As no building permit is required for painting it will be difficult to enforce as the entire house could be painted over a weekend. I have suggested that she pay the fee and then apply to the City Commission for a waiver of fee. This Board does not have the authority to waive City fees. 9. COA 8-131 234 S. Ocean, Nassau Point, New Construction, Randall Stofft, Architect; Authorized Agent. Consider roof , fence or walls, balcony railings, paving material, exterior paint colors and landscaping plan. For the new Board members: this is new construction of a two building, 4 unit town house project at the south west corner of S. AlA and Nassau Street. This project has been approved with the exception of the above items. Only these items will be considered at the meeting. Randall Stofft will bring all samples , colors and plans to the meeting for Board consideration. 10 . COA 8-119A 840 East Atlantic Avenue, The Boyd Building, Dimitrios Tomaras , Authorized Agent. Paint exterior, awnings and signs. The sample colors have been painted on the wall in front of Palm Beach Silks, 816 E. Atlantic ( last store to the west in the Boyd Building) and some on the wall which faces west. The samples are numbered and you should note your selection for color combinations by number. John Nanigian of Palm Beach Silks is coordinating the colors and if you stop in during store hours he will explain the samples. Drawings with various color combinations will be in the Preservation Office by Monday morning and you may come in and look at them if you wish. Plans , colors , awning samples and sign plans will be available at the meeting. All of the colors fall within the acceptable range. Staff does not recommend lavender be used in any of the combinations. 11 . Review and comment regarding Reikse Plat, 325 S.E. 7th Avenue. This is a Preliminary Plat for the Riekse Subdivision, the creation of three lots at the north east corner of S.E. 7th Avenue and S.E. 4th Street, R1-AA zoning. The address is 325 S.E. 4 7th Avenue. This item will come before the P&Z Board on September 17 , 1990. P&Z staff reports will be available at the office on Monday. A member of P&Z staff will be at the HPB meeting to explain the plat. 12 . Approval of Designation Report Drafts: The Arcade Building, 411-417 E. Atlantic Avenue The Colony Hotel, 525 E. Atlantic Avenue The Flamingo Service Station, 301 E. Atlantic Avenue. I am enclosing the drafts of the designation reports. Old members have already received copies and should have made their written comments, if any, for the meeting. New members will please also make comments or suggestions in writing. Action requested is to accept, modify or reject the first draft. 13 . Establish a time for a Special Meeting regarding the Design Guidelines draft early in the first week of October, 1990. You will receive copies of the draft by September 24, 1990 . In order to stay on our grant schedule the HPB must review the draft no later than October 3 , 1990 . All comments must be in writing. 14 . New Business 15 . Unfinished Business A. Consider the COA Approval Matrix The Matrix should be finalized at this meeting so that it can be included in the draft of the Design Guidelines. B. The non-contributing cottage, which housed the Sunday School at the Christian Science Church, S.E. 7th Avenue and S.E. 2nd Street, is now available for relocation. The Church is giving the building to anyone who will move it. The City has declined the offer. If you know of anyone who wants to move the house please have them contact me. 15 . Adjournment PLEASE NOTE: Drive by 36 Palm Square, the first house south of Atlantic Avenue on the west side of the street. The applicant is requesting PIM approval to install a 6 ' wood fence at the rear property line and to the rear corner of the house on the north property line; the fence would have a return to the house at this point. The fence will replace an existing fence which is all but totally destroyed. The return to the house and the north portion would be visible from the street. If the applicant returns the COA by Monday I will amend the agenda to allow this to be heard. This is not an emergency but it is an urgent situation. File Disk 4 Agendal8
