The character of a house constructed in the early twentieth century is vastly different than the character of one constructed during the 1930s and 1940s. While both houses illustrate an evolution, and are all more than 50 years old, each belongs to a specific time frame in history and each period of significance has its singular importance and special characteristics. Properties in historic districts must relate to the periods of significance that are documented in the historic district nomination. o National Register of Historic Places - SIGNIFICANCE: A district must be significant, as well as being an identifiable entity. . .must be important for historical, architectural, archeological, engineering, or cultural values. Therefore, districts that are significant will usually meet the last portion of Criterion C plus Criterion A, Crion B, other portions of Criterion Still. Criterion D. i Old School Square Historic District PERIOD OF SIGNIFICANCE • Development patterns show construction gap between the 1960s and 1990s when few if any new structures were built within the district. •. Date of construction of the most recent structures around 1955, indicating surge in construction activity immediately following end of World War II. • Field inspection of the district did not identify additional structures being built between 1955 and the mid 1990s to the early part of the 2000 decade. Existing structures did undergo alterations and in some cases additions, but the level of construction activity was relatively low during this period. •Reflects general development trend of most communities at this time, when post World War II development movement was away from the city's center and into the suburbs. -Delray Beach necessitated the rapid construction of affordable homes; local builders employed masonry construction (concrete block and other sturdy and easy-to-use materials). A number of examples of Masonry Vernacular buildings are found in the Old School Square area. • Extending the present Period of Significance to 1960 would cover new construction and alterations that will be 50 years old in less than 2 years from the date of resurvey, namely in 2010. • Appropriate to extend the Period of Significance an additional 5 years, to 1965, in order to provide a comfortable margin to include any construction activity, including alterations or additions that will acquire the 50 threshold using this time frame. Old School Square Historic isLrid National Register of Historic Places. SIGNIFICANCE: o . . .considered eligible if all of the components lack individual distinction, provided that the grouping achieves significance as a whole within its historic context. . .the majority of the components that add to the district's historic character, even if they are individually undistinguished, must possess integrity, as must the district as a whole. o The number of noncontributing properties a district can contain yet still convey its sense of time and place and historical development depends on how these properties affect the district's integrity. ❖ National Register of Historic Places - EVALUATING CONTEXT & SIGNIFICANCE: o . . .historical patterns that can be identified through consideration of the history of the property and the history of the surrounding area. In accordance with the National Register Criteria, the historic context may relate to one of the following: •An event, a series of events or activities, or patterns of an area's development (Criterion A); •Association with the life of an important person (Criterion B); •A building form, architectural style, engineering technique, or artistic values, based on a stage of physical development, or the use of a material or method of construction that shaped the historic identity of an area (Criterion C); or •A research topic (Criterion D). • Old Scaool Squre. His±oric DjsTrid Old School Square meets the National Register Criteria as follows: o Criterion A- An event, a series of events or activities, or patterns of an area's development: due to associations with events that have made a significant contribution to the broad pattern of the City's history as it represents the initial footprint for settlement and development of Delray Beach, with structures existing as early as the late 1890's, contains the Old School Square and Sundy House which are listed on the National. Register of Historic Places, represents the 1920s Land Boom and 1930s settlement following the Land Boom and includes post World War II growth from the 1940s through the 1960s. o Criterion B- Association with the life of an important person: due to associations with people significant to the City, such as John Shaw Sundy, Delray's first mayor, one of the early investors was Frederick Henry Link, Reverend John R. Cason, the Methodist Church Minister and Delray Beach pioneer. o Criterion C- A building form, architectural style, engineering technique, or artistic values, based on a stage of physical development, or the use of a material or method of construction that shaped the historic identity of an area: embodies one or more distinctive architectural styles or types such as the Mission, Queen Anne, French Colonial, Mediterranean Revival, Bungalow, American Four Square, Monterey, Neo-Mediterranean, Minimal Traditional, Masonry and Frame Vernacular, Ranch, Art Deco/Modern, Bauhaus, and International, with structures designed by renown Architect Samuel Ogren, Sr. Old School Square I- iisoric Dis:rict ❖ Historic Context - Local, State, and National o A local historic context represents an aspect of the history of a town, city, county, cultural area, or region, or any portions thereof. o Properties are evaluated in a State context when they represent an aspect of the history of the State as a whole. o Properties are evaluated in a national context when they represent an aspect of the history of the United States and its territories as a whole. For example, a post-war suburban subdivision may be the best reflection Of contemporary siting and design tenets in a metropolitan area...the nomination preparer must justify the exceptional importance of the property relative to similar properties in the community, State, or nation. ❖ HISTORIC DISTRICTS: ...eligible if they are an integral part of a district which qualifies for National Register listing...documenting that the property dates from within the district's defined Period of Significance and that it is associated with one or more of the district's defined Areas of Significance. Properties less than fifty years old may be an integral part of a district when there is sufficient perspective to consider the properties as historic...by demonstrating that: 1) the district's Period of Significance is justified as a discrete period with a defined beginning and end, 2) the character of the district's historic resources is clearly defined and assessed, 3) specific resources in the district are demonstrated to date from that discrete era, and 4) the majority of district properties are over fifty years old. The character of a house constructed in the early twentieth century is vastly different than the character of one constructed during the 1930s and 1940s. While both houses illustrate an evolution, and are all more than 50 years old, each belongs to a specific time frame in history and each period of significance has its singular importance and special characteristics. Properties in historic districts must relate to the periods of significance that are documented in the historic district nomination. o National Register of Historic Places - SIGNIFICANCE: A district must be significant, as well as being an identifiable entity. . .must be important for historical, architectural, archeological, engineering, or cultural values. Therefore, districts that are significant will usually meet the last portion of Criterion C plus Criterion A, C1jrion B, other portions of Criterion Ciar Criterion D. • { Old School Squ.ire Historic Dist: ics, PERIOD OF SIGNIFICANCE • Development patterns show construction gap between the 1960s and 1990s when few if any new structures were built within the district. • Date of construction of the most recent structures around 1955, indicating surge in construction activity immediately following end of World War II. • Field inspection of the district did not identify additional structures being built between 1955 and the mid 1990s to the early part of the 2000 decade. Existing structures did undergo alterations and in some cases additions, but the level of construction activity was relatively low during this period. 'Reflects general development trend of most communities at this time, when post World War II development movement was away from the city's center and into the suburbs. •Delray Beach necessitated the rapid construction of affordable homes; local builders employed masonry construction (concrete block and other sturdy and easy-to-use materials). A number of examples of Masonry Vernacular buildings are found in the Old School Square area. • Extending the present Period of Significance to 1960 would cover new construction and alterations that will be 50 years old in less than 2 years from the date of resurvey, namely in 2010. • Appropriate to extend the Period of Significance an additional 5 years, to 1965, in order to provide a comfortable margin to include any construction activity, including alterations or additions that will acquire the 50 threshold using this time frame. Old School Square Historic Jistrict National Register of Historic Places- SIGNIFICANCE: o . . .considered eligible if all of the components lack individual distinction, provided that the grouping achieves significance as a whole within its historic context. . .the majority of the components that add to the district's historic character, even if they are individually undistinguished, must possess integrity, as must the district as a whole. o The number of noncontributing properties a district can contain yet still convey its sense of time and place and historical development depends on how these properties affect the district's integrity. •• National Register of Historic Places - EVALUATING CONTEXT & SIGNIFICANCE: o . . historical patterns that can be identified through consideration of the history of the property and the history of the surrounding area. Alvarez Historic Preservation Planner Posted on: November 25, 2009 I HISTORIC PRESERVATION BOARD MEMORANDUM STAFF REPORT Property Owner: Bryce Newell & Jodie MacLellan Authorized Agent: Dennis Thompson, City of Delray Beach Project Location: 211 NW 1st Street/103 NW 1st Street, West Settlers Historic District HPB Meeting Date: December 2, 2009 COA: 2008-090 ITEM BEFORE THE BOARD The item before the Board is the consideration of a Certificate of Appropriateness (COA) and waiver associated with a fence on a contributing property located at 211 NW 1st Street/103 NW 1st Street, West Settlers Historic District, pursuant to Land Development Regulations (LDR) Section 2.4.6(H). BACKGROUND & PROJECT DESCRIPTION' The subject property consists of Lot 8, Block 43, Town of Delray, and is located on the northeast corner of NW 1st Street and NW 3rd Avenue. The property contains a concrete block and stucco ranch-style structure built in 1959. A detached garage constructed in 2009 is located to the rear of the property. In May 2009, the subject property was reclassified as a contributor to the West Settlers Historic District. In 2007, the Board approved a COA request for the installation of impact rated, 6/6, single hung windows with defined (not flat) muntins throughout the principal structure. In 2008, the Board approved a COA for the demolition of a circa 1983, detached two-car garage and new construction of a detached two-car garage. On September 17, 2009, the City Commission approved a Hold Harmless Agreement for the installation of a "removable fence" within the adjacent public right-of-way to the east (rear alley) and south (side-street, along NW 1st Street) of the property. In November 2009, a COA was administratively approved for the installation of landscaping, brick patios, and a 6' board-on-board wood fence located along the north and east property lines (including the alley) and a 4' along the asphalt line of NW 1st Street. See attached site plan for additional details. The subject request is to increase the height of the fence along the asphalt line of NW 1st Street from 4' to 6', and to install an arbor at the front of the property. The arbor measures approximately 7' in height. A waiver is required as fences and walls "over four feet (4') shall not be allowed in front or side street setbacks" for properties within historic districts. The subject COA and waiver request is now before the Board for consideration. A recommendation will be forwarded to the City Commission meeting of December 8, 2009 103 NW 3`a Avenue/211 NW 1' Street, 2010-013 HPB Meeting December 2, 2009 vt Page 2 of 4 ANALYSIS As noted above, the request is to install a 6' fence within the side-street setback, and a 7' arbor at the front walkway connecting the sidewalk to the front door. Pursuant to LDR Section 4.5.1(E)(3)(a)(1.)(c), fences and walls over four feet (4') shall not be allowed in front or side street setbacks. Therefore, a waiver request to exceed the 4' height limitation is required. Waiver Pursuant to LDR Section 2.4.7(B)(5), prior to granting a waiver, the granting body shall make findings that the granting of the waiver: (a) Shall not adversely affect the neighboring area; (b) Shall not significantly diminish the provision of public facilities; (c) Shall not create an unsafe situation; and, (d) Does not result in the grant of a special privilege in that the same waiver would be granted under similar circumstances on other property for another applicant or owner. The property owner has submitted the following in support of the request: "...The side of our home faces an alley (formally NW 1st Street) which has now become a place for vagrants to hang out because it basically dead ends to the Delray Beach Tennis courts. This alley/road is not a viable street and does not allow for cars or pedestrians. We have also had issues with people urinating and drinking along side of this alley because it is dark and somewhat secluded. We want to build a six foot fence around the sides and back of our house for privacy, security and to deter the vandalism and theft that has been a common occurrence since we moved in. For esthetic purposes we want the fence to be six feet along the sides and back of our home. We are planning on planting bushes along the outside of the fence and adding some lighting to deter people from hanging out on what is now the entrance to our driveway." STAFF COMMENT & ANALYSIS While the intent of the decreased height within historic districts is to maintain an attractive streetscape aesthetic reducing the adverse affect on the neighboring area, the waiver may be supported as follows: (a) NW 1st Street is not a through street and the fence's impact will be minimal as it transitions from the taller chain link fencing of the adjacent Tennis Center (not located within the district). The arbor is considered a feature and will enhance rather than detract from the neighborhood; (b) The provision of public facilities will not be affected by the increased height of either feature; (c) The increased height of the fence intends to create a safer situation for the property owner given the tendency for transients to congregate on the property and utilize it as an access way to the alley and adjacent properties. The increased height on the arbor will not create an unsafe situation; (d) While the circumstance regarding the fence is uncommon in a historic district, the request would likely be supported should a similar situation occur. Regarding the arbor, similar requests have been approved for this type of feature. Based on the analysis above, the request to increase the height of both the fence and arbor as requested may be supported. 103 NW 3`d Avenue/211 NW 1't Street,2010-013 HPB Meeting December 2,2009 Page 3 of 4 LDR Section 4.5.1 — Historic Preservation Sites and Districts (E) Development Standards: All development regardless of use within individually designated historic properties and/or properties located within historic districts, whether contributing or noncontributing, residential or nonresidential, shall comply with the goals, objectives, and policies of the Comprehensive Plan, these regulations, the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. (8)Visual Compatibility Standards. New construction and all improvements to contributing buildings, structures and appurtenances thereto within a designated historic district or on an individually designated property shall be visually compatible. (i) Walls of Continuity: Walls, fences, evergreen landscape masses, or building facades, shall form cohesive walls of enclosure along a street to ensure visual compatibility with historic buildings or structures within the subject historic district and the structure to which it is visually related. STAFF COMMENT & ANALYSIS The subject request is to increase the fence height from 4' to 6' within the side-street setback and install a 7' arbor at the front of the property. As noted in the waiver analysis, these requests will not detract from the neighborhood nor the contributing property. They are appropriate and compatible, and the additional landscaping along the fence will help to mitigate any potential negative impact on the streetscape. Therefore, the request may be supported to install a 6' fence along NW 1st Street and a 7' arbor at the front of the property, as noted on the attached plans. ALTERNATIVE ACTIONS A. Continue with direction. B. Move approval of the Certificate of Appropriateness (2010-010) for 211 NW 1st Street/103 NW 1st Street, West Settlers Historic District by adopting the findings of fact and law contained in the staff report, and finding that the request is consistent with the Comprehensive Plan and meets criteria set forth in the Land Development Regulations, the Delray Beach Historic Preservation Design Guidelines, and the Secretary of the Interior's Standards for Rehabilitation. EB-15.1 Policy: Fiscal Year 1996-97 established a 3% Management Match Program for certain eligible management employee positions. The Program was expanded in April 1999 to include certain key employee positions approved by the City Commission. A schedule of all currently eligible management and key employee positions is attached to this policy as Exhibit A. Eligible employees can elect to contribute up to 3% of their base salary into the ICMA 457 Deferred Compensation Plan or 3%I of their base salary to the ICMA 401A Plan with 1 the City matching the contribution in accordance with the following terms: 1. The total combined contribution of the City and employee cannot exceed the amount allowed per Internal Revenue Service regulations. 2. City and employee contributions shall cease upon the date the employee no longer works for the City as a regular full-time employee. 4. A re-hired employee who previously participated or was previously eligible to participate in the matching program shall not have any buyback rights under the matching program. 5. An eligible employee who desires to participate in this matching program may contribute more than 3% of their base salary (subject to IRS regulations), however, the City's contribution shall not exceed 3%. 6. Participation in the Program is voluntary and can be stopped at any time by written notification to the Finance Department.
