Alvarez Historic Preservation Planner Posted On: March 12, 2008 r HISTORIC `PRESERVATION BOARD MEMORANDUM STAFF REPORT Property Owner: Alan Schuering Authorized Agent/ Applicant: Perez Design, Inc./Francisco Perez-Azua Project Location: 8 East Atlantic Avenue, Old School Square Historic District HPB Meeting Date: March 19, 2008 File No: 2008-095 ,_ITEM`BEFORE THE BOAR© The item before the Board is the approval of a Certificate of Appropriateness and associated Class II Site Plan Modification and Landscape Plan for the property located at 8 East Atlantic Avenue, Taverna Eros, Old School Square Historic District, pursuant to LDR Section 2.4.5(G). The subject property is located on the south side of East Atlantic Avenue, between South Swinton Avenue and SE 1st Avenue. BACKGRfOU`ND/PROJ'EOT:DESCxRI,PTION The subject property is comprised of .22 acres described as the west 26' of Lot 4 (Less the south 14') and Lot 5, Block 69. The property is zoned OSSHAD (Old School Square Historic Arts District) and is considered a contributing property in the Old School Square Historic District. The property contains a two-story Masonry Vernacular commercial building constructed in 1950. In 2003, the HPB approved a Class III Site Plan Modification which primarily consisted of :the conversion of the first floor from retail space into restaurant, and reconfiguration of the asphalt parking area to accommodate thirteen (13) spaces to the west and south of the building. The subject application amends the previous approval by providing additional outdoor dining space through the following proposal: • Removal of four (4) existing parking spaces to be replaced with pavers for additional restaurant seating (combination of brick and another material to be determined); • Installation of a 8' x 36'wood trellis with stone veneer posts; • Installation/Relocation of one (1) handicap accessible parking space, and; • Installation of associated landscaping improvements. The four (4) spaces to be removed are located within the surface parking area immediately adjacent to the west side of the building and fronting Atlantic Avenue. Removal of these spaces has been addressed through the City Commission approval of January 15, 2008 for the property owner to pay an in-lieu fee for each space to be removed (total fee $62,400). This is possible as the new outdoor dining area will be classified as a Sidewalk Café and does not require additional parking as defined by the LDRs. 8 East Atlantic Avenue; avarna Eros,2008-095-SPM-HPB-CI.3 HPB Meeting March "9,2008 Page 2 of 4 SITE PLAN I)AODIpICATION ANALYSIS " COMPLIANCE WITH THE LAND DEVELOPMENT REGULATIONS: Items identified in the Land Development Regulations shall specifically be addressed by the body taking final action on the site and development application/request. LDR Section 2.4.6(H) —Certificate of Appropriateness: Pursuant to LDR Section 2.4.6(H)(5), the Board must make a finding that any Certificate of Appropriateness which is to be approved is consistent with Historic Preservation purposes pursuant to Objective A-4 of the Future Land Use Element of the Comprehensive Plan and specifically with the provisions of LDR Section 4.5.1. Future Land Use Element.Objective A-4: The redevelopment of land and buildings shall provide for the preservation of historic resources. The objective shall be met through continued adherence to the City's Historic Preservation Ordinance and the following policies: Policy A-4.1: Prior to approval or recommending approval of any land use or development application for property located within a historic district or designated as a historic site, the Historic Preservation Board must make a finding that the requested action is consistent with the provisions of Section 4.5.1 of the Land Development Regulations relating to historic sites and districts and the "Delray Beach Historic Preservation Design Guidelines': LDR Section 4.5.1(E)(3)(b)(1)(a-c) and the Delray Beach Historic Preservation Design Guidelines states the following with respect to parking: a. Locate parking adjacent to the building or in the rear. b. Screen parking that can be viewed from the public right-of-way with fencing, landscaping, or a combination of the two pursuant to Section 4.6.5. c. Utilize existing alleys to provide vehicular access to sites. The subject development request complies with the intent of the above noted requirements in that it is removing the parking access and four (4) spaces from East Atlantic Avenue, located in front of the existing structure on the subject property, and leaving the only access to the parking area from the alley. Further, the addition of the sidewalk café area which incorporates ample landscaping and a trellis will screen parking from visibility along East Atlantic Avenue. LDR Section 4.5.1(E)(8)(g) requires that the relationship of materials, texture, and color of the facade of a building and/or hardscaping shall be visually compatible with the predominant materials used in the historic buildings and structures within the subject historic district. The submitted plans include a paved area which will contain brick pavers along with another larger paver type whose material has not yet been determined. The Board may require a specific material type as a condition of approval or leave the decision entirely up to Staff and the Applicant. In addition, the proposed wood trellis is to contain concrete block columns finished with a stone veneer. While the trellis may be more.appropriate with wood columns, the stone veneer does not appear that it would be incompatible. In reviewing the entire proposal, the improvements to the subject property will be a great enhancement to that location. Site Plan Technical Items: The following application requirements and site plan technical items must be addressed prior to site plan certification. 1. Pursuant to LDR Section 2.4.3(A)(2), a copy of the latest warranty deed, as recorded with the County Clerk, for all the property under consideration, and a certificate from an attorney-at-law or a title insurance company certifying who the current fee simple title holders of record of the 8 East Atlantic Avcnue Taco-ra:c-rra Eros 2808-095-SPt M-HPB-CL3 > HPB Meeting March 19,2008 Page 3 of 4 subject property are, and the nature and extent of their interest therein shall be submitted. The title certificate shall list all easements, mortgages and encumbrances or record, and; 2. Show dimensions of the handicap space on the site plan. CPTED (Crime Prevention Through Environmental Design) Upon review of the submitted plans for compliance with CPTED standards and principles, the following was noted: Dining Area: 1. There needs to be parking stoppers, cement curb, steel bollards and metal bar fencing to separate the parking lot from the dining area. The wheel stops, cement curb and the metal bollards are needed to prevent a vehicle from entering the dining area. 2. The metal bar fencing is needed to establish the separation of the public parking lot from the dining area. This also reduces the risk of criminal activities from the alleyway entering the cafe area. Lighting: 1. The plans show light fixtures throughout the cafe dining area and parking lot. The lighting should be to the City's and OPTED codes and standards. Landscaping: 1. The plans show the additions of several different types of small trees and bushes to be added to the cafe area. The landscaping should be to CPTED standards. 2. The landscaping shouldn't obstruct the view of the customers and staff of the parking lot and the street. The above noted standards and principles should be addressed through the installation of a planting area and/or large planter located between the handicap space and outdoor dining area which will address the need for bollards and metal fencing as noted above. The installation of the additional landscaping will also provide for further beautification between the parking and dining areas. This revision has been noted as a condition of approval. Landscape Plan The proposed plan includes landscaping to be located at the perimeter of the newly created sidewalk area adjacent to the existing building. Upon review of the submitted landscape plan, the following was noted: 1. Due to the invasive root structure, the City does not support the installation of the Ficus Hedge adjacent to the paver brick sidewalk. Please provide an alternate plant material. 2. As Gumbo Limbo Trees are deciduous, another species may be more suited in the center of the count yard. The above-noted recommendations have been noted as conditions of approval. REVIEW BY OTHERS The Community Redevelopment Agency (CRA) considered the subject development proposal at its meeting of February 28, 2008, and recommended approval. The Downtown Development Authority (DDA) considered the subject development proposal at its meeting of March 10, 2008, and unanimously (4-0) recommended approval with the condition that the restaurant use operate within the confines as depicted on the submitted site plan. Continue with direction. B. C. Move denial of the COA request and associated Class III site plan modification, landscape plan, design elements, and waiver requests for 8 East Atlantic Avenue, Taverna Eros, Old School Square Historic District„ based upon a finding that the request is inconsistent with the Comprehensive Plan and does not meet criteria set forth in the Land Development Regulations and the Delray Beach Historic Preservation Design Guidelines.
