Alvarez Historic Preservation Planner Posted on: July 16, 2010 CITY OF DELRAY BEACH HISTORIC PRESERVATION BOARD ORDER In Re: 17 NE 7th Street, Del Ida Park Historic District Susan Stone, Property Owner Bill Hartman, Authorized Agent ORDER Following consideration of all the evidence and testimony presented at the July 21, 2010 meeting before the Historic Preservation Board for the City of Delray Beach and Pursuant to LDR Section 2.4.6(H)(5), prior to approval, a finding must be made that any Certificate of Appropriateness which is to be approved is consistent with Historic Preservation purposes pursuant to Objective A-4 of the Land Use Element of the Comprehensive Plan and specifically with provisions of Section 4.5.1, the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. The Historic Preservation Board finds that positive findings cannot be made with respect to LRD Section 4.5.1(E)(7) and 4.5.1(E)(8) that the application for Consideration of a Certificate of Appropriatengss (2010-183) for installation of a PVC fence on the property referenced above is hereby ✓✓ granted denied by a vote of & - O . Pursuant to LDR Sections 2.4.7(E)(1) and 2.4.7(E)(3)(a), a decision of the Historic Preservation Board may be appealed to the City Commission so long as a letter of appeal is received by the City Clerk within ten(10)working days of the action being appealed. The item before the Board is consideration of a Certificate of Appropriateness for the installation of a fence at a non-contributing property located at 17 NE 7th Street, Del-Ida Park Historic District, pursuant to LDR Section 2.4.6(H). BACKGROUND/PROJECT DESCRIPTION The subject property is located in the Del-Ida Park Historic District on the north side of NE 7th Street, between North Swinton Avenue and NE 2nd Avenue. The property consists of Lots 6 & 7, Block 1, Del-Ida Park. Lot 6 is vacant, while a single story, circa 1954 structure is located on Lot 7. The single-family residence is classified as non-contributing to the historic district. A 2002 COA is on file for the construction of a swimming pool to the rear of the structure. The current proposal is for the installation of a white, scalloped PVC fence to enclose the portion of the property which consists of Lot 6, spanning the rear of Lot 7, and adding a gate on Lot 7. The height is proposed as follows: • Rear: 6' privacy style with decorative scalloped top for a length of 100'. • Side Property Line — West: 4' picket with decorative scalloped top for a length of 34' measuring north from the front property line, then increasing to 6' along the balance of the property line. • Side Property Line — East: 4' picket with decorative scalloped top for a length of approximately 48' measuring north from the front property line, then increasing to 6' along the balance of the property line. A 6' fence and gate will also connect to the residence. • Front Property Line - 4' picket with decorative scalloped top for a length of approximately 50', spanning the entire width of Lot 6. Fences, walls, and gates are typically reviewed and approved administratively; however, the proposal involves the introduction of a modern material and Board approval is therefore required. The COA for the installation of a new fence is now before the Board for consideration. ANALYSIS LDR Section 4.5.1, Historic Preservation Sites and Districts (E) Development Standards: All development regardless of use within individually designated historic properties and/or properties located within historic districts, whether contributing or 17 NE 71"Street—2010-183-COA HPB Meeting July 21, 2010 Page 2 of 3 noncontributing, residential or nonresidential, shall comply with the goals, objectives, and policies of the Comprehensive Plan, these regulations, the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. (5) Standards and Guidelines. A historic site, building, structure, improvement, or appurtenance within a historic district shall only be altered, restored, preserved, repaired, relocated, demolished, or otherwise changed in accordance with the Secretary of the Interior's Standards for Rehabilitation, and the Delray Beach Historic Preservation Design Guidelines, as amended from time to time. (8) Visual Compatibility Standards. New construction and all improvements to both contributing and noncontributing buildings, structures and appurtenances thereto within a designated historic district or on an individually designated property shall be visually compatible. In addition to the Zoning District Regulations, the Historic Preservation Board shall apply the visual compatibility standards. (g) Relationship of Materials, Texture, and Color: The relationship of materials, texture, and color of the facade of a building and/or hardscaping shall be visually compatible with the predominant materials used in the historic buildings and structures within the subject historic district. The Delray Beach Historic Preservation Design Guidelines state the following with respect to fences: • New materials, some of them synthetic, may be approved on a case-by-case basis. STAFF COMMENT &ANALYSIS • The current proposal is for the installation of a PVC fence which will be highly visible from the public right-of-way. A vinyl fence is not an appropriate addition to any property located within a designated historic district, particularly when visible from the public right-of-way. It has been argued that vinyl fences require less maintenance than wood fences, that they retain their appearance over a longer duration, and that the fence itself will last longer.While it may be true that this fence type requires less maintenance, vinyl fences can be susceptible to yellowing and cracking and, as they are a relatively new innovation, there is no proof as to how long they will last. If a wood fence is properly maintained and painted regularly, it can last 50 years or more depending on the type of wood used, the location where it is installed, and whether or not it has been treated with a preservative to help resist decay, fungi and insects. Additionally, the use of vinyl materials which require more frequent replacement are not environmentally friendly in either their manufacturing or their ability to decompose when removed due to necessary replacement. The Design Guidelines state that new materials, some of them synthetic, may be approved on a case-by-case basis; however, it is recommended that should a vinyl material be approved, that it is at least minimally visible from the public right-of-way or where their location makes maintenance difficult. Approving the installation of a vinyl fence where it can be viewed from the public right-of- way could set a precedent and lead to similar applications. Based on the above analysis, therefore, positive findings cannot be made with respect to LDR Sections 4.5.1(E)(7) and 4.5.1(E)(8), the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. However, the Board may consider that the applicant provide a wood fence at the front and where visible from the public right-of-way, with vinyl fencing installed on the balance of the property. 17 NE 7h Street—2010-183-COA HPB Meeting July 21, 2010 Page 3 of 3 ALTERNATIVE ACTIONS A. Continue with direction. B. BACKGROUND/PROJECT DESCRIPTION The subject property is located in the Del-Ida Park Historic District on the north side of NE 7th Street, between North Swinton Avenue and NE 2'd Avenue. The property consists of Lots 6 & 7, Block 1, Del-Ida Park. Lot 6 is vacant, while a single story, circa 1954 structure is located on Lot 7. The single-family residence is classified as non-contributing to the historic district. A 2002 COA is on file for the construction of a swimming pool to the rear of the structure. The current proposal is for the installation of a white, scalloped PVC fence to enclose the portion of the property which consists of Lot 6, spanning the rear of Lot 7, and adding a gate on Lot 7. The height is proposed as follows: • Rear: 6' privacy style with decorative scalloped top for a length of 100'. • Side Property Line — West: 4' picket with decorative scalloped top for a length of 34' measuring north from the front property line, then increasing to 6' along the balance of the property line. • Side Property Line — East: 4' picket with decorative scalloped top for a length of approximately 48' measuring north from the front property line, then increasing to 6' along the balance of the property line. A 6' fence and gate will also connect to the residence. • Front Property Line - 4' picket with decorative scalloped top for a length of approximately 50', spanning the entire width of Lot 6. Fences, walls, and gates are typically reviewed and approved administratively; however, the proposal involves the introduction of a modern material and Board approval is therefore required. The COA for the installation of a new fence is now before the Board for consideration. ANALYSIS LDR Section 4.5.1, Historic Preservation Sites and Districts (E) Development Standards: All development regardless of use within individually designated historic properties and/or properties located within historic districts, whether contributing or 17 NE 7th Street—2010-183-COA HPB Meeting July 21, 2010 Page 2of3 noncontributing, residential or nonresidential, shall comply with the goals, objectives, and policies of the Comprehensive Plan, these regulations, the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. (5) Standards and Guidelines. A historic site, building, structure, improvement, or appurtenance within a historic district shall only be altered, restored, preserved, repaired, relocated, demolished, or otherwise changed in accordance with the Secretary of the Interior's Standards for Rehabilitation, and the Delray Beach Historic Preservation Design Guidelines, as amended from time to time. (8) Visual Compatibility Standards. New construction and all improvements to both contributing and noncontributing buildings, structures and appurtenances thereto within a designated historic district or on an individually designated property shall be visually compatible. In addition to the Zoning District Regulations, the Historic Preservation Board shall apply the visual compatibility standards. (g) Relationship of Materials, Texture, and Color: The relationship of materials, texture, and color of the facade of a building and/or hardscaping shall be visually compatible with the predominant materials used in the historic buildings and structures within the subject historic district. The Delray Beach Historic Preservation Design Guidelines state the following with respect to fences: • New materials, some of them synthetic, may be approved on a case-by-case basis. STAFF COMMENT &ANALYSIS The current proposal is for the installation of a PVC fence which will be highly visible from the public right-of-way. A vinyl fence is not an appropriate addition to any property located within a designated historic district, particularly when visible from the public right-of-way. It has been argued that vinyl fences require less maintenance than wood fences, that they retain their appearance over a longer duration, and that the fence itself will last longer. While it may be true that this fence type requires less maintenance, vinyl fences can be susceptible to yellowing and cracking and, as they are a relatively new innovation, there is no proof as to how long they will last. If a wood fence is properly maintained and painted regularly, it can last 50 years or more depending on the type of wood used, the location where it is installed, and whether or not it has been treated with a preservative to help resist decay, fungi and insects. Additionally, the use of - vinyl materials which require more frequent replacement are not environmentally friendly in either their manufacturing or their ability to decompose when removed due to necessary replacement. The Design Guidelines state that new materials, some of them synthetic, may be approved on a case-by-case basis; however, it is recommended that should a vinyl material be approved, that it is at least minimally visible from the public right-of-way or where their location makes maintenance difficult. Approving the installation of a vinyl fence where it can be viewed from the public right-of- way could set a precedent and lead to similar applications. Based on the above analysis, therefore, positive findings cannot be made with respect to LDR Sections 4.5.1(E)(7) and 4.5.1(E)(8), the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. However, the Board may consider that the applicant provide a wood fence at the front and where visible from the public right-of-way, with vinyl fencing installed on the balance of the property. ( VNNUmP7erZG12) HISTORIC PRESERVATION BOARD MEMORANDUM STAFF REPORT Authorized Agent: Bill Hartman Property Owner: Susan Stone Project Location: 17 NE 7th Street, Del Ida Park Historic District HPB Meeting Date: July 21, 2010 File: 2010-183-COA ITEM BEFORE THE BOARD The item before the Board is consideration of a Certificate of Appropriateness for the installation of a fence at a non-contributing property located at 17 NE 7th Street, Del-Ida Park Historic District, pursuant to LDR Section 2.4.6(H). BACKGROUND/PROJECT DESCRIPTION The subject property is located in the Del-Ida Park Historic District on the north side of NE 7th Street, between North Swinton Avenue and NE 2"d Avenue. The property consists of Lots 6 & 7, Block 1, Del-Ida Park. Lot 6 is vacant, while a single story, circa 1954 structure is located on Lot 7. The single-family residence is classified as non-contributing to the historic district. A 2002 COA is on file for the construction of a swimming pool to the rear of the structure. The current proposal is for the installation of a white, scalloped PVC fence to enclose the portion of the property which consists of Lot 6, spanning the rear of Lot 7, and adding a gate on Lot 7. The height is proposed as follows: • Rear: 6' privacy style with decorative scalloped top for a length of 100'. • Side Property Line — West: 4' picket with decorative scalloped top for a length of 34' measuring north from the front property line, then increasing to 6' along the balance of the property line. • Side Property Line — East: 4' picket with decorative scalloped top for a length of approximately 48' measuring north from the front property line, then increasing to 6' along the balance of the property line. A 6' fence and gate will also connect to the residence. • Front Property Line - 4' picket with decorative scalloped top for a length of approximately 50', spanning the entire width of Lot 6. Fences, walls, and gates are typically reviewed and approved administratively; however, the proposal involves the introduction of a modern material and Board approval is therefore required. The COA for the installation of a new fence is now before the Board for consideration. ANALYSIS LDR Section 4.5.1, Historic Preservation Sites and Districts (E) Development Standards: All development regardless of use within individually designated historic properties and/or properties located within historic districts, whether contributing or 17 NE 7```Street—2010-183-COA HPB Meeting July 21, 2010 Page 2 of 3 noncontributing, residential or nonresidential, shall comply with the goals, objectives, and policies of the Comprehensive Plan, these regulations, the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. (5) Standards and Guidelines. A historic site, building, structure, improvement, or appurtenance within a historic district shall only be altered, restored, preserved, repaired, relocated, demolished, or otherwise changed in accordance with the Secretary of the Interior's Standards for Rehabilitation, and the Delray Beach Historic Preservation Design Guidelines, as amended from time to time. (8) Visual Compatibility Standards. New construction and all improvements to both contributing and noncontributing buildings, structures and appurtenances thereto within a designated historic district or on an individually designated property shall be visually compatible. In addition to the Zoning District Regulations, the Historic Preservation Board shall apply the visual compatibility standards. (g) Relationship of Materials, Texture, and Color: The relationship of materials, texture, and color of the facade of a building and/or hardscaping shall be visually compatible with the predominant materials used in the historic buildings and structures within the subject historic district. The Delray Beach Historic Preservation Design Guidelines state the following with respect to fences: • New materials, some of them synthetic, may be approved on a case-by-case basis. STAFF COMMENT & ANALYSIS The current proposal is for the installation of a PVC fence which will be highly visible from the public right-of-way. A vinyl fence is not an appropriate addition to any property located within a designated historic district, particularly when visible from the public right-of-way. It has been argued that vinyl fences require less maintenance than wood fences, that they retain their appearance over a longer duration, and that the fence itself will last longer. While it may be true that this fence type requires less maintenance, vinyl fences can be susceptible to yellowing and cracking and, as they are a relatively new innovation, there is no proof as to how long they will last. If a wood fence is properly maintained and painted regularly, it can last 50 years or more depending on the type of wood used, the location where it is installed, and whether or not it has been treated with a preservative to help resist decay, fungi and insects. Additionally, the use of vinyl materials which require more frequent replacement are not environmentally friendly in either their manufacturing or their ability to decompose when removed due to necessary replacement. The Design Guidelines state that new materials, some of them synthetic, may be approved on a case-by-case basis; however, it is recommended that should a vinyl material be approved, that it is at least minimally visible from the public right-of-way or where their location makes maintenance difficult. Approving the installation of a vinyl fence where it can be viewed from the public right-of- way could set a precedent and lead to similar applications. Based on the above analysis, therefore, positive findings cannot be made with respect to LDR Sections 4.5.1(E)(7) and 4.5.1(E)(8), the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. However, the Board may consider that the applicant provide a wood fence at the front and where visible from the public right-of-way, with vinyl fencing installed on the balance of the property. 17 NE 7t" Street—2010-183-COA HPB Meeting July 21,2010 Page 3 of 3 ALTERNATIVE ACTIONS A. Continue with direction. B. Move approval of the Certificate of Appropriateness (2010-183) for the property located at 17 NE 7th Street, Del Ida Park Historic District, by adopting the findings of fact and law contained in the staff report, and finding that the request is consistent with the Land Development Regulations. C. Move denial of the Certificate of Appropriateness (2010-183) for the property located at 17 NE 7th Street, Del Ida Park Historic District, by adopting the findings of fact and law contained in the staff report, and finding that the request is inconsistent with the Land Development Regulations.
