following Waivers (COA 8-192) :
* Section 4 .6 . 16(H) (3) (a) , Perimeter Landscaping, to
reduce the required 5 ' wide landscape strip to 2 ' ; and
* Section 4 .6 . 16(H) (3) , Vehicular Encroachment, to allow
no curbing at the front driveway.

The Board approved the site plan for COA 8-192 based upon
positive findings with respect to Chapter 3 (Performance
Standards) of the Land Development Regulations, policies of
the Comprehensive Plan and Section 2 .4 .5(F) (5) subject to
the following conditions:
1 . That a revised site plan be submitted addressing Site
Plan Technical Items 1-7 of the Staff Report.
2 . That the hours of operation be limited to weekday
evenings after 5:00 P.M. , and weekends.
3 . That the seating capacity be limited to 40 seats.
4 . That there be no use of the second floor.
5 . That the off-site parking agreement be approved as to
form and content by the City Attorney' s office and
that it be properly executed and recorded.
6 . That valet parking service be provided.
7 . That the owner execute an agreement which provides
that if, within a two year period of time, the City
improves the alleyway, Damiano's will pay for that
portion which is adjacent to the property.

subject to the following conditions:
1. That the proposed Oleander along the west property
line be replaced with a Live Oak.
2 . That the proposed Live Oaks along the west property
line be located approximately 5 ' to the south to avoid
conflicts with existing trees .
3. That the hedge installed along the perimeter of the
site be 4 .5 ' in height at the time of planting, and
that it be maintained at a height of 6 ' to 8 ' along
the south property line.

* The removal of the low walls along the sides of the
porte-cochere.
* The picket fence to be used to screen the handicapped
ramp with the condition that Coco Plum be planted on
the north and east side of the fence for further
screening.
* The relocation of the lattice fence and gates which
create the trash enclosure.

4 . REPORTS FROM HISTORIC DISTRICTS:
The Del-Ida Park Neighborhood Association has elected a new
Chair, Colleen Gallagher and Vice-Chair, Toni Del-Fiandro.
5. UNFINISHED BUSINESS:
The Board was reminded that the National Trust Tour is to
be held on Saturday, October 10th.
It was noted that the CRA might possibly be interested in
the Blank House.
The CRA is working on creating a Downtown Historic
District. They are currently trying to recruit a Main
Street Director.
The Board requested Mrs. Cayce draft a letter from the
Board to the City Commission re the Board's objection to
the proposed 25 year lease agreement for the Busch's Dock.
Mr. Jamison questioned the status of OSSHAD, it was
suggested Mrs . Cayce draft a memo to David Kovacs, Director
of Planning re the status.

6 . NEW BUSINESS :
The Board was informed that the City is holding an Advisory
Board Training that will focus on formal meetings using
Roberts Rules of Order on October 27th and November llth
for any Board Member who wishes to attend.
Mrs . Cayce handed out a pamphlet on Resolution No . 152 ,
which will be on the November 3, 1992 Ballot, for the
Boards review. This Resolution regarding tax exemption for
historic propertiess, will be discussed at the Board' s
October 21st meeting.
7 . APPROVAL OF MINUTES : September 16 , 1992 Meeting

Approval of wooden wall sign located on the
east facade of the building.
BACKGROUND
On September 23, 1991 the HPB approved the subject wooden
wall sign for Brandy's Waterside Cafe. Several months ago
the applicant changed the establishment's name from Brandy' s
Cafe to Busch's Restaurant. On September 21, 1992 the
Building Department's sign review committee approved an
application to change the sign' s face to reflect the new
name. The applicant was informed that the sign required COA
approval from the HPB before a sign permit could be issued.
The sign face has been changed without a sign permit or COA.
ANALYSIS
The sign is 16 ' X 3 ' , constructed of wood and is not
illuminated. The new face' s text reads "Busch' s Seafood" ,
what appears to be a fish is depicted to the left of the
text and a lobster to the right. The background is white
with a narrow black border; the lettering hunter green; the
fish is green and the lobster red.
The originally approved sign face used colors to match the
existing awnings on the east windows and terrace; seafoam
green and pink, with a white background. The awning is a
prominent feature of the east facade and the color
coordination between sign and awning was effective. The new
sign colors are unrelated to the awning colors. However,
there is a band of windows between the awnings and the sign,
which tends to lessen the impact of the unrelated color
scheme.
ALTERNATIVE ACTION
1 . Approve the sign as existing.
2 . Approve the sign with the following modification:
Letters and border to be painted seafoam green to
match existing awnings . Allow the lobster to
remain red, and to conform to the symmetric design
of the sign, paint the fish red; or eliminate the
fish and substitute it for another red lobster.
3 . Deny the COA and have the sign removed and redesigned.

ITEM BEFORE THE B O A R D :
The action before the Board is that of approval of COA 8-192
which incorporates the following aspects of the development
proposal for Damiano' s at the Tarrimore House:
* Site Plan
* Landscape Plan
* Design Elements
The subject property is located at the southwest corner of N.
Swinton Avenue and N.W. 1st Street.
BACKGROUND :
The property consists of Lot 7, Block 60, Town of Linton which is
located within the Old School Square Historic District.
The development history dates back to 1924 when the first floor
of the existing structure was constructed as a single family
home. The partial second floor was constructed in 1939 . In
1988, improvements were made to the building, which included
repairs and maintenance i.e. reroofing, painting, and replacing
windows and doors. Site improvements were also made, including
the installation of a pea rock parking area at the rear of the
site, a perimeter picket fence, and landscaping.
On March 16, 1990, the Historic Preservation Board approved the
following six (6) variances associated with the Tarrimore Bed and
Breakfast Inn site and development plan.
1. Provision of a back-out parking space onto Swinton Avenue.
(Commercial uses are not allowed to back-out onto a street)
2 . Reduction of the required parking stall length of 18 ' to
vary between 17 .5 ' and 14 ' .
3 . Reduction of the required 24 ' driveway aisle width to 20 ' .
4 . Reduction of the parking aisle width from 24 ' to a
transition between 17 .5 ' and 16 ' .
5 . Reduction of the required 24 ' X 6 ' back-up maneuvering area.
6 . Deletion of landscape islands at the end of the parking row.
At its meeting of March 19, 1990, the Planning and Zoning Board
recommended approval of a conditional use and attendant site plan
for Tarrimore Bed and Breakfast Inn with conditions . On March
27, 1990, the City Commission approved the conditional use as
recommended by the Planning and Zoning Board.

The bed and breakfast inn and the associated improvements were
never established, and the conditional use approval and attendant
site plan have since expired. The structure was occupied as . a
single family residence until approximately January, 1991 and has
remained vacant since that time.
On September 16, 1992, a request for site plan approval for
Damiano' s at the Tarrimore House was submitted and is now before
the Board for action.
PROJECT DESCRIPTION :
The project involves the relocation of Damiano's Restaurant from
432 E. Atlantic Avenue to the Tarrimore House. The development
proposal incorporates the following:
* Conversion of an existing single family residence into
a 40-seat gourmet restaurant.
* Provision of 6 parking spaces on-site and 10 spaces
off-site at Michael Weiner's office building (northwest
corner of 1st Street and Swinton Avenue) via an
off-site parking agreement. The on-site parking lot
will have a pea rock surface.
* A valet parking drop-off area.
* Associated landscaping.
* Exterior design elements including: handicapped ramp,
trash container enclosure and demolition of
porte-cochere walls .
The restaurant will occupy the first floor only. At this time,
the second floor will remain vacant. The hours of operation will
be Wednesday - Saturday evenings 6 :00 P.M. - 10 : 00 P.M. and
Sunday Brunch 12 :00 P.M. - 3:30 P.M.
SITE PLAN ANALYSIS :
CHAPTER 3 (REQUIRED FINDINGS) : (Performance Standards - L.O.S. )
Pursuant to Section 3. 1. 1 of the Land Development Regulations,
prior to approval of development applications, certain findings
must be made in a form which is part of the official record.
This may be achieved through information on the application, the
Staff Report, or Minutes. Findings shall be made by the Board to
approve or deny the development application. These findings
relate to the following four areas:

FUTURE LAND USE MAP: The use or structures must be allowed in
the zone district and the zoning district
must be consistent with the land use designation.
The subject property has a Mixed Use land use plan designation
and an OSSHAD (Old School Square Historic Arts District) zoning
designation. The zoning is consistent with the land use.
Pursuant to Section 4 .4 .24 (B) (7) , within the OSSHAD, restaurants
are allowed as a permitted use. Based upon the above, it is
appropriate to make a positive finding with respect to the Future
Land Use Map.
CONCURRENCY: Facilities which are provided by, or through, the
City shall be provided to new development
concurrent with issuance of a Certificate of Occupancy. These
facilities shall be provided pursuant to levels of service
established within the Comprehensive Plan. For sewer and water,
concurrency shall mean that direct connection to a functioning
municipal system is made. For streets (traffic) , drainage, open
space (parks) , and solid waste, concurrency shall be determined
by the following:
* The improvement is in place prior to issuance of the
occupancy permit;
* The improvement is bonded, as part of the subdivision
improvements agreement or similar instrument, and there is a
schedule of completion in the bonding agreement;
* The improvement is part of a governmental capital
improvement budget; it has been designed; and a contract for
installation has been solicited.
Water and Sewer:
To date no water and sewer plans have been submitted; however,
the following is noted:
* Water service is provided to the site via a service lateral
connection to the existing 2" water main located within N.W.
1st Street.
* Sewer service is provided to the site via a service lateral
connection to an existing 8" sewer main located within the
alley to the rear (west side) of the property.
* Adequate fire suppression is provided via existing fire
hydrants located along N.W. and N.E 1st Street, within 300
ft. of the site.
The conversion from a single family residence to a restaurant
requires the installation of a backflow preventer and grease

trap. This item will need to be addressed with the plans
submitted for building permit review. No water or sewer main
extensions or upgrading is required with this development
proposal .
Drainage:
A preliminary drainage plan has been submitted indicating that
drainage will be accommodated on-site via an exfiltration system.
At this time, there are no problems anticipated with the proposed
system. Final drainage plans must be submitted for review by the
Engineering Department.
Streets and Traffic:
A Traffic Impact Study was prepared by the City' s Traffic
Engineer indicating that the proposed gourmet restaurant will
generate 150 new trips per day over and above the existing 10
trips generated by the single family residence ( 160 total trips) .
The traffic generated by this development will not have an
adverse impact on the level of service standards .
Parks and Open Space:
Park dedication requirements do not apply for nonresidential
uses. The open space requirements (25% non-vehicular open space)
have been met by applying Section 4 . 6 . 16(H) (3) (perimeter and
internal landscape requirements) . Thus, 37 .4% of open space has
been provided.
Solid Waste:
Trash generated by a restaurant of this size, with its relatively
low volume, will not be significant with respect to level of
service standards.
CONSISTENCY: Compliance with the performance standards set forth
in Section 3. 3 .3 along with the required findings
in Sections 2 .4 .5(F) (5) (General Compatibility and Harmony with
Adjacent Properties) shall be the basis upon which a finding of
overall consistency is to be made. Other objectives and policies
found in the adopted Comprehensive Plan may be used in making of
a finding of overall consistency.
A review of the objectives and policies of the Comprehensive Plan
was conducted and no applicable objectives and policies were
found.

Section 3 . 3 .3 (Standards for Site Plan Actions) : The applicable
performance standards of Section 3 . 3 . 3 and other policies which
apply are as follows :
A) Building design, landscaping, and lighting (Glare) shall be
such that they do not create unwarranted distractions or
blockage of visibility as it pertains to Traffic
Circulation.
The building and site will remain generally in their
existing configuration. The lighting will be designed to
complement the character of the building, and will not
create a glare or distraction to traffic.
B) Appropriate separation of travelways is made for vehicles,
bicycles, and pedestrians in a manner consistent with
Objective D-1 of the Traffic Element.
Patrons will drop off their vehicles at the valet station
and walk into the structure. Adequate pedestrian travelways
have been provided at the drop-off area and from the
handicapped parking space to the handicapped ramp. In
addition there are sidewalks adjacent to the property, which
provide adequate travelways from the off-site parking area
to the restaurant.
Section 2 .4 .5(F) (5) (Site Plan Findings) :
Pursuant to Section 2 .4 .5(F) (5) (Findings) , in addition to
provisions of Chapter Three, the approving body must make a
finding that development of the property pursuant to the site
plan will be compatible and harmonious with the adjacent and
nearby properties and the City as a whole, so as not to cause
substantial depreciation of property values .
The subject property is bordered on the north; south, east and
west by the OSSHAD (Old School Square Historic Arts District)
zone district. North are the law offices of Michael Weiner and
Associates; east are the Old School Square Cultural Arts Center
and Cason Cottage Museum; south and west are single family
residences. Less than one block west of the residences are the
City Hall and Tennis Center complexes .
Compatibility with the residences to the south and west will be
enhanced through the provision of required landscaping. Further
mitigation can be provided by requiring the proposed hedge
material to be 4 .5 ' high at the time of planting, and by
requiring it to be maintained at the maximum height allowed,
which is 8 ' . The limited hours of operation will further reduce
the potential impacts of this use on the adjacent residence.

The long term outlook for the Block in which the Tarrimore House
is located includes the conversion of several of the structures
to non-residential uses, and the elimination of certain
structures in order to provide parking for the adjacent uses .
The conversion of the Tarrimore House to an upscale restaurant
fits in well with that plan, and also complements the activities
which will be occurring at Old School Square. The use will
enhance rather than depreciate property values in the area, and
will be an inducement for the upgrading of nearby properties .
The development proposal retains the residential character that
is sought with developments within the OSSHAD zone district. As
the intent of the OSSHAD zone district is to promote mixed uses
in the manner proposed, a positive finding of compatibility
can be made.
COMPLIANCE WITH LAND DEVELOPMENT REGULATIONS:
Items identified in the Land Development Regulations shall be
specifically addressed by the body taking action on the
development application/request.
Parking
Pursuant to Section 4 . 6 .9 (C) (3) (d) , restaurants having up to
6,000 sq. ft. of floor area shall provide 12 parking spaces for
every 1,00 sq. ft. of floor area. Therefore, the proposed 1, 952
sq. ft. restaurant must provide 24 parking spaces . As presented,
there will be 16 spaces provided. Six (6 ) parking spaces will be
located on-site and 10 spaces will be located off-site at Michael
Weiner' s offices, via an off-site parking agreement. The use of
an off-site parking agreement, and the request for a reduction in
parking are discussed below.
Off-site parking agreement--Pursuant to Section 4 .6 .9 (E) (5)
of the LDRs, parking for a use may be provided off-site in
non-residential zoning districts, provided that the
properties are located within 300 feet of each other, and
that the provision of the parking does not diminish the
ability of the off-site property to meet its own parking
requirements . Off-site parking arrangements are
accommodated through the execution of an agreement which
stipulates that the off-site parking area may not be sold or
otherwise disposed of, except in conjunction with the
building which it is intended to serve, so long as those
parking facilities are needed. Such an agreement has been
submitted between Damiano 's and the Weiner property, and is
currently being reviewed by the City Attorney' s office.

The parking arrangement is acceptable as long as these two
businesses maintain separate working hours, with the law
office operating during the weekdays, and the restaurant
operating in the evenings and on weekends . If in the future
Damiano's wishes to serve lunches, they will have to provide
alternative parking arrangements . Therefore, any approval
of the use at this location, with the attendant off-site
parking, must be made contingent upon a separation of the
operating hours between the two uses .
Reduction in Parking--Pursuant to Section 4 . 6 . 9 (C) ( 1) (g) of
the Land Development Regulations, a reduction in the
required number of parking spaces may be granted, based
on the receipt of special documentation demonstrating
that the number of spaces provided is appropriate for a
particular location. The applicants are requesting
that the number of spaces required for the use at this
location be reduced from 24 to 16 .
As previously stated, the requirement for restaurant parking
is based on the square footage of the building, at 12 spaces
• for every 1,000 square feet. This standard is the same
regardless of the type of restaurant, and does not take into
account differences in customer turnover and overall volume.
For instance, the actual number of tables and seats provided
at Damiano's ( 10 tables, 40 seats) , is far fewer than the
number that could be accommodated in a structure of this
size. Only 4 tables will be placed in the main dining room,
which could easily accommodate twice as many. One entire
room will be an office, and another will go unused or will
be used for storage.
As stated in the architect' s letter, if customers seated at
6 of the 10 tables park two vehicles each, and those seated
at 4 of the tables park one vehicle each, the total number
of spaces used when the restaurant is fully occupied would
be 16 . Those figures are realistic for a restaurant of this
character.
In addition, the owners will be providing valet service to
park customer vehicles . Since valets maintain control of
the placement of vehicles, they can park cars behind one
another without disrupting overall circulation in the
parking lot. There is sufficient area between the two lots
to park additional vehicles in this manner if it becomes
necessary. The anticipated low turnover associated with
this type of dining makes this an acceptable parking
arrangement.
If the reduction in parking is approved, it should be
conditioned on a maximum of 40 seats, and on the provision
of valet parking service.

There is an existing parking area in the rear of the building
which was improved with a pea rock surface over a compacted
shellrock base. This was installed with the improvements to the
single family dwelling, in anticipation of its use as a bed and
breakfast. The proposed parking lot will have a pea rock surface
interior to the site and a hard surface for the handicapped
parking space and the ingress and egress points . The parking
spaces will be delineated with concrete wheel stops . Pursuant to
Section 4 .6 . 9 (D) (8) (a) , parking lots and spaces on historic sites
and within historic districts may be improved with a surface
material other than pavement, where there are 12 or fewer parking
spaces, subject to approval by the Historic Preservation Board.
Staff has no objection to the pea rock surface as proposed.
As stated in the Background section of this report numerous
variances were previously granted with the development proposal
for a bed and breakfast inn, which related to parking lot design •
standards . Since variances run with the land and do not expire,
those variances may be incorporated into any development proposal
for the subject property. The current development proposal
incorporates only variances #3 and #4, which allowed a reduction
in the size of the parking aisle and back-up maneuvering area.
Perpendicular parking spaces require a 24 ' driveway aisle for
adequate maneuvering area. However, a variance was granted which
allowed reduction of the aisle width to 17 .5 ' . This was allowed
in conjunction with a Bed and Breakfast Inn which typically has a
low volume and intensity and does not generate as many trips as a
restaurant. Therefore, in order to provide better
maneuverability for this use, the planting area on the east side
of the parking lot aisle should be reduced by 2 ' which will then
provide a 19 .5 ' wide driveway aisle.
Right-Of-Way Dedication
Pursuant to Section 5 . 3 . 1(D) (2) , the required right-of-way
width for N.W. 1st Street is 60 ' . However, pursuant to
Section 5 .3 . 1(D) (4) (Reduction in Width) , reduction in the
required right-of-way width may be granted by the body
having approval authority of the associated development
application.
Along N.W. 1st Street, 50 ' of right-of-way exists. This
width has been deemed acceptable by the City Engineer and a
waiver to this requirement is recommended.

Alley Improvement
They alley adjacent to Tarrimore is unimproved. Damiano' s
does not propose to use the alleyway for access, however,
the change in use triggers the requirement for its
improvement. The Tarrimore bed and breakfast inn was
approved with the condition that the owner execute an
agreement which provided for her future financial
participation in the improvement of the alleyway. That same
provision should be a condition of the restaurant approval .
Site Lighting
The site plan shows flood lights attached to the west side
of the structure. Pursuant to Section 4 . 6 . 8, lighting shall
be directed away from adjacent properties . The lighting
fixture shall not exceed 25 ' in height and must be equipped
with sharp cutoff luminaire, which will confine the lighting
the site.
Signage
No sign details have been provided however, a proposed
location has been designated. It appears that there will
not be any conflicts between the sign location and the
landscape material. The sign details require review and
approval by the HPB.
Trash Receptacles
The proposed plan provides for the use of roll-out carts in
lieu of a dumpster for trash disposal . Staff has contacted
Waste Management to verify that the use of such carts for a
restaurant of this size is acceptable. Waste Management is
evaluating the proposal to determine the feasibility of the
carts, and should provide a response prior to the HPB
meeting.
Building Setbacks
The existing structure encroaches into the required 15 ' side
street setback and the 25 ' front yard setback. This
existing nonconforming situation is not impacted by the
development proposal.

SITE PLAN TECHNICAL ITEMS:
The following are items that do not require specific action of
the Board however, the items must be addressed with the submittal
of a revised site/landscape plan and paving/drainage plans :
1 . Provide entrance/one way signs.
2 . Provide proposed grading plan. [Elevations should reference
National Geodetic Vertical Datum (N.G.V.D. ) ] .
3. Provide typical section of proposed parking area
construction showing material dimensions and specifications .
4 . Provide topographic survey showing existing elevations of
the site (N.G.V.D. ) , including vertical details of Swinton
Avenue and N.W. lst Street at access points .
5 . Show location of existing or proposed grease trap.
6 . Provide backflow preventer (RPZ) device for water meter.
7 . Provide details on proposed lighting of rear parking lot.
LAND S CAP E PLAN ANALYSIS :
Pursuant to Section 4 . 6 . 16(H) (3) (a) , a 5 ' landscape strip must be
provided between the off-street parking area and adjacent
right-of-ways ( 1st Street and the alley) . The applicants have
requested that this requirement be waived, in order to maintain
the existing 2 ' wide landscape strip. The landscape strip will
contain a new silver button wood hedge and an existing ficus
hedge along with a tree every 30 ' . In addition to the landscape
strip there will 2 ' car overhang, which will be sodded. However,
the 2 ' car overhang cannot be calculated into the required
landscape strip width. Taking into account the physical
constraints of the site and the provision of the required buffer
(plantings) , it is appropriate to recommend approval of the
waiver request.
Pursuant to Section 4 .6 . 16 (E) (3) (Vehicular Encroachment) ,
landscape areas are required to be separated from vehicular use
areas by nonmountable curbing. Curbing has not been provided at
the accessway just east of the porte-cochere ( front driveway) .
The area in question is one-way drive which is approximately 24 '
in length. It is unlikely that vehicles will encroach onto the
landscaped area.
Pursuant to Section 4 .6 . 16 (E) (5) , the proposed Oleander along the
west property line does not qualify as a tree. Thus, it is more
appropriate to provide a Live Oak instead of Oleander, which will

enable the requirement to be met . In addition, the live oaks
along the west property line should be located approximately 5 '
further to the south to prevent conflicts existing trees i . e .
Mango.
ELEVATIONS A N A L Y S IS •
The development proposal includes the following design elements
(exterior alterations ) which require analysis with respect to
compatibility with the existing historic structure.
Porte-Cochere Wall Removal
Tarrimore was constructed in 1924 as a single story vernacular
structure. In 1939 a second story and the porte-cochere were
added in the bungalow style. The house is now classified as an
example of bungalow architecture .
Porches , wide eves, massive porch and porte-cochere piers are
some of the exterior elements of the style . The plan calls for
the removal of the low walls along the sides of the
porte-cochere, in order to provide sufficient room for customers
to exit their vehicles . The walls do not appear to be part of
the 1939 remodeling, but seem to have been part of a later
addition. By demolishing the walls the piers will become a more
prominent part of design and the open spaces between will
accentuate their mass .
Handicapped Ramp
The picket fence is a unique method of screening the ramp.
The horizontal line of the fence top effectively screens the

Trash Enclosure
The relocated lattice fence and gates are appropriate and
with the proposed landscaping, should be sufficient to hide
the trash cans .

Agency reviewed the request and recommended approval of the
development proposal .
Neighborhood Notice:

ASSESSMENT AND CONCLUSIONS :
The proposed . use is consistent . with the policies of the
Comprehensive Plan and Chapter 3 of the Land Development
Regulations . In order to accommodate the proposed 40 seat
restaurant, a request has been made for the reduction of parking
based upon the restaurant ' s limited seating capacity and the
provision of valet parking services . As the site is physically
constraining, previously approved variances were utilized and
waivers requested in order to provide the maximum amount of
parking spaces possible on-site. However, the development
proposal retains the residential character and allows the
adaptive re-use that is sought with developments within the
OSSHAD zone district.
ALTERNATIVE ACTIONS :
1. Continue with direction.
2 . Recommend approval of COA 8-192 and the associated site
plan, landscape plan and design elements for Damiano' s at
the Tarrimore House with conditions .
3. Recommend denial of COA 8-192 and the associated site plan,
landscape plan and design elements for Damiano' s at the
Tarrimore House with basis stated.
RECOMMENDED A C T I O N :
A. Waivers
Recommend to the City Commission approval of the waiver
requests to Section 4 . 6 . 16 (H) (3) (a) , Perimeter Landscaping,
to reduce the required 5 ' wide landscape strip to 2 ' ; and

Dear Diane,
Thank you for reviewing the file for the Tarrimore house with Elizabeth Debs last week.
As you expected,the attached site plan contains six valet parking spaces using the variances
for lane width and maneuvering distances that were approved in 1990. Since the site plan is
similar to the 1990 plan,except for the addition of a one-way valet drop-off through the
existing carport.
A total of 16 parking spaces are provided because an off-street parking agreement for
10 spaces on Michael Weiner's property is being executed for restaurant use after 5 p.m.
Based on a ground floor area of 1,950 s.f. and 12 parking spaces per 1,000 s.f. for
restaurant use, 24 parking spaces are required. The parking deficit is 8 spaces.
The Land Development Regulations (LDR Sec. 4.6.9. (C) (1) (g)) allow for a reduction of
the parking requirements. We request that a parking reduction for a restaurant at Tarrimore
be granted based on the following reasons:
(1) The Tarrimore property is a historic structure located in the Old School Square
Historic District(OSSHAD). The City encourages redevelopment in this District and
the preservation of its historic characteristics. A restaurant enhances the District's
viability,but the high LDR parking requirements necessitate the purchase of an
additional parcel for parking, the cost and development expenses of which are not
affordable, and the demolition of other structures on an adjacent parcel. The
demolition of adjacent structures,which may have historic significance and
redevelopment potential that is lost to parking,runs contrary to land use for the
District.

(2) The parking requirements in the CBD are less stringent"in order to preserve and
protect the cultural and historic aspects of Downtown Delray Beach...." (LDR Sec.
4.4.13. (A)) The parking requirements are 3.3 spaces per 1,000 s.f. regardless of
use. The Tarrimore property and the OSSHAD are of equal cultural and historic
importance to Downtown Delray Beach. They are immediately adjacent to the CBD
and enhance the Downtown's village-like appearance. Based on 3.3 spaces per
1,000 s.f., only 7 parking spaces would be required for a restaurant at Tarrimore.
The Parking Study Committee has recommended that these less stringent parking
requirements be applied to the OSSHAD for new construction (and changes of use).
The City's Planning and Zoning Board concurs with this recommendation.
(3) The parking will be operated by valet. The valets can tandem-park and parallel-park
vehicles in the Tarrimore and Weiner lots. Approximately 8 vehicles can be parked in
this manner.
(4) The restaurant will be operated by three Damian family members who will operate
one vehicle on-premises. The other employees will not drive to work.
(5) The restaurant will contain 10 tables with seating for four per table. Assuming that 6
tables park two vehicles per table and 4 tables park one vehicle per table,only 16
parking spaces are necessary when the restaurant is fully occupied.
(6) The restaurant intends patronage from the OSSHAD theater crowd; some will park
elsewhere and walk to the restaurant.
(7) The CRA is developing a plan to make a temporary mulch parking lot with 20 parking
spaces, and later a permanent asphalt parking lot with a least 60 spaces on N.E. 1st
Avenue near the Tennis Center. These public parking areas can be used by the valets
for restaurant parking.

Thank you for expediting your review of a preliminary site plan for the Tarrimore House
and discussing your comments with Elizabeth Debs yesterday. The revised site plan has
been prepared based on your comments and is attached for your review.
The site plan for Damiano's at Tarrimore is similar to the 1990 landscape plan. The
perimeter landscape areas between the parking area and the public rights-of-way do not
comply with the landscape requirements in the Land Development Regulations.
A minimum landscape strip 5 feet in depth is required between the parking area and the
alley and N.W. 1st Street (LDR Sec. 4. 6. 16 (H) (3) (a)) The proposed site plan will
contain a landscape strip that is only 2 feet in depth.
We request that the City Commission grant relief from this provision through the waiver
process. (LDR Sec. 4. 6. 16 (C) (2) and Sec. 2. 4. 7. (B))
The proposed landscape strip matches the 1990 site plan and variances granted for lane
width and maneuvering distances in the parking area. The ficus hedge along this strip will
be upgraded. The existing matting used to screen the parking area from the alley (where
the ficus hedge did not root) will be replaced with a new ficus hedge at least 4 feet in
height.
Every effort has been taken to keep the existing 30' o.a. (overall)mango and the 14' o.a.
avocado trees in the parking area to maintain the property's historic context. Lighting of
the parking area will use these trees and the upgraded ficus hedge for more dramatic
restaurant dining.

According to a CRA plan to provide tennis center parking on N.W. 1st Avenue,the alley
would be abandoned and a walkway provided to N.W. 1st Street. If this alley is
abandoned the landscape strip between the parking area and the alley would exceed 5 feet in
depth and contain attractive landscaping.
We believe that Damiano's at the Tarrimore House will enhance the neighboring area, the
City Hall,Tennis Center and Old School Square. The perimeter landscape requirement
would result in a unacceptable narrowing of the existing driving aisle(the aisle is already
narrow by variance). Since a waiver would apply to this specific site which has an existing

Your quick response to the Tarrimore site plan is again appreciated.
As we discussed yesterday,curbing or wheel stops are required between all landscape
areas and the vehicular way (LDR Sec. 4. 6. 16. (E) (3)). After discussing the curbing
with you, the site plan has been revised to show 6" x 6" x 4'-0"railroad ties as curbing and
conc. wheel stops in all areas except the front yard. I understand that the Director has the
discretion to waive the Type "D" curbing prescribed by the LDR in lieu of the railroad ties.
Since it is desirable to maintain the residential appearance of the Tarrimore House as it
currently exists, curbs will not be provided along the new front yard concrete driveway
from Swinton Avenue to the Tarrimore House.
I ask that you recognize the special quality of the Tarrimore House and the Old School
Square Historic District and find that this waiver will not adversely affect the neighboring

SUBJECT: ADVISORY BOARD TRAINING
EFFECTIVE MEETING MANAGEMENT
Last year the City provided as part of the Advisory Board Orientation a
comprehensive training program on Effective Meeting Management. The
training was designed for the Chairperson and Vice Chairperson and was
extremely well received by those who attended.
I have asked Doug Randolph who is our Training Coordinator to once again
offer this program. The training will consist of two sessions to be held
in the first floor conference room at City Hall on the evenings of
October 27 and November 10. Each session will begin at 6:00 pm and will
finish by 9:00 pm.
On October 27 the training will focus on formal meetings using Roberts
Rules of Order. The training on November 10 will discuss pre-meeting
management and conducting informal meetings.
This year the training will be open to any member of our Boards and
Committees, however, I strongly urge all new members to make an effort
to attend. Please contact Doug Randolph at extension 7127 or Anita Barba
at extension 7056 to sign up for this training.
