ITEM BEFORE THE BOARD
The item before the Board is the consideration of a Certificate of Appropriateness (COA) and
waiver request associated with a revision to a non-contributing single-family residence on the
property located at 313 NW 1st Avenue, Old School Square Historic District, pursuant to
Land Development Regulations (LDR) Section 2.4.6(H).
BACKGROUND & PROJECT DESCRIPTION
The subject property is located on the east side of NW 1st Avenue, north of NW 3rd Street and
measures .43 acres. The parcel is located within the Old School Square Historic District and is
zoned OSSHAD (Old School Square Historic Arts District). The parcel, which is currently under
construction, was previously vacant and contained many mango trees. The new construction
consists of a one-story, single-family residence and detached, two-car garage approved by the
Board at its June 19, 2013 meeting.
The Board also approved two waiver requests:
• Section 4.4.24(F)(1), which provides for a maximum front elevation width of 60', whereas
71'11" was approved.
• Section 4.6.5(C), which limits heights of walls within the front yard to 6' in height,
whereas the approved wall, which encroaches into the front yard setback, measures 14'
in height and is attached to the front elevation as an architectural feature.
The current COA request is for the extension of a previously approved vertical roof feature. This
feature connects to the aforenoted wall, and is finished with textured stucco over concrete block.
The extended feature, however, encroaches into the Building Height Plane (BHP) which is
regulated by LDR Section 4.5.1(E)(8)(a). The BHP encroachment measures approximately 2'
high and 3'6" deep.
The COA and Waiver requests are now before the Board for consideration.

SECTION 4.5.1, HISTORIC PRESERVATION DISTRICTS AND SITES
Article 2.4, General Procedures
Section 2.4.6, Procedures for Obtaining Permits and Approvals
(H)(5), Certificate of Appropriateness for Individually Designated Historic Structures and
all Properties Located within Historic Districts, Findings: Prior to approval, a finding must
be made that any Certificate of Appropriateness which is to be approved is consistent with
Historic Preservation purposes pursuant to Objective A-4 of the Land Use Element of the
Comprehensive Plan and specifically with provisions of Section 4.5.1, the Delray Beach Historic
Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation.
Section 4.5.1, Historic Preservation Sites and Districts
(E), Development Standards, All development regardless of use within individually designated
historic properties and/or properties located within historic districts, whether contributing or
noncontributing, residential or nonresidential, shall comply with the goals, objectives, and
policies of the Comprehensive Plan, these regulations, the Delray Beach Historic Preservation
Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation.
STAFF COMMENT:
In accordance with the above, the aforenoted criteria has been analyzed throughout this report.
(E)(5), Standards and Guidelines, a historic site, building, structure, improvement, or
appurtenance within a historic district shall only be altered, restored, preserved, repaired,
relocated, demolished, or otherwise changed in accordance with the Secretary of the Interior's
Standards for Rehabilitation, and the Delray Beach Historic Preservation Design Guidelines, as
amended from time to time.
Standards
New additions, exterior alterations, or related new construction shall not destroy historic
materials that characterize the property. The new work shall be differentiated from the old and
shall be compatible with the massing, size, scale, and architectural features to protect the
historic integrity of the property and its environment. (Standard 9)
New additions and adjacent or related new construction shall be undertaken in such a manner
that if removed in the future, the essential form and integrity of the historic property and its
environment would be unimpaired. (Standard 10)
STAFF COMMENT:
In consideration of the applicable Standards noted above, the approved style is differentiated
from the "old" or historic architecture of the district, and was not considered to impact the
historic integrity of the "environment" or historic district. The new construction, if removed in the
future, will not impair the essential form and integrity of the environment, either. Regarding the
proposed feature, it remains in keeping with the architectural style which met the intent of the
aforenoted Standards. Therefore, positive findings can be made.
(E)(8)(a-I), Visual Compatibility Standards, new construction and all improvements to
contributing buildings, structures and appurtenances thereto within a designated historic district
shall be visually compatible. In addition to the Zoning District Regulations, the Historic
Preservation Board shall apply the visual compatibility standards provided for in this Section
with regard to height, width, mass, scale, facade, openings, rhythm, material, color, texture, roof
shape, direction, and other criteria set forth elsewhere in Section 4.5.1. .

(a) Height: The height of proposed buildings or modifications shall be visually compatible in
comparison or relation to the height of existing structures and buildings in a historic district for
all major and minor development. For major development, visual compatibility with respect to
the height of residential structures, as defined by 4.5.1(E)(2)(a), shall also be determined
through application of the following:
1. Building Height Plane (BHP): The building height plane technique sets back the
overall height of a building from the front property line.
(I) Architectural Style: All major and minor development shall consist of only one (1)
architectural style per structure or property and not introduce elements definitive of
another style.
STAFF COMMENT:
In consideration of the applicable Standards for Rehabilitation and Visual Compatibility
Standards noted above, the proposal meets their intent. While the extended feature encroaches
into the BHP area, the intent of the regulation is to mitigate impacts of scale and massing on the
streetscape while providing appropriately designed buildings in the historic districts. The
encroachment is not contrary to this intent, as this is isolated to a design feature and does not
add to the "overall height of the building", as specified above. Further, the feature is appropriate
to the modern characteristics of the building, and meets the intent of the "Architectural Style"
Standard noted above.
Given the above, positive findings can be made with respect to the applicable Visual
Compatibility Standards.
WAIVER REVIEW AND ANALYSIS
Section 2.4.7(B)(5), Procedures for Obtaining Relief From Compliance With Portions of
the Land Development Regulations, Waivers: Prior to granting a waiver, the approving body
shall make a finding that the granting of the waiver:
(a) Shall not adversely affect the neighboring area;
(b) Shall not significantly diminish the provision of public facilities;
(c) Shall not create an unsafe situation; and,
(d) Does not result in the grant of a special privilege in that the same waiver would be
granted under similar circumstances on other property for another applicant or
owner.
Section 4.5.1(E)(8)(a), Visual Compatibility Standards, Height
The height of proposed buildings or modifications shall be visually compatible in comparison or
relation to the height of existing structures and buildings in a historic district for all major and
minor development. For major development, visual compatibility with respect to the height of
residential structures, as defined by 4.5.1(E)(2)(a), shall also be determined through application
of the following:
1. Building Height Plane (BHP): The building height plane technique sets back the overall
height of a building from the front property line.

STAFF COMMENT:
The applicant provided the following statement in explanation of the waiver request:
"...request is to extend vertically an existing decorative architectural wall that frames the
entrance to the house behind the Building Height Plane as established in the Land Development
Regulations. This wall is an integral part of the design and was originally presented to the
Historic Preservation Board. The wall is only a design feature, an architecture extension whose
purpose is to just mark the access to the house and break the massing of the architecture. It is
not a mass or a column so it is for this reason that we feel that although it does encroach on the
BHP it does not affect in any significant way the street profile or the scale of the neighborhood
and stays within the intent of the code.
In consideration of the waiver criteria, the request can be supported in that it will not adversely
affect the neighboring area, as the encroachment is part of the architecture and will not impact
the neighborhood or the historic district. The provision of public facilities will not be impacted,
and an unsafe situation will not result from the granting of the waiver. Last, the approval of the
requested waiver will not result in a special privilege in that it would be supported if similar
circumstances were presented (ie architectural feature appropriate to the style which also does
not add mass to the structure). Therefore, positive findings can be made.
ALTERNATIVE ACTIONS
A. Continue with direction.
B. Move approval of the Certificate of Appropriateness (2014-132) for 313 NW 1st Avenue,
Old School Square Historic District, by adopting the findings of fact and law contained in
the staff report, and finding that the request and approval thereof is consistent with the
Comprehensive Plan and meets the criteria set forth in the Land Development Regulations.
C. Move denial of the Certificate of Appropriateness (2014-132) for 313 NW 1st Avenue, Old
School Square Historic District, by adopting the findings of fact and law contained in the
staff report, and finding that the request is inconsistent with the Comprehensive Plan and
does not meet the criteria set forth in the Land Development Regulations. (Motion to be
phrased in the affirmative. See above.)
RECOMMENDATION

Certificate of Appropriateness
Approve the Certificate of Appropriateness (2014-132) for 313 NW 1st Avenue, Old School
Square Historic District, by adopting the findings of fact and law contained in the staff report,
and finding that the request and approval thereof is consistent with the Comprehensive Plan
and meets the criteria set forth in LDR Sections 2.4.6(H)(5), subject to approval of the requested
waiver.

Approve the waiver to LDR Section 4.5.1(E)(8)(a)1., to permit encroachment into the Building
