Rose Sloan called the meeting to order and welcomed new Board
Member Sandy Jamison. She also requested the minutes reflect the
Board' s thanks to Spencer Pompey for the time and effort expended for
this Board.
Pay Cayce suggested sending a letter to Spencer Pompey in
recognition of his efforts.
2 . Public Hearing: Request for Variance No. 88-21 : Sundy House
Antique Gallery and Tearoom - 106 S. Swinton Avenue and Sundy Apartments
- 105 S.W. 1st Avenue . Louis G. Jensen, Owner or Howard McCall, Archi-
tect, Authorized Agent.
Rose Sloan presented a letter from the Sundy Property which is
attached into the record as part of the minutes.
Susan Ruby, Assistant City Attorney, noted that a request for a
variance "not to provide a maneuvering area just east of the Sundy
Apartments" had been omitted from Public Notice No. 8-21. This became a
moot item when the applicant expressed a desire to remove the proposed
sidewalk south of the handicap space and develop the resulting area as a
part of the parking lot.
At this time, comments from the applicant regarding parking,
refrigeration and curbing were presented.
David Kovacs, Planning Director, presented a summation with
regard to the conditions and recommendations for this issue.

The following people spoke in favor of the Sundy House peti-
tion:

The Public Hearing was closed.
Wayne Campbell moved to approve variances 4 and 5 as listed on
the public notice, seconded by Sandy Jamison. The vote was as follows:
Christine Bull - No; Wayne Campbell - Yes; Daniel Carter - No; Sandy
Jamison - Yes; Rose Sloan - Yes. Said motion failed 3-2 .
Daniel Carter moved approval of the COA for a refrigerator/
freezer unit placed on-site, seconded by Wayne Campbell. The vote was
as follows: Christine Bull - Yes; Wayne Campbell - Yes; Daniel Carter -
Yes; Sandy Jamison - Yes; Rose Sloan - Yes. Said motion passed 5-0.
Wayne Campbell moved approval of the parking lot design con-
sideration for numbers 1 and 3 as listed on the public notice, seconded
by Sandy Jamison. The vote was as follows: Christine Bull - Yes; Wayne
Campbell - Yes; Daniel Carter - Yes; Sandy Jamison - Yes; Rose Sloan -
Yes. Said motion passed 5-0.
Daniel Carter moved approval to accept the site plan with the
sidewalk removed in the 24 foot section, seconded by Christine Bull.
The vote was as follows: Christine Bull - Yes; Wayne Campbell - Yes;
Daniel Carter - Yes; Sandy Jamison - Yes; Rose Sloan - Yes: Said motion
passed 5-0 .
Wayne Campbell moved approval to waive and remove the pro-
tective curbing in the landscape area, seconded by Sandy Jamison. The
vote was as follows: Christine Bull - Yes; Wayne Campbell - Yes; Daniel
Carter - Yes; Sandy Jamison - Yes; Rose Sloan - Yes. Said motion passed
5-0 .
Wayne Campbell moved approval for 28 on-site parking spaces,
with the exception of handicap spaces, an agreement to utilize St.
Paul' s parking lot with the necessary spaces to accommodate the overflow
of parking for special events, and the provision that the parking
surface is to be pea rock, seconded by Christine Bull. The vote was as
follows: Christine Bull - Yes; Wayne Campbell - Yes; Daniel Carter -
Yes; Sandy Jamison - Yes; Rose Sloan - Yes. Said motion passed 5-0.
Daniel Carter moved approval of COA 147-D Site Plan changes
specifically walkways , canopies, and architectural refrigeration unit,
not location of the refrigeration unit, seconded by Christine Bull. The
vote was as follows: Christine Bull - Yes; Wayne Campbell - Yes; Daniel
Carter - Yes; Sandy Jamison - Yes; Rose Sloan - Yes. Said motion passed

feet, seconded by Christine Bull.
Wayne Campbell amended his motion and moved to reduce the
right-of-way to 50 feet, Christine Bull amended her second and moved to
reflect the 50 foot right-of-way. The vote was as follows: Christine
Bull - Yes; Wayne Campbell - Yes; Daniel Carter - Yes; Sandy Jamison -
Yes; Rose Sloan - Yes. Said motion passed 5-0 .
Daniel Carter moved to amend the waiver of installation until
such time that the parking lot to the south is installed or the City or
the applicant deems the sidewalk necessary.
