BACKGROUND The subject property is located at 2 Fisher Lane North on the east side of the street, south of NE 5`h Street. The property also fronts onto the Intracoastal Waterway. The property contains a one-story, single-family residence constructed in 1941. Although slightly altered over the year, the building and site have maintained their historic integrity. The designation report is attached which includes an in depth historic depiction of the property, photographs, original plans and additional relevant materials. Subsequent to this Public Hearing before the HPB, the designation will move forward for review by the City Commission where Public Hearings will be held on both September 20 and October 2,• ' The designation is now before the Board for consideration. I :3ei3? % ANALYSIS LDR Section 4.5.1(B), Criteria for Designation of Historic Sites or Districts: Pursuant to Section 4.5.1(B)(1), to qualify as a historic structure, individual properties, structures, sites, or buildings, must have significant character, interest, or value as part of the historical, cultural, aesthetic, and architectural heritage of the city, state, or nation. To qualify as a historic site, historic district, or historic structure, the property or properties must fulfill one or more of the criteria set forth in division (2) or(3) below;. The subject structure meets the following criteria: (B)(2) Historical or cultural significance: (d) Exemplifies the historical, political, cultural, economic, or social trends of the community in history; STAFF COMMENT: The residence at 2 Fisher Lane meets the above criteria in that many of Delray Beach's pioneers and business and community leaders are connected with the property. The property was first owned by Adolf and Anna Hofman, one of Delray's first settler families. The house was built for M. Fisher Wright, for whom Fisher Lane was named. Among other notable property owners, the current owner, Mr. Charles Hardiman, is a 55 year resident of Delray Beach and has served on the Boards of many local organizations. "Two Fisher Lane" Designation: 2013-189 HPB Meeting September 19, 2012: Page 2 of 3 (B)(3) Architectural or aesthetic significance: (a) Portrays the environment in an era of history characterized by one or more distinctive architectural styles; (b) Embodies those distinguishing characteristics of an architectural style, period, or method of construction; (d) Contains elements of design, detail, material, or craftsmanship of outstanding quality or which represented, in its time, a significant innovation or adaptation to the South Florida environment. STAFF COMMENT: The architectural significance is exemplified by the "Resort Colonial Revival" style. The style is indicative of design trends at a time when Delray Beach was a popular winter destination and the buildings were influenced by New England architecture yet maintained a Florida typology. Comprehensive Plan Future Land Use Objective A-4 The redevelopment of land and buildings shall provide for the preservation of historic resources. The objective shall be met through continued adherence to the City's Historic Preservation Ordinance and, where applicable, to architectural design guidelines through the following policies: Policy A-4.1 Prior to approval or recommending approval of any land use or development application for property located within a historic district or designated as a historic site, the Historic Preservation Board must make a finding that the requested action is consistent with the provisions of Section 4.5.1 of the Land Development Regulations relating to historic sites and districts and the "Delray Beach Design Guidelines". Policy A-4.2 In order to protect the City's historic resources, the Land Development Regulations shall include provisions for designation of historically significant buildings, structures, archaeological sites, or districts. The City shall conduct periodic neighborhood surveys to identify and evaluate potential historic resources at least once every five years. STAFF COMMENT: The proposed designation meets the intent of the applicable Objective and Policies noted above, as it will provide for the preservation of the subject structure, thereby ensuring the protection of an example of this type of style and building. Further, the comments above illustrate that the request meets the criteria set forth in LDR Section 4.5.1 which provides for the designation of "historically significant buildings." Therefore, the proposed designation is appropriate and a recommendation of approval should be forwarded to the City Commission. The Public Hearing dates for review of the subject designation by the City Commission have been tentatively scheduled for August 20 and September 3, 2013. COURTESY/ PUBLIC NOTICES Public Notice letters were mailed to the property owners within a 500' radius of 2 Fisher Lane. Courtesy Notices of the Public Hearing were sent to the Neighborhood Advisory Council, Delray Citizens Coalition, and the Palm Trail Homeowners Association. Continue with direction. B. Move a recommendation of denial to the City Commission that "Two Fisher Lane" not be listed in _ the Local Register of Historic Places at 2 Fisher Lane, by finding that the request is inconsistent with the Comprehensive Plan, and Sections 4.5.1(B) and 4.5.1(C) of the Land Development Regulations. RECOMMENDATION Move a recommendation of approval to the City Commission that "Two Fisher Lane" be listed in the Local Register of Historic Places at 2 Fisher Lane, by adopting the findings of fact and law contained in the staff report, and finding that the request is consistent with the Comprehensive Plan, and Sections 4.5.1(B) and 4.5.1(C) of the Land Development Regulations. 'P1. .Bk.10-�68 p, �� `s Architectural Significance Outstanding Builder Who Apprenticed with Architectural Firm in New England Two Fisher Lane is a concrete example of the path of Delray Beach's architectural heritage. The path evolved from frame vernacular cottages and bungalow homes to the deep-patterned stucco of the popular Mediterranean Revival and Mission styles of the 1920s Boom years. In the 1930s when Delray Beach was ranked fiftieth in population in Florida,the town was 10th in issuing building permits in the state. Fortunately for Delray Beach, in the depth of the Great Depression, its location on the ocean near Palm Beach, low density and sub-tropical climate drew well-off winter colony visitors. The winter visitors liked what they saw and stayed to build attractive cottages in a variety of revival styles: Colonial, Bermuda, Creole and Monterey. With its clean simple lines, shutters, courtyard and tiles,Two Fisher Lane seems a delightful mix of New England and South Florida. Perhaps the term Resort Colonial Revival fits it best. In the 1930s Delray's first registered architect Samuel Ogren Sr. created a "Better Housing Office"to provide the public with craftsmen in the construction trades. Two Fisher Lane reflects this craftsmanship. The architectural significance of the house is enhanced by the name on the old building card in City of Delray Beach records. That name is F.J. Schrader,the first man with architectural training who settled in Delray (1911) and built many homes and buildings for various uses. Among these are: the first city jail,the sturdy 1913 School now the Cornell Museum in the old school square, 1926 Florida Bungalow restored by the Delray Beach Historical Society, and the Fellowship Hall of the First Presbyterian Church on Gleason Street. The Fellowship Hall, formerly the Gibson Memorial Baptist Church and the original sanctuary of the Presbyterian Church, deserves further comment. The church was built on the site of an old orange grove traced back to the early 19th century. The orange grove was the first site in the area distinguished from the surrounding wilderness. On 19th century maps the beach area of what is now Delray Beach was designated, "Orange Grove Haulover."The Orange Grove is mentioned in several accounts of local pioneers. The first building in this vicinity was named for the old orange grove—the 1876 Orange Grove House of Refuge— a U.S. Government project to assist sufferers of the ship-wreck experience. The 1924 Fellowship Hall,the oldest surviving church building in Delray Beach, as well as the house at Two Fisher Lane reveal Schrader's building talent. Other older churches in town were substantially damaged or destroyed by the affects of the 1926 and 1928 hurricanes. Therefore, the buildings of these earlier churches date from 1929. Remarkably, Fellowship Hall, located only a block from the Atlantic Ocean, suffered merely a few cracked window panes. Mr. Schrader was not only the builder of the church; he was its financial backer. After the Baptist congregation was not able to finish paying for the church, F.J. Schrader sold it to the Presbyterians. Although Mr. Schrader was a Baptist, he stayed with his church building and was an active member of the Presbyterian Church for the rest of his life. Schrader was in his 50s when 2 Fisher Lane was constructed in 1941. The partial record of F.J. Schrader described above give him a significant place in the architectural heritage of Delray Beach. He was, by the way, an awarding-winning farmer within Delray's agricultural heritage and the first building inspector in the City to name a couple of additional accomplishments. Recently Roger Cope, a local architect who has worked on many restoration projects, made the following comments on the exterior of the house at 2 Fisher Lane regarding its architectural style: "...It is a 1941 home as you mentioned. Some of its features are mitered clapboard siding at the outside corners, minimal overhang at its roof, but with great detail in an added crown and custom wood trim, nautical style(round) attic vents with wood keystones at all four points(up, down and both sides), low or gentle roof slope, and brick fireplace. It is very much a Florida Vernacular style with a bit of resort and nautical features mixed in—and no small coincidence that it is on the waterway. If I had to pin it down more specifically, I would say it is'Resort Florida Vernacular'. I am now renovating a 1937 house in Delray Beach. It has many of the exact same features but a slightly simpler exterior wood trim package. So I have to believe the wood features on 2 Fisher Lane were quite elaborate when built." I think it is worthwhile to add comments in this report from the present owner about the interior and exterior of the house: "The architectural style is a harmonious combination of traditional New England and Florida features.There are four doors with fan window inserts at the top,three interior arched doorways, a cypress paneled dining room, Mexican tile floors,and a passage-way through two closets to connect the guest room to the rest of the house,and a fireplace. The exterior contains a concrete block patio that can be accessed directly from four different rooms in the house. The patio is separated from the street by a wall. In the rear of the home is a pool with a separate matching pool house. This area has a clear T-shaped with an outlook of Island Drive Inlet. My home was one of three similar houses in a row on Fisher Lane. The house to the south was torn down to make way for two large mansions. The house on the north is one of the original homes on Fisher Lane." Landscaping is lush, well-maintained and filled with fruit trees, but the ambiance of Fisher Lane is in danger of disappearing forever. It is one of the last of the charming human scale homes in the area. The owner is applying for Historic Designation for their property because he fears that surrounding property will continue to be demolished and would like for his property to remain. Historical and Social Significance To illustrate the Statement of Significance,the list of Delray pioneers, business, and social leaders of the community below who are connected with the house and its site include: Adolf Hofman and Anna Hofman, one of Delray's first settler families, owned the property where Two Fisher Lane is located as it was once part of land they owned. Adolf, a well-known and skillful farmer,was a founder of Trinity Lutheran Church, and later a land developer. The Hofman family owns Deed No. 1, made June 9, 1896,from the Model Land Company owned by railroad magnate, Henry Flagler. In a series of letters written by Adolf to his family in Germany, and now translated and held in the Delray Beach Historical Society archives, he says in Letter 7, dated at the height of the real estate boom in January 1925: "Since Delray is growing,the lots fetch colossal prices. I will divide my land between canal and railroad into lots." John W. Hall, another prominent pioneer of Delray is listed on the chain of title in 1925. Mr. Hall, a mayor of Delray,was Attorney-in-fact for the Hofman family and others on the 1924 Plat of Las Palmas Subdivision. John Hall and his son, Emmett who enjoyed success as an author of short stories and silent screen scenarios, built and operated the beautiful Mediterranean Style Delray Theatre that opened on Christmas Day of 1923. The 1941 house was built for M. Fisher Wright for whom Fisher Lane is named. Mr. Wright was followed as an owner by nationally-known business leader Gordon Gibbs,who was President of the famous Katherine Gibbs Secretarial Schools his mother founded, and his wife, Blanche. The Gibbs not only flew in their personal airplane to visit various Katherine Gibbs Schools, but when in Delray Beach, sometimes flew to the Bahamas for lunch. Local leaders and activists who have followed as owners the house are W. Cottingham Allen, a commissioner of Bethesda Hospital; Perry O'Neal, Chairman of the Board of Wayside House; and Charles and Priscilla Hardiman. Charles Hardiman,the current owner, has served on the Boards of numerous local non-profit organizations. He is a 55-year resident of Delray Beach. The late Priscilla Hardiman was a talented water-color artist. • Adolf& Ain a Hofman __ Source of Las Pahl as According to the information contained on page 61 of The City of Delray Florida by Frank Burnside Kingsbury of Keene,New Hampshire, (notes for a proposed history taken from 1925-35)he obtained the following information from Adolf and Anna Hofinan: "Adolf Hofrnan has deed No. 1,made June 9, 1896,Dade County,from the Model Land Co. for Lot No. 7 of the subdivision of Section 9 in Township Forty-six(46) South, of Range Forty-three(43)East containing sixty(60)acres,more or less excepting and reserving the right of way of the Florida East Coast Railroad,across the same,being a strip of land one hundred feet wide. This Lot No. 7 was 780 feet north by south, and ran from the Canal to Swinton Ave. The west end is now a part of Del Ida Park. See Sketch Map of A. Hofman's Land-next page." Lot 8 which is shown on the Plat of Las Palmas Subdivision dated November 15, 1924 is indicated on the sketch map as having been owned by Otto Schrader. Mr. Hofman mentions Otto Schrader in his 4th letter dated 16 June 1897. "I and my neighbor Schrader just recently shot two alligators."In his 1937 interview Mr.Hofman mentions that Otto Schrader went to Cuba after 10 years in Delray. Perhaps Mr. Schrader thought that he would make more profit on pineapples as a Cuban farmer. (Adolf Hofinan complains about the favorable treatment that Cuba farmers received from the F.E.C. Railway in his Letter No. 6.) In Letter 7 Hofman states"Since Delray is growing and the lots fetch colossal prices,I will divide my land between canal and railroad into lots." (January 18, 1925)According to Adolf Hofman's grandson,Richard Summerson,the family always called the area around Palm Trail, "Hofman Village". Listed on the Las Palmas plat is John W. Hall attorney in fact for Annie C. Hall,E.E. Hall,Mary Ethel Hall,Adolf Hofman,Anna Hofinan,L.L. Perkins and Bess Perkins. John Hall and his son,Emment,built the beautiful Mediterrean style Delray Theatre and opened it Christmas Day, 1923. They managed the theatre(their spelling)until 1936 when it was sold to the Sparks Theater chain.Before coming to Delray from Washington,D.C., in 1918,Emment Hall"enjoyed success as an author of short stories and scenarios." His wife,Eleanor,was an early supporter of the Delray Beach Historical Society In the 1925 sketch referred to in paragraph 2 it appears that Las Palmas is located on land owned by Hofman's neighbor Schrader. Since Adolf Hofman had a penchant for buying up land when the opportunity arose, it appears, on referring to the 1924 Las Palmas plat,that Adolf Hofman was at least one of the owners of the East portion of Lot 8. A better explanation is that the Model Land Company's Lot#7 is referred to as Lot#8 by 1924. • • Notes on Adolf Hofman Land by Judy Hofman In May of this year(1995)the last lot of Adolf's very large farm--over 50 acres with pineapples were planted alone--was sold. It is located behind the Acura Dealership on NE 7th Avenue with mango trees(6)from the original orchard planted on his homesite; and with the cement slab remaining from the old fruit packing warehouse. Only two lots to the south was the original log home;then a 2 story wooden home was built. It burned down in about 1975. Adolf's farm was on both sides on the"canal" (Intracoastal Waterway). Many lots were sold during the depression to pay taxes on the farm area. Adolf went blind in the early 40's and lived the remainder of his life in the same hone with his oldest daughter,Annie. He died in 1954 (actually 10/53 dp.) Annie moved to a small apartment on SE 7th Avenue in the 70's and lived until 1983. Clara is in a retirement home in Miami Springs. William A. (Hofman) lives in his own home in Hollywood. Adolf was also a pioneer of Trinity Lutheran Church. The history of the house follows the history of the development of Delray Beach especially in the neighborhoods north of East Atlantic Avenue, east of the Federal Highways, and east and west of the Intracoastal Waterway. The style of the house, unpretentious and of human scale is a significant example of the City's architectural heritage. It soon could be the last of its kind on charming, narrow Fisher Lane and is a unique and irreplaceable asset in its neighborhood. Further the history of Two Fisher Lane and its setting is filled with a long list of pioneers and business leaders who politically and socially guided the town through its infancy. After World War II,the list of prominent people with Fisher Lane connections continued. For example, in 1946 Mr. and Mrs. Gordon Gibbs purchased lots 38 through 43. Mr. Gibb's mother founded the famous Katherine Gibbs School in New York City. In 1934 Gordon Gibbs became President of the school. BACKGROUND & PROJECT DESCRIPTION The subject property is located within the CBD (Central Business District) zoning district and consists of Lots 3 and 4, Melvin S. Burd Subdivision. The property is located on the west side of NW 5th Avenue between NW 1st and NW 2"d Streets, south of the new pocket park located at the southwest corner of NW 5th Avenue and NW 2"d Street/Martin Luther King, Jr. Drive. The property has been more recently referred to as the "Muse House." However, it was previously known as the "Blakely House" as it was home to Mr. Raymond and Mrs. Althea Blakely. The 1996 survey file for the property indicates that Mrs. Blakely was "an influential teacher and community activist for over 40 years." A circa 1941, one-story, single-family residence, known as The Muse House, is located at 182 NW 5th Avenue and is classified as contributing in the West Settlers Historic District. An accessory structure consisting of a garage, carport, and utility room is situated to the rear of the historic structure. Building records indicate the garage was constructed in 1952, and the carport and utility room were added in 1960. In 2010, a Site Plan Modification was approved for the installation of 10 parking spaces along the south side of the property, removal of the circular driveway and curb cuts, and the installation of concrete walkways, lighting, and landscaping throughout the subject property. In 2012, a Class V Site Plan was approved for alterations to the historic structure, conversion of use from single-family residence to office, and associated parking improvements to the rear of the property and along the alley. The aforenoted approvals did not include any alterations, improvements, or changes of use to the accessory structure. The subject request is for the demolition of the accessory structure. While the Period of Significance for the West Settlers Historic District spans through 1970, the resurvey of the district in 2009 did not provide a survey or specify a classification for the 1952- 1960 accessory structure. Therefore, it is considered to be non-contributing. Subsequent to the demolition, bahia grass will be planted where the building currently stands. The COA and Class I Site Plan Modification are now before the Board for consideration. 182 NW 5.h Avenue.2013-186 HPB Meeting August 7, 2013 Page 2 of 3 SITE PLAN MODIFICATION ANALYSIS Article 2.4, General Procedures Section 2.4.6, Procedures for Obtaining Permits and Approvals (H)(5), Certificate of Appropriateness for Individually Designated Historic Structures and all Properties Located within Historic Districts, Findings: Prior to approval, a finding must be made that any Certificate of Appropriateness which is to be approved is consistent with Historic Preservation purposes pursuant to Objective A-4 of the Land Use Element of the Comprehensive Plan and specifically with provisions of Section 4.5.1, the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. STAFF COMMENT: In accordance with the above, the aforenoted criteria has been analyzed throughout this report. Article 4.5, Overlay and Environmental Management Districts Section 4.5.1, Historic Preservation Sites and Districts (E), Development Standards, all development regardless of use within individually designated historic properties and/or properties located within historic districts, whether contributing or noncontributing, residential or nonresidential, shall comply with the goals, objectives, and policies of the Comprehensive Plan, these regulations, the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. STAFF COMMENT: In accordance with the above, the aforenoted criteria has been analyzed throughout this report. (E)(7), Demolition, demolition of historic or archaeological sites, or buildings, structures, improvements, and appurtenances within historic districts shall be regulated by the Historic Preservation Board in the manner described in Section 4.5.1(F). Demolition of any structure, whether contributing or non-contributing, shall not occur until a building permit has been issued for the HPB approved redevelopment. All structures approved for demolition and awaiting issuance of a building permit for the redevelopment shall be maintained in a manner similar to that in which it existed at time of application unless the Chief Building Official determines that an unsafe building condition exists in accordance with Section 4.5.1(G). STAFF COMMENT: The proposal does not include additional construction or any redevelopment in place of the structure. Rather, bahia grass to match the existing landscaping will be planted in its place. A new landscape plan has not been submitted with a revised open space calculation. Should a new plan or a revised open space calculation be required for permit review, then a copy of this information shall also be provided for the subject file. This has been added as a recommended condition of approval. (E)(5), Standards and Guidelines, a historic site, building, structure, improvement, or appurtenance within a historic district shall only be altered, restored, preserved, repaired, relocated, demolished, or otherwise changed in accordance with the Secretary of the Interior's Standards for Rehabilitation, and the Delray Beach Historic Preservation Design Guidelines, as amended from time to time. Standards A property shall be used for its historic purpose or be placed in a new use that requires minimal change to the defining characteristics of the building and its site and environment. (Standard 1) 182 NW 5th Avenue;2013-186 HPB Meeting August 7,2013 Page 3 of 3 The historic character of a property shall be retained and preserved. The removal of historic materials or alteration of features and spaces that characterize a property shall be avoided. (Standard 2) STAFF COMMENT: The proposal to demolish an original garage and carport structure is not necessarily deemed to be in keeping with the Standards noted above. A reasoning or justification for the demolition has not been provided with the request. The removal of this accessory structure alters the character of the property and the illustration of its evolution as a single-family residence with the addition of additional space for vehicular storage. While the property is being converted to office space, Standard 1 above requires that when a property is-placed in a new use that it "require minimal change to the defining characteristics of the building and its site and environment." Further, Standard 2 requires that the historic character of a property be retained and preserved. While the structure is technically non-contributing, it was built during the district's Period of Significance and maintains integrity. The building is very simple and could be reconstructed or rehabilitated; however it is not proposed to be replaced, which should be considered in the Board's decision on this request. Given the above, Staff is unable to provide a clear recommendation to the Board and therefore, leaves the decision up to the Board's discretion. REVIEW BY OTHERS The West Atlantic Redevelopment Coalition (WARC) considered the subject request at its July 9, 2013 meeting, and recommended approval. ALTERNATIVE ACTIONS A. Continue with direction. B. Move approval of the Certificate of Appropriateness and Class I Site Plan Modification (2013-186) for 182 NW 5th Avenue, West Settlers Historic District by adopting the findings of fact and law contained in the staff report, and finding that the request and approval thereof is consistent with the Comprehensive Plan and meets the criteria set forth in the Land Development Regulations, subject to the following condition: 1. That if a new plan or a revised open space calculation is required for permit review, then a copy of this information shall be provided for the subject file. C.
