Mr. Jamison inquired about the Historic Tax Credit
Referendum and was informed by Mrs. Cayce that it goes into
effect January 1, 1993. This is a local government option
and the City will be receiving information after the first
of the year.
Mrs. Cayce informed the Board that the West Palm Beach
Guidelines are in if they wish to review them.
6 . APPROVAL OF MINUTES: December 2, 1992 Meeting
Sandy Jamison moved for approval of the minutes for the
December 2, 1992 meeting, seconded by Margie Miller. The
vote was as follows: Christine Bull - Yes; Daniel Carter -
Yes; Sandy Jamison - Yes; Margie Miller - Yes; Rose Sloan -
Yes . Said motion passed 5-0.
At this time the Board returned to Item #2 (COA 8-199) as they
had finished with Items 3 thru 6 .
2 . COA 8-199 : 5 N.E. 2nd Street; Coastal Revegetation, Inc. ;

The Board moved to recommend to the City - Commission
approval of the waiver requests to Section 4 .6 . 16 (H) (3) (d)
(Perimeter Landscaping) to reduce the required 5 ' wide
landscape strip to 2 ' along the north property line
adjacent to the parking area. With the requirement that
trees be planted every 30 ' to 40 ' adjacent to the parking
area for COA 8-199 .
Sandy Jamison moved for approval of COA 8-199 (Perimeter
Landscaping Waiver) , seconded by Margie Miller. The vote
was as follows: Christine Bull - Yes; Daniel Carter - Yes;

The Board moved to recommend to the City Commission denial
of the waiver request to Section 4 .6 . 16(F) (Irrigation
Requirements) , to allow no provisions for an automatic

The Board moved to approve a waiver to allow parking in the
side yard adjacent to Swinton Avenue as illustrated on the

The Board moved to approve COA 8-199 for the site plan for
Coastal Revegetation, Inc. based upon positive findings
with respect to Chapter 3 (Performance Standards) of the
Land Development Regulations, policies of the Comprehensive
Plan and Section 2.4 .5(F) (5) subject to the following
conditions:
1. That a revised site plan be submitted addressing Site
Plan Technical Items:
A. Designate the compact parking space as such with
a compact car sign at the head of the parking
space.
B. Under landscape notes, the perimeter tree
requirements are calculated at 4 and not 0 as
indicated on the plan.
C. Indicate trash receptacle locations on the plan.
2 . That written verification be provided by the Florida
Department of Community Affairs stating that the
handicapped accessibility requirements have been
waived for this development (i.e. handicapped parking
space and ramp, restroom facilities, other
requirements within the structure) .
3. That written verification be provided from Waste
Management stating that the use of roll-out carts is
acceptable, or provide accommodations for a dumpster
accordingly.

Live Oak tree adjacent to the northermost parking
space be moved 5 ' to the northwest.
2 . That the hedge which is to be installed along the
north property line be 4 .5 ' in height at the time of
planting, and maintained at a height of 6 ' to 8 ' .
3. That the proposed hedge along the east side of the
parking spaces be located to the east property line
and be 4 .5 ' in height at the time of planting, and
maintained at 6 ' to 8 ' .

The Board made the following motion for COA 8-199, Design
Elements:
1. Based on failure to make positive findings with
respect to Section 4 .5. 1 the Board denied the use of a
solid glass block enclosure for the entryway porch.
2. The Board approved a 15 glass pane wood door.
3 . The Board approved the use of terra cotta tile for
paving the entrance porch and step.
4 . The Board approved the picket fence as shown on the
proposed site plan. The fence may be embellished with
post caps or finials if approved by Board member Sandy
Jamison.
5. The Board approved the paver block driveway entrance
if acceptable to the City Engineer.

1 . The Board approved a recommendation to the City
Commission that a waiver be granted from Section
4 . 6 . 16 (H) (d) Perimeter Landscaping, to reduce the

The action before the Board is that of approval of COA 8-199
which incorporates the following aspects of the development
proposal for Coastal Revegetation, Inc. :
* Site Plan
* Landscape Plan
* Design Elements
•
The subject property is located at the northeast corner of N.
Swinton Avenue and N.E. 2nd Street.
BACKGROUND :
The property consists of Lot 19, Block 66, Resubdivision of Block
66, Town of Delray, which is located within the Old School Square
Historic District.
The existing one story single family residence was constructed in
1946 and is noncontributing from a historical perspective. The
architectural style is post World War II vernacular of the
1940 ' s . The structure is constructed of concrete block with a
fiberglass shingle roof and retains most of its original wooden
awning windows . With exception of the roof, which was probably
cement tile, the structure has not been significantly altered.
On November 2, 1992, a request for site plan approval to
establish a business office for Coastal Revegetation, Inc. was
submitted and is now before the Board for action.
PROJECT DESCRIPTION :
The project involves the relocation of the business office for
Coastal Revegetation, Inc. from 1050 S. Federal Highway to 5 N.E.
2nd Street. The development proposal includes the following:
* Conversion of an existing single family residence into
a business office.
* Removal of a 35 . 34 sq. ft. plywood shed at the rear of
the building.
• Construction of a 4 space pea rock parking lot with a
concrete pattern block apron at the entrance.
* Installation of a white picket fence along the south
property line and the south 35 ' along the west property
line.
-_ * Installation of associated landscaping.

* Existing chain link fence to remain along the north
property line and the north 66 ' along the west property
line.
* Improvements to the front entry to include installation
of glass block enclosure around the porch, terra-cotta
pavement material at the entry way, and replacement of
a glass jalousie door with a glass pane wood door.
SITE PLAN ANAL Y S I S :
REQUIRED FINDINGS: (Chapter 3)
Pursuant to Section 3. 1. 1 (Required Findings) , prior to
approval of development applications, certain findings must
be made in a form which is part of the official record.
This may be achieved through information on the application,
the Staff Report, or Minutes. Findings shall be made by the
body which has the authority to approve or deny the
development application. These findings relate to the
following four areas :
FUTURE LAND USE MAP: The use or structures must be allowed in
the zone district and the zoning district
must be consistent with the land use designation.
The subject property has a Mixed Use land use plan designation
and an OSSHAD (Old School Square Historic Arts District) zoning
designation. The zoning is consistent with the land use.
Pursuant to Section 4 .4 .24 (B) (2) , within the OSSHAD, business and
professional offices are allowed as a permitted use.
Coastal Revegetation, Inc. is a landscape constracting company
which designs landscape plans and installs landscape material.
Initially, there was a concern that the intended use of the
property was as a Contractor's Office, which is not permitted
within the OSSHAD. Contractor's offices typically include the
storage of equipment and materials, and provide a location to
dispatch workers and vehicles to and from job sites, whereas an
administrative office for a contractor functions mainly as a
location for record keeping and phone contacts . Pursuant to
staff' s request, an Affidavit was provided by the
applicant/property owner stating the following:
"The operation located at 5 Northeast 2nd Street, Delray
Beach, Florida 33444, will be a business office for
administrative purposes only. There will be no storage" of
vehicles, materials or equipment, and no dispatching from
this location. "
Based upon the above, it is appropriate to make a positive
finding with respect to consistency with the Future Land Use Map.

CONCURRENCY: Facilities which are provided by, or through, the
City shall be provided to new development
concurrent with issuance of a Certificate of Occupancy. These
facilities shall be provided pursuant to levels of service
established within the Comprehensive Plan.
Water and Sewer:
To date no water and sewer plans have been submitted; however,
the following is noted:
* Water service is provided to the site via a service lateral
connection to the existing 10" water main located along
Swinton Avenue.
* Sewer service is provided to the site via a service lateral
connection to an existing 12" sewer main located within N.E.
2nd Street.
* Adequate fire suppression is provided via an existing fire
hydrant located at the southeast corner of N.E. 2nd Street
Swinton Avenue.
All connections are existing and operational. No water or sewer
main extensions or upgrading is required with this development
proposal .
Drainage:
A drainage plan has been submitted indicating that drainage will
be accommodated on-site via sheet flow into landscape areas . The
Engineering Department has no objections with the proposed
system.
Streets and Traffic:
A Traffic Impact Study was prepared by the City's Traffic
Engineer indicating that the proposed office use will generate
37 ;new trips per day over and above the existing 10 trips
generated by the single family residence (47 total trips) . The
trafic generated by this development will not have an adverse
impapit on the level of service standards.
Parks and Recreation Facilities :
Park, dedication requirements do not apply for nonresidential
uses.- . Thus, the proposed development will not have an adverse
ippapt with respect to level of service standards.
Solid Waste:
Trash generated by the proposed office use will not be
significant with respect to level of service standards.

CONSISTENCY: Compliance with the performance standards set forth
in Section 3 .3.3 along with the required findings
in Sections 2 .4 .5(F) (5) (General Compatibility and Harmony with
Adjacent Properties) shall be the basis upon which a finding of
overall consistency is to be made. Other objectives and policies
found in the adopted Comprehensive Plan may be used in making of
a finding of overall consistency.
A review of the objectives and policies of the Comprehensive Plan
was conducted and no applicable objectives and policies were
found.
Section 3. 3.3 (Standards for Site Plan Actions) : The applicable
performance standards of Section 3.3 . 3 and other policies which
apply are as follows:
A) Building design, landscaping, and lighting (Glare) shall be
such that they do not create unwarranted distractions or
blockage of visibility as it pertains to Traffic
Circulation.
The building and site will remain generally in their
existing configuration and do not affect visibility as it
pertains to traffic circulation.
B) Appropriate separation of travelways is made for vehicles,
bicycles, and pedestrians in a manner consistent with
Objective D-1 of the Traffic Element.
The proposed use is a low volume traffic generator. The
parking area is adjacent to the building and no conflicts
are anticipated.
Section 2 .4 .5(F) (5) (Site Plan Findings) :
Pursuant to Section 2 .4 .5(F) (5) (Findings) , in addition to
provisions of Chapter Three, the approving body must make a
finding that development of the property pursuant to the site
plan will be compatible and harmonious with the adjacent and
nearby properties and the City as a whole, so as not to cause
substantial depreciation of property values .
The subject property is bordered on the north, south, east and
west by the OSSHAD (Old School Square Historic Arts District)
zone district. The surrounding properties contain single family
residences along with some vacant lots. One block west of the
residences are City Hall and the City Attorney offices.
Compatibility with the residences to the north will be enhanced
through the provision of required landscaping. The low intensity
of the office use will reduce the potential impacts on adjacent
properties. The upgrading of the site will enhance rather than
depreciate property values in the area, and will be an inducement
for the upgrading of nearby properties .

The development proposal retains the residential character that
is sought with developments within the OSSHAD zone district. As
the intent of the OSSHAD zone district is to promote mixed uses,
a positive finding of compatibility can be made.
COMPLIANCE WITH LAND DEVELOPMENT REGULATIONS:
Items identified in the Land Development Regulations shall be
specifically addressed by the body taking action on the
development application/request.
Parking Requirement
Pursuant to Section 4 .4 .24 (G) ( 1) , within the OSSHAD,
business and professional offices shall provide 1 parking
space for every 300 sq. ft. of floor area. The structure
contains 1, 116 sq. ft. of total floor area, thus requiring 4
parking spaces. Four (4) parking spaces (3 standard, 1
compact) have been provided. Pursuant to Section
4 . 6 . 9 (F) ( 1) (Compact Car Parking) , up to 30% of the required
parking for any use may be designated for compact. The one
compact space accounts for 25% of the required parking,
thus, this provision is met.
Parking Surface
The proposed parking lot will have a pea rock surface
interior to the site and a concrete paver block surface at
the accessway. The parking spaces will be delineated with
treated wood wheel stops . Pursuant to Section
4 .6 .9 (D) (8) (a) , parking lots and spaces on historic sites
and within historic districts may be improved with a surface
material other than pavement, where there are 12 or fewer
parking spaces, subject to approval by the Historic
Preservation Board. Staff has no objection to the pea rock
surface as proposed.
Side 'Yard Parking
Pursuant to Section 4 .4 .24(G) (2) , except for single family
`5:: • omes and duplexes, all parking shall be located in the side
>i* rear yard. No such parking is to be located in the area
'r;between the street and the building. However, where there
}ire existing buildings, the Historic Preservation Board may
waive this requirement during the site plan review process,
provided that it is determined that compliance is not
--31)''-feasible and that the residential character of the area will
t�1fbe maintained. If approved, such parking shall be
�esubstantially screened from off-premises view by a hedge, at
'' = least 4 ' in height.

The site plan indicates the provision of a parking space
along the west side of the building, adjacent to Swinton
Avenue. The physical constraints of the site require
placement of a parking space in this location. Further, it
is noted that there is an existing mature hedge, which
adequately screens the parking space. Therefore, based upon
these factors, it is appropriate for the Board to waive this
requirement.
Right-Of-Way Dedication
Pursuant to Section 5.3. 1(D) (2) , the required right-of-way
width for N.E. 2nd Street is 60 ' . However, pursuant to
Section 5 .3. 1(D) (4) (Reduction in Width) , reduction in the
required right-of-way width may be granted by the body
having approval authority of the associated development
application.
Along N.E. 2nd Street, 50 ' of right-of-way exists . This
width has been deemed acceptable by the City Engineer and a
waiver to this requirement is recommended.
Site Lighting
Site lighting is not being provided with this office
conversion. If in the future, site lighting is installed,
it must be done so in accordance with LDR Section 4 . 6 . 8
(Lighting) . It is noted that site lighting shall be
directed away from adjacent properties . The lighting
fixture shall not exceed 25 ' in height and must be equipped
with sharp cutoff luminaire, which will confine the lighting
the site.
Signage
No sign details have been provided however, a proposed
location has been designated. It appears that there will
not be any conflicts between the sign location and the
landscape material. The sign details require review and
approval by the HPB.
Trash Receptacles
Trash receptacle locations have not been provided on the
plan. The applicant has stated that roll-out carts will be
used in lieu of a dumpster. This arrangement should be
adequate for this scale of operation, however, verification
must be provided from Waste Management, Inc. indicating that
roll-out carts are acceptable. The trash receptacle
location must be indicated on the plan.

Site Plan Technical Items:
These items must be addressed with the submittal of revised
plans :
1. Designate the compact parking space as such with a compact
car sign at the head of the parking space.
2 . Under landscape notes, the perimeter tree requirements are
calculated at 4 and not 0 as indicated on the plan.
3. Indicate trash receptacle locations on the plan.
LAND S CAP E PLAN ANALYSIS :
Perimeter Landscaping
Pursuant to Section 4 .6 . 16(H) (3) (d) , a 5 ' landscape strip
must be provided between the off-street parking area and the
abutting property. Along the north property line, the
landscape strip tapers from 5 ' at the west end to 2 '
adjacent to the parking area. The applicant has requested
that this requirement be waived to a 2 ' landscape strip, in
order to accommodate the required parking. In addition,
trees are required every 30 ' . As the trees (live oak) could
not be accommodated within the 2 ' landscape strip, the
distance between the trees will need to be increased to
approximately 40 ' . Therefore, a Live Oak must be located 5 '
off the west property line and the proposed Live Oak
adjacent to the northernmost parking space must be located
5 ' to the northwest. Taking into account the physical
constraints of the site and the provision of adequate
buffering elsewhere along this property line, it is
appropriate to recommend approval of the waiver requests .
Landscaping Irrigation
Pursuant to Section 4 .6 . 16 (F) (Irrigation Requirements) , all
landscaped areas shall be provided with a sprinkler system,
automatically operated, to provide complete coverage of all
plant materials and grass to be maintained. The applicant
is requesting a waiver to this requirement due to some
unanticipated costs associated with converting the
structure for office use. Also, the applicant has indicated
' , rthat the some of the plant material will be drought
resistant, and sodded areas will be hand watered, including
he right-of-way areas. Once the drought resistant plants
- , Yget established, they will need very little watering.
Staff is not supportive of the waiver request, as the
property is on a prominent corner and the appearance of the
landscaping is very important. Further, ownership may
change and future manual maintenance cannot be guaranteed.

Hedge Location
The proposed hedge along the east side of the parking space
should be located to the east property line. This will
provide a sense of open space to those entering the site and
also provide additional buffering along the east property
line.
ELEVATION ANALYSIS :
The development proposal includes the following design elements
(exterior alterations) which require analysis with respect to
compatibility with existing structure and the adjacent historic
structures.
Glass Block Enclosure
The proposal includes enclosing the front entry porch with
glass block. Solid porch or entrance hood enclosures are
inappropriate to any architectural style. The use of glass
block for the enclosure is not suitable to the age of this
building. Glass blocks were used extensively before WWII
but were seldom seen in new construction until the Deco and
Moderne revival of the 1980 's .
Front Door
The existing glass jalousie front door is to be replaced
with a 15 glass pane wood door. The 15 pane door is not
consistent in style with the glass blocks.
Entry Walk
The porch and entryway steps will be paved with terra-cotta
tile. Terra-cotta tile is not a compatible material to
combine with glass block.
Picket Fence
A white wood picket fence is proposed along N.E. 2nd Street
and along the front yard portion of N. Swinton Ave. ; The
fence will be 30" high on 10 ' centers. The proposed;,plcket
fence is inappropriate with a glass block and terra-cotta.

The Board may want to suggest to the applicant that ;rother
entrance treatments be considered. For example, the facade could
be architecturally enhanced by boxing the support columns-=:to
approximately 8" x 8" and attaching a simple molding at the ;-;top
and bottom. A free standing trellis with vines, located on: the
front and east sides of the entrance would give the effect of
enclosure. A simple wood panel door would be appropriate to the
style of the building. Replacing the aluminum awnings with
canvas awnings and painting the front door to match the awnings
would create a unified professional exterior while retaining the
residential character of the building.

If the applicant is not granted a waiver from the handicapped
accessibility requirements, the handicapped ramp would need to be
located at the front step of the entryway enclosure.
OTHER I T E M S :
Handicapped Accessibility Requirements
Pursuant to the Florida Handicapped Accessibility
Requirements Manual, the conversion of the existing single
family structure to the office/commercial use, requires that
the structure be modified both internally and externally to
meet the handicapped accessibility requirements. Pursuant
to these requirements, a handicapped parking space and
accessible route to the building entrance must be provided
along with modifications to the interior of the building
i.e. restroom facilities, doorway widths, etc.
The applicant has submitted a request to the Florida
Department of Community Affairs (DCA) to have the
requirements waived. The proposed site plan does not
include any accessibility features . Depending upon the
outcome of the waiver request, the plan may have to be
modified to comply with the requirements. The most
appropriate location for a handicapped parking space is
along the west side of the building, on a hard surface. If
the waiver is not granted the changes which will need to be
made to the plan will be processed as a non-impacting site
plan modification.
REVIEW BY O T H E R S :
Community Redevelopment Agency:
At its meeting of November 19, 1992, the Community Redevelopment
Agency reviewed the development proposal . The Board had a concern
that the property being used as a contractor's office. After
discussing the item, the Board recommended approval of the
development proposal with the understanding that the building is
thLbe •used as a business office only, and not for contractor's
operations, (e.g. storage of materials, loading trucks, etc. )

business office will be used for administrative purposes only.

ASSESSMENT AND CONCLUSIONS :
The proposed use is consistent with the policies of the
Comprehensive Plan and Chapter 3 of the Land Development
Regulations . As the site is physically constraining, waivers
have been requested in order to provide the required amount of
parking spaces . However, the development proposal retains the
residential character and allows the adaptive re-use that is
sought with developments within the OSSHAD zone district.
ALTERNATIVE ACTIONS :
1 . Continue with direction.
2 . Recommend approval of COA 8-199 and the associated site
plan, landscape plan and design elements for Coastal
Revegetation, Inc . with conditions .

REQUEST FOR WAIVER
Coastal Revegetation , Inc. is hereby requesting a waiver for
the requirement of a 5 ft. landscape strip between the north
property line and our parking area , and accept a 2 ft. wide-
strip (which currently exists in the form of a 7 ft. Ficus
hedge) . Our request is based solely on the fact that we
cannot comply with Code requirements regarding the numbers
and sizes of parking spaces unless we decrease the landscape
strip from 5 ft . to 2 ft.
We are also requesting a waiver for the requirement o=f an
automatic irrigation system, as new plant materials will be
drought resistant , and sodded areas will be hand watered

Minutes of the Local Advisory Committee Meeting
April 8, 1992
6:30 p.m.
The meeting was attended by almost 100 local preservationists. David Doheny, Acting
President of the National Trust, opened the meeting and thanked the local community for
exhibiting such strong support of the conference.
Peter Brink, Vice President of Programs, Services & Information, reported briefly on the
overall conference theme of cultural diversity and how this theme would be developed in
the plenary sessions.
Mr. Brink also reported that an objective of this year's conference is to broaden the
audience to attendees to include more minorities. The National Trust is establishing a
•
minority scholarship program, and is encouraging state and local organizations to develop
methods of sending minority representatives.
Katharine Dickenson, National Trust Trustee, and Arva Parks, National Trust Advisor,
reported on the progress of the fund raising committee. The fund raising committee is
currently approaching major corporations, area banks, and small businesses soliciting
contributions to support the conference activities. Approximately$45,500 has been pledged
to date, including $20,000 from the National Park Service and $25,000 from the Florida
State Historic Preservation Office. The committee is seeking an additional $50,000 to
complete the conference budget. Should anyone on the Local Advisory Committee have any
resources to suggest, please contact Arva Parks in Miami.
Penny Jones, Director of Preservation Programs, reported on the plenary sessions, the
educational sessions, and the mobile workshops being offered during the conference. (See
attached)
Kathy Cox, Conference Manager, reported on the tours and special events being offered
during the conference. (See attached)

Kathy Cox also reported that the marketing effort for the conference had begun with
advertisements in the recent issues of Historic Preservation News. The preliminary program
will be printed in the June issue of Historic Preservation News which is mailed to 250,000
National Trust members around the country. An additional 30,000 will be direct mailed to
targeted lists of preservationists,primarily in the Southern region of the United States. Ms.
Cox mentioned that special press releases and public service announcements were available
for organizational newsletters. Should anyone know of an appropriate newsletter to receive
this information promoting the conference, please contact her at 202/673-4089.
After a brief question and answer period,the meeting was adjourned. The next meeting will
be held in September. Time and place will be announced in mid-summer.
